Wong Kim Ark: ​ Barred From His Homeland, One Chinese American’s Fight for Birthright Citizenship By August Neumann Word Count: 2488 Landmark United States Supreme Court cases are ingrained in the minds of many Americans, shaping their view of history; a history known for its tumults and hypocrisies, yet remaining a hopeful memoir steeped in the pursuit of liberty for all people. Belonging in the midst of cases as pivotal and transformative in America's story as Marbury v. Madison or Brown ​ ​ ​ v. Board of Education is a more obscure Supreme Court case: the 1897 case of United States v. ​ ​ Wong Kim Ark. Although cardinal in its decision regarding birthright citizenship for people of all ​ races, the case has largely been overlooked. To effectively analyze this neglected, but important piece of history, one must understand what life was like in America for Chinese immigrants in the late 1800s and how Wong Kim Ark found his way to the U.S. Supreme Court to ultimately defend his right to citizenship. What did U.S. v. Wong Kim Ark do for Chinese communities, if ​ ​ anything, and did it change the way they participated in the social and civic life in California and the broader U.S.? Lastly, where does birthright citizenship stand today? The decision secured birthright citizenship for Chinese Americans, but whether it helped them benefit from that citizenship remains unclear. Life for Wong Kim Ark and Chinese Immigrants Prior to the Case Most Chinese immigrants came in the early 1850s from the Pearl River Delta region in China, a densely populated region that today encompasses Hong Kong, Guangzhou, and Macao1.

Political Struggles Between Actors Conclusion Introduction Donald Trump, who had never served in any elected or appointed positions at any level of government, was elected as the 2016 Republican presidential candidate, then elected as the 45th President of the United States, predominantly reflecting the dissatisfaction of white working-class voters. Many of these voters feel that they have been left out of American politics, as mainstream Republican candidates during the primaries, along with Democratic candidate Hillary Clinton, targeted the emerging groups of voters, most of whom are minorities. Trump attracted an unexpectedly large number of voters, including many who traditionally supported the Democrat, with his proposals to build a wall along the Mexican border to be financed by the Mexican Government, to bar immigrants from any countries that harbor “terrorists,” and to have allies pay for the security provided to them by American forces. The fact that he narrowly defeated Clinton by taking the battleground states that suffered most in the economic downturn with his extremist rhetoric suggests that immigration issues will continue to take priority on the political agenda in the next administration.

Lindsay* Abstract Courts and scholars have long noted the constitutional exceptionalism of the federal immigration power, decried the injustice it produces, and appealed for greater constitutional protection for noncitizens. This Article builds on this robust literature while focusing on a particularly critical conceptual and doctrinal obstacle to legal reform—the notion that laws governing the rights of noncitizens to enter and remain within the United States comprise a distinct body of “immigration laws” presumed to be part and parcel of foreign affairs and national security. This Article argues that the U.S. Supreme Court’s recent immigration jurisprudence suggests a willingness to temper, and perhaps even retire, that presumption. In particular, the majority opinions in Zadvydas v. Davis and Padilla v. Kentucky evidence a growing skepticism among the Justices that the regulation of noncitizens comprises a discrete, constitutionally privileged domain of distinctly “political” subject matter that is properly buffered against judicial scrutiny.

Banks† INTRODUCTION Historically, immigration and citizenship law and policy in the United States has been shaped by the idea that certain immigrant populations present a threat to American society. Such ideas justified the Alien and Sedition Acts,1 the Chinese Exclusion Act,2 the enactment of new deportation grounds in 1917,3 and the adoption of national origin quotas in 1924.4 These ideas continue to operate today and influence law and policy. For example, on January 27, 2017, President Donald J. Trump declared that the entry of Iranian, Iraqi, Libyan, Somalian, Sudanese, Syrian, and Yemeni citizens along with Syrian refugees to the United States is “detrimental to the interests of the United States.”5 Two days † Charles J.     DISAGGREGATING “IMMIGRATION LAW” Matthew J. Lindsay* Abstract Courts and scholars have long noted the constitutional exceptionalism of the federal immigration power, decried the injustice it produces, and appealed for greater constitutional protection for noncitizens. This Article builds on this robust literature while focusing on a particularly critical conceptual and doctrinal obstacle to legal reform—the notion that laws governing the rights of noncitizens to enter and remain within the United States comprise a distinct body of “immigration laws” presumed to be part and parcel of foreign affairs and national security. This Article argues that the U.S. Supreme Court’s recent immigration jurisprudence suggests a willingness to temper, and perhaps even retire, that presumption. In particular, the majority opinions in Zadvydas v. Davis and Padilla v. Kentucky evidence a growing skepticism among the Justices that the regulation of noncitizens comprises a discrete, constitutionally privileged domain of distinctly “political” subject matter that is properly buffered against judicial scrutiny. To rescind that presumption would, in effect, disaggregate the category of “immigration law” for the purpose of constitutional review and subject federal authority over noncitizens to the same judicially enforceable constitutional constraints that apply to most other federal lawmaking. The disaggregation of immigration law would thus give full expression to noncitizens’ constitutional personhood. Reviewed by Michele Goodwin & Erwin Chemerinsky We are all already polluted. — Eula Biss (p. 76) INTRODUCTION Nearly a century ago, the United States found itself in the midst of a health crisis related to individuals it found to be socially unfit. At the time, social unfitness and “imbecility” were thought to be genetical- ly inscribed and heritable — contagious within the gene pool. Howev- er, as with many diseases, states feared that these conditions could be masked; how would they know who was unfit? Was it possible that the unfit could contaminate the broader gene pool? If so, how could states prevent this so-called genetic pollution from entering and spreading in their states? Eugenics policies provided a compelling answer for more than thir- ty states that adopted such legislation. Eugenics laws were designed to limit the reproductive capacities of Americans whom legislators per- ceived to be socially or mentally damaged, and therefore genetically unfit. Such laws literally stripped away the right to reproduce. Con- cerns about genetic and social contamination were so deeply rooted in the American consciousness that eugenics laws were adopted with rel- ative ease throughout the nation. The U.S. Supreme Court took up the issue in an infamous 1927 test case, Buck v.     Immigration Enforcement How it affects the AAPI Community Why should Asian Americans and Pacific Islanders be concerned about detention and deportation issues? United States immigration laws have tremendously affected Asian Americans and Pacific Islanders. Beginning with the Page Act of 1875 and the Chinese Exclusion Act of 1882, the U.S. immigration system excluded virtually all Asians from the United States. The few Asians who could migrate to the United States were denied citizenship, and could not vote or own property as a consequence. National origin quotas that discriminated against Asians were not fully eliminated until 1965 with the Immigration and Nationality Act (INA). Asian Americans are now the fastest growing racial group in the United States, and, as a result, are impacted by various immigration laws. Approximately 1 in 10 undocumented youth is Asian American or Pacific Islander. Due to a number of barriers, including cultural, financial hur- dles, and lack of clarity regarding the benefits of the program, far fewer AAPIs have applied for Deferred Action for Childhood Arrivals (DACA) than expected based on the estimated number of AAPIs eligible for DACA. DHS’s most recent data estimates that 1.3 million Asian Americans are undocumented out of 11 million undocu- mented immigrants, the vast majority of whom have lived in the United States for more than a decade. The top states where they reside are California, New York, New Jersey, Texas, Illinois, Virginia, Georgia and Washington. A staggering 78 percent of adult Asian Americans are foreign-born— more than any other racial or ethnic group in the United States.
