1. INTRODUCTION

1.1 Background of the Project

1. The proposed Chennai-Kanyakumari Industrial Corridor (CKIC) Power Sector Investment Project consists of (i) establishment of 765 kV transmission link from the southern section of CKIC () to load centers in North (Chennai) and North Western (i.e. ) regions of Tamil Nadu (ii) establishment of 400 kV pooling substation in southern region of CKIC (i.e. ) for collecting power generated from proposed upcoming power plants; and (iii) Institutional capacity building of TANTRANSCO for improved financial management and enhanced gender sensitive workplace.

2. The project is aligned with the following impact(s): industrial development and renewable energy generation in Tamil Nadu will be enhanced; the power supply to industrial demand centers in CKIC will be improved. The project has following outputs:

3. Output 1: A transmission link from the energy hub in southern CKIC to load centers in northern CKIC established. This will establish a 765 kV power transmission link between the energy generation hub in Madurai–Thoothukudi area and load centers in the western and northern parts of the state. The outputs consist of (a) (765/400/230 kV, 2x1,500 megavolt ampere [MVA] and 2x500 MVA) substation; (b) 765 kV transmission lines from Virudhunagar to Coimbatore; and (c) 400 kV transmission lines to link Virudhunagar substation to several 400/230 kV pooling substations for wind and solar power plants;

4. Output 2: A pooling substation for renewable energy established in southern CKIC. This will establish a pooling substation to receive electricity generated from power plants in the . This consists of (a) Ottapidaram (400/230/110 kV, 2x315 MVA and 2x200 MVA) substation; (b) 400 kV transmission lines to connect Ottapidaram substation with several power plants; and (c) 230 kV and 110 kV transmission lines to connect Ottapidaram substation with nearby load centers.

5. Output 3: Enhanced capacity for improved financial management and gender sensitive workplace. This will be delivered through the attached technical assistance grant. This will consist of (i) strengthening the financial management capacity of the Executing Agency, particularly in reconciling intercompany balances and establishing and maintaining a comprehensive fixed asset register; (ii) supporting the Executing Agency in adopting and implementing Indian Accounting Standards; (iii) facilitating the introduction of gender sensitive workplace practices and (iv) enhancing the capacity of TANTRANSCO for monitoring the environment and social impacts of transmission projects.

6. ADB has committed a regular loan of $451.0 million to TANTRASCO from ADB’s ordinary capital resources to help finance the project. The loan was approved on 04 November 2019. The loan agreement was signed on 28 November 2019 and became effective on 17 January 2020. TANTRASCO is the executing agency (EA) of the Project.

1.2 Objective and Methodology of the Monitoring Report

7. The report captures the overall social safeguards compliance status with regard to project’s Compensation Plan (CP) and regulatory requirements. The Compensation Plan is similar to the Resettlement Plan (RP) per ADB’s Safeguard Policy Statement, 2009 (SPS). The current semi-annual monitoring report covers the project implementation status and social safeguards measures during August 2020 to January 2021.

8. The semi-annual monitoring report is based on the review of available data and information received from the respective contractors and TANTRANSCO. In addition, the report captures the observations made by the social safeguard monitoring expert during the site visit held between 21-23 December 2020.

1.3 Social Safeguard Categorization

9. The Project is categorized as ‘B’ for Involuntary Resettlement (IR) and "C" for Indigenous Peoples impacts, as per ADB’s Safeguard Policy Statement, 2009 (SPS).

2. PROJECT IMPLEMENTATION STATUS

2.1 Contract award

10. The project has 7 packages and contract for all the 7 packages has been awarded. The package number, description of package, and name of contractor against each package is given in Table 1 below.

2.2 Land status and work progress in substation

11. The land ownership of both Virudhunagar and Ottapidaram substation is with TANTRANSCO. The land for Virudhunagar substation has been acquired through negotiated settlement by willing buyer and willing seller mechanism. The land for Ottapidaram substation has been procured by TANTRANSCO through negotiated settlement and through mutual transfer of land from Ind Bharat to TANTRANSCO. There are no persons living or using the substation land informally and therefore there will be no affected people. The status of substation land is given in Table 2.

