Will the Minister of TRIBAL AFFAIRS be pleased to state:-

(a) the details of the centrally sponsored schemes for the welfare of tribals and aborigines and for providing infrastructure facilities like healthcare, roads, housing, education etc.; (b) the details of the funds sanctioned and utilized by the State Governments and Non- Governmental Organisations (NGOs) for the purpose during each of the last three years and the current year, State-wise and Scheme-wise; (c) whether the Government has taken note of complaints on corruption/irregularities/ misappropriation of funds by NGOs during the said period; (d) if so, the details thereof, Scheme-wise and State-wise; and (e) the remedial steps taken by the Government in this regard ?

Statement in reply to Lok Sabha Starred Question No. 149 for 23.3.2012 (a) The Ministry of Tribal Affairs implements the following Centrally Sponsored Schemes (CSS) for the welfare of Scheduled Tribes in the country : (i) Post Matric Scholarships for ST students. (ii) Hostels for ST Boys and ST Girls. (iii) Establishment of Ashram Schools in Tribal Sub-Plan Areas, and (iv) Research, Information and Mass Education, Tribal Festival and others. (b) The details of funds sanctioned and utilized by the State Governments in respect of CSS during each of the last three years and the current year, State-wise and Scheme-wise is at Annexure-I-IV. The details of funds sanctioned and utilized by the NGOs/Universities/ Institutions under CSS of this Ministry is at Annexure-V. The Scheme-wise and State-wise grants released to NGOs/VOs under the Central Sector Schemes are at annexure VI-X. (c) Yes Madam. (d) The details of NGOs against whom complaints have been received is at Annexure-XI. (e) The complaints are inquired into and appropriate action is taken based upon the Inquiry Report.

(a)&(b): The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, administered by the Ministry of Tribal Affairs, seeks to recognize and vest the forest rights and occupation in forest land in forest dwelling Scheduled Tribes and other traditional forest dwellers who have been residing in such forests

for generations but whose rights could not be recorded. Though no specific instance of infringement of tribal rights during natural resources exploitation has come to the notice of the Ministry, complaints have been received over a period of time concerning denial of rights under the Forest Rights Act, 2006 and eviction of tribals from forest etc. These complaints have been sent to respective States/ UTs for taking necessary action as the onus of the implementation of the Act lies with the State Governments/ Union Territory Administrations. (c)&(d): The onus of implementation of the provisions of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, lies with the State Governments/ Union Territory Administrations. Therefore, the State Governments/ Union Territory Administrations have to protect the envisaged forest/tribal rights in case of infringement of these rights including those for natural resource exploitation. Ministry of Tribal Affairs has been interacting with all the State Governments and Union Territory Administrations urging them to ensure that forest rights of Scheduled Tribes and other traditional forest dwellers are recognized and vested in them as per the provisions of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006.

(a): No, Madam. As per the provisions of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 and the Rules framed thereunder, the responsibility for implementing the Act lies with the State/Union Territories Governments. According to the information received from the State/UT Governments, till 29th February, 2012, 31,70,247 claims were filed under the Act, out of which 27,27,684 (86.04%) claims were disposed of. 12,54,668 titles were distributed and 16,052 titles were ready for distribution. (b) & (c): Complaints have been received over a period of time concerning denial of rights under the Forest Rights Act, 2006 and eviction of tribals from forest etc. These complaints have been sent to respective States/UTs for taking necessary action as the implementation of the Act lies with the States/UTs. (d) The Ministry of Tribal Affairs has been interacting with all the State Governments and Union Territory Administrations urging them to ensure that forest rights of the forest dwelling Scheduled Tribes and other traditional forest dwellers are recognized and vested in them as per the provisions of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 at the earliest. Meetings with the concerned officers of the State/UT Governments are also conducted to review the progress of implementation of the Act.

INTEGRATED TRIBAL DEVELOPMENT PROJECT 30th March, 2012

(a): There are 192 Integrated Tribal Development Project (ITDPs)/ Integrated tribal Development Agencies (lTDAs) spread over 19 States/UTs in the country. The Ministry of Tribal Affairs releases grant to the State Governments for the implementation of the schemes/ programmes for Scheduled Tribes meant for their socio-economic development and protection against exploitation. The concerned State Governments implement these schemes/ programmes by releasing funds to their administrative units viz. ITDPs/ITDAs etc and details of funding and implementation of items of work of these schemes/ programmes, are maintained by these States. Since the responsibility of monitoring their administrative units, also rests with the State, such details are not maintained in the Ministry. (b),(c)&(d): Do not arise in view of reply to part (a) above.

