THE DELAWARE STATE FAIR, INC. AMENDED AND RESTATED CONTINGENCY PLAN FOR RESTRICTED FAIR OPENING July 23 – August 1, 2020 Harrington, DE

BACKGROUND

The Delaware State Fair (the “Fair”) is the annual gathering of local residents and farm families organized 101 years ago to promote agriculture by showcasing a variety of: (1) livestock species and other animals; and (2) displays involving the arts as well as agricultural products both manufactured and from the farm- home.

The Fair features a significant educational component led by groups such as 4-H and FFA who encourage young people to participate in agriculture, and offer both educational demonstrations and competitions. The primary purpose of training youth and to promote the welfare of farmers and a rural living lifestyle are active components of the Fair and have evolved to now include additional components such as commercial exhibits, direct commercial sales, food and beverage sales, a carnival, circus, strolling entertainment and concerts.

Simply called or referred to as the “Fair” by most, it is truly unique, steeped deep in family tradition and represents a true celebration of community in the most inclusive of terms and engagement. It is managed by a 78-person volunteer Board of Directors who comes from all three Delaware counties.

The annual fair takes place on a 257-acre tract of land located on US Route 13 south of the city of Harrington.

On Monday April 27, 2020, the Fair made the public announcement of the cancellation of all concerts and shows in the M&T Bank Grandstand during this year’s Fair. As the event sponsor, this proactive move was taken after assessing and concluding that the Fair could not practically create and enforce “moderate” physical distancing protocols contemplated in Phase 2 of Governor Carney’s 3-phase Plan for Economic Reopening and Recovery. (See Exhibit “A”)

With similar planning guidance and criteria in mind, the Fair has:

1. Cancelled the nightly parade whose route passes through the easterly side of the fairgrounds and by its nature creates large pockets of standing crowds which must be avoided; and 2. Is currently in discussions with the Fair’s circus provider (Circus Hollywood of Sarasota, FL) aimed at re-vamping the entire circus entertainment zone to eliminate the traditional large tent (“the big top”) with side walls that contact the ground around the tent’s entire perimeter to either: a. A completely open air performance environment with no tent material present; or b. Use a tent whose bottom 15’ (approx.) of sidewall will be removed during the Fair allowing more natural air ventilation contacting the backs of the entire audience seating area. The 3

circus provider has indicated that either option is possible. For public health reasons, the Fair prefers the completely open-air performance model.

It is respectfully submitted and suggested by the officers, directors and staff of The Delaware State Fair, Inc. that this year’s Fair (July 23 – August 1, 2020) can reasonably and safely be permitted to operate conditioned upon and with the expectation that those responsible for planning the Fair will conduct it in a way that takes into account the need to practice enhanced physical distancing throughout the fairgrounds’ programming areas and to impose precautionary measures throughout the entirety of the operations.

Currently according to the International Association of Fairs and Expos (IAFE), Outdoor Amusement Business Association (OABA), International Association of Amusement Parks and Attractions (IAAPA) and National Independent Concessionaires Association (NICA) in addition to local press coverage in the states of , Florida, Georgia, South Carolina, Texas, Oklahoma and :

1. Many late summer and fall fairs (specialty themed and more traditional county and state fairs) similar to our Fair size in terms of attendance have not been cancelled and continue to plan for this year’s event. On June 9, 2020, The New Jersey State Fair at Meadowlands announced a re- scheduling to late July and their plans include a carnival. The Maryland State Fair along with 8 other Maryland based county or regional fairs are still scheduled for late summer or early fall 2020; and 2. Amusement parks and attractions and carnivals of varying size and capacities including some of the largest attractions in the world (Universal Studios, Disney, Six Flags, Cedar Fair, Lego Land, and Sea World), have either recently re-opened with operational restrictions and are currently in operation or are planning an imminent re-opening which include Maryland (Ocean City), West Virginia, Florida (Disney), Georgia (circus and carnivals) , South Carolina (Myrtle Beach, SC theme parks and water parks), Texas (fairs and carnivals) and Oklahoma.

On Wednesday June 10, 2020 Maryland Governor Larry Hogan announced that effective Friday June 12, 2020; Maryland’s outdoor amusements are reopening including miniature golf, go-carts and amusement rides and supporting businesses such as food stands and games. Simply put, that announcement advises that Ocean City’s Trimpers Amusements located at First Street at the Boardwalk near the Ocean City Inlet Parking Lot (700 S. Atlantic Avenue, Ocean City, MD) and Jolly Roger Amusement Park (2901 Coastal Highway, Ocean City, MD) have been authorized to reopen on Friday June 12, 2020.

The most relevant “fair industry specific” and geographically nearby guidance that The Delaware State Fair could find was an announcement on June 5, 2020 (amended on June 10, 2020) by West Virginia Governor Jim Justice entitled: West Virginia Strong – The Comeback: Guidance for Fairs, Festivals, Amusement Parks and Rides. A copy of this fair and carnival re-opening guidance is attached hereto, marked as Exhibit “B” and incorporated herein by reference. West Virginia plans to allow fairs (w/carnivals) to resume operations effective July 1, 2020.