12. Virudhunagar 765/400 kV AIS Substation: According to the data shared by TANTRANSCO as of 20 December 2020, site preliminary works such as site clearance and mobilization has been completed. About 84% of cutting and filling works in the site has been completed. Activities have started in the 400 kV equipment foundations, construction of control room building and compound wall. During the site visit the contractor representatives informed that the impact of COVID-19 has delayed the construction work.

13. Ottapidaram 400/230-110kV Substation: As per the data shared by TANTRANSCO as of 08 January 2020, preliminary works such as bush clearing of entire 64 acres has been completed. Activities are ongoing in the 400 kV equipment foundations and equipment structures. Work on 230 kV equipment foundations and 110 kV equipment foundations is almost completed. The construction work of control room building, switchyard panel room and boundary wall is ongoing.

2.3 Status of detailed survey & route approval in Transmission Lines

14. The preliminary route alignments were prepared through satellite survey data by Anna University, Tamil Nadu. Based on the GIS survey data, three alternative routes were proposed for each transmission line (Route A, Route B and Route C). The best route for each transmission line was suggested by Anna University in consultation with the field team of TANTRANSCO and taking into consideration various factors such as avoiding habitat area, avoiding crop land, avoiding forest area, avoiding settlements etc.

15. Detailed survey was undertaken along the Anna University suggested line by the respective contractors to finalise the angle points and route alignment based on the actual field condition. The status of detailed survey for the transmission lines is presented in Table 3. The revised route alignment of a transmission line, which is based on the detailed survey by contractor, was sent to TANTRANSCO for review. After the review TANTRANSCO did the route approval of the revised alignment. It is to be noted that TANTRANSCO formed an expert committee to review the proposed route alignment of 765 kV double circuit line from Virudhunagar to Coimbatore. The 765 kV line comprised of three sections. KPTL is responsible for Reach 1, KEC is responsible for Reach 2 and Transrail is in charge of Reach 3 of the line. The expert committee reviewed the route alignments of 3 sections (Reach 1, 2 and 3) and approved the route alignment with some changes. For each transmission line the below paras describe the deviations between the Anna University suggested line and the final route alignment approved by TANTRANSCO.

16. 400 kV DC line from Kamuthi to Ottapidaram: According to the data received from TANTRANSCO detailed survey has been completed in the entire 71.6 km line. There is no deviation between the original route alignment suggested by Anna University and the approved route alignment done by TANTRANSCO. Figure 3 shows both the Anna University route and approved route.

17. 400 kV DC line from Udangudi to Ottapidaram: Detailed survey has been completed in the entire 67.9 km line. As per the original route alignment suggested by Anna University the total length was 70 km while the total length of the approved route alignment is 67.9 km. Figure 4 shows both the Anna University route and approved route.

18. 400 kV DC Line from Virudhunagar to Kayathar: As per the original route alignment suggested by Anna University the route was from Virudhunagar sub-station to Kayathar and the total length was 72 km. After the change in strategy by TANTRANSCO the approved route now connects from Virudhunagar sub-station to a common point AP 45. A newly built and

activated transmission line connects the Kayathar sub-station to Thennampatti sub-station through the common point AP 45. The total length of the approved route is 70.2 km. Due to the change in route alignment almost all the stretches of the approved route is deviated from the original route. Detailed survey completed in the entire 70.2 km line. Figure 5 shows both the Anna University route and approved route.

19. 765 kV DC Transmission Line from Virudhunagar to Coimbatore (Reach 1): Detailed survey has been completed in the entire 86.9 km line. As per the original route alignment suggested by Anna University the total length of Reach 1 was 86 km while the total length of the approved route alignment is 86.9 km. Figure 6 shows the route alignment of both the Anna University route and approved route.

20. 765 kV DC Transmission Line from Virudhunagar to Coimbatore (Reach 2): According to the data received from TANTRANSCO detailed survey has been completed in the entire 94 km line. As per the original route alignment suggested by Anna University the total length of Reach 2 was 87.7 km while the total length of the approved route alignment is 94 km. In some stretches there are major deviations between the route alignment suggested by Anna University and approved route (Refer Figure 7).

