DeFalco* ABSTRACT One of the goals routinely ascribed to international criminal law (“ICL”) prosecutions is the ability to improve the rule of law domestically in post-atrocity states. This Article reassesses the common assumption that the relationship between the pursuit of ICL accountability and improving the rule of law in post-atrocity states is necessarily a linear, wholly positive one. It does so through an analysis of the relationship between the Extraordinary Chambers in the Courts of Cambodia and the rule of law domestically in Cambodia. Through this analysis, this Article highlights the oft-ignored possibility that ICL prosecutions may actually have a mix of positive, nil, and negative effects on the domestic rule of law, at least in the short run. In the Cambodian context, this Article argues that such risk is quite real and arguably, in the process of being realized. These harmful rule of law consequences are most visible when viewed in light of the particularities of Cambodia’s rule of law deficit, which increasingly stems from government practices of subverting the rule of law through means obscured behind façades of legality. -
Revolution, Reform and Regionalism in Southeast Asia
Revolution, Reform and Regionalism in Southeast Asia Geographically, Cambodia, Laos and Vietnam are situated in the fastest growing region in the world, positioned alongside the dynamic economies of neighboring China and Thailand. Revolution, Reform and Regionalism in Southeast Asia compares the postwar political economies of these three countries in the context of their individual and collective impact on recent efforts at regional integration. Based on research carried out over three decades, Ronald Bruce St John highlights the different paths to reform taken by these countries and the effect this has had on regional plans for economic development. Through its comparative analysis of the reforms implemented by Cam- bodia, Laos and Vietnam over the last 30 years, the book draws attention to parallel themes of continuity and change. St John discusses how these countries have demonstrated related characteristics whilst at the same time making different modifications in order to exploit the strengths of their individual cultures. The book contributes to the contemporary debate over the role of democratic reform in promoting economic devel- opment and provides academics with a unique insight into the political economies of three countries at the heart of Southeast Asia. Ronald Bruce St John earned a Ph.D. in International Relations at the University of Denver before serving as a military intelligence officer in Vietnam. Commemorative Day for the Paris Peace Agreements Sunway Hotel, Phnom Penh – 22nd October 2014 His Royal Highness Samdech Norodom Sirivudh, Chairman of Cambodian Institute for Cooperation and Peace (CICP), Ambassadors, Distinguished Guests, ladies and gentlemen who work for peace in Cambodia. The Paris Peace Accords were signed on October 23rd 1991 and marked the official end of Cambodia’s civil war. At the first session of the Conference, Cambodia was represented by the four Cambodian Parties. At the second session of the Conference, the Supreme National Council of Cambodia, under the leadership of then President, H.R. Majesty King Norodom Sihanouk, represented Cambodia. The co-Presidents of the Conference were H.E. Mr. Roland Dumas, Minister for Foreign Affairs of the French Republic, and H.E. Mr. Ali Alatas, Minister for Foreign Affairs of the Republic of Indonesia. Both of these countries are here today, represented by H.E. Mr. Jean-Claude Poimboeuf, Ambassador Extraordinary and Plenipotentiary of France to Cambodia and H.E. Mr. Pitono Purnomo, Ambassador Extraordinary and Plenipotentiary of Indonesia to Cambodia. We are also thankful for the presence of CICP Executive Director, H.E. Ambassador Pou Sothirak, who was present at the peace talks and played an influential role in the post peace accord implementation period. We are honoured that those who created a space for peace then, are now here at our commemorative event. Significantly, 18 governments signed the agreement: Australia, Brunei Darussalam, Cambodia, Canada, the Peoples Republic of China, the French Republic, India, Indonesia, Japan, Laos, Malaysia, Philippines, Singapore, Thailand, the Soviet Union, the United Kingdom, the United States of America and the Socialist Republic of Viet Nam. -

Child Soldiers in Genocidal Regimes: The Cases of the Khmer Rouge and the Hutu Power Péter KLEMENSITS,1 Ráchel CZIRJÁK2 Genocide is one of the worst things one can imagine throughout the history of humanity. But in the cases of Cambodia and Rwanda this was even more serious as children were used as instruments of the massacres. Both the Khmer Rouge and the Hutu regime had their specific reasons for this act. The number of victims surpasses the millions, who either lost their lives, or suffered from various kinds of violence, because the young perpetrators were also victims, who carry the invisible scars in their souls. These historical examples are warnings for the international community to be active in situations like these, and stand up for the defenceless ones. Keywords: Khmer Rouge, Hutu, Tutsi, genocide, child soldiers Introduction At the end of the 20th century one of history’s most brutal genocides took place in Southeast Asia and Sub-Saharan Africa. Between 1975 and 1978, the Khmer Rouge in Cambodia, then in 1994, the Hutu regime in Rwanda, together murdered approximately 2.5 million people.3 In both countries, the armies of the ruling regime took part actively in the atrocities, which largely have been exposed by now. However, it is less known that due to the regime’s po- licies tens of thousands of children were indoctrinated and trained to serve as child soldiers and became perpetrators of the mass killings.4 Unfortunately, in the current world, mainly in developing countries, the use of children as soldiers is still widespread and the problem needs more attention from the international community. -

