21/14 Minutes

Resolved: That the minutes of the meeting held on 20 March 2014 having been printed and circulated, be taken as read and be confirmed and signed by the Chairman as a correct record with the inclusion of Jane Mitchell being added to the list of apologies.

24/14 Statement of Community Involvement

Considered:

The report of the Planning Policy Officer

The Officer directed Members to the Members Update Sheet where it was noted that an additional text be added to the end of the paragraph at the end of page 25 as follows:

‘On occasions where comments on a planning application are received after the application has been determined by Planning committee but before the statutory consultation deadline, should any new issues be raised the application would be reconsidered by Planning committee’.

Members commented as follows:

• Possibly need to consider extending the 3 minutes for speakers on major applications. • Can the name of the document be changed, so that it includes everyone not just the word ‘community’ which possible implies ‘community groups’? • Could a paragraph at the beginning of the document inform readers that the Authority is committed to a full and open consultation rather than being legally obliged? • Does the title in Section 4 need to be changed to ‘Development Management’ to be consistent?

The Director noted that the annual Parish Council training event was due to be held on the 30 April where issues relating to parish council consultation would be covered.

Recommendation: That Members approve the draft Statement of Community Involvement for consultation.

Resolved: That Members approved the draft Statement of Community Involvement for consultation subject to the amendments requested and the additional sentence as set out on the Members Update Sheet.

25/14 Consultation on Performance and S106 Contributions to Affordable Housing

Considered:

The report of the Planning Policy Officer

The Director confirmed that a letter from National Parks was being sent.

Resolved: That Members approved the response as suggested in paragraph 5.1 of the report as the Authority‘s response to the consultation paper but with a covering letter from the Chairman of the Authority referring to the conflicting messages on affordable housing delivery in national Parks by the Government from within the same department.

26/14 Planning Advice Note – Outdoor Advertisement and Signs

Considered:

The report of the Director of Planning

Members made the following comments:

• Feel that the tone of the advice note needs addressing • Is consulting on the advice note an option? • Generally it is the structure of the sign which is unacceptable • Would not want all the signs to be the same

The Director noted that it was not usual to consult on an advice note, but agreed that the advice note needed re-writing to be more flexible and advisory and to include working with the Highway Authority.

Recommendation: That Members approve the adoption of the Planning Advice Note on Outdoor Adverts and Signs and agreed the strategic approach to addressing unauthorised advance signs as set out in this report.

Resolved: That the Planning Advice Note on Outdoor Adverts and Signs be re-drafted and that the advice note be taken to the Development Plan Working Group for determination.

The following members of the public addressed the meeting regarding the Plans List Items indicated:

Considered:

The report listing applications and the Director of Planning’s recommendations thereon. Members also considered further information circulated on the Members’ Update Sheet at the meeting including; updated recommendations from the Director of Planning and comments received after the agenda was printed from: consultees, objectors and supporters.

Resolved:

(a) That with regard to all applications listed in the report and subject to:

(i) the amendments specified below; and

(ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above;

NYM/2014/0078/FL – Siting of 12 no. log cabins for holiday use and associated access and parking at Spiers House, Cropton for Forest Holidays LLP, c/o Mr Andy Rogers, Bath Yard, Bath Lane, Moira, Derbyshire, DE12 6BA. Decision All Members declared a personal interest in this item as they had all been lobbied. Approved as recommended with an amendment to condition 4 as per the Members Update Sheet: 4. GACS00 No external lighting shall be installed in the development hereby permitted other than as detailed in submitted drawing no. PL (60)010 received on 10 April 2014. The lighting shall be installed in accordance with these approved details and shall be maintained in that condition in perpetuity. 4. NYM/2014/0128/R3 – Application under regulation 3 (Town and Country Planning General Regulations 1992) for construction of a cycle trail (resubmission following withdrawal of NYM/2014/0038/R3) at Sutton Bank National Park Centre, Sutton Bank for North York Moors National Park Authority, fao: Mr Michael Graham, The Old Vicarage, Bondgate, Helmsley, York, YO62 5BP.

Decision Jim Bailey declared a personal interest in this item as he had been asked to speak to some landowners in his capacity as Chair of the Authority. Approved as recommended. 5. NYM/2014/0053/FL - Replacement of timber windows and doors with white uPVC at 6 Hall Garth Lane, for Mr D Rex, 6 Hall Garth Lane, Ayton, Scarborough, North Yorkshire, YO13 9JA. Decision David Jeffels declared a prejudicial interest in this item as a close neighbour and left the room. Approved as recommended but delegated back to Officers to agree the design of the windows. 6. NYM/2014/0080/FL – Variation of condition 4 of planning approval NYM/2010/0427/FL to allow for installation of uPVC door at 9 Dreaken Fold, West Ayton for Mr Robert Jarratt, 9 Dreaken Fold, West Ayton, Scarborough, North Yorkshire, YO13 9JR. Decision Approved as recommended. 7. NYM/2013/0684/CU – Change of use from car repair workshop to cycle repair, sales and hire shop together with associated café at Former Garage on Blackhorse Lane, Swainby for Mr John Nelson, 5 Enterpen, Hutton Rudby, , North Yorkshire, TS15 0EL. Decision David Hugill declared a personal interest in this item as had conversations with both the applicant and objectors in his Ward Member capacity. Bryn Griffiths declared a personal interest in this item as County Councillor for the area. Deferral was agreed for Officers to gather further information with regards to car parking, access details, comments from the Highway Authority and further detailed investigation of the viability of the existing village shop and the likely impact of the proposal on its operation.

8. NYM/2014/0065/FL – Conversion of barns to form 1 no. local occupancy dwelling and associated garden at Land North West of Everley Hotel, Mowthorp Road, Hackness for Mr Bill Tinsley, 39 Farside Road, West Ayton, Scarborough, North Yorkshire, Y013 9LE. Decision Approved as recommended.

9. NYM/2013/0576/FL – Insertion of 1 no. ground floor window (revised scheme to NYM/2012/0374/FL) at Chapel Cottage Annexe, Back Lane, Hutton le Hole for Mr & Mrs George Thompson, Chapel Cottage, Back Lane, Hutton le hole, York North Yorkshire, YO62 6UD. Decision Alison Fisher declared a prejudicial interest in this item as a close friend had written in support of the application and left the room. Jim Bailey and Janet Frank declared a personal interest in this item as the applicant was known to them. The recommendation of Officers was overturned and the application was approved as Members felt the character and appearance of the building would not be harmed by the proposal.