Figure 7: 765 kV DC Transmission Line from Virudhunagar to Coimbatore (Reach 2) 21. 765 kV DC Transmission Line from Virudhunagar to Coimbatore (Reach 3): According to the data shared by TANTRANSCO as on 19 January 2021, of the total length of 71.4 km, detailed survey completed in 54.8 km. The detailed survey is pending in the remaining section due to RoW issue created by Vivasaya Sangam parties and landowners. The contractor representatives during the discussion highlighted that “Enterupon” permission has been requested from District Collector and meeting with Superintendent of Police has been held to expediate the process of detailed survey. The route alignment of 3.74 km is on hold at CBE Gantry as the sub-station design at Coimbatore is yet to be finalized. The deviation between the route alignment suggested by Anna University and the actual approved route will be known once the detailed survey is completed in the entire line.

22. 230 and 110 kV Transmission Lines associated with Ottapidaram Substation: In this package there are five small transmission lines. According to the data received from TANTRANSCO, detailed survey has been completed in all five transmission lines (Refer Table 4 for detail). The revised route map for these lines is approved except for one line (110 kV DC line on DC tower from LILO of Eppodhmvendran to Ottapidaram SS). There is very minor deviation between the route alignment suggested by Anna University and the actual approved route for four of the five lines. The reasons for minor deviations in these lines at Gantry are due to the fact that the electrical layouts were not finalised during the Anna University survey. The Ottapidaram Substation layout and actual positioning of bays was finalised later. There is major deviation in route alignment for one line (110 kV DC line on DC tower from LILO of Eppodhmvendran to Ottapidaram SS) though in terms of distance there is minor variation. As per the original route alignment suggested by Anna University the total length of this line was 3.24 km while the total length of the revised route alignment is 3.31 km. Annexure 1 shows the route alignment of both the Anna University route and approved route of all the five lines.

2.4 Progress of construction in Transmission Lines

23. In the approved routes check survey was conducted by EPC contractors. Based on the check survey the type of towers, number of angle point and suspension towers and location of suspension towers was finalised. Table 4 gives the total number of towers, number of towers in private land and number of towers in government land for the transmission lines where check survey has been completed.

The construction work of tower foundation and erection is ongoing. it is being implemented on piecemeal basis after taking consent from affected landowners. Stringing work has been completed in some stretches of the 400 kV DC line from Kamuthi to Ottapidaram and Udangudi to Ottapidaram. Construction work in 230 and 110 kV lines associated with Ottapidaram Substation has not commenced as the route approval was done by EA recently. Below paras gives an update of the progress of constructions for various transmission lines.

25. 400 kV DC line from Kamuthi to Ottapidaram & Udangudi to Ottapidaram: As per the latest implementation status on 08 January 2021, of the total 206 towers in Kamuthi to Ottapidaram line, foundation of 178 towers has been completed. Erection has been completed

in 173 towers. Of the 71.6 km line, stringing has been completed in 29.6 km line. In the Udangudi to Ottapidaram line, of the total 200 towers, foundation of 95 towers has been completed. The erection has been completed in 89 towers. Of the 67.9 km line, stringing has been completed in 15.7 km line. Figure 8 and 9 show the stringing of lines in the Kamuthi to Ottapidaram line.

26. 400 kV DC line from Virudhunagar to Kayathar: According to the physical progress data as on 20 December 2020, of the total 201 towers, foundation of 25 towers has been completed. Tower erection work has not commenced. During the discussion the contractor representatives mentioned that the actual route alignment was approved by TANTRANSCO in September 2020. The foundation work was also delayed due to the impact of COVID-19 and rainfall due to Northeast monsoon.

27. 765 kV DC line from Virudhunagar to Coimbatore (Reach 1): According to the physical progress data as on 20 December 2020, of the total 247 towers, foundation work has been completed in 112 towers and erection has been completed in 58 towers. During the discussion the contractor representatives informed that initial delay in civil work was happened due to the impact of COVID-19. In addition, construction activities were hampered due to RoW issue created by Vivasaya Sangam parties and landowners. Figure 10 shows the completion of a tower erection and Figure 11 shows a tower erection work in progress in Reach 1 line.

