NO.23023900 DETAILED TENDER NOTICE Digitally signed & unconditional online tender is invited by the General Manager (Planning & Marketing), Central Office, Maharashtra Vahatuk Bhavan,Dr.Anandrao Nair Marg, Mumbai Central, Mumbai - 400 008 from the tenderer for the work as mentioned in, subsequent paragraph for appropriate categories of tenderers. 1. The bidder should upload scanned copy of undertaking duly notarized stating that his / there / her firm is not blacklisted in MSRTC / Government / Semi- Government institutions / Any STU on Rs. 100/- stamp paper in technical bid submission. If the bidder fails to do so, or hides these facts, while filing the tender; they will be automatically disqualified. 2. The tenders will be received online on above mentioned MSRTC E-tendering portal & will be opened as by General Manager (Planning & Marketing) on scheduled tender opening date. 3. The Competent Authority reserves the right to reject any or all the tender offers, without assigning any reason thereof. 4. The tenders shall be received online on above mentioned E-tendering portal in two envelope systems. 5. The Conditional tenders will be rejected. 6. Bidder should upload scanned attested photo copies of all documents on above mentioned e-tendering portal & produce in original at the time of technical bid opening. 7. While submitting e-tender, the tenderer /s shall take into consideration that they will have to pay service tax as per the rates decided by & as & when revised by Central Excise Department. The contractor will have to produce a registration certificate from Central Excise Department. 8. The acceptance of tender will be intimated by e-mail or otherwise by the authority competent to accept the tender or by the higher authority of MSRTC to the tenderer /s, which shall be deemed to be & intimation of the tender given by the authority competent to accept the tender. 9. The amount of EMD shall be forfeited in case after his / her / there tender is accepted if the bidder fail / fails to complete the contract document & pay the amount of security deposit within a specified time, that would be intimated in the Letter of Acceptance. 10. Decision of tender will vest with the Competent Authority who reserves the right of rejecting any or all the tenders without assigning any reason for doing so. 11. The tenders which are not accompanied by necessary information will be rejected without assigning any reason for doing so. 12. The tenderer whose tender is accepted will have to enter into a contract agreement with MSRTC & shall be required to pay the stamp duty for the execution of the contract agreement with MSRTC according to government rules & scale in force. 13. No alteration in the form of tender, specification etc. will be permitted. 14. While submitting tender, the tenderer / s shall take into consideration that they will have to pay all types of Taxes, Statutory body charges & etc. prevailing rates decided by & as & when revised by the Competent Authority / Department. 2 15. If there is an amendment in the tender, the same shall not be published in the newspaper & that will be published on https://mahatenders.gov.in in the form of corrigendum. The bidder should visit the site, prior to submission of tender & ascertain the local site condition, working restrictions, obstruction, terms & conditions in tender document regarding necessary approvals, NOC required for the work from the local authorities & shall quote the offer exclusive of all such expenses likely to be incurred while execution of the contract. **** GENERAL CONDITIONS OF e-TENDER AND INSTRUCTIONS TO TENDERERS. 1. GENERAL The Maharashtra State Road Transport Corporation (MSRTC) is established under the Road Transport Corporation Act, 1950 (RTC Act, 1950) and is jointly owned by the Government of Maharashtra and the Government of India. Section 19 (2) (I) of the RTC Act, 1950 empowers the M.S.R.T. Corporation to generate revenue by displaying advertisements on its establishments. The Corporation holds a fleet of around 17000 + buses and has 252 depots, 591 bus stations, 4421 pick-up sheds, 31 Divisions and a Central office located at Maharashtra Vahatuk Bhavan, Dr.Anandrao Nair Marg, Mumbai Central, Mumbai-400008. The Corporation intends to continue commercial exploitation of the part of its infrastructure to generate additional revenue by appointing "Sole Agent" for the whole State of Maharashtra. The Corporation's role in this business will strictly be confined to provide spaces in its possession for display of advertisements, without any financial liability whatsoever during the contractual period. The Corporation reserves the right to accept the advertisement proposal which is submitted by the Licensee and is beyond the scope of the Contract on the terms & conditions decided by the Corporation. The entire execution of the work of advertisements such as their fixing, carrying maintaining, effacing, refacing etc. will be the sole responsibility of the Licensee. 