On Tuesday June 9, 2020 Kentucky Governor Andy Beshear approved the opening plans for the annual Kentucky State Fair (August, 2020) which includes the same major elements as The Delaware State Fair

(grounds entertainment, livestock exhibition and shows, carnival rides, food and beverage vendors, games of chance and retail).

As Delaware quickly and responsibly approaches the June 15th implementation date for Phase 2 of “Delaware’s Reopening”, the Fair acknowledges full and due consideration of operational and public health guidance provided by Governor Carney (as set forth at www.governor.delaware.gov) and has incorporated that guidance into this amended and restated opening plan.

The Fair acknowledges that it is important to note that Phase 2 guidance will most certainly change as state guidelines, best practices, and guidance from public health professionals evolves towards Phase 3. The Fair shall periodically update this document with additional updated information as such updates become necessary.

Unlike other venues for mass gatherings such as concerts, movie theatres and sports arenas or stadiums, the Fair is differentiable along the following lines:

1. The Fair can manage and reduce capacity at over 28 different physical locations or points on the grounds in order to allow for appropriate social distancing. 2. All of the Fair’s grounds entertainment for 2020 is outdoors. 3. Livestock related programming occurs under roof with no walls or other vertical impediments to free and open air exchange with the outside environment. 4. 95% of fairgrounds dining will occur outside. The remaining 5% will occur under roof but with little to no sidewalls or partitions (i.e. Delaware Farm Bureau food stand and The Grange dining area). 5. Exposure time between non-same-household sheltering family members is somewhat limited and in completely controllable by the Fair’s guests themselves. 6. The Fair’s guests freely move throughout the outdoor portion of the fairgrounds, and its buildings, barns and tents. The Fair’s guests are not sitting in a single location, elbow-to-elbow, for an extended period of time. 7. The Fair’s buildings include several fully enclosed exhibit halls with HVAC systems, roofed structures with no sidewalls and structured tents with sidewalls, doors and HVAC services. 8. Based on prior surveys, nearly 90% of the Fair’s attendance is made up of family members who live in the same home and thus do not need to be physically distanced from each other.

INTRODUCTION

The principles and considerations outlined in this document were compiled from fair, outdoor attractions, amusement, agriculture, livestock exposition, food service, and commercial vendor industry trade associations including International Association of Fairs and Expositions (IAFE), Outdoor Amusement Business Association (OABA), National Independent Concessionaires Association (NICA) and International Association of Amusement Parks and Attractions (IAAPA) among other Delaware and federal sources.

The principles included in this plan are designed to provide the State of Delaware Office of the Governor and the Department of Public Health with assurance that the Fair, if given the opportunity to open and operate during the period July 23, 2020 – August 1, 2020, such operations can and will be conducted in compliance with then-existing phased guidance and public health protocols in place in late July.

In order to prepare such a plan, many key and critical assumptions have been made as to where the Fair reasonably believes the state will be by July 23 relative to public health protocols and the phased restarting of the Delaware economy.

The Fair has considered all three forms of official guidance published by the State of Delaware applicable to Phase 2 Recovery including:

1. General Guidance: Applicable to anyone outdoors while at the fairgrounds or in the roofed structures (without side walls); and 2. Industry Guidance: Applicable to indoor exposition and retail operations as well as outdoor and indoor food and beverage sales and consumption areas; and 3. Individual Business Guidance: The Fair has developed and appreciates individual case-by-case guidance offered by Department of Public Health and Fire Marshal officials who recognize the many facets or types of businesses conducted during the annual fair.

PROPOSAL

Following is a catalog of operational enhancements and contingency planning concepts currently under consideration by the Fair’s officers and staff aimed at satisfying what the Fair assumes to be the appropriately timed phased public health guidelines in effect in late July considered to be either mid or late Phase 3 reopening.

1. MAP IDENTIFYING MAJOR OPERATION AND PROGRAMMING AREAS (See Exhibit “C”)

A. Parking and shuttles; and B. Admission gates; and C. First Aid, public hygiene and sanitation areas; and D. Grounds entertainment and attractions; and E. Competitive exhibit areas, sponsor, commercial vending, government officials and agency exhibit space; and F. Livestock barns and livestock shows; and G. Outdoor and indoor food and beverage sales and dining areas; and H. Outdoor commercial exhibition of equipment and general wares; and I. Carnival; and J. Camping.

2. PROTOCOLS APPLICABLE TO ALL OPERATIONS AND PROGRAMMING AREAS

A. GENERAL HEALTH AND SAFETY

i. Face coverings will be worn in accordance with the State of Emergency Order (as amended) in effect during the period July 23, 2020 – August 1, 2020. ii. All individuals while outside anywhere on the fairgrounds WHEN IN PUBLIC shall be encouraged to maximize physical distance from others. iii. Unless otherwise amended by gubernatorial proclamation or other formal state issued guidance, building occupancy shall be established at 60% of Fire Marshal occupancy limits. Current capacity goals are based on a floor space square footage to occupant ratio of approximately 15 sq. ft. /person which compares quite favorably and safely to the NFPA Code standard of 7 sq. ft. /person. iv. Capacity limitations consistent with the guidance cited above applicable to the structures planned to be used and occupied during the 2020 Delaware State Fair are summarized as follows:

