1 AN ACT AMEND SECTION 27-103-302, CODE OF 1972, TO 2 PROVIDE THAT FROM AND AFTER SEPTEMBER 1, 2018, ALL BP OIL SPILL 3 SETTLEMENT FUNDS RECEIVED BY THE STATE SHALL BE DEPOSITED INTO THE 4 STATE BP SETTLEMENT FUND AND THE GULF COAST RESTORATION FUND; TO 5 CREATE A SPECIAL FUND IN THE STATE TREASURY TO BE DESIGNATED AS 6 THE "STATE BP SETTLEMENT FUND"; TO CREATE A SPECIAL FUND IN THE 7 STATE TREASURY TO BE DESIGNATED AS THE "GULF COAST RESTORATION 8 FUND" (GCRF); TO PROVIDE THAT MONIES IN THE GCRF SHALL BE USED, 9 UPON APPROPRIATION BY THE LEGISLATURE, TO PROVIDE ASSISTANCE TO 10 APPLICANTS THROUGH PROGRAMS OR PROJECTS AUTHORIZED BY THIS ACT; TO 11 PROVIDE THAT MONIES IN THE GCRF SHALL BE USED ONLY FOR PROGRAMS OR 12 PROJECTS THAT ARE LOCATED IN THE GULF COAST REGION AS DEFINED IN 13 THE FEDERAL RESTORE ACT; TO CREATE THE GULF COAST RESTORATION FUND 14 ADVISORY BOARD TO PROVIDE ADVICE TO MDA WHEN REVIEWING 15 APPLICATIONS FOR ASSISTANCE UNDER THIS ACT; TO PROVIDE THAT THE 16 MISSISSIPPI DEVELOPMENT AUTHORITY (MDA) SHALL BE THE ADMINISTRATOR 17 OF THE GCRF; TO AUTHORIZE MDA TO CARRY OUT ANY POWERS AND DUTIES 18 AUTHORIZED IN THIS ACT AND PROVIDE THAT MDA SHALL HANDLE ALL OF 19 THE DAY-TO-DAY MATTERS RELATING TO THE GCRF; TO LIMIT THE AMOUNT 20 OF THE ANNUAL ADMINISTRATION EXPENSES OF MDA IN CARRYING OUT ITS 21 DUTIES UNDER THIS ACT; TO SPECIFY THE APPLICANTS WHO ARE ELIGIBLE 22 FOR ASSISTANCE UNDER THIS ACT; TO PROVIDE THAT MDA SHALL ESTABLISH 23 CRITERIA, RULES AND PROCEDURES FOR ACCEPTING AND REVIEWING 24 APPLICATIONS FOR ASSISTANCE UNDER THIS ACT; TO PROVIDE THAT MDA 25 SHALL REVIEW, COMPILE, AND SCORE ALL TIMELY RECEIVED APPLICATIONS 26 AND SHALL PRESENT THE APPLICATIONS AND ITS RECOMMENDATIONS FOR 27 ASSISTANCE TO INDIVIDUAL PROJECTS TO THE LEGISLATURE NO LATER THAN 28 DECEMBER 1 OF THE YEAR; TO PROVIDE THAT THE LEGISLATURE SHALL 29 DETERMINE INDIVIDUAL PROJECTS THAT WILL BE FUNDED BY SEPARATE LINE 30 ITEMS IN AN APPROPRIATION BILL; TO PROVIDE THAT APPLICATIONS FOR 31 ASSISTANCE WILL BE RECEIVED THROUGH WEB PORTALS SET UP BY MDA; TO 32 AUTHORIZE MDA TO ESTABLISH PROGRAMS FOR MAKING LOANS, LOAN 33 GUARANTEES, GRANTS AND ANY OTHER FINANCIAL ASSISTANCE TO 34 APPLICANTS WHOSE PROJECTS ARE APPROVED FOR ASSISTANCE; TO SPECIFY S. 61 SECTION 1. Section 27-103-302, Mississippi Code of 1972, is 62 amended as follows: 63 27-103-302. Through August 31, 2018, all funds received by 64 or on behalf of the State of Mississippi through a negotiated

65 settlement for economic damages in connection with the explosion 66 on, and sinking of, the mobile offshore drilling unit Deepwater 67 Horizon, except for any funds that are required by the settlement

68 to be paid to any other public entity, shall be deposited into the 69 Budget Contingency Fund for appropriation by the Legislature. 70 From and after September 1, 2018, all funds received by or on 71 behalf of the State of Mississippi through a negotiated settlement 72 for economic damages in connection with the explosion on, and S. No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 2 (tb\rc) 73 sinking of, the mobile offshore drilling unit Deepwater Horizon, 74 except for any funds that are required by the settlement to be 75 paid to any other public entity, shall be deposited as follows: 76 (a) twenty-five percent (25%) of each annual payment of those 77 funds to the State of Mississippi shall be deposited into the 78 State BP Settlement Fund created in Section 2 of this act, and (b)

79 seventy-five percent (75%) of each annual payment of those funds 80 to the State of Mississippi shall be deposited into the Gulf Coast 81 Restoration Fund created in Section 3 of this act.

