1 Purpose of Report/Recommendations

1.1 To appraise Members on planning appeals currently in the system. A background table is enclosed in Appendix 9 showing the current status of any live appeals and any decisions made since the last meeting.

2 Background

2.1 Since transfer of Planning to local government, Members have been advised on a monthly basis of the transitional provisions for dealing with planning appeals following transfer of powers on 1st April 2015 as set out in The Planning (2011 Act) (Commencement No.3) and (Transitional Provisions) Order () 2015.

2.2 With regard to applications refused by the Council post 1st April 2015, officials have and will continue to notify the Planning Committee when appeals are received and dates for submission are published by the Planning Appeals Commission (PAC).

3 Key Issues

3.1 Members are advised that no new appeals were submitted to the PAC since the last Committee meeting

In all other cases the award of costs shall apply.

1 Purpose of Report/Recommendations

1.1 This report has been compiled to update Members on the progress made by the Planning Enforcement section for the business year 2019-2020.

2 Background

2.1 Derry City and Strabane District Council has the power to carry out Planning Enforcement powers which are set out in Part 5 of The Planning Act (Northern Ireland) 2011. This gives the Council discretionary power to take Enforcement action against breaches of planning control.

2.2 This review shows the performance of Council’s Planning Enforcement section for the business year 2019-2020. A breakdown of cases opened and cases closed for each business quarter has been provided and details of the number and type of Enforcement Notices served for 2019-2020 business year has been provided. For this business year Council has one target in relation to Enforcement which seeks 70% of Enforcement cases to be brought to a conclusion within 39 working weeks.

3 Live Case Loads

3.1 The Enforcement section started the business year with a caseload of 237 at the start of April 2019 which increased to 245 by the end of June 2019. Within the second quarter overall case numbers where reduced to 230. Numbers increased in the third and fourth quarter with the section finishing the business year with an overall case load of 264 at the end of March as shown in Table 1.

3.2 New Cases

3.3 From 1st April 2019 to 31st March 2020 the Enforcement section received a total of 171 new cases as shown in Table 2 which is a slight increase on the 2018-2019 business year when the section received a total of 164 new cases.

Page 36 Case Closures

3.4 For the 2019/2020 business year, a total of 176 cases have been closed as shown in Table 3 which is a decrease in closures from the previous year when the section closed 196 cases. In the first quarter of the business year the Enforcement section closed 25 cases from April to June with the closure rate increasing to 54 in the second quarter of the business year between July and September. Closure rates then reduced to 45 for the third quarter of the business year and increased again to 52 for the final quarter.

3.5 A total of 74 cases closed this year have had the breach of planning control remedied through negotiation between the Enforcement Officers and the land owner/operator or the breach has been regularised through the grant of planning permission and compliance with conditions attached. This equates to 42% of the cases closed for the business year being done so through negotiation and regularisation.

3.6 A further 59 cases which equates to 34% closed this year were found to have no breach of Planning control onsite when investigated by Enforcement Officers with 34 cases which equates to 19% investigated deemed not expedient to pursue as the breach was minor in nature when investigated.

3.7 For this business year, a total of 9 cases which equates to 5% have been closed as the breach of planning control was found to be immune from Enforcement action. In these cases evidence was submitted by the land owner/operator showing the breach was in existence for over 5 years; therefore no enforcement action could be taken and the use or development in question was therefore lawful.

3.8 Statistics provided by DFI showed that Council’s Enforcement section closed 78.1% of cases within 39 weeks for the business year 2019-2020, which exceeds the Enforcement target of closing 70% of cases within 39 weeks. This is also an improvement on the previous year when the section failed to meet the 70% Enforcement target and only achieve a closure rate of 53.6% of cases within 39 weeks.

3.9 Notices Served:

3.10 For the 2019-2020 business year the Enforcement section served a total of 23 notices 11 of which were enforcement notices. This is an increase overall from the 2018-2019 business year when 15 notices in total were served. Of the 15 served in 2018-2019 13 were enforcement notices.

