1. Description of Proposed Development A new build community facility to include access and car-parking from Fairview Road. Single storey comprising 860m2 of floor space.

2. EIA Determination The proposed site area is 0.65ha and above the threshold of 0.5ha. An EIA Determination was carried out and concluded it is unlikely that this new build community facility will have a significant environmental impact.

3. Site and Surrounding Area The application site comprises an area of informal open space, located off Fairview Road, to the south of Ederowen Park, east of Knockalla Park and west of St. Joseph’s RC Church. The site is within the Settlement Development Limits of Derry. The surrounding Appendix 10 area is typically characterised by residential properties. There is also a shop, including a Post Office and pharmacy, to the south of the application site.

Provided conditions and informatives which should be included in any planning approval.

8.2 NI Water are content with the proposal. Appendix 10

14.04.17 - In response to consultation dated 27th March 2017 NIW stated “Although it has been determined if NIW infrastructure is within 20m of your proposal, consultation with NIW is required at an early design stage by means of a Predevelopment Enquiry to obtain details of the availability of existing water and sewerage infrastructure and how their proposal may be serviced.”

8.3 Environmental Health are content with the proposal. 10.07.17 - In response to consultation dated 27th March 2017 EHD have provided comments on construction noise/dust, noise, odour and food hygiene. 06.10.17 - In response to consultation dated 26th September 2017 No further comment to make. Refer to previous consultation response dated 10/07/17.

8.4 Rivers Agency 20.10.18 - In response to consultation dated 26th September 2017 Provides comment on a working strip. Drainage Assessment requested. 28.02.18 - In response to consultation dated 19th January 2018 Provides comment on a working strip. The Drainage Assessment fails to meet the requirements of PPS 15. Amendments were requested. 23.05.18 - In response to consultation dated 29th March 2018 The Drainage Assessment fails to meet the requirements of PPS 15. Amendments were requested. 07.08.18 - In response to consultation dated 3rd August 2018 Regarding Drainage Assessment Revision C – Details of how runoff from the site will be controlled and safely disposed of supported by relevant correspondence from NI Water has been submitted as part of the drainage assessment. DfI Rivers accepts the reports logic and has no reason to disagree with its conclusions. DfI Rivers cannot sustain a reason to object to the proposed development from a drainage or flood risk perspective. The responsibility for the accuracy, acceptance of the Drainage Assessment and implementation of the proposed flood risk measures rests with the developer and their professional advisors. DfI Rivers recommends that this and the attenuation of stormwater to a rate of 43l/s is made a condition of any planning consent. Under the terms of Schedule 6 of the Drainage (Northern Ireland) Order 1973 the applicant must submit to DfI Rivers, for its consent for any proposal to carry out works which might Appendix 10

affect a watercourse such as culverting, bridging, diversion, building adjacent to or discharge of storm water etc.

8.5 Loughs Agency 15.05.17 - In response to consultation dated 27th March 2017 No objection in principle to the proposed development.

9. Representations 282 objections have been received. 9.1 Residents of Knockalla Park/Ederowen Park objected for the following reasons:  Anti-social behaviour – gathering of young people.  Road leading to the Centre will take away the only green area that is safe for the children of the Knockalla/Ederowen areas. Serous concerns for the safety of children who normally play in this area.  No consideration for older people living in the area, already concerned about anti-social behaviour and worried about bringing more young people together to escalate this problem. This could be avoided by re-locating to the area at the bottom of Fairview Road.  Why the community centres situated in the Chapel grounds and are not enough for the area.

9.2 Knockalla Action Group raised a number of concerns including:  The consultation was not published in the local newspapers or advertised well enough.  The leaflets were delivered by members of the Galliagh Women’s Group who have an interest in the building as they are one of the five groups going into the centre.  The consultation really should have took what the local community wanted not just to vote where the Community Centre was going.  The consultation was done on 26/11/14 and Council did not receive it until 02/03/17 so that consultation would be out of date.  The Knockalla Action group have canvassed Knockalla Park on 04/09/17 and the response has been overwhelming from the community who do not want the Appendix 10

Galliagh Community Centre at the back of the Co-Up shop in the Fairview Road. Will canvass the Ederowen Park on 11/09/17.  Letters were sent in in support of the resident’s objections who disagree to this being build and furthermore knew nothing about this being built.

