Body of Notice: The Public Employees Retirement System (PERS) Board will meet to discuss general business on Monday, March 20, 2000. The meeting begins at 8:00 a.m. until 12 p.m. The Teachers Retirement System (TRS) Board and PERS Board will hold a joint meeting to discuss the retiree medical plan and other retirement issues March 20th from 1 p.m. to 5 p.m. The TRS Board will meet to discuss general business and to hear appeals on March 21, 2000 from 8:00 am to 2 p.m. The PERS Board will meet to hear appeals on March 21 from 2 to 5 p.m. The meetings will be held at the Captain Cook Hotel, 939 West Fifth Avenue, Anchorage and are open to the public. PERS and TRS members are invited to attend.

Body of Notice: The REGULATORY COMMISSION OF ALASKA gives notice that ALASKA POWER COMPANY (APC) has filed a tariff revision [(TA 672-2)]. APC proposes to revise the calculation of the non-fuel component of the Power Cost Equalization (PCE) calculations. The proposed revision would result in an increase in PCE credits per kilowatt hour in all locations. APC requests a March 24, 2000, or earlier effective date for this filing.

Body of Notice: The REGULATORY COMMISSION OF ALASKA gives notice that GCI COMMUNICATION CORP. (GCI) has filed a tariff revision [(TA151-419)] to its intrastate interexchange (long distance) tariff as summarized below. GCI proposes to add the 595 Plan 60 Minute Option. To be eligible for this option, the Residential Customer must a) subscribe to GCI as its primary interexchange carrier, b) select GCI's 595 Calling Plan for interstate calling and c) select GCI's 595 60 Minute Option for their interstate calling. Customers enrolled in this 595 Plan 60 Minute Option will be charged a rate of $0.00 per minute for the first 60 minutes of combined interstate and intrastate Dial Station calls each month.

GCI also proposes to delete the 595 Plan 60 Minute Promotion.

The final draft of the Interior Alaska Subarea Contingency Plan (Interior Alaska SCP) is now undergoing public review. This plan is a supplement to the Alaska Federal/State Preparedness Plan for Response to Oil and Hazardous Substance Discharges/Releases (the Unified Plan). The public review period extends from March 1 to April 30, 2000.

The plan contains information on emergency response notification and procedures, available resources, and environmentally sensitive areas in the Interior Alaska subarea. The subarea consists of the Fairbanks North Star Borough, the Denali Borough, and Regional Educational Attendance Areas 12, 13, and 15, and part of 16.

There are no alternative modes of operation that change the air pollution control requirements applicable to the facility.

Emissions: The facility annual potential to emit is 210.03 tpy of regulated air contaminants (18.25 tpy of PM, 134.96 tpy of SO2, 36.79 tpy of NOX, 10.42 tpy of VOC, and less than 10 tpy of CO, H2S and Lead).

Department Preliminary Review: Based on review of the Kodiak Fishmeal Plant Title V Operating Permit Application, ADEC concurs that the facility will comply with emission standards listed in 18 AAC 50.040-090. As proposed, allowable emissions will not cause any violations of the ambient air quality standards and increments. The Preliminary Decision dated November 11, 1983 for the Vallenar Bay land disposal project has been amended to change the method of disposal from lottery sale to sealed-bid auction and to identify the specific lots to be sold and the lots and tracts to be retained in state ownership. Vallenar Bay Subdivision, Alaska State Land Survey No. 85-86, is located in the Ketchikan area, on the northwest side of Gravina Island in Sections 1, 10 and 11 of Township 75 South, Range 89 East, Copper River Meridian. Seventy lots totaling 125.91 acres are proposed for sale in fall of 2000.

The Division of Mining, Land and Water has made a Preliminary Finding and Decision to sell two parcels of land located on Revillagigedo Island. The parcels proposed for sale by sealed-bid auction in fall 2000 total 4.76 acres and are described as Lot 90, U.S. Survey 2403 located near Herring Cove within Section 36 of Township 75 South, Range 91 East, Copper River Meridian and Tract 17A of the Replat of Lots 6-11, 12A and 13-18, U.S. Survey 2817 on the peninsula between Deep Bay and Clover Passage, within Section 11, Township 73 South, Range 90 East, Copper River Meridian. The initiative petition titled, "An Act to increase Alaska's minimum wage to $6.50 per hour effective January 1, 2001, $6.75 per hour effective January 1, 2002 and thereafter, adjusted annually for inflation", was filed on January 10, 2000, in accordance with AS 15.45.140.

AS 15.45.150 requires that "[w]ithin not more than 60 days of the date the petition was filed, the lieutenant governor shall review the petition and shall notify the initiative committee whether the petition was properly filed?".

The Division of Elections completed its review of the above referenced petition. It has been determined that the initiative petition does not contain the required number of valid signatures. Under AS 15.45.140, signatures of qualified voters equal in number to 10 per cent of those who voted in the preceding general election and resident in at least two-thirds of the election districts of the state are required to be obtained. Thus, 22,716 registered voters were required to sign the petition in order for it to be properly filed.

Due to the insufficiency of qualified subscribers, the petition 99WAGE is determined to be improperly filed (AS 15.45.160) and will not appear on the 2000 general election ballot. Alaska Administrative Journal Page 37 Printed: 03/09/2000 02:47:55 PM

Under the authority of AS 29.06.010(a), I order the following:

Section 1. Findings. As lieutenant governor, I find that the governing body of the second class city of Sheldon Point, Alaska, has complied with the requirements of AS 29.06.010 to change the official name of its city from Sheldon Point, Alaska to Nunam Iqua. In particular, I find that the city took the following steps to comply with the requirements of AS 29.06.010 in order to change its official name:

(1) On August 9, 1999, the city council introduced Ordinance No. 99-05 for the purpose of changing its official name from the city of Sheldon Point to the city of Nunam Iqua;

(2) On September 30, 1999, public hearings were held on Ordinance No. 99-05 and the ordinance was subsequently passed on that date by the city council and made subject to ratification of the voters;

(3) On November 2, 1999, a city election to ratify the passage of Ordinance No. 99-05 was held;

(4) On December 9, 1999, the results of the November 2, 1999 ratification election of Ordinance No. 99-05 were certified by the city as to the following proposition: "Shall the City Change the Name "SHELDON POINT" TO "NUNAM IQUA?" with the vote tally being in favor of the name change as follows: 27 yes 12 no

(5) On February 3, 2000, the city filed with this office Ordinance No. 99-05 to change its official name to Nunam Iqua.

Sec. 2. Transition. Having found that the requirements of AS 29.06.010 have been satisfied, I order that the name the city of Sheldon Point, Alaska is officially changed to the city of Nunam Iqua, Alaska. Any civil or criminal suit, application, petition, hearing or other proceeding to which the city of Sheldon Point is a party and that is pending at or brought after the date the name change takes effect under sec. 3 of this Order, shall proceed in the name of city of Nunam Iqua as changed by this Order.

Sec. 3. Notification. Pursuant to AS 29.06.010(a), a copy of this Order is to be transmitted to the Department of Community and Economic Development.

Sec. 4. This Order takes effect March 2, 2000.