3.12 For the year 2019/2020, the section had 9 ongoing appeals. Of the 9 appeals the Enforcement section where notified of 8 where in relation to enforcement notices served and 1 appeal related to the non-determination of a Certificate of Lawful Use and Development.

3.13 At the end of March 2020, 5 appeals had been heard with decisions issued on 3 appeal hearings and a further 2 decisions outstanding. The 3 appeal decisions issued by the Planning Appeals Commission upheld the Councils Enforcement notices with amendments. A further 3 appeals where awaiting to be heard at the end of March 2020. The appeal received in relation to the non-determination of a certificated of lawful use was conducted as written representations during this business year with a decision outstanding at the end of March 2020.

3.15 For the 2019/2020 business year, 4 case has been cleared for summons to court by Planning Committee Member with dates for hearing outstanding.

1 Purpose of Report/Recommendations

1.1 This report has been compiled to update Members on the progress made by the Planning Enforcement section for the first Quarter of the business year 2020-2021.

2 Background 2.1 Derry City and Strabane District Council has Planning Enforcement powers which are set out in Part 5 of The Planning Act (Northern Ireland) 2011. This gives the Council discretionary power to take Enforcement action against breaches of planning control.

2.2 This review shows the performance of Council’s Planning Enforcement section for the first Quarter of the business year 2020-2021. A breakdown of cases opened and cases closed for the business quarter have been provided and details of the number and type of Enforcement Notices served has been provided. For this business year Council has one target in relation to Enforcement which seeks 70% of Enforcement cases to be brought to a conclusion within 39 working weeks.

3 Live Caseloads

3.1 The Enforcement section started the business year with a caseload of 245 at the beginning of April 2020, which increased to 256 by the end of June 2020. This increase in numbers over the 1st Quarter compared to the previous year is due to restriction put in place as a result of COVID-19 when officers were unable to carry out site inspections except for priority or emergency site visits on TPO sites and Listed Buildings. Site visits resumed in mid-May on a phased basis with outdoor low-risk site visits resuming first.

Page 41 The section saw a slight increase in caseload over the 1st quarter compared to the previous year when the caseload at the end of the 1st quarter of 2019/2020 business year was 245 as shown in Table 1. The Section currently has a live caseload of 253 for the year-to-date.

3.2 New Cases

3.3 From 1st April 2020 to 31st June 2020 the Enforcement section received a total of 36 new cases as shown in Table 2 which is a slight increase from the same quarter in the 2019-2020 business year when the section opened a total of 35 new cases. For the second quarter of the business year-to-date the section has opened 35 new cases.

3.5 For the first quarter of the business year, a total of 15 cases have been closed as shown in Table 3 which is a reduction in closures from the same period in the previous year when the section closed 25 cases.

3.6 A total of 4 cases closed in the first quarter of the business year have had the breach of planning control remedied through negotiation between the Enforcement Officers and the land owner/operator, or the breach has been regularised through the grant of planning permission and compliance with conditions attached. This is a reduction in number for the first quarter in the previous year when the section closed 12 cases through negotiation or the regularisation through the grant of planning permission.

3.7 A further 4 cases closed for the first quarter of the business year were found to have no breach of Planning control onsite when investigated by Enforcement Officers which is a decrease from the previous year when 9 cases where deemed to have no breach of planning control. A total of 5 cases investigated where deemed not expedient to pursue as the breach was minor in nature when investigated which is an increase from the same time the previous year when 4 cases were deemed not expedient to pursue.

3.8 For the first quarter of the business year, 2 cases were closed due to immunity, which is the same as in the first quarter in the previous year when the section closed 2, as they were found to be immune from enforcement action.

3.9 Statistics provided by DFI showed that Council’s Enforcement section closed 12.5% of cases within 39 weeks for the first quarter of the business year 2020-2021 which falls well below the Enforcement target of closing 70% of cases within 39 weeks. The contributing factors are that staff were restricted in visiting and processing the more recent cases to closure, and the majority of cases closed were older cases. Staff and senior management have been engaging in prioritising work plans for the team to move forward now to catch up on the backlog of site visits and actions on the new cases received. This will enable a return to a more balanced approach to concluding cases as we move through quarter two and into quarter three of 2020/2021.