(a): Demographic details in respect of people residing in forest areas in the country are maintained by the respective State/ Union Territory Governments. (b): The Ministry administers special area programme of Grant under Article 275(1) of the Constitution for the welfare of Scheduled Tribes including forest dwelling Scheduled Tribes to bridge critical infrastructural gaps focussing on the sectors like roads, health, education, drinking water etc. A part of special area programme of SCA to TSP is also used for integrated development of forest villages in 12 States where forest dwellers reside. The development envisaged is in terms of providing basic minimum facilities and services like safe drinking water, healthcare, primary education, approach roads and other infrastructure facilities. (c): The funds released to States and utilisation reported by them during last three years under special area programmes of grant under Article 275(1) of the Constitution and Special Central Assistance to Tribal Sub-Plan are at Annexures-I & II . No funds have been sanctioned/ released during the current year so far. (a): During 2011-12, a total of 239 proposals for ongoing projects were received against which 154 projects for an amount of Rs. 77.09 crore were sanctioned. This included arrear grants in certain cases. Details of the NGOs and brief nomenclature of the projects are enclosed as Annex. (b) to (d): The objective of partnership with Voluntary Organizations is to supplement Government efforts and to have a wider reach in implementing tribal welfare and development programmes. By implementing projects, Voluntary Organizations have been able to reach beneficiaries also in the remote tribal areas while adding to the coverage by the Government. (e): The number of proposals received and sanctioned for Grant-in-Aid to NGOs during the last three year, State-wise is at Annex. During the current financial year, no release has been made so far.

(a) to (c): The Ministry of Tribal Affairs has received some complaints over a period of time concerning denial of rights under the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006. These complaints have been sent to respective States/UTs for taking necessary action as the responsibility for implementation of the Act lies with the States/UTs. Some complaints alleging eviction of tribal communities from forest land were also sent to the Ministry of Environment & Forests for necessary action. No representation from Papikondalu Tribal eco-development and eco-tourism society in Andhra Pradesh for safeguarding their forest rights has, however, been received in the Ministry.

(b) & (c): The Committee has given its specific findings and recommendations on several aspects of Forest Rights Act which include (i) Implementation of FRA: Process and institutions (ii) Implementation of FRA: Individual Forest Rights (iii) Implementation of FRA: Community Forest Rights (iv) Implementation of FRA: Implementation of Development Projects (v) Implementation for Special Groups (vi) Protected Areas and Critical Wildlife Habitats (vii) Future Structure of Forest Governance (viii) Enhancing Livelihoods through NTFPs (ix) Convergence of Development Programmes for STs and OTFDs. The committee has submitted its Report to the Government which is under examination.

(a) to (e): A statement is laid on the Table of the House. Statement referred to in reply to parts (a) to (e) of Lok Sabha Starred Question No. 108 (8th position) for answer on 17.08.2012 tabled by Shri Arjun Charan Sethi and Shri Pakuri Lal regarding “Forest Rights and Titles” (a): As on 31-07-2012, the number of claims filed for the recognition of forest rights and number of titles distributed under the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, are 32,28,887 and 12,68,766 respectively. The State/UT wise details are at the Annexure. (b) to (e) : The objective of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 is to remedy the historical injustice done to the forest dwelling Scheduled Tribes and other traditional forest dwellers. The Act has substantially met this mandate through distribution of 12,68,766 titles to the eligible claimants under the Act. However, several factors have come to the notice of the Ministry that are impeding the implementation of the Act in its letter and spirit and constraining the flow of intended benefits of this watershed legislation to the eligible forest dwellers. The recognition of community rights such as rights to minor forest produce, grazing areas, water bodies, habitats of Particularly Vulnerable Tribal Groups, pastoralists’ routes remains very low. The rate of rejection of claims is also high. The Ministry accordingly undertook an exercise to arrive at certain provisions/ steps for facilitating robust implementation of the Act. Pursuant to the said exercise, the Ministry has issued guidelines to the State Governments/ Union Territory Administrations on 12.7.2012 for improved implementation of the Act. These guidelines pertain to process of recognition of rights, evidence requirements, rights to minor forest produce, community rights, community forest resource rights, protection against eviction, diversion of forest lands and forced relocation, awareness raising, monitoring and grievance redressal. To facilitate efficacious translation of objectives of the Act, the Ministry has initiated the process of amendments in the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Rules, 2008. The draft Rules titled “The Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Amendment Rules, 2012 has been published in the Gazette of India, Extraordinary, Part II - Section 3 - Sub-section

