Katherine Kerswell Chief executive London Borough of Croydon Bernard Weatherill House 8 Mint Walk Croydon CR0 1EA December 17th Dear Katherine Kerswell, Initially, I wrote to Croydon Council on the 27th July to raise concerns about the impact of the LTN scheme. I also spoke to the former Croydon Cabinet Member for transport and expressed my deep concerns with the scheme, as well as having written to the Secretary of State for Transport to raise my concerns and request any further assistance he can provide. Unfortunately, this matter remains a major issue locally - my constituents have continued to be impacted with reports of increased road rage, traffic and road closures. London Borough of Bromley challenged the legality of the LTN scheme, due to the failure of Croydon to consult with LBB before implementing the scheme. I welcomed the news that Croydon Council allowed a formal consultation on the final agreed proposals, allowing residents to comment formally on the proposals. However, I was disappointed to have been informed last week that the consultation was extended by another 14 days as local businesses were not included in the first consultation. It is right that local businesses are consulted, but I had hoped that this would have been done at the outset. The consultation, therefore, ends on Friday and the outcome will not be known until early January causing further delay and distress to those affected. My view remains unchanged, I believe that if a better scheme can work for both Boroughs, it should be trialled first. If this isn’t possible then the current roadblocks should be voted out and the idea abandoned as it simply has not worked in practice. -

TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) ORDER 1995 (AS AMENDED) NOTICE OF DIRECTION CONFIRMED UNDER ARTICLE 4(1) TO WHICH ARTICLE 5 APPLIES The London Borough of Croydon made an Article 4(1) Direction on 5 September 2014, under Article 4(1) of the Town and Country Planning (General Permitted Development) Order 1995, as amended. Following a six week period for receipt of representations the Council has confirmed the Article 4 Direction on 6 November 2014. The Direction withdraws the permitted development right granted by Class J Part 3 Schedule 2 of the Order for development consisting of a change of use of a building and any land within its curtilage to a use falling within Class C3 (dwelling house) of the Schedule to the Use Classes Order from a use falling within Class B1(a) (offices) of that Schedule. The effect of the Direction is that permitted development rights for this type of development are withdrawn and planning permission will therefore be required for a change of use from offices (Use Class B1(a)) to residential (Use Class C3). The Article 4 Direction applies to the whole of the Croydon Opportunity Area. A copy of the Direction, including a map defining the area covered can be viewed at the Council Offices at Bernard Weatherill House, 8 Mint Walk, Croydon, CR0 1EA; or can be viewed on the Council’s website at www.croydon.gov.uk/article4 and at the Croydon Central Library. Alterations to the Town and Country Planning (General Permitted Development) Order 1995 (as amended) through the serving of an Article 4 Direction to the Chatsworth Road Conservation Area Dear owner or occupier, I am writing to inform you of proposed local changes to the planning regulations which will affect your permitted development rights. Permitted development rights derive from a general planning permission granted from Central Government and allow homeowners to make certain changes to their properties without the need to apply for planning permission from the local planning authority. Local planning authorities have powers under Article 4 of the Town and Country Planning (General Permitted Development) Order 1995, as amended; to remove certain permitted development rights. An Article 4 Direction does not prevent the development to which it applies, but instead requires that planning permission is first obtained from the local planning authority for that development. The need to serve an Article 4 Direction to the Chatsworth Road Conservation Area was established through the production of the Chatsworth Road Conservation Area Appraisal and Management Plan Supplementary Planning Document that was adopted in April 2013. This document identified threats to the conservation area’s special character as a result of minor development, some of which can be carried out under permitted development rights. -

We were established through the Theatres Trust Act 1976 'to promote the better protection of theatres' and provide statutory planning advice on theatre buildings and theatre use in England through The Town and Country Planning (Development Management Procedure) (England) Order 2015, requiring the Trust to be consulted by local authorities on planning applications which include 'development involving any land on which there is a theatre'. Comment: Please note the Trust was not directly consulted of this application despite it falling within our remit as outlined above. We have had extensive engagement with the Council regarding Fairfield Halls, including an Advisory Review which was carried out in June 2016 and set out various recommendations to help ensure the venue’s viability into the future. We have also formally commented on previous iterations of the development. We have previously expressed some concern regarding the ‘get-in’/servicing arrangements and layout and we consider this revised proposal to represent an improvement. We also welcome that the existing crescent-shaped artist’s entrance and sub-station has been retained. -

NOTICE IS HEREBY GIVEN that Croydon Council propose to make the above Order under Sections 84, 87 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act, 1984 as amended and all other enabling powers. 2. The general effect of the Order would be to prohibit any motor vehicle exceeding a speed of 20 miles per hour in the area described in Schedule 1 to this Notice, excluding the roads bounding the area (as specified) and those roads/sections of roads within the boundary listed in Schedule 2 to this Notice. Roads within the boundary of the new area to which an existing 20mph speed limit applies will continue to retain their speed limits under their respective Orders. 3.