v. Guests occupying Fair provided outdoor public seating (entertainment zones, livestock judging and dining) shall be encouraged to maintain at least 6’ of social distancing between unrelated parties. Initial installations of benches, bleachers and dining/picnic tables shall take into account the 6’ of distancing separation (8’ for free standing dining tables without attached seating i.e. single unit picnic tables). “Distancing Ambassadors” shall be utilized to frequently convey this distancing guidance verbally to those occupying fair provided public seating (entertainment, livestock judging and dining). Live entertainers shall frequently make announcements before and during their performances reinforcing and encouraging guests’ compliance with social distancing 8

protocols. vi. Frequent handwashing is essential and is the responsibility of all employees and guests. The Fair will widely communicate reminders of the importance of frequently washing hands with soap and water for 20 seconds. vii. The Fair shall increase the number of free-standing handwashing stations and hand sanitizer and/or disinfecting wipe dispensers on the fairgrounds including eating areas, shuttle stops, gates, etc. Hand sanitizer used shall be alcohol-based (min. 60%) and have anti-microbial agent(s) that kills or renders inactive 99.9% of all known bacteria, viruses, and fungi that are present on surfaces. viii. The wearing of cloth face coverings (masks) or face shields by guests, exhibitors, vendors, carnival personnel, staff, entertainers and volunteers shall follow the combination of current general as well as general business and industry specific guidelines which can be summarized as follows broken down by where the on- fairgrounds activities take place:

ix. Disposable gloves shall be worn by all individuals preparing or otherwise coming in direct contact with food or beverage sold on the grounds. x. The Fair and carnival operator shall use no-touch thermometers to check temperatures of their employees as recommended by Delaware public health officials. xi. Where privacy and modesty can be preserved, the Fair shall leave open restroom doors in order for users to avoid touching high contact objects such as restroom doors and handles. xii. The Fair will manage overall outdoor entertainment and livestock judging seating capacity by first applying the appropriate Phase 2 goal of 60% rated capacity of bleacher seating and then applying social distancing protocols applicable to non-family guest units. xiii. The Fair has reevaluated all grounds entertainment show times and has added to the number of strolling acts who are better equipped to perform to smaller groups throughout the grounds and to communicate to attendees their need to adhere to and follow social distancing protocols. All stage centered and strolling performers will be conducting twice as many shows each day of shorter duration. The performance day shall start earlier in the morning (to draw patrons to less popular grounds visitation times) and shall end earlier in the evenings. A copy of the master grounds entertainment schedule (including carnival, buildings and livestock show times guidance is attached hereto, marked as Exhibit “D” and incorporated herein by reference.

xiv. The Hon. John C. Carney, Governor of the State of Delaware shall be the sole determiner of what, if any, Governor’s Day activities will take place on Thursday July 30, 2020 including on-grounds appearances, the presentation of his cabinet members in the Hertrich Plaza, the occurrence of the annual Governor’s Day Dinner and the possibility of spectator free live harness racing. If further consideration of the dinner is requested by Governor Carney, the Fair will explore the possibility of holding the dinner in the Harrington Raceway and Casino’s ballroom which would allow enhanced distancing compared to the traditional location in the M&T Bank Grandstand’s clubhouse. xv. In cases involving transactions with the public, the Fair will encourage the following practices: 1) The Fair will promote and encourage the advance online purchase of gate admission passes and online reservations for grounds attractions which have capacity-controlled bleacher seating areas (i.e. circus, racing pigs, camel show and dog show). 2) The Fair will promote the use of touchless payment systems, arrange credit card readers so guests can insert/swipe their own cards and arrange for guests to scan their own gate admission pass(es). 3) The Fair will install and use acrylic (plexi-glass shields) or other type of barriers/hygiene screens placed between gate admission ticket sellers and guests who are in frequent, close interaction areas in order to reduce possible infection or contamination. Those barriers and hygiene screens will be cleaned regularly. xvi. In an effort to bolster reassurance among the guests, the Fair’s “Clean Team” whose members are responsible for cleaning and sanitizing duties, will be highly visible throughout the fairgrounds. xvii. First Aid protocols administered by the Fair and Harrington EMS personnel shall address how to manage guests, volunteers or employees who present with COVID-19 symptoms. 1) Personnel should be equipped with appropriate personal protective equipment (PPE). 2) Fair First Aid staff and Harrington EMS shall identify an isolation/quarantine area for the individual and his/her immediate party while initial assessment is completed. 3) The Fair shall be prepared to thoroughly clean and sanitize locations visited by a guest, volunteer or employee with COVID-19 symptoms. The Delaware Division of Public Health or CDC public health guidelines will be followed. xviii. The Fair shall engage in the periodic cleaning and disinfecting of commonly used and touched surfaces (i.e. ATMs, vending machines, tables, counters, hand rails, baby changing stations, towel and soap dispensers, benches, door handles and panic-bars, toilets, faucets, sinks, etc.). 11