9.3 Letter on behalf of residents from Knockalla Park and Ederowen Park, addressed to the Planning Committee:  Have received letters about amended plans and cannot understand why and how this is still going on. Would be interested to know and understand the decision making process as 280 people signed and dated signatures disagreeing with this proposal.  Cannot understand how between 9 and 26 people suggested this area when 280 disagree.  Please reconsider the area again, as we have suggested before there are other areas where this would be more suitable and clearly seen.

9.4 Letter for and on behalf of the Knockalla/Ederowen residents:  Unable to locate amended plans on website  Position of the Knockalla/Ederowen residents has not changed. We do not want a Community Centre built behind the Co-op on the Fairview Road, Derry.  Flooding – Flood issues regarding the houses from 67-72 if the road is built at a higher elevation than what is currently there it is obvious that there is going to be more flooding. House numbers 62 to 66 and the houses below them, like Mrs McCartney’s, will be at risk of more flooding because of the Community Centre being built.

10. Planning Assessment, including Other Material Considerations Section 6 (4) of the Planning (Northern Ireland) Act 2011, requires the Council to make planning decisions in accordance with the area plan for the council area unless material considerations indicate otherwise.

This proposal has therefore been assessed against the policy framework listed in paragraph 7 above and all other material considerations including consultation responses and relevant planning history. Appendix 10

10.1 Strategic Planning Policy Statement for Northern Ireland The SPPS introduces transitional arrangements which will operate until the Council’s Plan Strategy has been adopted. During this period Planning Authorities will apply existing policy (in this case PPS 8 - the retained policy) together with the SPPS. Any conflict between the SPPS and the retained policies must be resolved in favour of the SPPS. There is no conflict or change in policy direction between the provisions of the SPPS and those of PPS 8. PPS 8 therefore remains the applicable policy context under which to consider the proposed development.

The SPPS supports good design and positive place-making. In terms of design and visual impact, the proposal is acceptable. This proposal would be in keeping with the residential character of the area.

10.2 Derry Area Plan 2011 The Derry Area Plan 2011 applies in this case. The site is located within the development limits of Derry. Policy BE1 – ‘Urban Design’ therefore applies. This policy requires development proposals to make a positive contribution to townscape and be sensitive to the character of the area surrounding the site in terms of design, scale and use of materials. As the proposed site is on unzoned “white land” in DAP 2011, Policies R1 and R2 regarding Recreation and Open Space do not specifically apply and PPS 8, Policy OS 1 is the relevant policy test for the proposal located on existing unzoned open space.

This proposal does make a positive contribution to townscape. The proposed single storey community facility is sensitive to the character of the surrounding residential area in terms of design, scale, massing and materials. This proposal meets Policy BE1.

10.3 PPS 8: Open Space, Sport and Outdoor Recreation Policy OS 1 ‘Protection of Open Space’ states that development will not be permitted that would result in the loss of existing open space or land zoned for the provision of open space. The presumption against the loss of existing open space will apply irrespective of its physical condition and appearance. An exception will be permitted where it is clearly shown that redevelopment will bring substantial community benefits that decisively outweigh the loss of the open space.

Appendix 10

The application site is on unzoned “white land” in the Derry Area Plan 2011. The site is comprised of part of an open grassed area and is considered an “amenity green space” of public value as defined in Annex A of Planning Policy Statement (PPS 8) ‘Open Space, Sport and Outdoor Recreation’, and therefore Policy OS 1 applies. Policy OS 1 advises a presumption against the loss of existing open space will apply irrespective of its physical condition and appearance. However an exception is permitted where it is clearly shown that redevelopment will bring substantial community benefits that decisively outweigh the loss of open space. The policy amplification in para 5.5 advises that in such cases (exceptions), applicants will be generally be expected to demonstrate that their proposals are supported by the local community.

