4 Economic Regulation of Utility Infrastructure Janice A. Beecher ublic infrastructure has characteristics of both public and private goods and earns a separate classification as a toll good. Utilities demonstrate a Pvariety of distinct and interrelated technical, economic, and institutional characteristics that relate to market structure and oversight. Except for the water sector, much of the infrastructure providing essential utility services in the United States is privately owned and operated. Private ownership of utility infrastructure necessitates economic regulation to address market failures and prevent abuse of monopoly power, particularly at the distribution level. The United States can uniquely boast more than 100 years of experience in regulation in the public in- terest through a social compact that balances and protects the interests of inves- tors and ratepayers both. Jurisdiction is shared between independent federal and state commissions that apply established principles through a quasi-judicial pro- cess. The commissions continue to rely primarily on the method known as rate base/rate-of-return regulation, by which regulators review the prudence of in- frastructure investment, along with prices, profits, and performance. Regulatory theory and practice have adapted to emerging technologies and evolving market conditions. States—and nation-states—have become the experimental laborato- ries for structuring, restructuring, and regulating infrastructure industries, and alternative methods have been tried, including price-cap and performance regu- lation in the United Kingdom and elsewhere. Aging infrastructure and sizable capital requirements, in the absence of effective competition, argue for a regula- tory role. Title 61 Public Utility Regulation Chapter 1
TITLE 61 PUBLIC UTILITY REGULATION CHAPTER 1 PUBLIC UTILITIES LAW -- APPLICATION AND DEFINITIONS 61-101. Title and application. This act shall be known as "The Public Utilities Law" and shall apply to the public utilities and public services herein described and to the commission herein referred to. 61-102. Commission. The term "commission" when used in this act means the Idaho public utilities commission. 61-103. Commissioner. The term "commissioner" when used in this act means one of the members of the commission. 61-104. Corporation. The term "corporation" when used in this act includes a corporation, a company, an association and a joint stock association, but does not include a municipal corporation, or mutual nonprofit or cooperative gas, electrical, water or telephone corporation or any other public utility organized and operated for service at cost and not for profit, whether inside or outside the limits of incorporated cities, towns or villages. 61-105. Person. The term "person" when used in this act includes an individual, a firm and a copartnership. 61-106. Transportation of persons. The term "transportation of persons" when used in this act includes every service in connection with or incidental to the safety, comfort, or convenience of the person transported and the receipt, carriage and delivery of such person and his baggage. 61-107. Transportation of property. The term "transportation of property" when used in this act includes every service in connection with or incidental to the transportation of property, including in particular its receipt, delivery, elevation, transfer, switching, carriage, ventilation, refrigeration, icing, dunnage, storage, and handling, and the transmission of credit by express corporations. -

Introduction The purpose of this essay is to critically examine Friedrich Hayek’s broadside against the conceptual intelligibility of the theory of social or distributive justice. This theme first appears in Hayek’s work in his famous political tract, The Road to Serfdom (1944), and later in The Constitution of Liberty (1960), but he developed the argument at greatest length in his major work in political philosophy, the trilogy entitled Law, Legis- lation, and Liberty (1973-79). Given that Hayek subtitled the second volume of this work The Mirage of Social Justice,2 it might seem counterintuitive or perhaps even ab- surd to suggest the existence of a genuinely Hayekian theory of social justice. Not- withstanding the rhetorical tenor of some of his remarks, however, Hayek’s actual con- clusions are characteristically even-tempered, which, I shall argue, leaves open the possibility of a revisionist account of the matter. Summary hile many states and localities are turning to privatization as a way to provide services to their citizens, surprisingly little is known about these choices. Much of the debate over Wprivatization pays little attention to the rationales and consequences of private vs. public service provision. With an eye toward advancing understanding about privatization, the University of Michigan’s Offi ce of Tax Policy Research (OTPR) and Center for Local, State, and Urban Policy (CLOSUP) sponsored a series of studies on privatization. This empirically grounded research can provide policymakers with a sound basis for assessing whether and how privatization should be undertaken. This report begins by providing a historical background of privatization and a discussion of the nature and prevalence of privatization in the United States. Section II provides an overview of the empirical research on cost savings, quality, equity, employment, and political effects of privatization. The fi ndings from the papers commissioned by OTPR and CLOSUP are presented alongside fi ndings from other previously published research. Our review of the literature suggests the following conclusions about privatization: • Private providers may or may not be more effi cient than public providers. Whether privatization leads to greater cost savings depends largely on whether there is competition in service provision. • The quality of privatized services may or may not be higher than publicly provided services. Gov- ernments can play an important quality assurance role by monitoring and evaluating the delivery of privatized services. -