xix. The Fair’s “Clean Team” shall initiate and maintain periodic cleaning and disinfecting of public seating areas in the Hertrich Plaza, food courts, livestock judging patron seating bleachers, and bleacher seating in entertainment zones such as the circus (circus staff), camel show, racing pigs, dog show and carnival lot (carnival staff), etc. xx. When determining cleaning/sanitizing frequency, the Fair will take the following factors into account: 1) Traffic/number of touches; and 2) The environment (indoor/outdoor, warm/cold, wet/dry) and location; and 3) The surface being cleaned; and 4) The cleaning agent’s chemical properties (including virus kill times and drying times). xxi. The Fair will undertake a reexamination of its prior practice of employing and or accepting volunteer duties from persons considered “at-risk” by public health officials. xxii. Anywhere there is the potential for people to stand in a line, queuing instructions (i.e. signage) and devices shall be used to promote either straight lines or “L” shaped lines in order to avoid serpentine configurations which make it difficult for patrons to maintain safe distances from one another. xxiii. Tractor or truck pulled commercial shuttle trailers as well as the Fair’s new ADA shuttle will be used to transport guests from remote parking areas to the gates and for on- grounds transportation along established routes. The Fair’s historic use of golf cart style shuttles (6 passenger) typically used to transport exhibitors, some guests and volunteers from the Exhibitor Parking Lot onto the main fairgrounds will be discontinued this year due to the inability to provide appropriate distance between the driver and unrelated parties and among unrelated guests themselves. Shuttle drivers and safety riders shall remind riders of the need to maintain the appropriate amount of physical separation and shall manage the available onboard space to accommodate these public health protocols. Tape marking on seats may be considered by the Fair in order to more effectively communicate visual distancing cues. xxiv. The Fair and carnival will provide proper signage and literature to ensure that all volunteers, employees, and departmental superintendents know the symptoms of COVID-19 and follow current protocols if symptoms develop. xxv. All vending and ATM machines will be cleaned and disinfected frequently. The Fair will position sanitizing stations near all vending and ATM machines and monitor their status.

B. BUILDING PUBLIC CONFIDENCE IN THE FAIR AND GUEST COMMUNICATIONS

i. Communication protocols will be developed by the Fair to communicate the need to address: 1) COVID-19 specific emergency medical service calls; and 2) Physical distancing violations; and 3) Any need for an immediate cleaning or sanitation service. ii. The Fair’s Marketing Department shall develop important lines of communication conveyed though the Fair’s website, social media channels and on-grounds signage warning exhibitors, employees, volunteers and guests about the risk of contracting COVID- 19 in any public space. Messaging shall take the following form: “The Delaware State Fair is committed to keeping you healthy and safe, but we cannot guarantee you won’t be exposed to COVID-19. We rely on you to protect yourself. Please: A. Wash your hands often and avoid touching your face. B. Maintain your distance from others. C. Cover your mouth and nose when coughing or sneezing. D. Avoid unnecessarily touching any surfaces, objects or things while on the fairgrounds. E. If you’re sick, please don’t attend the Fair and encourage your family not to attend until you are well.” 1) Other messaging shall highlight the Fair’s guests’ responsibility to remember that, currently, the Delaware Division of Public Health and the CDC are recommending people 65 years and older, those who live in nursing homes or long-term care facilities, and people with underlying medical conditions (particularly if not well controlled) should either remain home or if visiting the Fair, keep their distance from others. Underlying medical conditions include: chronic lung disease or moderate to severe asthma, serious heart conditions, immunocompromised, severe obesity (body mass index (BMI) of 40 or higher), diabetes, chronic kidney disease undergoing dialysis, and liver disease. 2) The Fair will communicate new COVID-19 related operational procedures to guests prior to their arrival via the Fair’s website and various social media platforms aimed at establishing reasonable expectations and instilling confidence by the public including: a) Identifying COVID-19 symptoms and messaging that asks guest to come back another day if anyone in their party is experiencing the symptoms; and b) If required by the Delaware Division of Public Health, directives on wearing masks/ face coverings for employees and guests; and c) Physical distancing guidelines; and d) Capacity limits for grounds attractions and how to avail themselves of the free admission reservation process through the online ticketing platform; and 14

e) General efforts undertaken by the Fair to facilitate social distancing; and f) The Fair’s enhanced cleaning and sanitizing protocols.

3) The Fair shall use and incorporate universal icons aimed at effectively and efficiently communicating many of the public health protocols identified hereunder as follows:

a) General Protocols I. Promote Robust Health Policy for our Guests - Prior to visiting the Fair, all guests will be asked to review our health policy on our website, which requires that all attendees to have been healthy for at least 14 days prior to their visit. II. The Fair shall post signs identify where face masks must be worn b) Screening Protocols I. Check the Temperature of Employees - Fair employees will be screened for high temperatures when they arrive to check in for their scheduled daily shift. c) Social Distancing Protocols I. Promote 6 ft. Separation in all Queues - We’ll have clear markers for all of our Fairground’s entry, ride, restroom and dining queues to help guests keep a safe distance from one another. “Distancing Ambassadors” will monitor the queues to ensure that the social distancing is being promoted. II. Separate Guests on Rides & Attractions - Minimize contact between parties and follow social distancing guidelines for each of our amusement rides and attractions. III. Promote Guest Separation in Seating Areas - Our dining seating areas will be reconfigured to encourage sufficient distance between seated parties. In areas where strangers are seated together, seats will be removed or blocked off to promote a clear 6-foot gap between guests. IV. Reduce Indoor Facility Venue Capacity - While the majority of the Delaware State Fair experience takes place outdoors, we do have indoor shopping and exhibit areas. Capacity at each of these buildings will be reduced to ensure that there is plenty of room for social distancing as previously stated. V. Separate Employees and Guests with Protective Equipment - We are introducing individual protection equipment at many of our ticket vending booths to definitively separate guests from ticket sellers.