82 SECTION 2. There is created in the State Treasury a special 83 fund to be designated as the "State BP Settlement Fund." The 84 special fund shall consist of funds required to be deposited into 85 the special fund by Section 27-103-302, funds appropriated or

86 otherwise made available by the Legislature in any manner, and 87 funds from any other source designated for deposit into the 88 special fund. Unexpended amounts remaining in the special fund at 89 the end of a fiscal year shall not lapse into the State General 90 Fund but shall remain in the State BP Settlement Fund. Any

91 investment earnings or interest earned on amounts in the special 92 fund shall be deposited to the credit of the special fund.

93 SECTION 3. (1) There is created in the State Treasury a 94 special fund to be designated as the "Gulf Coast Restoration Fund" 95 (GCRF). The GCRF shall consist of funds required to be deposited 96 into the GCRF by Section 27-103-302, funds appropriated or 97 otherwise made available by the Legislature in any manner, and

No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 3 (tb\rc) 98 funds from any other source designated for deposit into the GCRF. 99 Unexpended amounts remaining in the GCRF at the end of a fiscal 100 year shall not lapse into the State General Fund, and any 101 investment earnings or interest earned on amounts in the GCRF 102 shall be deposited to the credit of the GCRF. 103 (2) Monies in the GCRF shall be administered by the

104 Mississippi Development Authority (MDA), and shall be used, upon 105 appropriation by the Legislature, to provide assistance to 106 applicants through programs or projects authorized by this act. 107 Monies in the GCRF shall be used only for programs or projects 108 that are located in the Gulf Coast region as defined in the 109 federal RESTORE Act, but not to expand beyond the boundaries of 110 Hancock, Harrison, Jackson, Pearl River, Stone, and George

111 Counties. If a county is included in the coastal zone, then the 112 county seat of that county would be considered a part of the 113 coastal zone.

114 SECTION 4. (1) Monies in the Gulf Coast Restoration Fund 115 shall be used only for the purposes specified in this act, and no

116 other expenditure, appropriation or transfer of monies in the GCRF 117 shall be made except by an act of the Legislature making specific

118 reference to the GCRF as the source of those monies. 119 (2) If any monies in the GCRF are obligated or pledged as 120 security for any debt incurred by MDA, and the monies in the GCRF 121 that have been obligated or pledged are later expended, 122 appropriated, transferred, obligated or pledged for any other

S. B. No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 4 (tb\rc) 123 purpose, the debt for which the monies were originally obligated 124 or pledged shall be the obligation and indebtedness of the State 125 of Mississippi secured by the full faith and credit of the state.

126 SECTION 5. (1) There is created the Gulf Coast Restoration 127 Fund Advisory Board for the purpose of providing guidance and 128 expertise to MDA when reviewing applications for assistance under

129 this act. The advisory board shall consist of the following seven 130 (7) members: 131 (a) Three (3) appointments from the Governor; 132 (b) Two (2) appointments from the Lieutenant Governor; 133 and 134 (c) Two (2) appointments from the Speaker of the House 135 of Representatives.

136 (2) The Governor shall appoint the chairman of the board and 137 the board shall elect such other officers as it considers 138 necessary from among its members. 139 (3) A majority of the members of the board shall constitute 140 a quorum for the conduct of meetings and all actions of the board

141 shall be by a majority vote. 142 (4) The Mississippi Development Authority shall provide any

143 necessary administrative support to the board. No person 144 nominated for, appointed to or serving as a member of the board 145 may be an elected official. 146 (5) Members of the board shall serve without compensation, 147 per diem or mileage expense.

S. B. No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 5 (tb\rc) 148 (6) All expenses of the MDA in carrying out its duties and 149 responsibilities under this section shall be paid from funds in 150 the Gulf Coast Restoration Fund.

151 SECTION 6. (1) MDA shall be the administrator of the Gulf 152 Coast Restoration Fund. MDA is authorized to carry out any powers 153 and duties authorized in this act and shall handle all of the

154 day-to-day matters relating to the GCRF. 155 (2) The annual administration expenses of MDA in carrying 156 out its duties under this act shall not exceed one percent (1%) of 157 the amount of the funds deposited into the GCRF under Section 158 27-103-302 for that year. MDA may recover from applicants and 159 recipients of funds under this act a portion of the costs 160 associated with administering assistance provided under this act,

161 which shall not be subject to the one percent (1%) limitation 162 under this subsection.

