BACKGROUND INFORMATION: At their August 28, 2019 meeting, the East Lansing Planning Commission took action on site plan and special use permit application from Northern United Brewing Company, LLC for the property at 218 Albert Avenue to establish a brewery, winery, distillery, and artisan pizza restaurant. The property is located in the B-3, City Center Commercial, zoning district.

With eight (8) members present, the Commission voted unanimously to recommend the City Council approve the application.

RECOMMENDATION: Approve the request pursuant to the Planning Commission's recommendation and conditions of approval.

Dear Mayor Meadows and Council Members:

At its August 28, 2019 meeting, with eight (8) members present, the East Lansing Planning Commission took action on the following:

Special Use Permit and site plan application from Northern United Brewing Company, LLC for approval for the property at 218 Albert Avenue to establish a brewery, Winery, distillery and artisan pizza restaurant and bar.

Given that the proposal meets all applicable ordinance requirements, provided the conditions of approval listed herein are met, the Planning Commission voted unanimously to recommend approval of the site plan and special use permit, subject to the following conditions:

1. The capacity of the restaurant shall not exceed 236 persons; seating for no less than 231 diners shall be provided at tables and/or booths. The seating plan shall be reviewed and approved by the Director of Code Enforcement and the Fire Marshal in accordance with Building and Fire Code requirements.

2. Persons under 21 years of age shall not be permitted to enter the premises after 11:00 p.m. unless accompanied by a parent or legal guardian.

3. The proprietor shall work with the Police Department to develop and implement an effective security plan and provide for appropriate staff training.

4. The restaurant shall be designed, operated and maintained at all times consistent with responsible business practices and so that no excessive demands shall be placed upon public safety services, nor any excessive risk of harm to the public health, safety or sanitation, interference with vehicular or pedestrian traffic or parking, or the continuance or maintenance of any unlawful conduct, public nuisance or disorderly conduct either within the establishment or on or about the adjacent businesses and public streets, alleys, parks, parking facilities or other areas open to the public. The proprietor shall make reasonable effort to report to authorities any unlawful conduct that is observed from the premises. A violation of this Section is a misdemeanor and is considered cause for a license suspension or revocation or denial pursuant to Sec. 8-67.

5. The restaurant shall comply with the requirements and performance standards for a “restaurant” as set forth in Sections 8-181 and 8-182 of Chapter 18 of the City Charter at all times.

6. The proprietor shall obtain and maintain the required State Liquor License.

7. An annual City Entertainment Permit must be obtained prior to conducting any activity on the premises as described under section 8-251 of Article V, Division 1, Chapter 8 of the City Code.

8. A Memorandum of Special Use Permit shall be filed with the County Register of Deeds per section 50-96 of the City Code.

9. Seasonal seating for up to 36 persons may be provided in the outdoor service area, but such seating shall not increase the overall capacity of the facility as stated in condition 1 above. An annual use of right-of-way permit for outdoor seating shall be obtained prior to any outdoor seating in the public right-of-way on Albert Avenue.

10. The outdoor service area shall be vacated by 12:00 midnight daily.

11. The outdoor service area shall be effectively delineated and contained with fencing, shrubbery or similar means to control access to the area.

12. Furniture and equipment used in conjunction with the outdoor service area shall be stored in an inconspicuous space seasonally when the area is not in use.

13. No live or recorded music or telecommunication device shall be provided in the outdoor service area which is audible from any adjacent residential property.

14. Lighting provided for the outdoor service area shall be designed to direct light downward and not onto any adjacent property.

15. The trash containers shall be constructed and screened in accordance with the requirements

of section 50-147 of the City Code.

16. Recycling containers shall be provided in accordance with section 36-86 of the City Code.

STAFF REPORT August 23, 2019 Special Use Permit/Site Plan Application Jolly Pumpkin 218 Albert Avenue

SUBJECT

An application for Site Plan and Special Use Permit approval from Northern United Brewing Company, LLC to establish a brewery, winery, distillery and artisan pizza restaurant and bar at 218 Albert Avenue. The subject property is in the B-3, City Center Commercial District.