2. EXTENT OF TENDER : The tender called for herein is for grant of Licence to secure and display advertisements on the spaces / sites that will be made available by the Corporation in its bus stations/buses as mentioned in tender, subject to the conditions mentioned below and further subject to the general conditions of the contract annexed hereto. 3. OFFERS FOR THE AGENCY Tenderers, may offer their online quotations for guaranteed revenue to the Licensor on the basis of potential of total No. of advertisement spaces in its 3 All bus stations for the advertisement category which will be made available for displaying advertisement thereon. The list of all bus stations is attached herewith as Annexure A. Advertisements in Depot premises /buses will not be permitted. The above lists are only illustrative and subject to change from time to time. 4. GUARANTEED REVENUE OFFER The tenderer who desires to take License for All bus stations of Maharashtra State has to quote his offer to the Corporation for three years of the Contract to be paid in 36 post dated cheques of equal monthly instalments and in advance. This Guaranteed Revenue should be exclusive of all taxes, duties, cesses, fees, etc. Total amount of Guaranteed Revenue offered for 3 years = Equated Monthly Instalments 36 months Bouncing of cheque would be dealt with as per criminal / civil proceeding and as per the terms of the tender. 5. EARNEST MONEY DEPOSIT i) Tender for Sole Licensee be accompanied by the Earnest Money Deposit of Rs.55,000/- (Rupees. Fifty Five Thousands only) .This deposit amount should be paid by online through Nationalized / Scheduled Bank in favour of "MSRTC Fund Account" payable at Mumbai. ii) Payment of EMD through other sources will not be accepted. iii) No interest shall be paid on Earnest Money Deposit. iv) The Earnest Money will be forfeited: a) If the tender is withdrawn by the tenderer(s) before the opening of the tender or within 180 days from the date of opening of the tender. b) If the successful tenderer(s), fails (i) to pay 36 instalments of Guaranteed Revenue in advance by post dated cheques payable on a Nationalized / Scheduled Bank payable at Mumbai or (ii) to deposit the Cash Security Deposit in advance or (iii) To execute Stamped agreement within the stipulated time. v) The Earnest Money Deposit by the unsuccessful tenders(s) will be refunded as soon as possible after the tender is opened and License is granted. The unsuccessful tenderer(s) will have to surrender to the Financial & Chief Accounts Officer of the Corporation, the original receipt of the Earnest Money Deposit for getting its refund. vi) The Earnest Money Deposit of the successful tender(s) will be refunded/ adjusted with the instalment of Guaranteed Revenue to be paid in advance alongwith Security Deposit. vii) If any times, it is discovered that Tenderer has submitted more than one tender under different name, all such tender (s) will be rejected / agreement cancelled / Earnest Money Deposit or Security Deposit will be forefeited. The tenderer would also be black listed and debarred from participating in future tenders. 4 6. QUOTATION: Quotation must be submitted online in TWO separate online envelopes called "TECHNICAL" and "FINANCIAL" envelopes in scheduled time Eligibility conditions:- Following document should be uploaded in Online Technical Envelope(T1) in PDF format, if required can be zipped as well and then uploaded. These documents need to be digitally signed by individual contractor's digital signature and uploaded during Online Bid Preparation stage. Certified copy of profit & loss A/c for two years (in the Compulsory year ( 2015-16 & 2016-17 ) certified by the Chartered Accountant. 4. Copy of Balance Sheet, duly certified by the Chartered Compulsory Accountant for last two years i.e.in the year ( 2015-16 & 2016-17 ) 5. Latest Income Tax return of the Assessed Financial Year Compulsory of last 2 years i.e. ( 2015-16 & 2016-17 ) 6. A self Certified copy of the latest list of Partners / Compulsory Directors. 7.
