The direct effect of Community legislation Direct applicability and direct effect Variola (1973) (regulations) Grad (1970) (decision in conjunction with directive) van Duyn v Home Office (1974) Nederlandse Ondernemingen (1977) (control of limits left by directive, even if it leaves some choices) Pubblico Ministero v Ratti (1979) ("estoppel" and individual may rely on directive to the extent that it complies with it) Marshall (1986) and Faccini Dori (1994) (no "horizontal" direct effect) Interpretation in line with Directive: Von Colson and Kamann (1984) (law implementing the directive) and Marleasing (1990) (law prior to the directive) Kolpinghuis Nijmegen (1987) ("a directive cannot, of itself and independently of a law adopted for its implementation, have the effect of determining or aggravating the liability in criminal law of persons who act in contravention of the provisions of that directive") Arcaro (1996) (limit of duty of construction in the criminal context) The "incidental" effect of directives: Individuals may suffer a burden by virtue of a Directive, in "triangular" relationships. The third party may not be plaintiff or defendant, but the beneficiary of a public decision which is challenged (e.g. public procurement or environmental impact assessment). The reaction of Member States Generally respected. Some courts may find that the legal basis of primacy and direct effect is to be found in their own domestic constitution. As a result, some constitutional/supreme courts, while accepting the core principles, have reserved for themselves powers of exceptional review. Full effectiveness of EU law: the problem of national remedies Procedural autonomy: in the absence of Union rules governing the matter, it is for the domestic legal system of each Member State to designate the courts and tribunals having jurisdiction and to lay down the detailed procedural rules governing actions for safeguarding EU rights. Two limits: national rules "must not be less favourable than those relating to similar domestic claims" (principle of equivalence) and must not embody requirements and time- limits "such as in practice to make it impossible or excessively difficult" to exercise those rights (principle of effectiveness). Liability of Member States for breach of EU law Francovich (1991) (lack of implementation of directive; damages against the State to compensate for lack of horizontal direct effect) Brasserie du pêcheur and Factortame (1996) (individual may bring a damages claim in the national courts on account of an act or omission of a legislative organ). Köbler (2003) (decisions of judicial bodies adjudicating at last instance). Conditions for liability: EU law confers a right of reparation where three conditions are met: (i) the rule of law infringed must be intended to confer rights on individuals; (ii) the breach must be sufficiently serious; and (iii) there must be a direct causal link between the breach of the obligation resting on the State and the damage sustained by the injured parties. www.un.org/law/avl .

For the past two decades, researchers consistently have reported that law-related curricula and instruction make a positive impact on youth when compared to traditional approaches to teaching and learning law, civics, and government. The overall conclusion is that LRE programs have a positive effect on student knowledgeabout law and legal processes, and individual rights and responsibilities. Inaddition, there is evidence that LRE programs have a positive influence on student attitudes and behavior. The most positive changes in student behavior often are associated with LRE programs where the following elements are present: instruction is of high quality and promotes higher order thinking; students are actively involved in the instructional process; teachers thoughtfully mediate the curriculum through wise selection of materials and outside resource persons; administrators actively support the program; and instructors have a network of professional peer support. This review incorporates an analysis of the major databases that yielded 9 technical reports, 6 scholarly papers, and 25 dissertations directly linked to law-related education.

Following the declared European foreign policy vector, it is impossible, in fact, to avoid the process of adaptation in the internal legal policy of Ukraine. The approximation of Ukrainian law to the EU acquis communautaire is not only the instrument for deepening our economic cooperation with the European Union, but also the important measure to enhance further development of Ukraine in general. In the late 80-s, the Central and Eastern European countries voluntarily initiated the adaptation programs of their political, economic and legal orders to the ones of the European Community. It was unilateral initiative, without any legal obligations under international law. Hungary and Slovenia even before the Association Agreements had implemented the draft law examination procedures on its compliance with the EU legislation. Striving to pave its way to the European Union membership, Ukraine should initiate the adaptation process as soon as possible. Given basic analysis can not cover the full scope of adaptation problems, as a profound research paper can be written in any particular area. That is why I will try to point out the key problems of the implementation of state policy in this area and the ways of its improvement. We are not to forget the efficient successful experience of our neighbours, Poland and Slovakia, in their eurointegration aspirations, so the comparative method is used in analysis in order to enlighten the main tasks and challenges, which Ukraine could face on its way of adaptation.

It can safely be said that without these doctrines the EU would never have been as success- ful and effective as it has been. THE AGES OF EUROPEAN LAW Vlad Perju∗ Prologue: Habermas on the Transnationalization of Democracy European integration poses fundamental challenges to political and legal thought. Over the past two decades, Jürgen Habermas has been engaged in a bold and influential project of articulating the normative foundations of political integration in Europe. Habermas’s starting point is that the pacification of European states created the preconditions for political decision-making beyond the national level. Once state power was tamed, and states accordingly “civilized”, national governments could pursue common policies in response to the pressures of economic globalization. The problem, however, is that the preconditions for political life at the supranational level have not been properly realized. Habermas sees a growing disconnect between the demands of integrated markets, which form one part of the larger, systemic integration of world society, and lingering political fragmentation in Europe. Perhaps the diagnosis of political fragmentation seems surprising given that the member states of the European Union have over the decades consented to ever-greater transfers of powers to the supranational political institutions. But the reality is more complex. The political crises of the past ∗ Associate Professor, Boston College Law School and Director, Clough Center for the Study of Constitutional Democracy. 1 decade, and most notably the recent “crucifixion”1 of Greece in the recent debt negotiations, reveals a state of affairs where the European Council – that “complete anomaly”, as Habermas calls it2 – remains central to the EU’s political life. Two – constitutional – theories thereby exist: monism and dualism. Monist States make international law part of their domestic legal order. International law will here directly apply as if it were domestic law. By contrast, dualist States consider international law separate from domestic law. International law is viewed as the law between States; national law is the law within a State. While international treaties are thus binding ‘on’ States, they cannot be binding ‘in’ States. International law needs to be ‘transposed’ or ‘incorporated’ into domestic law and will thus only have indirect effects through the medium of national law.