EXISTING CONDITIONS

The space where Jolly Pumpkin will locate, is a white box suite in the Center City development along Albert Avenue. The development includes retail and parking and residential uses on the upper floors. The residential use is reserved for residents 55 years and older.

The property is in the B-3, City Center Commercial, zoning district, as are the properties to the north, east, south and west. Across Albert Avenue to the north, are, the Hopcat restaurant with student housing on the upper floors, the Blue Owl coffee shop and Fieldhouse restaurant. To the south, is another building in the Center City development which includes a Target store on the first floor and student housing on the upper floors. To the east, is the 231 M.A.C. Avenue building which includes The Riv, Pin Ball Pete’s and office uses on the upper floors. To the west, is the future Fosters Coffee and Barrio Taco.

PROPOSED DEVELOPMENT

Jolly Pumpkin is a restaurant proposing to operate in a suite of the Center City development along Albert Avenue. The applicant is proposing seating for 231 persons inside and 36 outside. The inside is divided into two areas, the ground floor and the mezzanine. The mezzanine has seating for 88 persons and the ground floor accommodates the remaining seating for 143 persons.

STAFF REVIEW – Site Plan

A site plan application must meet the specific use and dimensional standards of the

zoning district in which it is to be located and a number of other required conditions for development specified in the Zoning Code. A site plan application must substantially comply with the general standards of review specified in Sec. 50-38 of the Code. A site plan must also comply with other applicable local ordinances and state and federal statutes, and be consistent with the objectives of the City’s comprehensive plan. A site plan may be approved subject to certain conditions or modifications necessary to bring the plan into conformance with these requirements, including the approval of any variance that may be granted by the zoning board of appeals.

A. Zoning District Standards

The purpose of the B3 District “is to provide for a wide range of commercial and high- density residential land uses designed to serve the residents and shoppers of the East Lansing City Center. Because of its proximity to the Michigan State University campus and nearby residential neighborhoods, a major characteristic of the City Center is its intense core of pedestrian activity. This activity helps to create a unique social environment where people can gather and enjoy the festive atmosphere of a university downtown, attractive landscaping and greenery, and the diversity of retail shops.”

B. General Standards of Review for Site Plan Approval (For a detailed list of the standards, please see Sec. 50-38 of the Code)

1) General site conditions. The site shall be designed and developed to provide a logical relationship between functional elements, to effectively serve the purposes for which it is to be developed, and to be reasonably compatible with surrounding properties.

The overall development was designed to provide additional housing, parking and commercial services for the City.

(2) Natural features. The site shall be designed and developed to minimize the disruption or loss of its desirable natural qualities and to enhance its overall appearance. There shall be no net loss in either wetland area or wetland benefits due to development of the site.

The site was an urban redevelopment site. There were no natural features

(3) Traffic Access. The site shall be designed and developed to provide safe and efficient access for all forms of travel and to minimize impacts on adjacent public facilities.

(4) Utilities and public services. The site shall be designed and developed to facilitate the efficient provision and maintenance of adequate public services.

There are adequate public services and utilities to service the site. The infrastructure was upgraded in this area in the last 10 years.

(5) Environmental protection. The site shall be designed and developed to minimize any risk of pollution of natural resources and to protect the public health, safety and welfare.

The site has been designed and developed to minimize any risk of pollution of natural resources and to protect the public health, safety and welfare. A green roof system is proposed to filter run-off prior to reaching the City’s storm sewer system.

Prior to the approval of final plans and the issuance of any construction permits, in addition to complying with all applicable local construction standards and specifications, the applicant will need to provide the Planning Division:

1. 2 – Copies of the final Floor Plan and Site Plan 2. Signed copy of the Memorandum of Special Use Permit

E. Objectives of the Master Plan

This site is designated for M4 in the City’s master plan. It allows up to eight stories or ten stories with a bonus. It allows a variety of uses such as residential, light manufacturing, warehouse, office, retail, hotel, restaurant, place of assembly, museum, and laboratory.

