Press Release
Tayside Man Demands A Public Inquiry Into Botched Operations By Suspended NHS Tayside Surgeon
After major back surgery in 2007 (Transthoracic Microdisectomy T5/T6) by the now suspended Consultant Neurosurgeon, Professor Muftah (Sam) Salem Eljamel, former Radio Tay DJ and college lecturer Patrick Kelly is demanding a Public Inquiry after discovering that the Neurosurgeon had in fact not carried out this operation despite claiming that he did. This was major surgery which required two surgeons working on Mr Kelly. The surgeon entered into his side, deflated the lung, went through the rib cage to get to the spine although this work was carried out, nothing else was.
After discovering that Professor Sam Eljamel had been suspended from his senior medical post in 2014, Mr Kelly decided to ask Ninewells Hospital for a revue of his medical case. Then right out of the blue there was some shocking news for Mr Kelly. He said, “Recent MRI
St Andrew’s House, Regent Road, Edinburgh EH1 3DG www.gov.scot
Scans from 2014 from Ninewells Hospital showed that my discs are in exactly the same position as they were pre-op in 2005. This meant that although I underwent major surgery nothing was done to me on the operating table. I believe this is a criminal act by this neurosurgeon. I almost lost my life after surgery when my wound opened and I started to haemorrhage very badly. I recall a doctor telling me that I might not make it through the night. Quite casually he said, ‘if the blood goes into your lungs then you won’t be alive in the morning.’ Thankfully it did not and I’m still here today. However, I am now left in a medically poor condition due to this surgeon’s negligence. I suffer chronic pain caused by severe nerve damage to my back. This has resulted in hardening of both hamstrings causing my knees to give way and walking is a major struggle. I now have other back related problems which are too numerous to mention and I am fully dependent on very strong pain killers to get through the day. I am also financially ruined due to medical negligence and because my wife works I don’t qualify for the ESA benefit. I want to know what the NHS or Scottish Government are going to do to assist people like myself who cannot work again due to this surgeon’s failings, and to stop me from heading into financial ruin because I cannot claim benefits due to my wife working. I will also be totally embarrassed and humiliated by having to attend ATOS for medical assessments, especially when none of this is my fault. I have worked through chronic pain for many years but it is now too much for me. It is terrible what this surgeon has done to me and my family.”
Mr Kelly met Consultant Neurosurgeon, Mr David Mowle, in September 2014, and in a letter he said, “I have now carefully reviewed the latest MRI Scan of your thoracic spine. This does demonstrate persistent small disc protrusions at the operated T5/6 level and also at theT6/7 level. These are very similar in appearance to the pre-operative MRI Scan from 2005.” Mr Kelly believes that this statement proves that no surgery took place on his back in 2007.
There is another troubling and disturbing reason why Mr Kelly is asking for a Public Inquiry into Professor Eljamel. Mr Kelly said, “When I was in hospital there were a few patients who were awaiting surgery by Professor Eljamel for various medical conditions including brain tumours. Given the fact that Professor Eljamel did not carry out the operation on me, and just left me, can we be sure that he did not do the same to them? If he did not operate on these patients then some may have been left to die. How would we know? The only person who knows the answer to this is Professor Eljamel. For all we know we may have another Dr Harold Shipman here. Although Shipman poisoned his patients perhaps Eljamel just left them to die? Also a firm of solicitors have said in a letter to me that they had a number of cases relating to surgery by Professor Eljamel. This is why I believe a Public Inquiry is the best and only way forward to answer these questions. Personally speaking I have so many questions that I want answers to. I believe that anyone who has been operated on by Professor Eljamel should go back to Ninewells Hospital and request an urgent medical review to find out if the proper medical procedures were carried out in a safe professional manner. Professor Eljamel came to the UK in 1982 and I just wonder how many more are like me suffering from botched medical treatment at his hands.”

As you know the professor was suspended and has since left the employ of NHS Tayside. You may also be aware of a demand made through the columns of The Courier newspaper by [REDACTED – PERSONAL INFORMATION (S38(1)(B)] - that there ought to be a public inquiry into the work of the professor. That view is supported by my constituent who believes the question of the professor's competence should be the subject of detailed scrutiny in the form of such an inquiry. There is a significant amount of background and actions around this doctor, whom I suspended from duty in December 2013, who was referred to and investigated by the GMC, and who has now retired from the NHS.
Having conducted an internal investigation into his practice, which was passed to the GMC, any patient who was identified as potentially disadvantaged has been notified.
If you would like to give me a call I can give you the full spec, such that you can decide which elements are most important to pass further.