U.S. Environmental Protection Agency State Climate and Energy Technical Forum Background Document An Overview of PUC s for State Environment and Energy Officials May 20, 2010 Public utility commissions (PUCs) regulate electric, gas, telecommunications, water and waste water utilities. In most states a single agency will regulate these sectors; however, in some states these functions may be split between more than one agency. Commissioners are typically appointed by the governor and generally serve 4 to 6 year terms, although in approximately one quarter of the states commissioners are elected. As a general rule, utility commissions are charged with assuring that utilities provide reasonable, adequate and efficient service to customers at just and reasonable prices. Utility regulation takes many forms, including price regulation, resource planning and acquisition, reliability and quality of service regulation. PUCs typically regulate all investor-owned utilities (IOUs) in their state. Municipal and cooperative utilities are often exempted from PUC regulation or have limited regulation. Focusing on electric utility regulation, this document will explore the responsibilities of PUCs, their decision making processes, how their decisions can affect clean energy1 and air quality. Each of these public goods presents global challenges and potential remedies to promote economic development. Without these goods, developing countries are unable to compete, prosper or attract capital from abroad. The undersupply of these goods may affect prospects for economic development, threatening global economic stability, peace and prosperity. The need for public goods provision is also recognized by the Millennium Development Goals, internationally agreed goals and targets for knowledge, health, governance and environmental public goods. Because of the characteristics of public goods, leaving their provision to market forces will result in their under provision with respect to socially desirable levels. Coordinated social actions are therefore necessary to mobilize collective response in line with socially desirable objectives and with areas of comparative advantage and value added. International public goods for development will grow in importance over the coming decades as globalization intensifi es. Corrective policies hinge on the goods’ properties. There is no single prescription; rather, different kinds of international public goods require different kinds of policies and institutional arrangements. The Report addresses the nature of these policies and institutions using the modern principles of collective action. Group Size and Collective Action: Third Party Monitoring in Common
COMPARATIVEAgrawal, Goyal / THIRD-PARTYPOLITICAL STUDIES MONITORING / February 2001 This article examines the hypothesis that group size is inversely related to successful collective action. A distinctive aspect of the article is that it combines the analysis of primary data collected by the authors with a game-theoretic model. The model considers a group of people protecting a commonly owned resource from excessive exploitation. The authors view monitoring of indi- vidual actions as a collective good and focus on third-party monitoring. We argue that the costs of monitoring rise more than proportionately as group size increases. This factor along with lumpiness in the monitoring technology yields the following theoretical conclusion: Medium-sized groups are more likely than small or large groups to provide third-party monitor- ing. The authors find that the empirical evidence is consistent with this theoretical result. Introduction Digital media allowed for the emergence of new artistic practices and innovative modes of production. In particular, the advent of Internet and digital technologies drastically enhanced the ability for multiple au- thors to collaborate towards the creation of large-scale collaborative works, which stand in contrast to the traditional understanding that artistic production is essentially an individual activity. The signi6cance of these practices in the physical world is illustrated by the recent deployment of FabLabs (Fabrication Laboratories), that employ innovative technologies – such as, most notably, 3D printing, which is recently gaining the most interest – to encourage the development of new methods of artistic production based on participation and interaction between peers. -

Introduction Integrated water resources management seeks an efficient blend of all water resources (e.g., fresh surface water, groundwater, reused water, desalinated water) to meet the demands of the full range of water users (e.g., agriculture, municipalities, industry, and e-flows). Water scarcity and droughts already affect many regions of the world and are expected to increase due to climate change and economic growth. In this Special Issue, 10 peer-reviewed articles have been published that address the questions regarding the economic effects of water scarcity and droughts, management instruments, such as water pricing, water markets, technologies and user-based reallocation, and the strategies to enhance resiliency, adaptation to scarcity and droughts. There is a need to improve the operation of institutions in charge of the allocation and re-allocation of resources when temporal (drought) or structural over-allocation arises. Water scarcity, droughts and pollution have increased notably in recent decades. A drought is a temporary climatic effect or natural disaster that can occur anywhere and can be short or prolonged. -
