INTRODUCTION – SUPPLEMENTAL AND OTHER COMPENSATIONS 1.1 The apocalyptic terrorist attack by the means of four hi-jacked planes committed against the World Trade Center in New York, NY , the Pentagon in Arlington, VA and the aborted flight ending in a crash in the rural area in Shankville, PA ON September 11th, 2001 is the only real time example that triggered this proposed Convention on Compensation for Damage to Third Parties from Acts of Unlawful Interference Involving Aircraft. 1.2 It is therefore important to look towards the post incident resolution of this tragedy in order to adequately and pro actively complete ONE new General Risk Convention (including compensation for ALL catastrophic damages) for the twenty first century. 2. DISCUSSION 2.1 Immediately after September 11th, 2001 – the Government and Congress met with all affected and interested parties resulting in the “Air Transportation Safety and System Stabilization Act” (Public Law 107-42-Sept. 22,2001). 2.2 This Law provided the basis for Rules and Regulations for: a) Airline Stabilization; b) Aviation Insurance; c) Tax Provisions; d) Victims Compensation; and e) Air Transportation Safety. DCCD Doc No. 28 - 2 - 2.3 The Airline Stabilization Act created the legislative vehicle needed to reimburse the air transport industry for their losses of income as a result of the flight interruption due to the 911 attack.

DOCKET DOT-OST-2011-0138 DOCKET DOT-OST-2001-10644 January 15, 2019 A Key Lime Air Company This document serves as a response to Orders Requesting Proposals DOT-OST-2011-0138 and DOT- OST-2001-10644 posted on regulations.gov on January 15, 2019 by the United States Department of Transportation. Key Lime Air was established as a small passenger and cargo operation in 1997. Over the past 22 years, it has not only grown to be one of the largest cargo feeder aircraft networks in the region but has also expanded into a substantial passenger charter and scheduled passenger airline operating as the Denver Air Connection and authorized to conduct operations under FAR 135 (both commuter and on-demand) as well as FAR 121 (both Domestic and Supplemental). The Denver Air Connection currently flies for over 30 NCAA sports teams, numerous oil companies, and clients in the movie and entertainment industry as well as providing the only scheduled air service from Sheridan and Riverton, Wyoming to Denver for over 3 years. During this period, these communities have enjoyed 99.6% completed flights with an impressive 94.91% on time performance which is well above the industry standard. In addition to these flights, the Denver Air Connection has been flying between Grand Junction and Centennial Airport in Colorado five days per week since 2005 where the same level of consistency and reliability has been maintained to this very day.

    National Transportation Safety Board Aviation Accident Final Report Location: Englewood, CO Accident Number: CEN15FA090 Date & Time: 12/30/2014, 0429 MST Registration: N404MG Aircraft: CESSNA 404 Aircraft Damage: Substantial Defining Event: Loss of engine power (total) Injuries: 1 Fatal Flight Conducted Under: Part 91: General Aviation - Positioning Analysis The pilot was conducting an early morning repositioning flight of the cargo airplane. Shortly after takeoff, the pilot reported to air traffic control that he had “lost an engine” and would return to the airport. Several witnesses reported that the engines were running rough and one witness reported that he did not hear any engine sounds just before the impact. The airplane impacted trees, a wooden enclosure, a chain-linked fence, and shrubs in a residential area and was damaged by the impact and postimpact fire. The airplane had been parked outside for 5 days before the accident flight and had been plugged in to engine heaters the night before the flight. It was dark and snowing lightly at the time of the accident. The operator reported that no deicing services were provided before the flight and that the pilot mechanically removed all of the snow and ice accumulation. The wreckage and witness statements were consistent with the airplane being in a right-wing- low descent but the airplane did not appear to be out of control. Neither of the propellers were at or near the feathered position. The emergency procedures published by the manufacturer for a loss of engine power stated that pilots should first secure the engine and feather the propeller following a loss of engine power and then turn the fuel selector for that engine to “off.” The procedures also cautioned that continued flight might not be possible if the propeller was not feathered.