(i), dated 19.7.2012 for inviting objections and suggestions within one month of its publication from all the persons likely to be affected thereby. The proposed amendments to the Rules relate to laying down a procedure for identification of hamlets or settlements and process of their consolidation, increasing the mandatory Scheduled Tribe membership of Forest Rights Committees from the present one-third to two-third, reducing the present requirement of quorum of two-third in the gram sabha meetings to one-half, clarifying that the term ‘bona fide livelihood needs’ includes fulfillment of livelihood needs of self and family including the sale of surplus produce arising out of exercise of rights, allowing transportation of minor forest produce within and outside forest area through locally appropriate means of transport by gatherers or their cooperatives or associations or federations, laying down the process for recognition of rights including community rights, insertion of new Claim Forms for Rights to Community Forest Resource and Title Form for Community Forest Resources etc. The guidelines issued by the Ministry on 12.7.2012 and the proposed amendments to the Rules, when notified, would lead to better implementation of the Act at the ground level. At present, there is no proposal to amend the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006.

(b): As per the guidelines of the scheme ‘Development of Forest Villages’ which is being implemented as a part of the Special Area Programme ‘Special Central Assistance To Tribal Sub-Plan’, the concerned State Governments frame their monitoring and evaluation mechanism in accordance with the guidelines issued by the National Afforestation and Eco-Development Board (NAEB) of the Ministry of Environment and Forests. The scheme is implemented through the Forest Development Agencies (FDAs). FDAs submit their progress reports to the NAEB through the Principal Chief Conservator of Forests (PCCF) of the respective States. NAEB thereafter, submits the progress report to the Ministry of Tribal Affairs.

(a) & (b): Minor Forest Produce provides essential food, nutrition, medicinal needs and also cash income to the large number of tribal who are living in and around the forest. However, the Minor Forest Produce economy provides poor returns to gatherers. The issue of providing fair price to the gatherers for the Minor Forest Produce has engaged the attention of the Government in recent years. Government has enacted the Scheduled Tribes & Other Traditional Forest Dwellers” (Recognition of Forest Rights) Act, (FRA) 2006. This Act, inter alia, provides right of ownership, access to collect, use & disposal of Minor Forest Produce which has been traditionally collected within or outside the village boundaries. To ensure fair prices to Minor Forest Produce gatherers, there is a provision to give grants-in-aid to the State Tribal Development Cooperative Corporations for Minor Forest Produce operations for which Rs. 20 Crores has been provided in current year’s budget. (c) to (e): The Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 seeks to vest the forest rights on forest dwelling Scheduled Tribes and other traditional forest dwellers who have been residing in such forests for generations. These rights include right to access to collect, use and dispose of the Minor Forest Produce. One of these forest rights also relates to their right to protect, regenerate or conserve or manage any community forest resource which they have been traditionally protecting and conserving for sustainable use.