This proposal will result in fragmentation of the existing open space and some loss of open space, however it will bring substantial community benefits that decisively outweigh the loss of the open space. The proposal is a multi-purpose hub for community groups and includes offices, a multi-purpose area, a social/café area, a computer suite and therapy room. The initial proposal involved siting the community facility south of 21 and 22 Ederowen Park. The proposed siting was amended on 8th September 2017 following a meeting with residents, and the proposed community facility will be positioned on the eastern side of the site. The reasoning for this was to retain as much open space as possible and to move the proposed community centre away from the pensioner bungalows. Pedestrian link footpaths are proposed which will link Knockalla Park and Ederowen Park to both the remaining open space and the proposed new community facility. Sufficient open space, approximately two thirds of the existing open space, will remain once the community centre and car park are developed. It is noted that the following groups are to move into the proposed centre and vacant their current premises:

1) Galliagh Womens Group

2) Off the Streets

3) Teach Na Failte

4) CRJ

5) Galliagh Community Development

All of the groups listed with the exception of Teach Na Failte currently occupy dwellings within the area, (Galliagh Women’s Group occupy 2 dwellings) therefore once they move Appendix 10

into the proposed centre, this will free up approximately 5 social housing units. This will also benefit the community.

Therefore on balance, the proposal accords with Policy OS 1 of PPS 8 and the DAP, as the proposal will bring substantial community benefits which decisively outweigh the loss of open space. The community objections are considered and valid planning matters addressed and further considered below.

10.4 It is noted there have been 282 objections made on this application. The main points made by the objectors are summarised at ‘Section 9. Representations’ above and considered below:  Anti-social behaviour is not a material planning consideration. Re-siting was proposed with the revised scheme and the proposed community centre is now sited further away from the pensioners’ bungalows.  The Community Centre referred to within the Chapel grounds is run by the Church. The Community Centre at Lenamore referred to is an Education Authority Centre located on Lenamore Road and is not within walking distance of this proposal. It is approximately 16 minutes’ walk away via Glencaw Park. This proposal is for a Council facility. Current local community facilities are limited in their provision, both in size and the capacity to accommodate activities and services, or are not available or accessible in the evenings and weekends.  Children’s play – there is an equipped Children’s Play Area nearby at the junction of Heather Road and Ederowen Park. This is approximately 4 minutes walking distance from the Spar shop.  Road leading to the Centre will take away the only green area that is safe for the children of the Knockalla/Ederowen areas. Serous concerns for the safety of children who normally play in this area - During the PAD process, DfI Roads advised that the new junction be spaced 30m from both the Shop entrance and Knockalla Park. The use of a lesser junction spacing would not only be outside the Department’s guidelines, but it may also prejudice road safety. A reduced junction spacing could add to driver confusion both for those on the priority road and those using the accesses.  Consultation issues – this was carried out prior to submission of the planning application.  Flooding – Drainage Assessments were requested and DfI Rivers were consulted on these and are content with the proposal, subject to conditions. Appendix 10

The scheme is satisfactory in terms of siting, height, scale, massing and design. With regard to design of the proposal, the materials will be zinc finished composite insulated panels to the roof, smooth painted render to walls, polyester powder coated rainwater goods, polyester powder coated aluminium windows and polyester powder coated aluminium doors. There will also be integrated roller shutters and photovoltaic panels. It is a multi-functional community centre providing and range of facilities and physical space for the local community. The design is functional and is acceptable. Stakeholder consultation took place in 2014 and 2018. There is limited access to alternative provisions and existing facilities are highly utilised. Letters of commitment to use the proposed new facilities have been provided by 11 local community groups/user groups, 5 of which wish to be permanently located at the proposed new Community Centre.