STAFF REVIEW – Special Use Permit

A Special Use Permit application may be approved if it meets the requirements for Site Plan approval reviewed above and if the applicant makes an affirmative showing and the City finds that the application meets the following additional standards of review specified in Sec. 50-94 of the Code. A Special Use Permit may also be approved subject to reasonable conditions or certain modifications necessary to ensure that the use conforms to all applicable requirements.

A. All uses. Except as may be provided elsewhere in the Zoning Code, each Special Use Permit application shall meet each of the following standards:

(1) The proposed use shall be consistent with the purpose of the use district in which it is located and the purpose and provisions of this division.

The proposed use of a restaurant is consistent with the purpose of the use district in which it is located and the purpose and provisions of this division.

(2) The site plan for the property shall be approved in accordance with the provisions of section 50-36 of this chapter.

The site plan will be reviewed under the standards of section 50-36.

(3) The proposed size, height, architectural character and placement of new or expanded structures on the site shall be reasonably compatible with the existing or anticipated buildings on adjacent properties.

The proposed restaurant is in the new Center City development which was approved by City Council in 2017.

(4) Streets and access facilities serving the site shall be able to safely accommodate the expected traffic generated by the proposed use; the use shall not cause excessive traffic congestion or delays, obstruct access to adjacent properties, or imperil the safety of motorists, pedestrians or bicyclists.

The design and development of the parking and access to the Center City project took into consideration that the uses would be a mix of residential, restaurant, retail and office uses.

(5) The proposed use shall not adversely affect the use and enjoyment of adjacent properties by generating excessive noise, vibration, light, glare, odors or any other form of pollution or nuisances.

The applicant is proposing outdoor seating. However, the outdoor seating will be required to be closed by midnight and no electronic sound producing device shall be plainly audible from beyond the property line.

(6) The proposed use shall not materially diminish the economic value of adjacent properties or the city as a whole.

There is no reason to believe that the use would materially diminish the economic value of the adjacent properties or the city as a whole.

(7) The proposed use shall not materially diminish the privacy, safety, security or enjoyment of any residential dwelling or residential neighborhood within the vicinity of the site.

The use is not expected to materially diminish the privacy, safety, security or enjoyment of any residential dwelling or residential neighborhood within the vicinity of the site.

(8) The proposed use shall be located with direct access to and frontage on a major street as designated in the major street plan, or within an area designated for adaptive reuse in the city center element of the comprehensive plan.

B. Specific uses. In addition to the standards above, to address their unique characteristics, certain uses shall also meet the applicable standards below.

(2) Businesses selling alcoholic beverages. The following additional standards shall apply to restaurants and businesses licensed or to be licensed for the sale of alcoholic beverages or alcoholic liquor for consumption on or off the premises. a. The establishment shall not be located in such proximity to churches, elementary, or secondary schools, child development centers, or community centers so as to annoy, injure, offend, disrupt, disturb, or interfere with the activities conducted thereon or the persons conducting, attending, or traveling to or from such premises. Staff has reached out to The Peoples Church, St. Thomas Aquinas Church and Martin Luther King Chapel and expect to get a reply from each prior to City Council taking final action on the application. b. The establishment shall not cause or continue an undue concentration of similar uses in the neighborhood such that liquor establishments and trade become a dominant influence or feature of the district or neighborhood. See attached map. c. The establishment shall be designed, operated, and maintained at all times consistent with responsible business practices and so that no excessive demands shall be placed upon public safety services, nor any excessive risk of harm to the public health, safety, or sanitation, interference with vehicular or pedestrian traffic or parking, or the continuance or maintenance of any unlawful conduct, public nuisance, or disorderly conduct either within the establishment or on or about the adjacent businesses and public streets, alleys, parks, parking facilities, or other areas open to the public. The establishment shall make reasonable effort to report to authorities any unlawful conduct that is observed from the premises. The requirements of this section shall be a written condition of each special use permit issued to

a restaurant. This will be made a condition of approval. d. Restaurants selling alcoholic beverages shall provide to the city manager reports and business records, in the form and manner required by an administrative order to be published by the city manager and approved by the city council, to permit the city to review and determine continued compliance with the requirement and performance standards of the definition of "restaurant" in section 50-8 and chapter 18 of the City Charter. The requirements and performance standards of the definition of "restaurant" in section 50-8 and the reporting requirements of this subsection shall be a written condition of all special use permits issued to restaurants licensed to sell alcoholic beverages. This will be made a condition of approval.