(a) & (b): The Ministry of Tribal Affairs provides grant-in-aid to State Governments/UT Administrations/ Autonomous Bodies and Non-Governmental Organizations under the Central Sector Scheme of ‘Vocational Training in Tribal Areas’. The main objective of this scheme is to upgrade the skills of ST youth in various traditional/ modern vocations to enable them to gain suitable employment or become self-employed. Funding under the Scheme is availed by setting up and running Vocational Training Centres (VTCs) mainly in remote areas/ rural areas deficient in facilities or by supporting vocational training for STs in already existing institutions in townships/ districts subject to the maximum assistance @ Rs. 30,000/- per annum per ST trainee which includes monthly stipend of Rs. 700/- to the trainees. The vocational training programmes are of one year duration. This scheme is need-based, demand-driven and no State-wise allocation is made. The grant-in-aid to implementing agencies is considered based on the availability of funds under the scheme and receipt of complete proposals as per the provisions of the scheme which inter-alia include recognition/ accreditation of VTCs under ‘Modular Employable Skills” from the Regional Directorate of Apprenticeship Training of State Governments/ UT Administrations or recognition under ‘Craftsmen Training Scheme’ from National Council of Vocational Training. (a) & (b): The Ministry of Tribal Affairs enacted the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 with the objective of remedying the historical injustice done to the forest dwelling Scheduled Tribes and other traditional forest dwellers. The Act has substantially met this mandate through distribution of 12,68,766 titles to the eligible claimants under the Act till 31st July, 2012. However, the number of community rights recognized remains low and the rate of rejection of claims is more than fifty percent. (c) & (d): Complaints have been received over a period of time concerning denial of rights and eviction of tribals from forest etc. These complaints have been sent to respective States/UTs for taking necessary action as the implementation of this Act lies with the States/UTs. (e), (f) & (g): Yes, Madam. Several factors have come to the notice of the Ministry that are impeding the implementation of the Act in its letter and spirit and constraining the flow of intended benefits of this watershed legislation to the eligible forest dwellers. The recognition of community rights such as rights to minor forest produce, grazing areas, water bodies, habitats of Particularly Vulnerable Tribal Groups, pastoralists’ routes remains very low. The rate of rejection of claims is also high. The Ministry accordingly undertook an exercise to arrive at certain provisions/ steps for facilitating robust implementation of the Act. Pursuant to the said exercise, the Ministry has issued guidelines to the State Governments/ Union Territory Administrations on 12.7.2012 for improved implementation of the Act. These guidelines pertain to process of recognition of rights, evidence requirements, rights to minor forest produce, community rights, community forest resource rights, protection against eviction, diversion of forest lands and forced relocation, awareness raising, monitoring and grievance redressal. To facilitate efficacious translation of objectives of the Act, the Ministry has initiated the process of amendments in the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Rules, 2008. The draft Rules titled “The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Amendment Rules, 2012 has been published in the Gazette of India, Extraordinary, Part II - Section 3 - Sub-section (i), dated 19.7.2012 for inviting objections and suggestions within one month of its publication from all the persons likely to be affected thereby. The proposed amendments to the Rules relate to laying down a procedure for identification of hamlets or settlements and process of their consolidation, increasing the mandatory Scheduled Tribe membership of Forest Rights Committees from the present one-third to two-third, reducing the present requirement of quorum of two-third in the gram sabha meetings to one-half, clarifying that the term ‘bona fide livelihood needs’ includes fulfillment of livelihood needs of self and family, including the sale of surplus produce arising out of exercise of rights, allowing transportation of minor forest produce within and outside forest area through locally appropriate means of transport by gatherers or their cooperatives or associations or federations laying down the process for recognition of rights, including community rights, insertion of new Claim Forms for Rights to Community Forest Resource and Title Form for Community Forest Resources etc.

The guidelines issued by the Ministry on 12.7.2012 and the proposed amendments to the Rules, when notified, would lead to better implementation of the Act at the ground level. At present, there is no proposal to amend the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006.

(e) whether there has been no progress at all with regard to the implementation of the said Act in some States including Bihar, Tamil Nadu and Uttarakhand; and

(a) & (b): The recommendations/ suggestions of the Joint Committee of the Ministry of Environment & Forests and Ministry of Tribal Affairs constituted under the Chairmanship of Dr. N.C. Saxena to study in detail the implementation of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 are still under examination.

(c) & (d): As per the provisions of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 and the Rules framed thereunder, the responsibility for implementing the Act lies with the State Governments/ Union Territory Administrations. According to the information received from the State Governments / Union Territory Administrations, the status of implementation of the Act, as on 31st July, 2012, was as under:

The Ministry has issued detailed guidelines on 12.7.2012 to State Governments/ UT Administrations and the process of amendments in the Forest Rights Rules, 2008 has also been initiated to ensure better and effective implementation at the ground level.

(e) & (f): Yes, Madam. There are some States/ UTs, including Bihar, Tamil Nadu and Uttarakhand that are lagging behind in implementation of the Act for various reasons. The status of implementation of the Act in these States/ UTs is indicated in the statement at Annexure.

Therefore, the Scheduled Tribes and Other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 in true sense does not have much relevance to the State of Arunachal Pradesh.

The same has also been notified by the Government of Mizoram on 3.3.2010. 10. Nagaland ------The land holding system and the village system of the Naga people is peculiar in that the people are the land owners. Hence, the Act per se may not be applicable to the State of Nagaland. However, a Committee has been constituted to examine the applicability of the Act in Nagaland as per provision of Art. 371(A) of Constitution of India. 11. Sikkim ------The State Government has issued a notification dated 28.1.2008 regarding constitution of an Expert Committee for identification of Critical Wildlife habitats in Protected Areas (PAs) and has also constituted the various Committees under the Act. However, in Sikkim there are no forest dwelling STs and other Traditional Forest Dwellers in the true sense of the terms. Most of the STs of Sikkim hold revenue land in their own name and they are not solely dependent on the forests for their livelihood.