28. 765 kV DC line from Virudhunagar to Coimbatore (Reach 2): As per the physical progress data as on 22 December 2020, of the total 268 towers, foundation work has been completed in 76 towers and erection has been completed in 65 towers. Stringing work has been completed in 3.8 km. During the discussion the contractor representatives informed that there was delay in civil work due to the impact of COVID-19. In addition, construction of foundation activities was hampered due to RoW issue created by Vivasaya Sangam parties and landowners. Figure 12 is the image of an erected tower on private land and Figure 13 shows an erected tower on government land in Reach 2 of 765 kV DC line.

29. 765 kV DC line from Virudhunagar to Coimbatore (Reach 3): According to the implementation status data as on 19 January 2021, of the approved 135 towers, foundation of 33 towers has been completed and erection has been completed in 14 towers. The construction of foundation is being implemented on piecemeal basis after getting the clearance from TANTRANSCO. The contractor representatives during the site visit informed that delay in construction of foundation work was happened due to the impact of COVID-19 and due to RoW issue created by Vivasaya Sangam parties and landowners.

2.5 Compensation provisions and process of compensation

30. To govern the compensation of project affected people the relevant national laws applicable to this project are: (i) The Electricity Act, 2003; (ii) The Indian Telegraph Act, 1885; and (iii) Ministry of Power's (MoP) guideline, 2015 related to compensation for transmission line. The compensation principles adopted for this project also comply with applicable laws and regulations of the Energy Department, Government of Tamil Nadu (Revised guidelines for payment of compensation towards damages in regard to RoW for transmission lines 110 kV and 230 kV lines and above).

31. MoP guidelines, 2015: The Ministry of Power, Govt. of India vide its notification dated 15th October 2015 has issued guidelines for payment of compensation for damages regarding RoW. The said guideline was adopted by Government of Tamil Nadu vide G.O. No. 63 Energy Department dated 22-11-2017 for implementation. As per the guideline the following compensation shall be paid in addition to normal tree and crop damage compensation:

. Compensation @ 85% of land value as determined by District Magistrate or any other authority based on circle rate/guideline value/Stamp Act rates for tower base area (between four legs).

. Compensation towards diminution of land value in the width of Right of Way (RoW) Corridor, due to laying of transmission line subject to maximum of 15% of land value as determined based on circle rate/guideline value/Stamp Act rates.

32. The Government of Tamil Nadu issued orders stating that only in the case of acquiring Right of Way for transmission lines through private negotiation, which will avoid unnecessary litigation for enhanced compensation, the negotiated value of the land may be determined as per the Revenue and Disaster Management Department, which can then be adopted as the basis of compensation for such Right of Way. This was adopted by Government of Tamil Nadu vide Letter No. 41/A/2018, Energy Department dated 16-05-2018 for implementation.

33. G.O. (Ms) No. 86 (Revised guidelines for payment of compensation): In the Government of Tamil Nadu order (G.O. (Ms) No. 86) dated 30-10-2019 guidelines issued for payment of compensation towards damages in regard to RoW for transmission lines 110 kV and 230 kV lines and above. The Government issued the following orders:

1. For the tower base area, the existing provision of 85% shall be enhanced to 100% of assessed land value as per above procedure. 2. For diminution of land value for stringing corridor area (RoW) the existing provision of 15% shall be enhanced to 20% of assessed land value as per above procedure. 3. Rs. 50,000/- is fixed as minimum payable amount for tower base area for first 3 cents, if the assessed land value is less than Rs. 50,000/-. 4. Rs. 10,000/- may be fixed for every additional one cent or part thereof, if the tower base area exceeds 3 cents and this would be added to the minimum payable amount for tower base area.

The guideline also mentions the method of calculation of the assessed value if the 100% assessed value for tower base area is more than the amount calculated as per point 3 and 4 above. Refer Annexure 2 for the detailed guidelines of G.O. (Ms) No. 86 (Revised guidelines for payment of compensation).

34. The provisions of the G.O. (Ms) No. 86 are being implemented for this project for the land compensation of tower base area and land compensation of corridor area (RoW). The compensation amount for crop and tree is based on the rate determined by the Department of Agriculture and Department of Horticulture.

