This tender is called for competitive bidding to finalize annual rate contract for transportation of goods from our two factories located at Panihati and Manicktala, Kolkata to our various depots and C&Fs located at various places of India. Details of destination location and type of transportation system required is mentioned in bid format. Terms & Conditions

1. All Bids to be submitted in Two Bid system (Techno-Commercial) duly sealed and superscripted with tender no and date. Contents of technical bid must be EMD and filled Annexure-I with all necessary supporting documents and the price bid should contain only the quoted rates as per the price bid format given below in page no: 8 to 19. Only technically qualified bidders price bid will be evaluated. 2. The rate quoted by the party for transportation of goods should be firm. All such rates shall be valid from 01/08/2018 up to 31/07/2019 for All India transportation, transportation of Alum & for Local (Kolkata/WB) transportation. The rates should be inclusive of all charges, including LOADING, UNLOADING, HAMALI, STATISTICAL, TOLL TAX or any other charges required for transportation of goods. The bid should provide break-up of each head to arrive at the quoted rate in the following format:

3. RISK PURCHASE: The Transport contractor shall place their Lorries within 24 hours of intimation to them in case of full truckload dispatches. Company shall have right to apply Risk Purchase Clause in case of Non- placement/refusal of trucks in time for consecutive two occasions i.e. Company will hire vehicles from

other sources and difference of payment will be recovered from pending bills/from earnest money of transporters lying with Company.

4. BCPL may ask L-2 bidder to match the L-1 price to have at least two transporters for each destination, however It is as per BCPL’s discretion only.

5. In case of small consignments of ‘Part Load’ goods are to be lifted by the Transporters from Company’s factory premises on intimation and supply should be affected on “Door Delivery Basis”.

6. No Transshipment will be allowed. If transshipment is proved, BCPL management will be at liberty to impose penalty of Rs. 1,000/- or may discontinue the Annual contract altogether even if the consignment reaches in stipulated time.

7. Transporter will be liable for any loss due to PILFERAGE, DAMAGE, TRANSHIPMENT, THEFT of finished products, raw materials, packing materials. In such case, Company will recover the amount of loss by deducting the amount from the bills of the transporters or from their earnest money lying with Company. In case of accidents and fire during transportation, the matter should be informed to ordering authority of BCPL within 24 hours of occurrence along with Police FIR. In such case, however, Company reserves the right to recover the amount of loss by deducting the amount of loss from the bills of the transporters or from their earnest money.

8. BCPL will not be liable to pay any detention charge for delay caused in unloading at the consignee level. In case however the consignee is a customer, BCPL will negotiate with the customer for the early release of the consignment. If the customers agrees to pay detention charges such charges will be transferred to transporters.

9. Payment will be made by BCPL from Corporate Office, 6, Ganesh Chunder Avenue, Kolkata – 700 013, through NEFT/RTGS within 60 days from the date of receipt of bills supported by documents like delivery challans, C/N and goods received in good conditions or certificate of damage and / or short received. All bills must be submitted at Distribution department, Maniktala / Panihati factory as the case may be.

10. In case of dispatch by full truckload, the transporters are not permitted to transport any other materials, not belonging to BCPL, in the same truck even if some space is available. If transporter is found guilty in such case the BCPL will impose penalty on the transporter as per company’s discretion.

11. The Company reserves the right to accept or reject any or all quotations in part or in full at any time contract without assigning any reason whatsoever.

12. PRICE ESCALATION CLAUSE: Rate revision during the tenure of the Rate Contract may be allowed by BCPL only if the Diesel Price increases/ decreases during the period for more than 10%. This means :

a) Up to 10% increase/ decrease in Diesel Price, no request for Rate Escalation will be entertained.

b) In case of Diesel Price increases/ decreases by more than 10%, a price escalation of the actual percentage of Diesel Price hike over 10% will be considered for payment i.e. if during the R.C. period Diesel Price increases/ decreases for more than 10%, the R.C. Rates will be changed by the differential %, i.e.( Actual hike in % - 10% ). 13. EARNEST MONEY: Earnest Money is to be deposited by the transporter along with the Tender by way of Demand Draft in favour of M/s. Bengal Chemicals & Pharmaceuticals Ltd. payable @Kolkata, amounting (1) Rs. 2, 00,000/- only for All India Depot transportations with or without Alum Transportation (2) Rs. 50,000/- only for Alum Transportation and (3) Rs. 50,000/- and Rs 25,000/- for Local (Kolkata/WB) Transportation.

14. PENALTY CLAUSE: Delay in delivery for more than two days beyond stipulated time for the destination will be charged @ Rs. 2,000/- (Two thousand only) per day (as mentioned in the Tender Paper).

15. If materials are broken/ damaged during loading and unloading period, trade price of such broken/damaged goods will be deducted from transporter’s bill. Similarly in case of short delivery items, value at trade price of such goods will also be recovered from the bills of Transporter.

16. Any Truck without Dispatch Order (D/O) will not be entertained in the Factory. No truck will be allowed to enter into the Factory premises for loading or any other dispatch related job beyond 12 noon generally.

17. BCPL will specify their requirement for Part load / 9MT / 16MT Trucks at least 24 hours before Schedule. Since load cannot be exact, the Transporter must be prepared not to claim any additional amount up to 9100 Kgs. in case of 9MT and 16200 Kgs. in case of 16MT truck. Transporter has to accept some extra load upon request from BCPL.

18. The Transporter’s Representatives / Personnel must properly count C.B. Boxes. Any claim for short receipt will not be entertained on a later date.

19. INSURANCE CLAUSE: For transit insurance if the declared value of damaged/broken/lost (short) delivered products are:

(A) up-to 2% of whole consignment value, no insurance claim can be lodged. In this case the value of damaged/broken/lost (short) delivered products will be deducted from the freight bill of the transporter. The value of the said Broken/Damaged/Lost (short) stocks will be considered as per the rates mentioned in the challan.

(B) For more than 2% of whole consignment value, insurance claim can be preceded. In this case the concerned transporter need to submit the FIR copy, photographs and intimation letter within 24 hours from the occurrence of accident/fire/theft or loss to this office online and submit hard copies of the same at our respective destination at the time of delivery. Amount of insurance claim = Declared value (of damaged/broken/lost [short] delivered products) in the Challan– 2% of whole consignment value.
