O R D E R

Sri S.Bhanu Shankar Rao, Hyderabad has filed a Complaint dated 27-06-2018 which was received by this Commission on 30-06-2018 for not getting the information sought by him from the PIO / O/o. the District Collector, Hyderabad District, Abids Road, Nampally, Hyderabad.

The brief facts of the case as per the Complaint and other records received along with it are that the Complainant herein filed an application dated 15-05-2018 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application annexed. TSIC

The Public Information Officer has not furnished the information to the Complainant.

As the Complainant did not receive the required information from the PIO even after 30 days of filing his application, he preferred this Complaint before the Commission requesting to arrange to furnish the information sought by him u/s 18(1) of the RTI Act, 2005.

The Complaint was taken on file and notices were issued to both the parties for hearing on 11-7-2019.

The Public Information Officer, Inspector of Survey, O/o the Deputy Director, Survey & Land Records, Hyderabad is present. The Public Information Officer, Spl. DC(LP), O/o the District Collector, Hyderabad filed affidavit wherein she submitted that the 6(1) application was transferred U/s 6(3) to the Public Information Officer, O/o the Dy. Director, S& LR on 04.06.2018.

The complainant submitted that he did not receive the sought information from the PIO.

The Public Information Officer, O/o the DD, S&LR submitted that the information sought at Sl.No.1 is not related to their office and information sought at point no.2 is not available. Accordingly a reply dated 24.07.2018 was prepared re-transmitting the application to the Public Information Officer, Spl. Dy. Collector (LP), Hyderabad District for necessary action by marking a copy to the complainant but the same got mixed up with other papers and could not be sent to the concerned parties due to negligence of clerk. The Public Information Officer submitted that on receipt of notice from TSIC the matter has come to light and necessary action has been initiated against the concerned clerk. The Public Information Officer further submitted that the reply will be communicated to the concerned parties immediately.

Heard the parties and perused the records.

The Commission directs the PIO to furnish factual information to the complainant forthwith and submit compliance report to the Commission.

With the above direction, the complaint is closed.

The Public Information Officer is cautioned to be prompt while dealing with applications filed under RTI Act, 2005 and strictly adhere to the stipulated time limits.