35. Process of Compensation: The affected landowner (people) of the tower base is identified through the local people and verified through the village administrative officer (VAO). After the identification, the Assistant Engineer/Assistant Executive Engineer undertakes consultation with the affected landowner. During the one-to-one consultation, information on the project, compensation provision for affected land, trees and crops are given to affected landowner. After the consent of affected landowner, detailed assessment of affected land, tree and crops is done in the presence of TANTRANSCO official and district revenue official. Work on tower foundation has commenced after taking consent from affected landowners. The particulars of the detailed assessment are filled in the Madras Electricity Department (MED) form issued to affected landowner. The signature of the land owner in the filled MED form is taken before the processing of compensation. The contractor provides the compensation amount in cheque to the affected landowner on behalf of TANTRANSCO. Later TANTRANSCO reimburse the compensation amount to the contractor. A similar process is followed for the compensation of crop and tree for tower foundation and erection and compensation of land, crop and tree for stringing in corridor area (RoW). Sample of filled MED forms are attached in Annexure 3.

36. Status of Compensation payment: Table 5 provides the summary of status of compensation payment per type of compensation for various transmission lines. Figure 14 and 15 show evidence of compensation cheques received by the affected people.

37. A format (spreadsheet) has been prepared and circulated to all the EPC contractors to record the data contained in the MED form (affected asset and compensation data). Annexure 5 contains the database of the compensation data of the affected people who have received the compensation during the reporting period.

3. SOCIAL SAFEGUARDS COMPLIANCE STATUS

3.1 Compliance status of Compensation Plan

38. The draft compensation plan (RP) was prepared in 2018 and was disclosed in July 2019. The status of compliance of the compensation plan is mentioned in Table 6.

4 INSTITUTIONAL ARRANGEMENTS AND GRIEVANCE REDRESS MECHANISM

4.1 Project Management Unit and Project Implementation Unit

39. The Department of Energy, Tamil Nadu has the overall responsibility for ensuring the project implementation on behalf of Government of Tamil Nadu. Tamil Nadu Transmission Corporation Limited (TANTRANSCO), the state-owned transmission utility, serves as the executing agency (EA) and implementing agency (IA) for implementation of the ADB-financed project. The Government of India channel the ADB loan proceeds to the Government of Tamil Nadu, which then on-lend those funds to TANTRANSCO. The Government of Tamil Nadu provide counterpart funds available to TANTRANSCO as equity investments to augment TANTRANSCO’s capital base.

40. TANTRASCO has existing Project Management Unit (PMU)/Project Implementation Unit (PIU) for the implementation of the proposed project. The PMU at headquarter consists of a technical team and a financial team. The technical team is headed by Director /Transmission project and supported by Chief Engineers and Superintending Engineers. The financial team is headed by Director/Finance and supported by Chief Financial Controller and Financial Controllers.

41. The execution of project at site level is supported by PIU at Madurai and Coimbatore headed by Chief Engineer Transmission project-II, Trichy. The PIU at Madurai consists of a team headed by Superintending Engineer/GCC/Madurai and supported by Executive Engineer/C/765kV /TP Virudhunagar and Executive Engineer/TLC/. The PIU at Coimbatore is headed by Superintending Engineer/GCC/Coimbatore and supported by Executive Engineer/TLC/Coimbatore.

42. TANTRANSCO is responsible for ensuring compliance with the loan covenants with regard to social safeguards. The PMU is responsible for preparation, planning, and monitoring of the implementation of CP/RP and grievance redress during various phases of the project cycle. In addition, the PMU is responsible for preparation and submission of semi-annual social monitoring reports to ADB.

43. The PIUs at Madurai and Coimbatore are responsible for supervision of the implementation of CP/RP by the EPC contractors. Relevant line departments at the district level are also involved to assist the PIUs in the CP/RP implementation. In addition, the PIUs and relevant district level officials are responsible for assessment and approval of compensation payment in accordance with the entitlement matrix of the CP/RP; ensuring of timely reimbursement of compensation payment made by the contractors; conduct periodic consultations with the affected people; and share required data and information for preparation of semi-annual social monitoring reports.