163 SECTION 7. (1) Applicants who are eligible for assistance 164 under this section include, but are not limited to, local units of 165 government, nongovernmental organizations, institutions of higher

166 learning, community colleges, ports, airports, public-private 167 partnerships, private for-profit entities, private non profit

168 entities and local economic development entities. Projects that 169 are eligible for assistance under this section are projects that 170 have the potential to generate increased economic activity in the 171 region, as described in Section 8(3) of this act.

No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 6 (tb\rc) 172 (2) MDA shall establish criteria, rules, and procedures for 173 accepting and reviewing applications for assistance under this 174 section. MDA, with advice from the Gulf Coast Restoration Fund 175 Advisory Board, shall review, compile and score all timely 176 received applications, and shall present the applications and its 177 recommendations for assistance to individual projects under this

178 section to the Legislature no later than December 1 of the year. 179 The Legislature shall determine individual projects that will be 180 funded under this section by separate line items in an 181 appropriation bill. 182 (3) Applications for assistance under this section will be 183 received through web portals set up by MDA. MDA shall set 184 criteria for the web portal which may include protection of the

185 confidentiality of any or all of the application.

186 SECTION 8. (1) MDA is further authorized, on such terms and 187 conditions consistent with the criteria set forth in this section 188 as it may determine, to establish programs for making loans, loan 189 guarantees, grants and any other financial assistance from the

190 GCRF to applicants whose projects are approved for assistance 191 under this section. MDA shall establish criteria, rules and

192 procedures for accepting, reviewing, granting or denying 193 applications, and for terms and conditions of financial assistance 194 under this section in accordance with state law. The Legislature 195 shall appropriate monies from the GCRF to the MDA to fund the

No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 7 (tb\rc) 196 programs established under this section in an amount requested 197 annually by MDA for such purpose. 198 (2) Applicants who are eligible for assistance under this 199 section include, but are not limited to, local units of 200 government, nongovernmental organizations, institutions of higher 201 learning, community colleges, ports, airports, public-private

202 partnerships, private for-profit entities, private non profit 203 entities, and local economic development entities. 204 (3) MDA shall establish programs and an application process 205 to provide assistance to applicants under this section that 206 prioritize: 207 (a) Projects that will impact the long-term 208 competitiveness of the region and may result in a significant

209 positive impact on tax base, private sector job creation and 210 private sector investment in the region; 211 (b) Projects that demonstrate the maximum long-term 212 economic benefits and long-term growth potential of the region 213 based on a financial analysis such as a cost-benefit analysis or a

214 return-on-investment analysis; 215 (c) Projects that demonstrate long-term financial

216 sustainability, including clear performance metrics, over the 217 duration of the project; 218 (d) Projects that leverage or encourage leveraging of 219 other private sector, local, state and federal funding sources

No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 8 (tb\rc) 220 with preference to projects that can demonstrate contributions 221 from other sources than funds from the BP settlement; 222 (e) Projects that are supported by multiple government 223 or private sector entities; 224 (f) Projects that can move quickly and efficiently to 225 the design, engineering, and permitting phase;

226 (g) Projects that enhance the quality of life/place and 227 business environment of the region, including tourism and 228 recreational opportunities; 229 (h) Projects that expand the region's ability to 230 attract high-growth industries or establish new high-growth 231 industries in the region; 232 (i) Projects that leverage or further enhance key

233 regional assets, including educational institutions, research 234 facilities, ports, airports, rails and military bases; 235 (j) Projects that are transformational for the future 236 of the region but create a wider regional impact; 237 (k) Projects that enhance the marketability of existing

238 industrial properties; 239 (l) Projects that enhance a targeted industry cluster

240 or create a Center of Excellence unique to the region; 241 (m) Infrastructure projects for business retention and 242 development; 243 (n) Projects that enhance research and innovative 244 technologies in the region; and

248 SECTION 9. (1) Assistance provided under this act may not 249 be used to finance one hundred percent (100%) of the cost of any 250 project.

251 (2) Contracts executed by MDA with recipients of assistance 252 under this act must include provisions requiring a performance 253 report on the contracted activities, must account for the proper 254 use of funds provided under the contract, and must include 255 provisions for recovery of assistance if the assistance was based 256 upon fraudulent information or the recipient of the assistance is 257 not meeting the performance requirements established by MDA of the

258 assistance. Recipients of assistance under this act must 259 regularly report to MDA the status of the project on a schedule 260 determined by MDA.

261 SECTION 10. (1) The scope of a financial audit of 262 recipients of assistance under this act shall include funds

263 related to any year in which the recipient receives assistance 264 under this act. The scope of review for these funds shall

265 include, but is not limited to, compliance with state and federal 266 laws related to the receipt and expenditure of those funds and the 267 criteria established by MDA. 268 (2) The State Auditor shall conduct performance audits of 269 MDA's administration of the GCRF under this act. The scope of

No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 10 (tb\rc) 270 review shall include, but is not limited to, evaluating internal 271 controls, internal audit functions, reporting and performance 272 requirements required for use of the assistance, and compliance 273 with state and federal law. The audit shall include any funds 274 disbursed under this act and matching funds provided in the 275 contract with MDA.