The tribal reserves have been notified as reserved or protected forest reserve.

As intimated by Planning Commission, there is no proposal to give Special Package in the current financial year for the development of tribal areas. However, backward and tribal districts are covered under the two specific programmes namely, Backward Region Grant Fund (BRGF) and Integrated Action Plan(IAP) for Selected Tribal and Backward Districts of selected states including Odisha. The district component of BRGF covers 19 districts of Odisha including 8 KBK districts. Further, the 8 KBK districts are also covered under the Special Plan for KBK districts. In addition, the IAP which initially covered 15 districts of Odisha presently covers 18 districts, including 8 KBK districts.

(a) to (e): As reported by National Tiger Conservation Authority, Ministry of Environment & Forests, the Government of Andhra Pradesh has notified the Kawal Tiger Reserve, District Adilabad in April, 2012 under the Wildlife (Protection) Act, 1972. The Village relocation from the core/critical tiger habitat is done on voluntary basis under the mutually agreed terms and conditions, as per provisions contained in the Wildlife (Protection) Act, 1972 and Scheduled Tribes and Other Forest Dwellers (Recognition of Forest Rights) Act, 2006 with an enhanced package of Rs.10 lakhs per family. M/o Environment & Forests has informed that it has not received any such proposal from the State.

MSP OF MEDICINAL PLANTS 31st August, 2012

(a) & (b): As per the provision of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, ‘Minor Forest Produce’ includes all non-timber forest produce of plant origin including bamboo, brush wood, stumps, cane, tussar, cocoons, honey, wax, lac, tendu or tendu leaves, medicinal plants and herbs, roots, tubers and the like. However, Dr. T. Haque Committee constituted by M/o Panchayati Raj to look into aspects of Minimum Support Price (MSP), Value addition and marketing of Minor Forest Produce (MFP) in Fifth Schedule Areas, had made certain recommendations about Minimum Support Price (MSP) for the Minor Forest Produce (MFP). Based on these recommendations and to ensure remunerative returns to MFP gatherers, a Central Sector Scheme of MSP for MFP has been contemplated. However, details of such a scheme have not been worked out as yet. (c) & (d): No such proposal has been received from State Governments so far as Ministry of Tribal Affairs is concerned.

IMPLEMENTATION OF FOREST RIGHTS ACT 7th September, 2012

(a) & (b): The issue of providing fair price to the gatherers for the MFPs and economically empowering the forest dwellers and the tribals in particular has engaged the attention of the Government in recent years. Dr. T. Haque Committee was constituted by Ministry of Panchayati Raj to look into aspects of Minimum Support Price (MSP), Value addition and marketing of Minor Forest Produce (MFP) in Fifth Schedule Areas. On the basis of the recommendations of the committee, a Central Sector Scheme of Minimum Support Price for Minor Forest Produce has been contemplated.

(c): The Committee, inter alia, recommended that strategic government intervention is necessary in the form of Minimum Support Price (MSP) for selected Minor Forest Produce. Further, the Committee recommended setting up of a “National Minor Forest Produce Price Commission”, strengthening of the “Tribal Cooperative Marketing Development Federation of India, Ltd. (TRIFED)”, strengthening of State Government Agencies, accountability to Gram Sabha of all Corporations/Federations that undertake MSP operations, amending the laws reflecting clearly the ownership of MFPs by the Gram Sabha etc.

(d): The details of the scheme have not been worked out.

(b): On the recommendation of committee of Secretaries, Ministry of Panchayati Raj constituted a committee under the chairmanship of Dr. T. Haque on 23.08.2010 to suggest appropriate measures for implementation of provisions regarding Ownership, Price Fixation, Value Addition and Marketing of Minor Forest Produce (MFP). The Committee has inter-alia recommended for amendment in State laws and Indian Forest Act, 1927 to clearly reflect the ownership of MFP by the Gram Sabha, fixation of Minimum Support Price, defend MSP at State level, promoting the value addition in MFPs in a participatory manner for ensuring payments to MFP gatherers at par with marked with better prices. Committee has also recommended creation a knowledge base about MFPs.

(c): in view of the replies to parts (a) & (b), this question does not arise.

DISPLACEMENT OF TRIBALS 23rd November, 2012

(b) whether a large scale rejection of claims under the Scheduled Tribes (STs) and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 has resulted in displacement of these tribals;

(c) if so, the details thereof along with the reaction of the Government thereto; and

(d) the action taken/being taken by the Government to protect the rights of these tribals and to compensate and rehabilitate them?