4.2 Grievance Redress Mechanism

44. Grievance Redress Mechanism (GRM) is an integral and important mechanism for addressing/resolving the concerns and grievances of project affected people. The grievances may include concerns of affected people arising out of implementation of the project, implementation of the Compensation Plan for resettlement impacts as well as adverse

environmental impacts. The Grievance Redressal Committee (GRC) is expected to resolve the concerns and grievances of the affected people during the project cycle. 1. The scope of the GRM is:

. To examine all kinds of concerns or grievances arising out of implementation of the project, including concerns relating to the resettlement compensation, environmental concerns or adverse project impacts, and to resolve such grievances in a transparent manner.

. GRC will not deal with matters pending in the courts of law. . For the GRM, only members of GRC, affected people and/or representatives of affected people will be allowed to participate in the meetings and consultations for 1 grievance redressal. . Decision of the GRC will be communicated to the aggrieved in writing/E-MAIL.

45. Grievances can be initially and informally handled at the site-level. The site level consultation with potential affected parties, TANTRANSCO and contractor can take place in an informal setting and no written records are required to be maintained. If the affected person is not satisfied with the remedial measures proposed by the contractor, he/she can make a formal representation to the GRM. The complaint can relate to either compensation payment or environmental issues.

46. The GRC has been formed by TANTRANSCO in June 2020. An operational guideline on functioning of GRM (GRC) has been developed in consultation with TANTRANSCO which describes the procedures and mechanism for the smooth operation of the GRM and GRC. The procedures have been updated in response to implementation experience and reflects a revised GRC membership and process that is designed to better reflect social norms and community leadership preferences. The operational guideline on GRM (GRC) has been accepted by TANTRASCO. The copy of the acceptance letter is attached in Annexure 4.

47. The GRM consists of two levels. The first level is handled by a GRC established at the General Construction Circle (GCC) level. The second level GRC is established at the project level and is headed by the Chief Engineer (Trichy).

48. The members of the GRC at first level (GCC level) are: Superintending Engineer in respective GCC and a contractor’s representative. During the grievance redressal, the affected people can invite an elected representative of village panchayat/urban ward2 from the his/her village/urban ward to ensure that the interest of the affected people is duly protected as per the extant compensation notification issued as per relevant Government Order.

49. The second level GRM is at project level. The GRC at project level is the appellate authority and will be responsible to address the unresolved complaints from the GCC (first) level. The members of the GRC at project level consist of Chief Engineer/Transmission

Projects-II/Trichy; Chief Financial Controller/TANTRANSCO; and Superintending Engineer/Civil-I/Transmission. Acting as the Chairman of GRC, the Chief Engineer/Transmission Projects-II/Trichy reviews the complaints coming directly to him from any other sources (ADB, affected people, TANTRASCO head quarter) and assign the complaints to the relevant GCC for the redressal. In case it is not addressed at first and second level GRC, the second level GRC can refer the matter to the District Magistrate.

4.3 Grievance Redress Process and Status of Complaints Received

50. The GRC Chairman reviews the complaints coming to him from various sources (directly from affected people, ADB, unresolved complaints from the first level). The GRC Chairman reviews the incoming complaints and associated documents and records and constitute the GRC panel for redressal. The affected people (petitioner) is contacted by the office of Chief Engineer for an amicable solution of the grievance of the affected people. The petitioner is invited to the office of GRC Chairman for discussion. If needed, the committee Chairman conduct an inspection or consultation at the site of the affected party by a TANTRANSCO official assigned for the purpose. The inspection of the site or any other consultation is done with the presence of aggrieved AP and/or a representative nominated by the aggrieved AP. The field inspection report is signed by the TANTRANSCO official and the petitioner. Box 1 shows a field inspection report. Once the grievance is addressed, an action taken report (ATR) is prepared by the GRC Chairman.

51. During the reporting period from August to December 2020, a total of 8 complaints received from the project affected people. There are 7 individual complaints and one complaint from a group of villagers. All the 7 individual complaints were received by the ADB. As per the procedure ADB forwarded these complaints to the GRC chief for further action. Table 7 provides the details of the complaints received and the status of complaints.