VI. Separate Guests in Entertainment Viewing Areas - Guests viewing entertainment, in the form of live outdoor shows and street performances will be separated from the performances and each other by at least six feet. d) Sanitation and Disinfection Protocols I. Enhanced Cleaning Teams to Disinfect Common Areas - We are significantly increasing our efforts to sanitize and disinfect all high touch points, such as chairs, benches, tables, etc. II. Provide Hand Sanitizer Stations throughout the Fair - We will have a large number of hand sanitizer stations throughout the Fairgrounds offering free hand sanitizer to guests and employees. III. Provide Hand Washing Stations for Guests throughout the Fair - We will provide guests with easy access to hand washing stations in the Fair’s high traffic areas. IV. Monitor and Sanitize Restroom Areas - We will staff each restroom area with personnel who will disinfect all high touch point areas within the restrooms on a regular basis. V. Sanitize & Disinfect Ride Units - Cleaning teams will spray or wipe down seats and restraints to give the riders a safe and sanitary experience. VI. Clean & Sanitize Employee Work Areas - Employee work areas in both the back and front of house will be sanitized multiple times each day according to CDC guidelines. VII. Priority Cleaning Regimen for All Dining Areas - Trained, dedicated clean team members will continuously monitor and disinfect dining areas. VIII. Eliminate Open-Access Condiment, Topping Stations - Ketchup, mustard and other condiments will now be securely stored and served to guests upon request. IX. Eliminate Self-Service Cutlery & Napkin Stations - Napkins, knives, and forks will now be securely stored and provided to guests with their meal, as required or upon request. e) Signage, Communications and Training Protocols I. Guest Communication Program - Guest emails will regularly feature information about how to best plan for a visit to the Fairgrounds. Topics will include new reservation systems, social distancing recommendations, disinfectant procedures, and more.

II. Display Social Distancing & Hygiene Signage - Signage reminding guests to practice social distancing and good hand hygiene will be displayed conspicuously throughout the Fairgrounds. III. Mandatory COVID-19 Training for All Fair Employees - We’ll require all of our employees to attend orientation sessions instructing them how to stay safe and keep our guests safe. f) 2020 Health and Safety Policy. A copy of the Fair’s 2020 Health and Safety Policy is attached hereto and marked as Exhibit “E” and referred to herein by reference. This policy shall be displayed on the Fair’s website and near each guest admission gate.

C. COVID SIGNAGE PLAN

i. In accordance with recommendations of the CDC, the Delaware Division of Public Health and the Delaware Division of Small Business, the Delaware State Fair has developed and plans to implement a new on grounds and digital signage plan. A copy of the entire plan that reflects the signage content and planned placement locations on the grounds is attached hereto, marked as Exhibit “F” and incorporated herein by reference.

D. ADMISSION AND ENTRY

i. Historically, the Fair’s most popular daily entry times to the grounds were in the evening between 4:00PM and 9:00PM which closely corresponded with the arrival of the M&T Bank Grandstand concert/show attendees. For 2020, the grandstand concerts and shows have been cancelled, thus contributing to the flattening of the Fair’s typical daily admission curve during those particular hours. ii. Further flattening of the ground’s admissions curve shall occur through the Fair’s implementation of the concept of timed-entry gate admission coupled with significant financial incentives. 1) Depending upon the guest’s arrival time , the following financial incentives will be offered each and every day: a. 8AM - 11AM: FREE ADMISSION ($9.00/adult savings and $4.00/youth savings); and b. 11AM - 4PM: HALF-OFF ADULT AND YOUTH ($4.50/adult savings and $2.00/youth savings); and c. 4PM – Close: REGULAR ADMISSION ($0 savings)