(a) & (b): The Government is aware that displacement of Scheduled Tribe People takes place during various development projects. As per information received from the Department of Land Resources, the National Rehabilitation and Resettlement Policy 2007 has been formulated to address this problem. The Policy provides for addressing the basic minimum requirements in all projects which lead to involuntary displacement. The policy has been circulated to various States/UTs for implementation.

(c) & (d): Displacement of tribals due to rejection of claims under the Scheduled Tribes & Other Traditional Forest Dwellers (Recognition of Forest Right) Act, 2006, has not been reported to the Ministry of Tribal Affairs.

(e): Section 4(5) of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 provides that no member of a forest dwelling Scheduled Tribe or other traditional forest dwellers shall be evicted or removed from forest land under his occupation till the recognition and verification procedure is complete. Further, the Ministry has issued comprehensive guidelines to the State/UT Governments on 12.07.2012 and amended the Forest Rights Rules on 06.09.2012 to ensure that rights of the forest dwelling STs and other traditional forest dwellers are recognized under the Scheduled Tribes & other traditional forest dwellers (recognition of forest right) Act, 2006, and wrongful rejection of claims does not take place.

MINOR FOREST PRODUCE 23rd November, 2012

(e) The time by which these amendments are likely to be made?

(a) to (e): It had been noticed that traditional rights of Forest Dwelling Scheduled Tribes and other Traditional Forest Dweller of ownership, usufruct and management over forest resources had been constrained. The union Government enacted the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 to correct this historic injustice and guaranteed rights to hold and live in the forest land under the individual or common occupation for habitation or for self-cultivation for livelihood; communities rights such as nistar or by whatever name called, including those in erstwhile Princely States, Zamindari or such intermediary regimes; right of ownership access to collect, use and dispose of Minor Forest Produce which has traditional been collected within or outside village boundaries; other communities rights of uses or entitlements such as fish and other products of water bodies, gazing and traditional seasonal resource access of nomadic and pastrol communities; rights including community tenures of habitat and habitation of PTGs and pre-agricultural communities; rights in or over disputed lands under any nomenclature in any States where claims are disputed; rights for conversion of Pattas or grants issued by any local authority or any State Government on forest lands to titles; rights of settlement and conversion of all forest villages, old habitations, unsurveyed villages and other villages in forest, whether recorded, notified or not into revenue villages, right to protect, regenerate or conserve or manage any community forest resource which they have been traditionally protecting and conserving for sustainable use; rights which are recognized under any state law or laws of any Autonomous District Council or Autonomous Regional Council or which are expected as rights of tribals under any traditional or customary law of the concerned tribes of any State; rights of access to by biodiversity and community rights to intellectual property and traditional knowledge related to biodiversity and cultural diversity; any other traditional right customarily enjoyed by the forest dwelling Scheduled Tribes or Other traditional forest dwellers but excluding the traditional right of hunting or trapping or extracting part of the body of any species of wild animal; right to in-situ rehabilitation including alternative land in cases where the Scheduled Tribes and Other traditional forest dwellers have been illegally evicted or displaced from any forest land of any description without receiving their legal entitlement to rehabilitation prior to the 13th day of the December, 2005.

Appropriate changes in Rules have been brought about on 06.09.2012 and guidelines have been issued on 12.07.2012 to ease out the problems and hindrances encountered in the implementation of the Act, and to provide unencumbered access to rights already conferred by the Act.

The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Amendment Rules, 2012 notified by the Ministry on 06.09.2012 provide for (1) disposal of Minor Forest Produce with in and outside forest areas through appropriate mines of transport, (ii) Modification of the transit permit regime in relations to transportation of Minor Forest Produce and issue of the transit permit by a committee constituted by the Gram Sabha or the person authorized by the Gram Sabha and (iii) making the collection of the Minor Forest Produce free of all royalties or fees or another charges. The guidelines issued by the Ministry on 12.07.2012 inter-alia requires the State Government to ensure recognition of the forest rights relating to Minor Forest Produce and to bring the State Policies in alignment with the provision of Scheduled Tribes and Other Traditional Forest Dwellers) Act, do away the monopoly for the Forest Corporations in the trade of minor forest produce in the States, p lay the facilitation role in not only transferring unhindered absolute rights over minor forest produce to forest dwelling Scheduled Tribes and Other Traditional Forest Dwellers but also in getting them remunerative price for the minor forest produce collected and processed by them.