52. Complaint from the residents of Padiyur village: A complaint from residents of Padiyur Village was received by TANTRANSCO and Asian Development Bank (ADB)’s Accountability Mechanism, which falls in Reach 3 of the 765 KV Virudhunagar – Coimbatore transmission line. TANTRANSCO held that the villagers made the complaint on the basis of the route alignment mentioned in the Compensation Plan which was prepared in 2018 by Anna University and TANTRANSCO. In the complaint the residents expressed the concern that Anna University suggested transmission line is passing through the residential buildings and requested to change the alignment. A revised route alignment has been prepared by TANTRANSCO in consultation with Anna University and the route was approved by TANTRANSCO on 12 November 2020. TANTRASCO official informed the petitioner that in the approved route map the line is not passing over any residential buildings. On 9 December 2020, the residents of Padiyur village informed to ADB’s Accountability Mechanism and GRM that their complaint has been resolved by TANTRASCO in coordination with Asian Development Bank.

53. In order to address the complaint of resident of Padiyur village ADB had its internal discussions. An action plan has been prepared that suggests preparation of option study analysis of the 3 options/alternatives for justifying the most feasible route for the affected stretch. The option analysis report concluded and recommended that Option-2: (Route B- Approved Route prepared in November 2020 by TANTRANSCO) is the most feasible option taking into consideration social and environment features and specifically taking into consideration the number of buildings and structures, compensation and construction cost. It may be noted here that though the residents of Padiyur village have formally withdrew the complaint from the Accountability Mechanism ADB is taking the measures mentioned in the action plan to close the complaint.

4.4 Consultation and disclosure of project information

54. Consultation with affected people plays an important role during various stages of the project implementation. Consultations make people aware about the project and its potential impacts and during the process obtain the views of the people affected with regard to loss of land, assets and compensation.

55. Consultations with affected people were carried out by TANTRANSCO and contractors during the detailed survey, during determination of agreed compensation values, during disbursement of compensation and during the construction.

56. The dissemination of project information and transmission line alignment to the affected people was made by one-to-one consultation through the contractor during the detailed survey due to COVID-19 restrictions on public meetings/consultations. After the identification of affected people through the village administrative officer, TANTRANSCO officials (AE, AEE) undertook individual consultation with each affected people. During the one-to-one consultation, information on the project, compensation for affected land, trees and crops were given to affected landowner. Information regarding the provisions of G.O. (Ms) No. 86 (Revised guidelines for payment of compensation) is properly explained to the affected landowner during the consultation. After the consent of affected landowner, detailed assessment of affected land, tree and crops was done in the presence of district revenue officials and recorded in the MED form given to the affected landowner. Work on tower foundation was commenced after taking the signature of affected landowners in the MED form.

57. The updating of RP (CP) is being planned. This updating will be based on detailed design and approval of the route alignment by TANTRANSCO for various transmission lines.

Information dissemination and public consultations with the people in the approved route has commenced in transmission lines where there are major deviations from the original line (Anna University suggested line). The information on public consultations will be used for the updating of RP.

58. The contractor informed the affected landowner about the tentative construction schedule on foundation work well before the commencement of work. The contractor informed the affected people about the tentative construction schedule for erection and stringing in the relevant stretches of the transmission line before the commencement of construction.

59. The entitlement matrix in the draft Compensation Plan has been shared to the TANTRANSCO official at the GCC level and district level officials. The entitlement matrix is available with all the EPC contractors. The copy of entitlement matrix and G.O. (Ms) No. 86 (Revised guidelines for payment of compensation) is also available at the project site office of TANTRANSCO inter alia at site office of the contractor.

60. In order to avail broad support from the affected people along the transmission line corridor for smooth implementation of the project, TANTRANSCO will disclose project information in an accessible place, and in a form and language (English and Tamil) understandable to affected people.

61. Information dissemination about the existence of GRM will be done by TANTRANSCO. The information on GRC and information containing instructions on how to make a grievance should be displayed at appropriate places as deemed appropriate by the TANTRASCO official. This will ensure that affected people are aware about the existence of a GRM for the redressal of grievances, if any.

4.5 Site Visit

62. A site visit was conducted by the Safeguard TA consultants (Environment, Safety and Social Safeguard) appointed by the ADB. The site visit was held between 21 December to 23 December 2020. In addition to the visit of selected sites, the consultants held discussion with all the contractors.