276 (3) In addition to the rules of the State Auditor, the State 277 Auditor shall adopt rules for the form and conduct all financial 278 audits performed by independent certified public accountants and 279 for audits of recipients of assistance under this act. 280 (4) The State Auditor may report findings to the Secretary 281 of the Treasury of the United States in addition to the reporting 282 requirements under state law.

283 (5) The costs of the audits performed as provided in this 284 section may be paid from the GCRF.

285 SECTION 11. MDA shall file an annual report with the Speaker 286 of the House, the Lieutenant Governor, the Chairs of the 287 Appropriations Committees of the House and the Senate, and the

288 Legislative Budget Office not later than December 1 of each year, 289 including detailed information regarding at least the following

290 specific areas: 291 (a) Receipts and expenditures of the funds received and 292 provided as assistance under this act; 293 (b) Expenditures for all administration expenses of MDA 294 in carrying out its duties under this act;

No. 2002 *SS26/R16.3* # deleted text version # 181E/SS26/R16.3 PAGE 11 (tb\rc) 295 (c) Overview of applications reviewed and a detailed 296 description of applications approved for assistance for the 297 current year; and 298 (d) Schedule of all applications for which assistance 299 was provided under this act detailing status of progress, start 300 date, anticipated completion date, benchmark achievements, and any

301 modifications to the original application after receipt of 302 assistance.

303 SECTION 12. (1) The State Treasurer shall transfer funds 304 from the Budget Contingency Fund to the following special funds in 305 the following amounts: 306 (a) Fifty-two Million Eight Hundred Ninety-three 307 Thousand Dollars ($52,893,000.00) to the 2018 Transportation and

308 Infrastructure Improvements Fund created in House Bill No. 1, 309 First Extraordinary Session of 2018; 310 (b) One Million Dollars ($1,000,000.00) to the 311 Mississippi Highway-Railroad Grade Crossing Safety Account created 312 in Section 57-43-15; and

313 (c) Seven Million Five Hundred Thousand Dollars 314 ($7,500,000.00) to the Mississippi Railroad Improvements Fund

315 created in Section 57-46-1. 316 (2) The State Treasurer shall transfer seventy-five percent 317 (75%) of the amount remaining in the Budget Contingency Fund after 318 the transfers required in subsection (1) of this section into the 319 Gulf Coast Restoration Fund created in Section 3 of this act.

322 Section 9. (1) A special fund, to be designated the "2018 323 Transportation and Infrastructure Improvements Fund," is created 324 within the State Treasury, which shall consist of funds made 325 available by the Legislature in any manner and funds from any

326 other source designated for deposit into such fund. The fund 327 shall be maintained by the State Treasurer as a separate and 328 special fund, separate and apart from the General Fund of the 329 state. Unexpended amounts remaining in the fund at the end of a 330 fiscal year shall not lapse into the State General Fund, and any 331 interest earned or investment earnings on amounts in the fund 332 shall be deposited into such fund.

333 (2) Monies deposited into the fund shall be * * * expended, 334 upon appropriation by the Legislature, for infrastructure projects 335 and/or other projects that are economically beneficial that are 336 otherwise provided by law to be funded by monies in this fund. 337 disbursed, in the discretion of the Department of Finance and

338 Administration, as follows: 339 (a) To pay the costs incurred by the Mississippi

340 Transportation Commission and the Mississippi Department of 341 Transportation to widen Mississippi Highway 16 to three (3) lanes 342 as follows:

349 (b) To assist in paying the costs associated with 350 preconstruction, design, engineering, land acquisition, 351 right-of-way acquisition, construction and development of the 352 Reunion Parkway project from Bozeman Road to Parkway East in 353 Madison County, Mississippi...... $8,000,000.00. 354 (c) To assist the East Metropolitan Corridor 355 Commission, which is a commission operating as a local public

356 agency representing the Jackson Municipal Airport Authority, the 357 City of Brandon, Mississippi, the City of Flowood, Mississippi, 358 and the City of Pearl, Mississippi, in paying the costs associated 359 with land acquisition and implementation of the East Metro 360 Corridor project in Rankin County, Mississippi, from its current

361 terminus at the southeast corner of, and within, the 362 Jackson-Medgar Wiley Evers International Airport, traversing

363 easterly and southerly and terminating at Interstate 20 at 364 Crossgates Boulevard in Brandon, Mississippi...... $8,000,000.00. 365 (d) To assist DeSoto County, Mississippi, in paying the 366 costs of rebuilding Holly Springs Road in DeSoto County and 367 drainage improvements to the road...... $3,000,000.00.