2) We predict that this hybrid public health policy and financial value driven model will have a very positive impact on spreading out on-grounds visitation times thus allowing for greater distancing between guests. 3) This highly modified admission model based on arrival time will be in effect for the duration of the 2020 Fair and will consistently be made available each and every day and offered to all guests regardless of whether their passes were purchased online in advance or on the grounds at the time of their visit. 4) The Fair has reevaluated its typical menu of discount admission days including “Pepsi” Day, Kids’ Day, Armed Forces Day and the two (2) day and night long “Senior Days” (previously geared towards the exact segment of our population deemed “high risk” by our public health authorities) and plans to eliminate the historically recognized discount days in favor of adopting and conducting the same 3-tiered pricing model identified above each and every day. 5) Enhanced marketing efforts will be undertaken by the Fair to publicize the discounted gate admission prices available to those who chose to arrive earlier in the day. iii. All forms of gate admission passes including those sold online or awarded as part of the Fair credentialing process (i.e. shareholders, directors, exhibitors, staff, etc.) will be offered in a mobile format capable of being downloaded to and displayed on a mobile phone. This will help lessen on-grounds ticket buying and accompanying queues and promote less contact with ticket sellers (who operate in individual booths with appropriate plexi-glass shields) and gate admission scanners (no exchange of a paper ticket necessary) who will scan the barcode displayed on the guests’ smart phone without having to touch the admission pass and without guests having to touch the scanning device. iv. Operating hours shall be maintained from 8:00AM until approximately 11:00PM each day allowing the public as much flexibility as possible to decide the appropriate and safest time for them to visit the fairgrounds. v. The Fair shall develop dialog with significant stakeholders (i.e. carnival and vendors) to increase the availability of contactless transactions including the payment for goods or services, handling of coupons and tickets, the application of wristbands and elimination of the use of hand stamps, etc.

E. OUTDOOR ENTERTAINMENT AREAS

i. Outdoor entertainment zones include the Hertrich Plaza, the outdoor circus, racing pig show, camel show, dog show, The Roost and the Menagerie of Exotic Animals. ii. Except for the Menagerie, bleacher and/or bench style seating will be provided for guest comfort. 18 iii. Initial placement of the seating units (bleachers or benches) shall be appropriately distanced. Family members and persons living in the same household will be encouraged to sit together. All other individuals will be encouraged to maintain at least 6’ of physical distance from unrelated persons. Entertainers will be asked to make frequent announcements regarding distancing. iv. Seating plans for the entertainment zones follow (typical and COVID layouts):

3. AGRICULTURE – LIVESTOCK SHOWS

A. The Fair has completely rescheduled the livestock presence on the grounds in order to promote enhanced distancing among exhibitors, their animals and general patrons. In the past, the occupancy of 2 large barns (Kent Barn: sheep/swine and Schabinger Barn: beef cattle/dairy cattle) has been shared between two species. In 2020, only one species will be housed in each barn at a time, each for a 5-day stretch. B. Move-in times of individual species will be staggered to allow for enhanced distancing among exhibitors and their family members. C. Service aisles will be closed to the public. Main north/south walkways will be widened and consideration will be given to use of one-way guest flow patterns. D. Bleacher seating shall be offered in the following barns for guests to observe livestock judging events (1) New Castle Barn, Kent Barn and Quillen Arena. The Quillen Arena is so large and the size of the guest body attending the shows is relatively small compared to the cavernous seating capacity of the Quillen Arena. E. Animal pen and livestock show seating areas and layouts (typical and COVID versions) reflective of reduced seating capacities and enhanced distance between animal stalls for the New Castle Barn (goats), Simpson Barn (goats), Kent Barn (sheep or swine) and Schabinger Barn (beef or dairy cattle) follow (typical and COVID layouts):

F. Livestock barns hosting judging competitions/shows will be closed to the public while the shows are in progress. This will allow for controlled access to show seating areas. Capacity controls and distancing goals can be more easily met with these restrictions in place. The Fair will establish occupancy limits for each bleacher livestock show seating or viewing area based on Phase 2’s 60% capacity level. Reduced capacity limits will trigger the distribution of a specific number of color-coded wristbands that must be displayed in order for the bearer to watch the show from the bleachers. Wristbands shall be self-applied by the livestock show attendee. Specific patterns for bleacher sitting area ingress and egress shall be identified. G. Due to the challenges of meeting social distancing protocols in the livestock show environment, the Fair will exercise great efforts to discourage stand-up attendance around the various show rings while the shows are in progress. H. For those family members or guests who cannot be accommodated with in-person livestock show viewing of judging being conducted in the Simpson and Kent Barns, the Fair plans to live-stream those specific judging events via the Fair’s Facebook page/site. Due to the overall size of the Quillen Arena and the typical number of show attendees, social distancing in the arena’s bleacher seating areas shall not trigger any concerns related to capacity limitations under Phase 2 guidance.

I. Because of the large crowd drawing popularity of the annual Junior Livestock Auction and Livestock Extravaganza, the Fair has taken the following steps to enhance compliance with social distancing protocols: i. The annual Junior Livestock Auction will be conducted in a virtual format using a commercial online platform. No live audience will be assembled on the fairgrounds during the conduct of the 9-hour auction; and ii. The Fair has cancelled the 2020 Livestock Extravaganza and the Pretty Animal Contest, both of which have historically drawn large crowds of participants and viewers that cannot be safely accommodated. J. Since livestock judges actively engage with both exhibitors and animals in the show ring, the Fair has prescribed new guidance for judge participation and interaction to include the following: i. Specifying minimum distance of 6’ between judge and handler/exhibitor except when examining the animal by touch or feel is required; and ii. Administering a no-contact temperature check of all judges at the start of each day of judging. Temperature should be below 100.4 F (38 C) according to the U.S. Centers for Disease Control. and iii. Allow only immediate family members to appear in any livestock show staged photos. Judges should not be requested to nor appear in any of these photos.

