RESOLUTION NO. 2016-33

DESTRUCTION OF COUNTY RECORDS OF THE KOOTENAI COUNTY PROSECUTING ATTORNEY, CIVIL DIVISION

WHEREAS, Idaho Code § 31-871 states that county records may only be destroyed by resolution of the Board of County Commissioners; and,

WHEREAS, Idaho Code § 31-871 requires the resolution ordering and disposition of county records to list, in detail, records to be destroyed; and,

WHEREAS, an audit of certain county records and legal files in the possession of the Kootenai County Prosecuting Attorney, Civil Division, has been performed and legal advice regarding the disposal of said records and files has been received.

NOW THEREFORE, IT IS HEREBY RESOLVED that the records and legal files of the Kootenai County Prosecuting Attorney as identified on Exhibit “A” attached hereto and previously classified as temporary, semi-permanent and/or permanent by Resolution No. 2016-32 have surpassed their statutory retention period as public records and may be destroyed.

BE IT HEREBY FURTHER RESOLVED that the destruction and disposition of the records and legal files identified in Resolution No. 2016-32 shall be done under the direction and supervision of the Kootenai County Prosecuting Attorney.

Upon a motion to adopt the text of the foregoing Resolution made by Commissioner ______, and seconded by Commissioner ______, the following vote was recorded:

Upon said roll call, the text of the foregoing was duly enacted as a Resolution of the Board of County Commissioners of Kootenai County, Idaho, on the 15th day of March, 2016.
