Why filing a probate should not be delayed By: Atty. Robert L. Ferris

Although there is no time limit or statute of limitation to file a probate it is usually not wise to delay the process. The longer a probate is delayed the greater the likelihood that it will become more and more difficult to complete. Here is an example. Anna’s mother died in 2000 without a will or a trust. Anna’s father died five years earlier. Anna was an only child and she continued to live in the house owned by her deceased parents without probating her mother’s estate. In 2008 Anna died unexpectedly and in 2010Anna’s two children have found a buyer and want to sell their mother’s house. Since title to the house is still in the names of Anna’s deceased parents an affidavit of death for Anna’s father will need to be recorded at the county recorder’s office. The affidavit is necessary to transfer ownership of the house from Anna’s mother and father to Anna’s mother. Since Anna’s mother died without a trust her estate will need to be probated in order for the property to pass to Anna who is an only child and therefore the only heir to her mother’s estate. The probate of Anna’s mother’s estate may take anywhere from 8 months to a year or longer. The prob- lem is that in 2010 Anna is already dead so the property cannot be transferred to Anna. Anna’s estate will now need to be probated and an estate representative appointed so that Anna’s mother’s estate (the house) can be transferred to the estate representative of Anna’s estate, who will then be able to transfer the property to Anna’s two sons at the conclusion of the probate of Anna’s estate. Sometimes it can be difficult to find an attorney willing to probate a case that has been delayed for many years because the attorney’s statutory fee for probating an estate is based on the value of the estate at the time of death.