(a)&(b) : The Ministry of Tribal Affairs implements a Centrally Sponsored Scheme of “Establishment of Ashram Schools in Tribal Sub Plan Areas”. As per the provisions of the scheme in the Tribal Sub-Plan Areas, 100% central assistance is provided for construction of all ST girls’ ashram schools and boys’ ashram schools in naxal-affected districts identified by Ministry of Home Affairs from time to time and for boys’ ashram schools other than in naxal- affected districts only, 50% of the total estimated cost is shared by the Ministry. Under the scheme, only construction cost is provided in full or shared by the Ministry. The running and maintenance of these ashram schools including filling up of vacancies of teachers is solely the responsibility of the concerned State Government/UT Administration.

(b) The Andaman and Nicobar Islands (Protection of Aboriginal Tribes) Regulation, 1956 (PAT), amended vide “the Andaman and Nicobar Islands (Protection of Aboriginal Tribes) Amendment Regulation, 2012 and notified in the Gazette of India on 2-7-2012 and further notified in the Andaman & Nicobar Gazette was brought into force w.e.f. 9.7.2012, making provisions for stringent punishment including imprisonment for exploitation of tribal communities in the Andaman & Nicobar Islands.

(c) Yes Madam.

(d) Under Section 8 of the principal Regulation, stringent penal provisions has been included for violations:- (i) 3 years imprisonment and fine in the event of taking photograph/videos of aboriginal tribes; encroaching, hunting and poaching in reserve area; promoting tourism through advertisement on aboriginal tribes; setting up of commercial/tourist establishment in the Buffer Zone. (ii) 7 years imprisonment and fine in the event of introducing of any form of Alcohol/intoxication & any inflammable or explosive substances to aboriginal tribes.

NATIONAL COMMITTEE ON FOREST RIGHTS ACT, 2006 7th December, 2012

(a) to (c): The Ministry of Environment & Forests and the Ministry of Tribal Affairs had constituted a Joint Committee in April 2010 to study in detail the implementation of the Forest Rights Act, 2006 (FRA) including factors that were aiding/ impeding its implementation and recommend necessary policy changes in the future management of the forestry sector in India which might be necessary as a consequence of the implementation of the

Forest Rights Act. The Committee has submitted its report to the Government. The report includes inter-alia recommendations/ suggestions relating to process and institutions of the FRA, individual and community forest rights, future structure of forest governance, enhancing livelihoods through non-timber forest produce and convergence of development programmes for tribals and forest dwellers. The recommendations/ suggestions of the Committee are under examination.

NON-TIMBER FOREST PRODUCE 7th December, 2012

(b) to (e): The Ministry of Panchayati Raj had constituted a committee under the chairmanship of Dr. T. Haque on 23.08.2010 to suggest appropriate measures for implementation of provisions regarding Ownership, Price Fixation, Value Addition and Marketing of Minor Forest Produce (MFP). This committee has since submitted its report. It recommends introduction of Minimum Support Price for 13 MFPs. However, details of the scheme for introduction of Minimum Support Price of NTFPS have not been finalized.

TRIBALS IN FOREST AREAS 7th December, 2012

(a) & (b) : This Ministry is implementing a programme for development of Forest Villages since 2005-06 for integrated development of forest villages with a view to raise the Human Development Index (HDI) of the inhabitants of the Forest Villages and for providing basic facilities and services in 2,474 forest villages/ habitations spread over 12 States. Under the programme, infrastructure work relating to basic services and facilities viz. approach roads, healthcare, primary education, minor irrigation, rainwater harvesting, drinking water, sanitation, community halls, etc. are taken up for implementation. So far, this Ministry has released Rs.65379.04 lakh for the development of these forest villages.

(c): To assess the specific effect of the programme of development of Forest Villages on the lives of tribals, no specific study has been conducted as yet.

RIGHTS OVER FOREST RESERVES 7th December, 2012

(d) the steps taken by the Union Government to resolve the conflict;

(e) whether there is any proposal to handover forests to gram sabhas; and

(f) if so, the details thereof?

(a): The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (in short, Forest Rights Act, 2006), administered by the Ministry of Tribal Affairs, seeks to recognize and vest the forest rights and occupation in forest land in forest dwelling Scheduled Tribes and other traditional forest dwellers who have been residing in such forests for generations but whose rights could not be recorded. The forest rights of the forest dwelling Scheduled Tribes and other traditional forest dwellers recognized under the Act inter alia include(i) the right of ownership, access to collect, use, and dispose of minor forest produce which has been traditionally collected within or outside village boundaries, and (ii) right to protect, regenerate or conserve or manage any community forest resource which they have been traditionally protecting and conserving for sustainable use.

