Manchin and Puccio helped the billionaire owner of The Greenbrier win the governor’s race as a Democrat in 2016.

MEMORANDUM OPINION AND ORDER This suit challenges the constitutionality of West Virginia’s Ballot Order Statute, which mandates that ballots for partisan offices list first the party whose presidential candidate received the most votes in the last election. Following the parties’ bench trial, the Court must now weigh the extent to which the Statute burdens the plaintiffs’ First and Fourteenth Amendment rights against the state’s asserted interests. Finding the state’s interests insufficient to justify the burdens created by the Statute, the Court now declares the Ballot Order Statute unconstitutional, enjoins the defendants from enforcing it, and orders the defendants to implement a constitutional ballot ordering system for future elections, including the November 2020 general election.     We, the undersigned Democratic State Party Chairs, are calling for immediate federal and state action to ensure that every eligible voter has the opportunity to cast their ballot without the risk of contracting or spreading COVID-19. The United States of America is simultaneously in the midst of an unprecedented global viral outbreak and an extremely consequential series of elections. The rapid spread of COVID-19 has halted virtually all public gatherings and rendered the act of leaving one’s home for non-essential reasons dangerous. As things stand, both of these acts are necessary for millions of American voters to uphold their Constitutional right to select their representatives. Every state is currently unprepared to address the seismic shift in election administration necessary to ensure the 2020 election proceeds during a pandemic and must start implementing these changes by mid-April. The funding is needed right now to protect the 2020 election. If left unchanged, our current electoral system poses a severe public health risk that could rapidly accelerate the spread of COVID-19 while disenfranchising countless voters and calling into question the legitimacy of our elections. Just like our healthcare system and our economy, our elections infrastructure will need a massive infusion of resources to ensure that elections can go on and every voter has access to the ballot during the COVID-19 pandemic. To remedy this untenable situation, we urge federal lawmakers to immediately appropriate at least $2 billion for state and local elections administrators to implement the following reforms: • a universal and easily accessible vote-by-mail system which should include: o provisions for free or prepaid postage, o allowing ballots postmarked by election day to count, o reforming any signature match laws to protect voters, o and allowing community organizations to collect and deliver voted, sealed ballots.

    MEMORANDUM To: ​Fellow Democrats From:​ Belinda Biafore, West Virginia Democratic Party Chair Subject​: COVID-19 Update Yesterday we were informed by Governor Jim Justice that we have confirmed our first case of COVID-19 in West Virginia. As you also know this is most likely due to lack of testing so everyone should not only continue to take appropriate precautions outlined by our leaders and health officials but should increase those precautions when able. U.S. Senator Joe Manchin has advocated and requested more testing and protection materials such as gloves and masks for our health workers. Governor Jim Justice has also closed our restaurants, bars, and casinos except for the ability to carry out and drive-thru. Today Governor Justice expanded that to gyms and other facilities and stressed the importance of employers allowing their employees to work from home. You can find his press conference here: https://www.pscp.tv/w/1BRJjQkvzXBGw Also today Secretary of State Mac Warner and Attorney General Patrick Morrisey held a press conference regarding our primary election in May. We were assured that virtually all West Virginians would qualify for an absentee ballot during this crisis. As you know, the CDC suggested not holding gatherings of more than 50 people for at least 8 weeks and our national leaders have indicated to keep group gatherings smaller than 10. We firmly suggest that we all follow these precautions in order to keep everyone safe. We are still in constant contact with the DNC Rules and Bylaws Committee regarding our County Conventions. We want you to be assured we are taking appropriate action and carefully measuring the effects this will have.