3.10 Notices Served:

3.11 For the first quarter of the 2020-2021 business year the Enforcement section served a total of 9 notices, 6 of which were Planning Contravention Notices with 1 Enforcement Notice and 1 Stop Notice. This is decrease from the same quarter in the previous year when the section served 14 notices. This drop is due to Covid-19 restrictions whereby there was limited ability to carry out site inspections until mid-May and subsequently action cases.

3.13 For the first quarter of the business year and year-to-date, the section had 7 ongoing enforcement appeals. Of the 7 appeals, 4 have been heard with recent decisions on 2 appeals.

 Appeal 2018/E0041 for the Alleged unauthorised winning and working of materials, stockpiling of minerals and export of materials; Alleged unauthorised change of use of land for screening and crushing of minerals; Alleged unauthorised erection of cabin used as an office, staff room and toilet; Alleged unauthorised erection of storage unit; Alleged unauthorised ponds; Alleged unauthorised silt lagoons; Alleged unauthorised earth bunds; Alleged unauthorised deposition of waste material, scrap metal and disused vehicles on lands Lands North , South and East of 33 Castlewarren Road, Donemana with the PAC upholding the Councils Enforcement Notice variation.  Appeal 2019/E0033 existing development and use of an entrance, access haul road and crossing point connecting the existing sand and gravel pit and washing plant site to the Castlewarren Road. Access point into lands C.360m north east of 35, Castlewarren Road, Donemana, Strabane. This

Page 45 appeal was for the non-determination of a Certificate of Lawful use and development existing. The PAC allowed the Certificate with variations.

Officers are awaiting results from 2 further hearings from the Commission with a further 3 appeals yet to be heard. For the same period:

1 Purpose of Report/Recommendations 1.1 To appraise Members on the Permitted Development for Agricultural buildings and Operations.

2 Background

2.1 The Planning (General Permitted Development) Order (NI) 2015 has provision within Part 7 that allows permitted development for agricultural buildings and operations subject to specific criteria.

3 Key Issues

3.1 The Planning (General Permitted Development) Order (NI) 2015 permits development for 37 development types on the Schedule to Article 3 of Order. Part 7 specifically refers to Agricultural Buildings and Operations and permits development for Classes A, B, C and D. Part 7 is included in Appendix 11.

3.2 Part 7 Class A permits development for the carrying out on agricultural land comprised in an agricultural unit of -

(a) works for the erection, extensions or alterations of a building; or

(b) any excavation or engineering operation.

Both (a) and (b) must be reasonably necessary for the purposes of agriculture within that unit.

3.3 Paragraph A.1 lists the specific circumstances (a-i) when development is not permitted. Paragraph A.2 provides interpretation on Class A.

Page 47 3.4 Part 7 Class B permits development for the winning and working on land held or occupied with land used for the purposes of agriculture and any minerals reasonably necessary for agricultural purposes within the agricultural unit of which it forms part. Paragraph B.1 lists when development is not permitted, and B.2 specifies the conditions and B.3 provides interpretation on the wording used.

3.5 Part 7 Class C permits development for the construction, formation, laying out or alteration of a means of access to a road. Para C.1 lists when development is not permitted by Class C.

3.6 Class D permits development for the carrying out on agricultural land comprised in an agricultural unit of works for the erection, extension or alteration of a building or structure for the purpose of:-

(a) the generation (including the co-generation) of energy from anaerobic digestion biomass; or

(b) the storing of digestate

including the works for the installation, alteration or replacement of a flue forming part of an anaerobic digestate system.

Para D.1 lists the specific circumstances when development is not permitted by Class D and para D.2 provides interpretation on Class D.