Jolly Pumpkin estimated their occupancy at 250 on their restaurant license application. I processed the charge accordingly ($1,625.) If they do end up getting approved for a different occupancy, their annual license fee would be adjusted to reflect that. Each application shall include suf?cient information and detail to determine ifthe proposed development meets applicable standards of review under the Zoning Code and other applicable standards. The information shall be prepared by persons with applicable competencies so that the city may rely on its accuracy and feasibility. Applications shall be submitted to the Department of Planning and Community Development.

Plan submission requires five (5) full sets of plans, no larger than 24" x 36" in size, and one (1) full set of plans reduced to 11” x 17" or smaller. Plan documents must be accurate and legible, drawn to a designated scale and dimensioned as appropriate to enable staff to determine compliance with relevant Code standards. Plans depicting the overall site should be prepared at the largest scale possible, a scale of one inch equal to no more than 100 feet. Floor plans and building elevations shall be drawn at no less than one~eighth inch equal to one foot.

Each submission also must include a completed application form, the required written information, a signed copy of this checklist, a signed copy of the environmental permits checklist, and the required application fee, made payable to the City of East Lansing. Any variations from these submission requirements must be approved by the Zoning Administrator. The application shall typically include the following drawings and information, as may be relevant to the nature of the application and the city's review requirements:

E (1) A site plan, as defined in section 50-9 of the Zoning Code, showing: the proposed size and location of buildings, parking and access facilities, free-standing signs and other improvements to be constructed or installed on the site, and the proposed use and treatment of other areas on the site. The site plan shall be clearly dimensioned to show the setbacks of buildings and parking areas, the separation between buildings and parking areas, the height of buildings, the width of roadways and driveways, the size of parking spaces, and other elements of the site plan as necessary to ensure the site plan complies with the applicable dimensional standards of the Code.

El (2) An existing topographic survey and boundary description of the site, drawn at the same scale as the site plan, showing the following existing conditions:

El (3) A proposed landscape plan which, at a minimum, conforms to the requirements of section 50- 840 of the Zoning Code, drawn at the same scale as the site plan or larger, showing: the Previously location and size of areas to be landscaped; the type, size and placement of plant materials to submitted by be installed; the type, size and location of existing trees and significant clusters of trees or developer shrubs to be preserved; the location and height of proposed earth berms; and the size and design of fences or other screens to be erected. Northern United Brewing Company is excited to be opening its newest Jolly Pumpkin microbrewery, tasting room and gastropub on Albert Street in East Lansing. Jolly Pumpkin pairs its world‐class craft beer with a creative, full menu of irresistible appetizers like our truffle fries, farm to table entrees and wood‐ fired pizza. A sample menu of our offerings is attached.

Our East Lansing Jolly Pumpkin will feature a three‐barrel brew house system brewing our North Peak recipes on site. We’ll supplement these beers with Jolly Pumpkin’s funky, wild yeast‐fermented sour beers that are brewed and barrel‐aged at our Dexter, Michigan brewing facility. Jolly Pumpkin restaurants generally feature over thirty draft options for beer enthusiasts to explore. Northern United also produces its own Nomad ciders and Bonafide wines, and distills its Civilized and Olde Mission spirits, in order to offer our patrons the broadest range of options.

The restaurant will seat up to 250 guests, including our seasonal outdoor seating, and will be open daily from 11 am to 12 am on weekdays and 2 am Friday and Saturday evenings, with food service available until close. We anticipate a staff of 20 full‐time employees and 35‐40 part‐time employees among our kitchen and wait staff, bartenders and management. Trash will be disposed of daily via the Center City common area facilities.

Our other locations adjacent to college campuses—Ann Arbor, Midtown Detroit, Grand Valley State University’s Grand Rapids campus and Chicago’s Hyde Park—have given us a wealth of experience in providing a distinctive culinary experience to a sophisticated, diverse customer base. East Lansing is a natural fit for the tasting room/restaurant we are proud to offer, and we look forward to becoming a member of the East Lansing and Michigan State University community.