4. COMMERCIAL EXHIBIT, COMPETITIVE EXHIBIT AND SPONSOR EXHIBIT BUILDINGS AND MARKETPLACE TENT

A. All fully enclosed buildings and structured tent occupied in furtherance of exhibition and commercial activities will be reconfigured by the Fair and rated for reduced occupancy limits and the limits shall be managed by Fair security personnel stationed at the front entrance of each building or tent. Each entrance and exit will be clearly marked and be physically separated, maintained and observed by security personnel in order to enforce capacity limits. B. Layouts of all indoor space (included structured tent) have been redrawn to comply with building capacity and social distancing protocols. Except for the Centre Arena/FFA and 4-H Building (omitted due to overall size of the building in relation to the average guest load), layouts applicable to the Delaware Building (elected officials and state agencies), Dover Building (competitive exhibits), Exhibit Hall (sponsors) and Marketplace Tent (inside retail sales and promotions) are shown below (typical and COVID layouts):

C. Check-in of commercial vendors, sponsors and competitive exhibitors will be extended to allow for a more orderly and safer (increased opportunity to enhance distancing) load-in period. Load-in by appointment may be necessary to insure proper distancing. D. Move-out of commercial vendors, sponsors and competitive exhibitors will be coordinated to allow for a more orderly and safer (increased opportunity to enhance distancing) load-out period. E. Individual exhibitor display areas will be reconfigured to promote appropriate distancing. Reconfiguration takes into account wider aisles for the passage of patrons who seek to maintain the appropriate distancing between strangers. F. One-way traffic patterns down aisles will be established and clearly marked. G. Demonstration areas shall be reconfigured to maintain appropriate distancing between patrons and booth staff. H. There shall be no sampling or consumption of food or drink from live cooking demonstrations, food judging competitions or food related contests. I. The Fair will reconfigure judging in the culinary department to allow distancing and to permit the removal of a face mask by a judge in order to sample entries.

5. CAMPING AND HOUSING

A. The Fair will reconfigure all on-grounds camping areas with enhanced physical distancing between camper lots to provide at least 6’ of unoccupied space. B. The Fair will establish a network of one-way roadways within the camping areas. C. The Fair shall consult with the Delaware Division of Public Health for specific guidance on whether it will be possible and under what conditions common areas supporting campers on the grounds such as showers can be used during the Fair. D. Establish a daytime and nighttime occupancy limit and policy regarding the on-grounds State Police Barracks. E. Campers will be required to carry a face mask or cloth covering and wear it in restrooms and any other fully enclosed buildings and when social distancing of at least 6 feet cannot be maintained as required currently in all Delaware state parks. F. Exhibitor camping on the fairgrounds is typically conducted in three separate geographic areas (North, Central and South Campgrounds). In 2019, the Fair hosted almost 360 exhibitor related campers representing 100% of capacity as previously approved by the Fire Marshal. This year the number of campers has been reduced by 111 campers thereby reducing our exhibitor related camping to approximately 60% of capacity. G. 6. CARNIVAL RIDES AND GAMES (Wade Shows)

A. Wade Shows, the carnival operator shall confer with the Fair regarding the specific rides and attractions (i.e. games) that will set up and operate on the fairgrounds. The evaluation shall include criteria such as managing personal distancing during the ride between unrelated parties, contact points between the patron and vertical surfaces (i.e. soft play or interactive mazes), and the need for enhanced sanitizing of high-touch surfaces between uses. As deemed necessary, the Fair and Wade Shows shall confer with both the State of Delaware Fire Marshall’s Office (chief ride and amusement regulator) as well as the Delaware Division of Public Health for further guidance. B. Carnival lot layout shall include the need to widen the midways and walkways to promote social distancing. The Fair’s typical ride count shall be reduced for 2020 in order to allow for greater social distancing among guests in walkways and ride lines. C. Carnival and Fair shall confer on the use of an app driven digital platform offering cashless transaction payment and ticketless ride access. Consideration shall also be given to offering ride promotions and pricing discounts during the first 3 hours of carnival operations on select days (1:00PM – 4:00PM) in order to draw guests during less crowded times. Carnival shall consider allowing the purchase of ride access by the hour to coincide with Fair’s desire to flatten the time of admission curve. D. As a general rule, carnival employees should avoid physically assisting/lifting guests. If a guest needs assistance, they will first ask another family member to help. It is understood that carnival employees may still need to physically assist/lift guests in the event of a ride evacuation. E. The carnival and Fair shall reconfigure the ride, game and related food unit lot layout to allow for as many straight or “L” shaped lines as possible. Switchback or serpentine style lines will be avoided. Visual ground markings shall be installed to reinforce the concept of 6’ in separation between others not in their family group. F. The carnival shall follow enhanced cleaning and disinfecting protocols required by the CDC and Delaware Division of Public Health pertaining to frequently touched ride and game components (i.e. rings, bucks, bean bags, balls, water guns, etc.) as well as the carnival’s food units’ guest service areas. Deep cleanings of carnival rides and other attractions shall occur at the end of the night and before guests arrive the following day. G. Physical distancing requirements shall be considered by the carnival when operating multi- player games when unrelated parties approach the games. Game “barkers” shall frequently remind players that they have an obligation to maintain social distancing between individuals or groups that do not live under the same roof. H. The carnival shall place in service additional hand washing and hand sanitizer dispensing stations throughout the carnival/game/food unit lot with special attention to the carnival’s

food service units. Placement shall also include carnival employee common areas typically considered “back of house”. I. The carnival shall provide appropriate signage (bilingual if possible) for all guests and employees whose messaging is instructional on public health policy matters related to distancing and personal hygiene. J. The carnival shall require its personnel to monitor compliance with distancing and cleaning/sanitizing policies. K. Ride capacity, especially involving rides with rows or multiple seat clusters, will be reduced to allow proper distancing.