3.7 Permitted Development is also subject regulations 55 and 66 of the Conservation (Natural Habitats, etc) Regulations (NI) 1995 (a). This means that any permitted development shall not take place until it is demonstrated it is not likely to have a significant effect on a European site or a European offshore marine site (either alone or in combination with other plans or projects).

In practice this means when assessing proposals for permitted development, officers will have to consider if the scheme would require Habitats Regulations Assessment.

3.8 Permitted Development is also subject to (The Planning (Environmental Impact Assessment) Regulations (NI) 2017. Permitted development is not granted for any proposals that would fall into Schedule 1 of the EIA regulations, Schedule 2 developments in a sensitive area, or any proposal exceeding the Schedule 2 thresholds, unless the proposal has been confirmed as not being EIA development under regulation 6 of the EIA regulations, and is not likely to have significant effect on the environment.

Page 48 3.9 If an applicant requires confirmation that an existing or proposed agricultural building or operation is permitted development, they must submit a Certificate of Lawful Use or Development to Council, which is also subject to appeal to the Planning Appeals Commission in the event of refusal or non-determination.

4 Financial, Equality, Legal, HR, Improvement, Rural Needs and other Implications

4.1 Certificates for Lawful Use or Development are subject to the appeals process under the Planning Appeals Commission (PAC) and therefore Council could receive Costs claims in respect of any decision appealed. Equally Council could submit a Costs claim to the PAC if it was considered necessary and appropriate.

Permitted A. The carrying out on agricultural land comprised in an development agricultural unit of— (a) works for the erection, extension or alteration of a building; or (b) any excavation or engineering operation;

reasonably necessary for the purposes of agriculture within that unit.

Development A.1 Development is not permitted by Class A if— not permitted (a) the development is on agricultural land less than 0.5 hectares in area; (b) it consists of or includes the erection, extension or alteration of a dwelling; (c) a building, structure or works not designed for the purposes of agriculture is provided on the land; (d) the building or structure to be erected is the first agricultural building on the unit;

(e) the nearest part of any building or structure so erected or extended is more than 75 metres from the nearest part of a group of principal farm buildings; (f) the nearest part of any building or structure so erected or extended is less than 75 metres from a dwellinghouse (other than a dwellinghouse of any person engaged in agricultural operations on that unit);

(g) the ground area to be covered by— (i) any works or structure (other than a fence) for the purposes of accommodating livestock or any plant or machinery arising from engineering operations; or (ii) any building erected or any building as extended or altered; exceeds 500 square metres, calculated as described in paragraph A.2(b); (h) the height of any part of the building, structure or works within 3 kilometres of the perimeter of an airport exceeds 3 metres, or 12 metres in any other case; (i) any part of the development is within 24 metres from the nearest part of a special road, or within 24 metres of the middle of a trunk or a first or second-class road or 9 metres from the middle of other classes of road.

Interpretation of A.2 For the purposes of Class A— Class A (a) the area of 0.5 hectares shall be calculated without taking into account any separate parcels of land; (b) the ground area referred to in A.1(g) is the ground area which the proposed development covers together with the ground area of any building (other than a dwellinghouse) or any works, structure, plant or machinery within the same unit which is being provided by Class A or has been provided within the preceding two years and any part of which is within 75 metres of the proposed development; (c) “agricultural land” has the meaning assigned to it by the Agriculture Act (Northern Ireland) 1949(23);

(d) “agricultural unit” means land which is occupied as a unit for the purposes of agriculture other than fish farming but includes any dwelling house or other building occupied by the same person for the purpose of farming the land by the person who occupies the same unit; (e) “building” does not include anything resulting from engineering operations;

Class B

Permitted B. The winning and working on land held or occupied with development land used for the purposes of agriculture of any minerals reasonably necessary for agricultural purposes within the agricultural unit of which it forms part.

Development B.1 Development is not permitted by Class B if any excavation is not permitted within 24 metres of the nearest part of a special road or within 24 metres of the middle of a trunk or a first or second- class road or 9 metres from the middle of other classes of road.

