DATED 31.10.2012) THIS PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE IMPUGNED ORDER AT ANNEXURE-J & ETC. THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING: O R D E R The plaintiffs had made an application under Order 6 Rule 17 CPC r/w Order 23 Rule 1 CPC and sought for amendment of plaint as follows:- “Proposed Para 7 [b] The plaintiffs are the absolute owners in possession and enjoyment of the land measuring 2 acres 14 guntas [out of 3 Acres 29 Guntas] in Sy. No.81/2 & 83/3 of Doddanekundi, K.R.Hobli, Bangalore East Taluk. The Defendant nos.2 to 42 are claiming rights over individual sites forming part of the suit schedule property under alleged sale deeds said to have been executed by defendant no.1 proclaiming himself as alleged GPA Holder of the plaintiffs. The said GPA is denied and disputed by the plaintiffs. Hence the plaintiffs have claimed a declaration in terms of prayer [c] to declare that the alleged sale deeds are not binging on the right and interests of the plaintiffs. 9 Proposed Para 7 [c] The extent of land covered by each of the impugned sale deeds [if added up together] comprises only about 1 acre 11 guntas whereas the plaintiffs are the absolute owners in possession of the entire schedule property which measures 2 acres 14 guntas. Regarding the land covered by the Sale Deeds, the defendants cannot and ought not to dispute the title of the plaintiffs, since the defendants are claiming rights and interest to their sites from the plaintiffs [through alleged GPA holder]. Insofar as the balance land i.e., excluding the sale deed area, the defendants are not concerned about the same. Hence there is no need or necessity for the plaintiffs to seek for declaration of that balance area i.e., 1 acre 3 guntas [which is 2 acres 14 guntas minus 1 acre 11 guntas]. In the above circumstances insofar as the declaratory relief [a] and injunctive relief [b] are concerned the plaintiffs restrict such declaration and injunction only to the extent of the area/measurements as mentioned in the respective sale deeds which is stated in prayer [c]. Therefore, the plaintiffs do not press declaratory relief [a] and injunctive relief [b] for an extent beyond the area covered by the sale deeds mentioned in the prayer [c]. Hence declaratory relief [a] and injunctive relief [b] is only sought for 1 acre 11 guntas extent and not for 2 acres 14 guntas. The extent of the sites covered by the impugned sale deeds and referred in relief [c] is 10 morefully described in the schedule nos.1 to 39 in place of the schedule as existing. Proposed amendment to relief [a] To declare that the plaintiffs are the absolute owners of the suit schedule property nos.1 to 39, which is the respective schedules to the impugned sale deeds referred in relief – [c] and totally measuring 1 acre 11 guntas in Sy.