7. FOOD AND BEVERAGE SALES AND DINING AREAS

A. All food establishments (mobile or existing structures) shall secure a Temporary Food Establishment Permit (TFE) from the Division of Public Health and in doing so shall meet or exceed all licensing requirements imposed by the State of Delaware. B. The fairground-wide food stand layout has been reconfigured to provide additional spacing between units in order to accommodate new straight or “L” shaped service or queuing lines stands in the same row initiating and managing lines running in the same direction. C. All napkins shall be distributed to Fair guests via a dispenser (no loose pile of napkins) or distributed directly by a cashier or server. D. Condiments shall be cook or server applied or provided via individual packets and distributed by a cashier or server. No guest operated self-serve condiment containers (i.e. squirt bottles or pump dispensers) will be permitted. E. Individual eating utensils, if offered, must be distributed directly by a cashier or server or be individually pre-packaged and wrapped in cellophane. F. No self-serve open straw boxes will be permitted. Straws should be distributed either directly by a cashier or server or distributed in a drop down self-actuated dispenser. G. Food vendor and Fair managed seating areas shall be cleaned and disinfected after guests exit their seats and before the seating of new guests, whenever possible. A deep cleaning shall take place at the end of the night and before guest sales begin the next day. H. All seating areas shall be reconfigured to support adequate distancing. I. Unrelated parties and guests should be encouraged by way of signage to seek and occupy their own tables or areas of general seating that support appropriate distancing between unrelated parties. J. Food vendors will dispense all food and drink items directly to the guest. There shall be no form of guest self-service food or beverage selection or delivery permitted. Sale and re-use of refillable drink containers shall be prohibited, in order to reduce the likelihood of multiple guests and cashiers or server personnel coming in contact with common surfaces. New single use cups must be used with every cup-based beverage sale. 38

K. Food vending employees who handle cash shall not handle food. L. All food and beverage service personnel shall be required to wear masks and gloves as required by the Delaware Division of Public Health. It will be the Concessionaires’ responsibility to provide all employees with face coverings and disposable gloves.

IMPORTANT, PLEASE READ CAREFULLY BEFORE ENTERING THE FAIRGROUNDS

The health and safety of everyone entering the fairgrounds is our top priority. We have implemented several measures that you will see throughout the fairgrounds which are designed to protect the Fair’s guests, exhibitors, concessionaires, volunteers and employees from potential exposure to the COVID-19 virus (“Coronavirus”) by minimizing contacts, promoting social distancing and enhancing sanitation throughout the property.

In addition, to further protect the health and safety of persons on the fairgrounds, you will not be admitted to the park and you should stay home if within past fourteen (14) days you have:

1. Tested positive or have been deemed presumptively positive with the Coronavirus; 2. Sought testing to determine whether you might have the Coronavirus, and have not yet received the results; 3. Been informed that you may have been exposed to Coronavirus or learned that you have been in the immediate vicinity of a person now known to have been carrying the Coronavirus; or 4. Experienced any of the following symptoms commonly associated with the Coronavirus, including cough, shortness of breath or difficulty breathing, OR two or more of any of the following: fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, new loss of taste or smell.

As required by the State of Delaware, once you enter upon the fairgrounds, there are certain buildings and areas where you must or are encouraged (depending upon the building or area) to:

1. Wear your protective face mask or facial protective gear (other than children two and under) while inside any of the Fair’s fully enclosed buildings; and 2. Adhere to the social distancing and personal sanitization guidelines posted throughout the grounds. 56

The Fair reserves the right to modify these requirements on a case-by-case basis to accommodate any circumstance that in the Fair’s sole discretion warrants a modification to this policy.

The Delaware State Fair, Inc. cannot guarantee that you will not be exposed to Coronavirus during your visit or while on any part of the fairgrounds.

The CDC advises that older adults and people of any age who have serious underlying medical conditions might be at higher risk for severe illness from Coronavirus.

Guests should evaluate their own risk in determining whether to attend. People who show no symptoms can potentially spread Coronavirus if they are infected and any interaction with the general public poses an elevated risk of being exposed to Coronavirus.

By coming to the fairgrounds in any capacity, you acknowledge and agree that you assume these inherent risks associated with your presence on the fairgrounds.

If at any time the Fair determines that someone on the grounds does not meet the criteria outlined in this policy, the Fair reserves the right to refuse entry or (if the person is already on the grounds) immediately remove that person from the grounds.

These actions are at the sole discretion of The Delaware State Fair, Inc.

By entering the fairgrounds, you acknowledge that you have read, understand and agree to abide by this policy.
