Jethwa was campaigning against alleged illegal mining in the Gir Sanctuary areas in Saurashtra region, which is allegedly backed by some politicians. He was shot at by unidentified assailants. Joint Commissioner of police, Satish Sharma "Amit Jethwa was killed in firing by two assailants who came on a motorcycle. The murder happened in the evening between 8:30 and 8:45 in the Sola police station area. Further investigation is on," said Joint Commissioner of Police, Satish Sharma. Jethwa had filed a Public Interest Litigation (PIL) in the Gujarat High Court last month. The petition alleged that mining activities were being carried out in Una and Kodinar in Saurashtra allegedly by Junagadh BJP MP Dinubhai Boghabhai Solanki and his relatives. Jethwa had further alleged that the Solankis were also running illegal mines and stone crushers in a village on the border oFRf OGMir TfoHrEe WstEsB. The president, elected by an electoral college, is the chief of state, and the prime minister is the head of the government. India's constitution--the source of authority--provides the legal framework for the guarantee of human rights through its Fundamental Rights and Directive Principles. Under the constitution, the 28 states have a high degree of autonomy and have primary responsibility for issues of law and order. President Pratibha Patil was elected in 2007 to a five-year term with 65.8 percent of the vote, and Manmohan Singh became prime minister for a second term following the Congress Party-led coalition's victory in the 2009 general elections, which were considered free and fair, despite scattered instances of violence. Separatist insurgents and terrorists committed numerous serious abuses. Security forces reported to civilian authorities; unlike in previous years, there were no reported instances of security forces acting independently of government authority. Major human rights problems included reported extrajudicial killings of persons in custody, killings of protesters, and torture and Separatist insurgents and terrorists in Jammu and Kashmir, the Northeastern States, and the Naxalite belt committed numerous serious abuses, including killing armed forces personnel, police, government officials, and civilians.

This special leave petition impugns the judgment and order dated 25th September, 2012 passed by the Gujarat High Court at Ahmedabad in Special Criminal Application No.1925 of 2010. By the aforesaid judgment, the High Court has directed that the investigation into the death of Amit Jethwa 1 Page 1 (hereinafter referred to as ‘Jethwa’), a Right to Information activist be investigated by the CBI authorities and further directing that the proceedings pursuant to the charge sheet submitted by the Gujarat Police shall remain stayed. 2. The facts leading to the filing of the special leave petition out of which the present criminal appeal arises are as under: Jethwa had filed a Public Interest Litigation, SCA No.7690 of 2010, against the State of Gujarat and others with the following prayer: “The appellant therefore prays that your Lordship may be pleased to: a. Admit this petition. b. Those working to promote and protect the rights of marginalised groups also faced serious reprisals, including when protesting against development projects that threaten or destroy the land, natural resources and livelihood of their communities. Defenders of women's rights and of environmental rights were also targeted, and several activists who denounced corruption were assassinated. Political context In 2010-2011, the Government of India was forced to battle the consequences of an increased Naxalite (Maoist) insurgency in seven States, which was singled out by Prime Minister Manmohan Singh on April 21, 2010 as the biggest internal security threat, asserting that "no quarter can be given to those challenging the authority of the Indian State". Despite lengthy peace talks with Pakistan, the situation in Jammu and Kashmir also remained volatile. In the context of both conflicts, security forces frequently resorted to excessive use of force and were responsible for extrajudicial killings, torture, enforced disappearances and other forms of violence, often without being held accountable.

INDIA 2017 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY India is a multiparty, federal, parliamentary democracy with a bicameral legislature. The president, elected by an electoral college composed of the state assemblies and parliament, is the head of state, and the prime minister is the head of the government. Under the constitution the 29 states and seven union territories have a high degree of autonomy and have primary responsibility for law and order. Voters elected President Ram Nath Kovind in July to a five-year term, and Narendra Modi became prime minister following the victory of the National Democratic Alliance coalition led by the Bharatiya Janata Party in the 2014 general elections. Observers considered these elections, which included more than 551 million participants, free and fair despite isolated instances of violence. Civilian authorities maintained effective control over the security forces. The most significant human rights issues included police and security force abuses, such as extrajudicial killings, disappearances, torture, arbitrary arrest and detention, rape, harsh and life-threatening prison conditions, and lengthy pretrial detention. Widespread corruption; reports of political prisoners in certain states; and instances of censorship and harassment of media outlets, including some critical of the government continued. There were government restrictions on foreign funding of some nongovernmental organizations (NGOs), including on those with views the government stated were not in the “national interest,” thereby curtailing the work of these NGOs. Legal restrictions on religious conversion in eight states; lack of criminal investigations or accountability for cases related to rape, domestic violence, dowry-related deaths, honor killings, sexual harassment; and discrimination against women and girls remained serious problems.

Chief Justice of India , Supreme Court of India is the last savior for public who are suffering injustices at the hands of powers that be , whose fundamental rights & human rights are violated. But inspite of repeated appeal for justice CJI & SUPREME COURT OF INDIA turned their blind eye , became deaf , mute spectator. CJI , SCI let down the suffering masses. CJI & SCI are hand in league with criminals and are operating cunningly without leaving a trace of evidence.
