PUBLIC COMMENT (This is an opportunity for residents to comment briefly on matters included on the agenda and otherwise of interest to the Commission.) 4. PUBLIC HEARING (This agenda item includes development proposals presented to the Planning & Zoning Commission for discussion and recommendation to the Village Board for final action) A. 99 Quentin Road – Steil Plaza (PZC 2017-5) The applicant has requested continuance of the application while feedback from Commissioners is incorporated into revisions. Absent - Commissioner Giannini. Commissioner Muir will be serving as a full member this evening due to an absence. Chairman Stratman noted a quorum was present. Also present: Community Development Director Sarosh Saher, Associate Village Planner Katie Wil- liams, Asst. Village Manager Roy Witherow, Village Clerk Kathleen Johnson. CONSIDERATION OF MINUTES AND FINDINGS OF THE COMMISSION A. Approval of the November 15, 2017 Meeting Minutes of the Planning & Zoning Commission: MOTION was made by Commissioner Baumann, seconded by Commissioner Muir, to approve the November 15, 2017 minutes of the Planning and Zoning Commission as submitted. Upon roll call vote: AYES: 6 Commissioners Baumann, Castillo, Dannegger, Riley, Schultz, and Muir. NAYS: 0 ABSTENTIONS: 1 Chairman Stratman ABSENT: 1 Commissioner Giannini MOTION CARRIED PUBLIC COMMENT - None PUBLIC HEARINGS: MOTION was made by Commissioner Baumann, seconded by Commissioner Riley, to open the fol- lowing public hearings at 6:34 p.m. Upon roll call vote: AYES: 7 Chairman Stratman, Commissioners Baumann, Castillo, Dannegger, Riley, Schultz, and Muir. He said the new applications would be heard first with the continued applications to follow. Detailed information is contained within the accompa- nying staff report and all exhibits submitted by the applicant. Applicant – David Downs, Brabo LLC David Downs, Brabo LLC, related his experience with Jiu Jitsu and explained the benefits of the disci- pline. He expects 10-20 students per class and is does not know at this time if he will operate on week- ends. Director Saher said there have not been any objections from the public or the Industrial Council. MOTION was made by Commissioner Baumann, seconded by Commissioner Muir, to close the public hearing on Application PZC 2017-12 100 Oakwood Road, Unit H, Brazilian Jiu Jitsu Studio at 6:40 p.m. Upon roll call vote: AYES: 7 Chairman Stratman, Commissioners Baumann, Castillo, Dannegger, Riley, Schultz, and Muir. NAYS: 0 ABSENT: 1 Commissioner Giannini MOTION was made by Commissioner Baumann, seconded by Commissioner Schultz, to receive into the public record the staff review of compliance of this Application with the zoning standards as pre- sented by staff, and to make these standards a part of the official record for the Application. Upon roll call vote: AYES: 7 Chairman Stratman, Commissioners Baumann, Castillo, Dannegger, Riley, Schultz, and Muir. NAYS: 0 ABSENT: 1 Commissioner Giannini MOTION was made by Commissioner Baumann, seconded by Commissioner Schultz, to receive into the public record the testimony presented by the Applicants, testimony presented by members of the public, and in response to questions by the Planning and Zoning Commission members any testimony presented by Village Staff at tonight’s Public Hearing. NAYS: 0 ABSENT: 1 Commissioner Giannini E. 927 South Rand Road – Meat and Potatoes Eatery (PZC 2017-14) Public hearing to consider the request for a Special Use Permit in order to operate a drive-through lane accessory to a permitted eating place in the B-3 Regional Shopping Zoning District. Detailed infor- mation is contained within the accompanying staff report and all exhibits submitted by the applicant. Applicant – Jim Grund, The Fidelity Group Jason Sfire, Fidelity Group, presented their proposal to establish a drive-through and outdoor seating for a restaurant at 927 S. Rand Road in the Deerpath Commons Retail Center. The restaurant will oc- cupy the space vacated by Timothy Grant Jewelers and be open from 11 - 9 Monday - Thursday and 11 to 10 on Friday and Saturday and 12 - 8 on Sunday. There are no plans for music. The outdoor seating are will be approximately 18x20 feet located in the front of the building. Mr. Sfire said there will be no major changes to the exterior of the building. Commissioner Schultz asked if the loss of parking spaces for the drive-through could create a shortage in parking. Director Saher said he has not heard any concerns about parking from the other tenants or the developer, and at this time, Staff is not concerned about losing parking spaces. William Howard, 328 Denberry Drive, lives behind the proposed restaurant and had concerns about noise from the drive-through speakers and kitchen exhaust. He asked if the speakers level could be controlled after 9 p.m. Jeff Halen, 154 S. Pleasant Road, complimented Mr. Sfire and his company for coming through with another good tenant and said they have been doing a nice job with the work they have been doing re- cently. Marty Tillsen, 33 E. Harbor Drive, had safety concerns about vehicles exiting the shopping center to go northbound and thought the use would add to rush hour traffic.