63. During the discussion, the contractor representatives provided updates on implementation progress and highlighted implementation challenges. Table 7 provides the summary of the discussion with each contractor.

64. Based on the observation made during site visit and review of physical progress and compensation data following implementation issues were identified.

. In 400 kV DC line from Kamuthi to Ottapidaram and from Udangudi to Ottapidaram stringing is already completed in some stretches of the transmission line corridor (RoW). However, the process of land compensation has not started. . The recording of compensation data for corridor (RoW) was not done in the database for corridor compensation. . There was no display of project information either in the contractor site office/ store area or along the transmission line corridor. There was no display of information regarding the GRM and instructions on how to submit grievance by the affected people.

5 CONCLUSION

65. During this reporting period, the detailed survey by respective contractors has been completed in all the transmission lines except in one line (765 kV DC line Virudhunagar - Coimbatore Reach 3). In the Reach 3 transmission line detailed survey is pending in some portions due to the issue created by Vivasaya Sangam parties and landowners. The final routes for all transmission lines have been approved except in some portions of Reach 3 of 765 kV DC line.

66. The construction work is ongoing in both the substation and in all transmission lines except in one package (Package 9: 230 and 110 kV Transmission Lines associated with Ottapidaram Substation). In the initial period, the impact of COVID-19 has delayed the construction work in the substations as well as transmission lines.

67. The construction of tower foundation and erection is ongoing and in different stages across the transmission lines. Stringing of lines is ongoing in 400 kV DC line from Kamuthi to Ottapidaram and Udangudi to Ottapidaram line. Stringing has commenced in Reach 2 of 765 kV DC line Virudhunagar – Coimbatore.

68. The provisions of the Government of Tamil Nadu G.O. (Ms) No. 86 are being implemented for this project for the land compensation of tower base area and land compensation of corridor area (RoW). As per the provision, 100% of the assessed land value is provided as land compensation for land affected by tower base and 20% for land compensation of corridor area. The compensation amount for crop and tree is based on the rate determined by the Department of Agriculture and Horticulture of Government of Tamil Nadu. The particulars of the affected land/crop/tree are filled in the Madras Electricity Department (MED) form issued to affected landowner. The contractor provides the compensation amount in cheque to the affected people and TANTRANSCO reimburse the compensation amount to the contractor.

69. The GRM consists of two levels. The first level is handled by a GRC established at the General Construction Circle (GCC) level. The second level GRC is established at the project level and is headed by the Chief Engineer (Trichy). An operational guideline on functioning of GRM has been developed in consultation with TANTRANSCO. During the reporting period from August to December 2020, a total of 8 complaints has been received from the project affected people and through the GRM all the complaints are closed.

70. Consultations with affected people were carried out by TANTRANSCO and contractors during the detailed survey, during determination of agreed compensation values, during disbursement of compensation and during the construction. The contractor has informed the affected landowner about the tentative construction schedule on foundation, erection and stringing work before the commencement of work.

71. The entitlement matrix in the draft Compensation Plan has been shared to the TANTRANSCO official at the GCC level and district level officials. The entitlement matrix is available with all the EPC contractors.

72. Based on the observation made during site visit by TRTA consultants and review of physical progress and compensation data some implementation issues were identified. These includes timely payment of land and crop/tree compensation for stringing in corridor (RoW) especially in 400 kV DC line from Kamuthi to Ottapidaram and from Udangudi to Ottapidaram; display of project information through signage including information on GRM and proper record keeping in compensation database and other formats. It is expected that TANTRANSCO will act on these areas on an urgent basis.

The contractor provides the agreed compensation amount in cheque to the affected landowner on behalf of TANTRANSCO. Later TANTRANSCO reimburse the compensation amount to the contractor. As the evidence of payment, the cheque number is mentioned in the compensation database given in Annexure 5 of the report.

The RP cost estimates were done in 2018 and were based on the anticipated number of affected households. Since the number of actual affected household will vary from 2018 RP estimate the actual compensation amount may vary. Determining the actual number of affected households is an ongoing process and the actual RP cost can be estimated after the agreed compensation amount for all the affected HH is known. The SMR will keep the record of compensation cost for each monitoring period and will be summed up at the end once the entire process is completed.