Conditions B.2 Development is permitted by Class B subject to the conditions— (a) that no mineral extracted during the course of the operation shall be moved to any place outside the land from which it is extracted, except to land which is held or occupied with that land and is used for the purposes of agriculture;

(b) the surface of the land shall be levelled and any topsoil replaced as the uppermost layer; (c) the land shall so far as practicable be restored to its former condition before the extraction took place.

Interpretation of B.3 For the purposes of Class B the expression “purposes of

Class B agriculture” includes fertilizing the land used for the purposes of agriculture, and the maintenance, improvement or alteration of any buildings, structures or works occupied or used for such purposes on land so used.

Class C

Permitted C. The construction, formation, laying out or alteration of a development means of access to a road.

Development C.1 Development is not permitted in Class C if— not permitted (a) it is required in connection with development for which a planning application is necessary under Part 3 of the 2011 Act; or (b) the land is within a site of archaeological interest.

Class D

Permitted D. The carrying out on agricultural land comprised in an development agricultural unit of works for the erection, extension or alteration of a building or structure for the purpose of— (a) the generation (including the co-generation) of energy from anaerobic digestion of biomass; or (b) the storing of digestate; including works for the installation, alteration or replacement of a flue forming part of the anaerobic digestion system.

(i) the total capacity of the anaerobic digestion system exceeds— (i) 200 kilowatts in relation to the generation of electricity; and (ii)

285 kilowatts thermal in relation to the production of heat; (j) feedstock not produced on land within the agricultural unit is used in the anaerobic digestion system; (k) feedstock not produced on land within the agricultural unit is stored within that unit; (l) it would result in more than one anaerobic digestion system within the agricultural unit.

Interpretation of D.2 For the purposes of Class D— Class D (a) the ground area referred to in D.1(f) is the ground area which the proposed development covers together with the ground area of any building or structure previously provided for the purposes of anaerobic digestion; (b) “agricultural land” has the meaning assigned to it by the Agriculture Act (Northern Ireland) 1949; (c) “agricultural unit” means land which is occupied as a unit for the purposes of agriculture other than fish farming but includes any dwellinghouse or other building occupied by the same person for the purpose of farming the land by the person who occupies the same unit.

1 Purpose of Report/Recommendations

1.1 To appraise Members on the position regarding the assessment of planning applications that require the appropriate assessment of ammonia emissions, following receipt of correspondence from Friends of the Earth on 14th August 2020 (Appendix 12).

2 Background

2.1 Friends of the Earth (FoE) wrote to Council on 14th August 2020 setting out their view regarding the position on ammonia issue as outlined by the Minister for Agriculture, Environment and Rural Affairs to Mid and East Antrim Council on 22nd July 2020. Both letters are attached in Appendix 12.

3 Key Issues

3.1 Members of the Planning Committee have received previous updates from Officers regarding the ongoing issue of how ammonia emitting projects are assessed by both NIEA and Shared Environmental Services (SES) (Appendix 13). This remains the current position to date.

Page 57 3.2 Officers understand that a revised operational policy is being currently prepared by NIEA (DAERA) which will be issued in draft format for public consultation in October 2020 as indicated at the recent Strategic Planning Group. Heads of Planning were also advised that a consultation period would follow which should extend to all parties including Councils. In the interim Council will continue to receive advice from both NIEA and SES in relation to all ammonia emitting projects, as outlined in the previous paper to Members dated 24th March 2020. There are approximately 15 current cases in the system whereby ammonia emissions are part of the consideration and Officers will continue to progress those cases when the consultees have fully responded on the issues.

Dear Sirs,

NIEA OPERATIONAL POLICY ON AMMONIA EMITTING PROJECTS

We refer to the above matter recently discussed at the Mid and East Antrim Council Meeting on 3 August 2020.

You will of course be aware that a discrepancy about the appropriate policy to apply to planning decisions concerning ammonia emitting projects arose when Shared Environmental Services adjusted its policy to reflect a much lower threshold of permitted ammonia emissions. This revised policy was subsequently withdrawn subject to legal challenge.

