CLOSURE ORDER WITH DISCONNECTION OF ELECTRICITY

WHEREAS, M/s. Viswarupa Steel Pvt. Ltd. (hereinafter referred to as the industry) located at Road, Mouza – Ankurhati, Gazipara, P.O.- , P.S.- Domjur, – 711 409 is engaged in production of MS ingot.

AND WHEREAS, the industry was inspected by the officials of the WEST BENGAL POLLUTION CONTROL BOARD (hereinafter referred to as the Board) on 10/02/2012. During inspection it was observed that the industry had installed one (1) no. additional induction furnace of capacity 7 MT/heat without obtaining Environmental Clearance from the SEIAA and NOC/Consent to Operate from the Board and it was operating without air pollution control device resulting in considerable fugitive emission. However, air pollution control (APC) device attached to the old induction furnace was found in operation and stack attached with the said furnace was apparently clear.

AND WHEREAS, the Consent to Operate for 1 no. 7 MT/heat induction furnace expired on 31/12/2011. The industry has submitted application for renewal of Consent to Operate for 1 no. induction furnace having two crucibles on 18/01/2012.

AND WHEREAS, the industry was called for a hearing on 15/03/2012 for the violation of Environmental Statute as mentioned above.

AND WHEREAS, the Director of the industry appearing in the hearing agreed with the above mentioned observation of the Board. He submitted that they would operate 2nd furnace of capacity 7MT/heat after obtaining necessary permission from the appropriate authority.

NOW THEREFORE, considering the non-compliance as mentioned above, M/s. Viswarupa Steel Pvt. Ltd. located at Domjur Road, Mouza – Ankurhati, Gazipara, P.O.- Salap, P.S.- Domjur, Howrah – 711 409 is hereby closed by the Board with immediate effect.

The electricity connection of the industry is ordered to be disconnected forthwith.

The Director (HR), WBSEDCL is requested to take necessary steps to disconnect the electricity connection of the industry immediately.

The Officer-In-Charge, Domjur Police Station, Dist.Howrah is directed to execute the closure against the aforementioned industry and submit compliance report to the State Board within seven(7) days from the receipt of this Memo.

This direction is being issued to the Officer-in-Charge, Domjur Police Station and the Director(HR),WBSEDCL in conformity with the order of the Hon'ble High Court, Calcutta dated 21/08/1998 and 28/04/1999 respectively.

The Environmental Engineer, Howrah Regional Office of the Board is requested to take necessary steps for proper execution of the closure and also visit the industry involving the local police station and the concerned Nodal Police Officer.

This order has been issued in exercise of the powers conferred under the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 and Rules made thereunder and has the approval of the Competent Authority.
