UNIFORM LAWS RECOMMENDATIONS Chairman Hogue called on Representative Klemin, Commissioner, North Dakota Commission on Uniform State Laws, for testimony regarding Recommendations of the North Dakota Commission on Uniform State Laws - 2017 Legislative Session. He said the commission recommended five uniform Acts for introduction during the 2017 legislative session and is tentatively recommending one uniform Act. Because the state has a similar statute, he said, the commission is tentatively recommending the Uniform Power of Attorney Act. He said the commission members will consult with interested parties to determine whether to introduce the Uniform Power of Attorney Act, which seeks to preserve the durable power of attorney as a low-cost, flexible, and private form of surrogate decisionmaking while deterring use of the power of attorney as a tool for financial abuse of incapacitated individuals.

JAEGER December 3, 2018 In accordance with Section 54-03-03 of the North Dakota Century Code, I certify the enclosed list is a true and correct record of members of the House of Representatives elected in the General Election held on November 6, 2018. The State Canvassing Board certified the results of the election on November 16, 2018. As specified in Section 16.1-15-45 of the North Dakota Century Code, Certificates of Election were then prepared by the Secretary of State and signed by the Governor, the Clerk of the Supreme Court (as the designated representative of the State Canvassing Board), and the Secretary of State. Each newly elected member of the Legislative Assembly was then issued their Certificate of Election (copies enclosed), as specified in Section 16.1-15-46 of the North Dakota Century Code. In addition, in accordance with Section 4, Article XI, of the North Dakota Constitution, an Oath of Office (or affirmation) form was provided to each Representative, with instructions to execute the Oath before a Notary Public and file it with the Secretary of State before he or she assumes the duties of their office. Subcommittee Minutes: Testimony 1 Chairman Koppelman opened the hearing. Aaron Burst, Association of Counties testified in support of the bill. I have a proposed amendment. The grand jury system in NO is not usable by state prosecutors primarily because of some language that I am suggesting changing. Rep. Delmore: Can you tell me why you are using a percent for the number of signatures needed instead of a required number? Burst: It is harder to use a numbers-basis due to population fluctuations. Rep. Paur: Is there a mechanism in the process now? Burst: In the case where the state's attorney refuses to do their job, there should be some sort of citizen's aspect. Rep. Kasper's bill leaves in a citizen component; it just changes the thresholds. Secondly, there are parts in the code already that allow the citizen to petition for failure to the state's attorney to do their duty. Rep. Klemin: Does the amendment refer to a grand jury procedure when a private citizen is the subject of the inquiry, whereas the bill covers conditions of public prisons in the county or misconduct of public officials? Are there two focuses on what the grand jury is to do? Burst: Correct. Rep. Klemin: Does the term public prisons include the state penitentiary in Burleigh County? Burst: It would have to include the Department of Corrections.

ASSIGNMENT OF ADDITIONAL COMMITTEE RESPONSIBILITY Senator Holmberg, Chairman, Legislative Management, said he is assigning the committee an additional responsibility to review the potential purchase of the Research Enterprise and Commercialization Building on the campus of the University of North Dakota. He said the building was originally financed and constructed by a nonprofit entity. He said the Legislative Assembly through Section 23 of 2013 Senate Bill No. 2003 authorized the State Board of Higher Education to enter a purchase and financing agreement with a private entity to purchase the building using donations, gifts, or other funds. He asked the committee to review the status of the building purchase, including the source of any funds used in the purchase.

Minutes: achments 1-5 Representative Sebastian Ertelt, Sponsor: (Attachment 1) (6:25) Representative Skroch: In the clarification of the word "maintenance", what type of projects does it apply to? Representative Ertelt: The word "maintenance" is not found in this definition. The term is used within this chapter of law. Cleaning out and repairing would be maintenance. It talks about obstructions or sediment being cleaned out to get the drain to what it was originally. Representative Headland: "Not to exceed its original function." What does that mean? Are you trying to say you don't want more water moved than originally planned? What if deeper and wider is needed? Representative Ertelt: That is why design is included to what it was before. This language doesn't prohibit from widening or deepening a drain. If it is beyond the current design, the more formal process would need to be followed. Representative Headland: Your intention is to not allow any more development on a drain. It is limited to its original design Representative Ertelt: I am not one to prohibit progress. Widening and deepening may need to occur. If you are moving more water, than use the process. Representative Satrom: Do we have a problem with people widening and then causing problems for those downstream? Representative Ertelt: You will hear from some that are affected even though they are not downstream.