(b) to (d): Yes, Madam. There is some conflict between the Forest Rights Act, 2006 and the Indian Forest Act, 1927. Section 2 (i) of the Forest Rights Act, 2006 defines the term “minor forest produce” to inter alia include bamboo, brush wood, stumps and cane, whereas Section 2(7) of the Indian Forest Act, 1927 defines bamboos as trees, which also includes palms, stumps, brush wood and canes. The Ministry of Environment & Forests, at the level of the then Minister of State (I/C) Environment & Forests, has issued an advisory to the all Chief Ministers on 21.3.2011, bringing to their notice the legal provisions of the Forest Rights Act, 2006 and requested them to direct the State Forest Departments to treat bamboo as a minor forest produce and respect the rights accrued to communities as per the Forest Rights Act, 2006.

(e) & (f): There is no proposal under the consideration of the Ministry of Tribal Affairs to hand over forests to Gram Sabhas. The Forest Rights Act, 2006, however, empowers the holders of any forest right, Gram Sabha and village level institutions in areas where there are holders of any forest right under this Act to inter alia protect the wildlife, forest and bio-diversity and ensure that the decisions taken in the Gram Sabha to regulate access to community forest resources and stop any activity which adversely affects the wild animals, forests and the bio- diversity are complied with.

CLASSIFICATION OF BAMBOO 7th December, 2012

(a) to (d): As reported by Ministry of Environment & Forests, the Sub-Section (7) under Section 2 of the Indian Forest Act, 1927, defines “tree” which includes bamboos. The clause (b) (i) under Sub Section 4 of the Section 2 of IFA, 1927 defines “forest produce” which include trees. Under section 2 (i) of the Scheduled Tribes and Other Traditional Forest Dwellers (recognition of Forest Rights) Act (FRA), bamboo has been included as minor forest produce which covers all non-timber forest produces of plant origin.

The Indian Forest Act, 1927 provides for protection and sustainable management of forest produce as defined under the Act, including bamboo to meet the provisioning needs and livelihood sustenance of the forest dwelling communities including tribals. The FRA recognizes and vests certain forest rights in forest dwelling Scheduled Tribes and other traditional forest dwellers who have been residing in such forests for generations.

BAN ON EXPLOITATIION OF MFP FOR TRIBALS 7th December, 2012

(f) the funds sanctioned, released and utilised by the State Governments under various welfare themes for the forest dwellers during each of the last three years and the current year?

(a): Demographic details in respect of the people residing in the forest areas in the country are maintained by the respective State Governments / Union Territory Administrations.

(b) to (c): The schemes/ programmes implemented by the Ministry of Tribal Affairs are meant for the socio- economic development of all the Scheduled Tribes in the country, including those living in the forest areas. This Ministry is implementing a programme for development of forest villages since 2005-06 for integrated development of forest villages with a view to raise the Human Development Index (HDI) of the inhabitants of the Forest Villages and for provision of basic facilities and services in 2,474 forest villages/ habitations spread over 12 States. Under the programme, funds are released out of Special Central Assistance to Tribal Sub-Plan for infrastructure work relating to basic services and facilities viz. approach roads, healthcare, primary education, minor irrigation, rainwater harvesting, drinking water, sanitation, community halls, etc. for development of Forest Villages.

(d) to (e) : The Union Government took note of the fact that the forest dwellers had been precluded from asserting their genuine claims to forest resources which traditionally belonged to them. The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 was enacted to recognize and vest the forest rights and occupation in forest land in forest dwelling Scheduled Tribes and other Traditional Forest Dwellers who have been residing in such forests for generations but whose rights could not be recorded. This Act not only recognizes the right to hold and live in the forest land under the individual or common occupation for habitation or for self-cultivation for livelihood but also grants several other rights to ensure their control over forest resources which inter alia include right of ownership, access to collect, use, and dispose of minor forest produce; community rights such as nistar; habitat rights for primitive tribal groups and pre-agricultural communities; right to protect, regenerate or conserve or manage any community forest resource which they have been traditionally protecting and conserving for sustainable use.

Appropriate changes in the Rules have been brought about on 06.09.2012 and guidelines have been issued on 12.07.2012 to ease out the problems and hindrances encountered in the implementation of the Act, and to provide unencumbered access to rights already conferred by the Act.

(f): The funds allocated to the State Governments and utilization reported by them during the last three years and the current year under the development of forest villages programme is at Annexure.
