OPINION AND ORDER
On August 1, 2005, Buckeye TeleSystem, Inc. (Buckeye), filed an application, pursuant to
the Michigan Telecommunications Act (MTA), MCL 484.2101 et seq., to amend its license to provide basic local exchange service. Buckeye seeks to alter the geographic service area of its license to include the following service areas consisting of portions of Bedford, Erie, Ida,
Summerfield, and Whiteford Townships in Monroe County, Michigan, and a portion of Riga
Township in Lenawee County, Michigan. The proposed service area will consist of an area starting at the Michigan-Ohio state line at a point 3,326 feet east of Clark Road in Whiteford
Township, Monroe County; northerly along this line to Sterns Road; westerly along Sterns Road
to a point 100 feet west of Rodesiler Highway; north along this line to a point 2,961 feet north of
Ottawa Lake Road E.; then easterly along this line to a point 320 feet west of Old US Highway
223; then north to Fike Road; east along Fike Road to a point 1,129 feet east of Old US Highway 223 then south to Temperance Road then; easterly along Temperance Road to US 23; turning
north along US 23 to School Road; turning east to Summerfield Road; turning north to a point
200 feet south of Morocco Road; turning east to Jackman Road; turning south to a point 1,210
feet south of Rauch Road; turning east to Lewis Ave; turning north to Rauch Road; turning east
along Rauch Road to Minx Road; turning south to a point 2,655 feet south of Samaria Road then;
east 1,239 feet then south parallel to Minx Road to Erie Road; then west to Minx Road; then
south to East Sub Station Road; turning east to a line 325 feet east of M-125; turning southwesterly along and 325 feet west of M-125 to the Ann Arbor railroad tracks; then
southeasterly to the Michigan-Ohio state line; and, finally, turning west along the state line to the
starting point 3,326 feet east of Clark Road and the Michigan-Ohio state line. This outline
includes virtually all of Bedford Township, and parts of Whiteford Township, Summerfield
Township, Ida Township, and Erie Township in Monroe County, and parts of Riga Township in
Lenawee County, Michigan. The service area designated above will also include all parcels
abutting the above named roads forming the outside boundary of the service area. The proposed service area also consists of a non-contiguous area in Erie Township known as Lost Peninsula.
This is a small piece of Michigan land that is bordered on the west by the Ottawa River, on the
north and east by Lake Erie, and on the south by Ohio.
Buckeye served a notice of opportunity to comment on other local exchange carriers and all
county clerk offices. No comments were filed by the September 30, 2005 due date.
The Commission finds that approval of (company’s) application is in the public interest.
The expansion of the license is conditioned on compliance with the anti-slamming procedures
adopted in Case No. U-11900, the number portability provisions of the MTA, and the number
reclamation process adopted in Case No. U-12703. Further, the expansion of the license is
Page 2 U-14607 conditioned upon the provision of service to customers in the added exchanges within a reasonable time. Failure to comply fully with those procedures may result in revocation of the license or other penalties.
The Commission FINDS that:
a. Jurisdiction is pursuant to 1991 PA 179, as amended, MCL 484.2101 et seq.; 1969
PA 306, as amended, MCL 24.201 et seq.; and the Commission’s Rules of Practice and
Procedure, as amended, 1999 AC, R 460.17101 et seq.
b. Amending Buckeye’s license to provide basic local exchange service is in the public interest.
THEREFORE, IT IS ORDERED that:
A. The license of Buckeye TeleSystem, Inc., to provide basic local exchange service is amended to include service areas consisting of portions of Bedford, Erie, Ida, Summerfield, and
Whiteford Townships in Monroe County, Michigan, and a portion of Riga Township in Lenawee
County, Michigan.
B. Buckeye TeleSystem, Inc., shall provide basic local exchange service in accordance with the regulatory requirements specified in the Michigan Telecommunications Act, MCL 484.2101 et seq., including the number portability provisions of Section 358, the anti-slamming procedures adopted in Case No. U-11900, and the number reclamation process adopted in Case
No. U-12703.
C. Before commencing basic local exchange service in the areas added to the license by this order, Buckeye TeleSystem, Inc., shall submit its tariff identifying the additional exchanges in which it will offer service.