DfI Roads are content with the access proposals and have recommended conditions. DFI Rivers have considered the flooding issues raised by objectors and are content with the drainage proposals on the site.

Finally, in consideration of residential amenity, the protection of the privacy of adjacent private residential dwellings has been considered and addressed by the amended siting as the new community facility will be positioned on the Eastern side of the site, with good separation distance from the surrounding residential properties. EHD have been consulted and have no objection regarding noise. There will be no adverse impact on the residential amenity of the nearby residents.

10.5 On balance, therefore, the proposal scheme meets the policy tests outlined in the SPPS, DAP 2011, PPS 3 and PPS 8.

11. Conclusion and Recommendation In summary, the proposal is considered acceptable. Having considered the proposal against the policy and all material considerations, approval is recommended in accordance with the SPPS, DAP 2011, PPS 3 and PPS 8.

Appendix 10

12. Conditions

1. As required by Section 61 of the Planning Act (Northern Ireland) 2011, the development hereby permitted shall be begun before the expiration of 5 years from the date of this permission.

Reason: Time Limit.

2. The vehicular access, including visibility splays and any forward sight distance, shall be provided in accordance with Drawing No. 05 bearing the date stamp 16 May 2018, prior to the commencement of any other development hereby permitted. The area within the visibility splays and any forward sight line shall be cleared to provide a level surface no higher than 250mm above the level of the adjoining carriageway and such splays shall be retained and kept clear thereafter.

Reason: To ensure there is a satisfactory means of access in the interests of road safety and the convenience of road users.

3. The Private Streets (Northern Ireland) Order 1980 as amended by the Private Streets (Amendment) (Northern Ireland) Order 1992.

The Council hereby determines that the width, position and arrangement of the streets, and the land to be regarded as being comprised in the streets, shall be as indicated on drawing no. 05 bearing the date stamp 16 May 2018.

Reason: To ensure there is a safe and convenient road system within the development and to comply with the provisions of the Private Streets (Northern Ireland) Order 1980.

4. The Private Streets (Northern Ireland) Order 1980 as amended by the Private Streets (Amendment) (Northern Ireland) Order 1992.

No other development hereby permitted shall be commenced until the works necessary for the improvement of a public road have been completed in Appendix 10

accordance with the details outlined blue on drawing no. 05 bearing the date stamp 16 May 2018. The Department hereby attaches to the determination a requirement under Article 3(4A) of the above Order that such works shall be carried out in accordance with an agreement under Article 3 (4C).

Reason: To ensure that the road works considered necessary to provide a proper, safe and convenient means of access to the development are carried out.

5. The new footway linkage coloured red on drawing no. 05 bearing the date stamp 16 May 2018 shall be completed prior to the commencement of any other works hereby permitted.

Reason: To ensure there is a satisfactory means of pedestrian access maintained during the works.

6. The gradient of the access road shall not exceed 4% (1 in 25) over the first 10m outside the road boundary. Where the vehicular access crosses a footway, the access gradient shall be between 4% (1 in 25) maximum and 2.5% (1 in 40) minimum and shall be formed so that there is no abrupt change of slope along the footway.

Reason: To ensure there is a satisfactory means of access in the interests of road safety and the convenience of road user.

7. No retailing or other operation in or from any building hereby permitted shall commence until hard surfaced areas have been constructed and permanently marked in accordance with the approved drawing no. 05 bearing date stamp 16 May 2018 to provide adequate facilities for parking, servicing and circulating within the site. No part of these hard surfaced areas shall be used for any purpose at any time other than for the parking and movement of vehicles.

Appendix 10

Reason: To ensure that adequate provision has been made for parking, servicing and traffic circulation within the site.

8. Prior to commencement of development a 1:500 scale block plan shall be submitted to and agreed in writing with the Council showing a working strip of minimum width 5m along the northern boundary of the site.

Reason: To allow for the protection and ongoing maintenance of an existing culverted watercourse.