Darcy Schmitt, Senior Planner, highlighted site plan and special use permit application for 218 Albert Avenue as outlined in August 9, 2019 staff report. Boyle asked if there will be a brewery on site. Schmitt said yes. Wolf asked regarding an entertainment license. Schmitt said applicant has not requested an entertainment license.

Bollman asked if applicant is in attendance at meeting to answer questions. No applicant or representative came forward. Bollman opened the public hearing.

Seeing no one come forward, Bollman closed the public hearing.

Bollman said this item will return to Planning Commission at a future meeting and requested that applicant be in attendance at that time.

Tony Grant, CEO Northern United Brewing Company, 2319 Bishop Circle East,

Dexter, applicant, highlighted Jolly Pumpkin microbrewery, tasting room and gastropub to be opened at 218 Albert Avenue. He answered Commissioner questions

regarding on-site brewing, outdoor seating, and size of restaurant compared to other Jolly Pumpkin locations.

Motion: Cahill moved to recommend approval to City Council request from

Northern United Brewing Company, LLC for Special Use Permit approval for the property at 218 Albert Avenue to establish a brewery, Winery, distillery and artisan

pizza restaurant and bar, subject to 16 conditions listed in August 23, 2019 staff report. Motion was seconded by Wolf. Vote: All yeas. Motion passed unanimously.

1. The capacity of the restaurant shall not exceed 236 persons; seating for no less than 231 diners shall be provided at tables and/or booths. The seating plan shall be reviewed and approved by the Director of Code Enforcement and the Fire Marshal in accordance with Building and Fire Code requirements.

2. Persons under 21 years of age shall not be permitted to enter the premises after 11:00 p.m. unless accompanied by a parent or legal guardian.

3. The proprietor shall work with the Police Department to develop and implement an effective security plan and provide for appropriate staff training.

4. The restaurant shall be designed, operated and maintained at all times consistent with responsible business practices and so that no excessive demands shall be placed upon public safety services, nor any excessive risk of harm to the public health, safety or sanitation, interference with vehicular or pedestrian traffic or parking, or the continuance or maintenance of any unlawful conduct, public nuisance or disorderly conduct either within the establishment or on or about the adjacent businesses and public streets, alleys, parks, parking facilities or other areas open to the public. The proprietor shall make reasonable effort to report to authorities any unlawful conduct that is observed from the premises. A violation of this Section is a misdemeanor and is considered cause for a license suspension or revocation or denial pursuant to Sec. 8-67.

5. The restaurant shall comply with the requirements and performance standards for a “restaurant” as set forth in Sections 8-181 and 8-182 of Chapter 18 of the City Charter at all times.

6. The proprietor shall obtain and maintain the required State Liquor License.

7. An annual City Entertainment Permit must be obtained prior to conducting any activity on the premises as described under section 8-251 of Article V, Division 1, Chapter 8 of the City Code.

8. A Memorandum of Special Use Permit shall be filed with the County Register of Deeds per section 50-96 of the City Code.

9. Seasonal seating for up to 36 persons may be provided in the outdoor service area, but such seating shall not increase the overall capacity of the facility as stated in condition 1 above. An annual use of right-of-way permit for outdoor seating shall be obtained prior to any outdoor seating in the public right-of-way on Albert Avenue.

10. The outdoor service area shall be vacated by 12:00 midnight daily.

11. The outdoor service area shall be effectively delineated and contained with fencing, shrubbery or similar means to control access to the area.

12. Furniture and equipment used in conjunction with the outdoor service area shall be stored in an inconspicuous space seasonally when the area is not in use.

13. No live or recorded music or telecommunication device shall be provided in the outdoor service area which is audible from any adjacent residential property.

14. Lighting provided for the outdoor service area shall be designed to direct light downward and not onto any adjacent property.

15. The trash containers shall be constructed and screened in accordance with the requirements of section 50-147 of the City Code.

16. Recycling containers shall be provided in accordance with section 36-86 of the City Code.