THE TRUTH ABOUT THE VIETNAM WAR BRUCE HERSCHENSOHN Decades back, in late 1972, South Vietnam and the United States were winning the Vietnam War decisively by every conceivable measure. That’s not just my view. That was the view of our enemy, the North Vietnamese government officials. Victory was apparent when President Nixon ordered the U.S. Air Force to bomb industrial and military targets in Hanoi, North Viet Nam’s capital city, and in Haiphong, its major port city, and we would stop the bombing if the North Vietnamese would attend the Paris Peace Talks that they had left earlier. The North Vietnamese did go back to the Paris Peace talks, and we did stop the bombing as promised. On January the 23rd, 1973, President Nixon gave a speech to the nation on primetime television announcing that the Paris Peace Accords had been initialed by the United States, South Vietnam, North Vietnam, the Viet Cong, and the Accords would be signed on the 27th. What the United States and South Vietnam received in those accords was victory. At the White House, it was called “VV Day,” “Victory in Vietnam Day.” The U.S. backed up that victory with a simple pledge within the Paris Peace Accords saying: should the South require any military hardware to defend itself against any North Vietnam aggression we would provide replacement aid to the South on a piece-by-piece, one-to-one replacement, meaning a bullet for a bullet; a helicopter for a helicopter, for all things lost -- replacement. The advance of communist tyranny had been halted by those accords. -

Honour Killing in Sindh Men's and Women's Divergent Accounts Shahnaz Begum Laghari PhD University of York Women’s Studies March 2016 Abstract The aim of this project is to investigate the phenomenon of honour-related violence, the most extreme form of which is honour killing. The research was conducted in Sindh (one of the four provinces of Pakistan). The main research question is, ‘Are these killings for honour?’ This study was inspired by a need to investigate whether the practice of honour killing in Sindh is still guided by the norm of honour or whether other elements have come to the fore. It is comprised of the experiences of those involved in honour killings through informal, semi- structured, open-ended, in-depth interviews, conducted under the framework of the qualitative method. The aim of my thesis is to apply a feminist perspective in interpreting the data to explore the tradition of honour killing and to let the versions of the affected people be heard. In my research, the women who are accused as karis, having very little redress, are uncertain about their lives; they speak and reveal the motives behind the allegations and killings in the name of honour. The male killers, whom I met inside and outside the jails, justify their act of killing in the name of honour, culture, tradition and religion. Drawing upon interviews with thirteen women and thirteen men, I explore and interpret the data to reveal their childhood, educational, financial and social conditions and the impacts of these on their lives, thoughts and actions. -

The views contained within do not necessarily reflect UK government policy. Author details The author is a Senior Lecturer, Defence Studies Department, Kings College London. This case study draws on a combination of primary and secondary sources. The primary sources are mainly limited to US Government documents, particularly those dealing with the internal deliberations of the Nixon administration as well as the minutes of meetings at the 1972-1973 Paris peace talks. The secondary sources used include a much wider range, such as general histories of the conflict, as well as more specific diplomatic histories that draw on primary source material from each of the key participants in the conflict (US, North Vietnam, South Vietnam, Provisional Revolutionary Government, USSR and China). Background to Elite Bargains and Political Deals Project This case study is one of a series commissioned to support the Stabilisation Unit’s (SU’s) development of an evidence base relating to elite bargains and political deals. The project explores how national and international interventions have and have not been effective in fostering and sustaining political deals and elite bargains; and whether or not these political deals and elite bargains have helped reduce violence, increased local, regional and national stability and contributed to the strengthening of the relevant political settlement. Drawing on the case studies, the SU has developed a series of summary papers that bring together the project’s key findings and will underpin the revision of the existing ‘UK Approach to Stabilisation’ (2014) paper. -

Federal-State Cooperative Program for Population Estimates/ Local Population Estimates A series of reports presenting population estimates prepared under the auspices of the Federal-State Cooperative Program for Local Population Estimates. The objective of this program is the development and publication of State-prepared estimates of the population of counties using uniform procedures largely standardized for data input and methodology. The methods were mutually agreed upon by the individual States and the Bureau of the Census and were selected on the basis of the results of an extensive test of methods against the 1970 census conducted in late 1971 and early 1972. The estimates for counties are consistent with independent State population totals regularly prepared by the Bureau of the Census and published in the P-25 series of reports. Pages vary. One of the most atrocious aspects of the regime was the deployment of tens of thousands of children as child soldiers through the indoctrination of the ideologies of the state as well as through coercion and intimidation. This paper intends to study the impact of child soldiering on child psyche through an analysis of two texts- Luong Ung’s First They Killed My Father and Patricia McCormick’s Never Fall Down. The paper shall explore how militarization and authoritarian rule dismantles commonly held perceptions about childhood as a period of dependency and vulnerability, where instead, children become unwitting perpetrators of horrible crimes that ultimately triggers trauma and disillusionment. In its analysis of the texts, the paper shall attempt to use Hannah Arendt’s concept of the ‘banality of evil’ in the context of the child soldiers whose conformation to the propaganda of the Khmer Rouge lacked any ideological conviction. -

INTRODUCTION Rape as an act of genocide is a recent and controversial topic in international law. When genocide first emerged as an international crime in response to the atrocities committed by the Nazis during World War II, sexual violence was not part of the discourse. In 1948, when the Genocide Convention was established to define and codify the crime of genocide, rape was still viewed as an inevitable byproduct of war1 rather than a deliberate strategy. It was not until 1998 in the landmark case of the International Criminal Tribunal for Rwanda, Prosecutor v. Akayesu,2 when rape was successfully prosecuted as an act of genocide. In the wake of Akayesu, the international legal community is beginning to recognize genocidal rape as a distinct crime. During the 1971 Liberation War, in which Bangladesh seceded from Pakistan,3 it is estimated that between 200,000 and 400,000 women were raped,4 and thousands became pregnant as a result.5 Four decades later, Bangladesh’s International Criminal Tribunal (the “Tribunal”) began to charge individuals for crimes committed during the Liberation war.6 The Tribunal has yet to establish a prosecutorial plan for sexual crimes, opening up debate * J.D.