In an effort to clarify what policy now prevails, Mid and East Antrim wrote to the Department of Agriculture, Environment and Rural Affairs seeking clarification on the appropriate protocol to apply when assessing the impact of ammonia emitting developments on protected sites.

Friends of the Earth have concerns over the implications of the response received by DAERA (attached for ease of reference) for local government as a competent authority in making planning decisions concerning this specific type of ammonia emitting development.

As such, this letter has been sent to all Councils in Northern Ireland.

THE NORTHERN IRELAND AMMONIA CRISIS AND ITS EFFECT ON PUBLIC HEALTH

Ammonia (NH3) is an air pollutant largely emitted from agriculture which is known to have a damaging impact on biodiversity, including sensitive habitats and ecosystem resilience as well as human health. It is produced by many common farming activities such as the housing of livestock, the storage and spreading of manure and slurries and the application of fertiliser. Ammonia emitted into the air is subsequently deposited as nitrogen onto land and water surfaces. These nitrogen deposits can travel many miles from the original ammonia source.

Excessive ammonia emissions can also lead to increases in particulate matter which is associated with human health impacts.

Most of Northern Ireland, including our designated sites and other priority habitats are receiving levels of nitrogen which are significantly above their critical load, the concentration at which significant ecological damage occurs.

STATUTORY CONSULTEES POLICY REVIEW AND RESULTING UNCERTAINTY

In his correspondence addressed to the Chief Executive of Mid and East Antrim Borough Council dated 22 July 2020 (attached), Minister Poots confirmed that the current NIEA operational policy on ammonia emitting projects is subject to ongoing review and a new protocol would not be in place until the Autumn.

In the absence of a new policy, determinations made under this old policy have been termed by NIEA officials at a number of Planning Appeals Commission hearings as “vulnerable to legal challenge”.

As a result, the ongoing review of this policy renders NIEA’s existing policy on ammonia emitting projects incapable of providing scientific certainty to competent authorities.

THE PRECAUTIONARY PRINCIPLE

The law is clear about what stance competent authorities should adopt under these circumstances.

The precautionary principle states that a competent authority must establish beyond scientific doubt that there will be no significant harm caused by a development on protected sites before it is given approval. This approach is confirmed at paragraph 57 of the “Waddenzee” Judgement (ECJ C127/02) and was discussed in a Northern Ireland context in Friends of the Earth’s Lough Neagh case heard in the Court of Appeal (2017 NICA 41).

The Orleans v Vlaams Gewest Case 2017 (Case C-187/15 Env LR 12 at [48]-[52]) states that a statutory authority must not grant planning permission unless it is “certain” on the basis of the “best scientific knowledge in the field” that the proposed development would not adversely affect the integrity of the designated site within the meaning of the habitats regulations.

Furthermore, an appropriate assessment will be unlawful if “it contains gaps and lacks complete, precise and definitive findings and conclusions capable of removing all reasonable scientific doubt as to the effect of the works proposed (Case C404-09 Commission v Spain [2011] ECR I-11853).

Effectively, for a development of this nature to attain approval from a statutory authority, there cannot be “lacunae” in the scientific evidence (C323/17) People Over Wind v Coillte Teoranta [2018] Env LR 31 at par[38].

The vulnerability of NIEA’s current operating policy coupled with the fact that it is under review represents significant scientific doubt or “lacunae” in the evidence over the effects of ammonia emitting developments on sensitive receptor sites within the meaning of the habitats regulations. Moreover, a policy under review does not represent the “best scientific knowledge in the field” within the meaning of the Orleans v Vlaams Gewest caselaw.

When a statutory authority is faced with such obvious scientific doubt the precautionary principle must apply. To quote the European Court of Justice in Waddenzee, “…where doubt remains as to the absence of adverse effects on the integrity of the site linked to the plan or project being considered, the competent authority will have to refuse authorisation”.
