    0239 AHMED, THE SANCTUARY OF PROSECUTORIAL NULLIFICATION 1/17/2020 3:02 PM THE SANCTUARY OF PROSECUTORIAL NULLIFICATION Zohra Ahmed* INTRODUCTION In the aftermath of the 2016 election, the shortcomings of existing sanctuary protections came sharply into focus.1 Historically, cities enacted sanctuary protections to extricate their law enforcement agencies from activities related to federal immigration enforcement. In sanctuary cities, local government agencies are typically restricted from sharing information with federal immigration authorities or from cooperating in apprehending individuals targeted for removal.2 After the White House issued an Executive Order (EO) in late January 2017, many immigrant rights advocates recognized that external facing policies that proscribed direct cooperation would not suffice.3 The EO announced that Immigration and Customs Enforcement (ICE) would prioritize removing any undocumented person charged or convicted of a crime, no matter how serious.4 Recognizing the vital role state criminal courts play and would continue to play in fueling deportations, public defenders in New York City (“City”) identified a new actor with the power to enact stronger protections: the prosecutor.5 * Clinical Teaching Fellow, Cornell Center on the Death Penalty Worldwide, Cornell Law School, and member of 5 Boro Defenders. By VICTOR PORCELLI News Editor The Courtesy Meals Program, which is supposed to be free, affected some financially vulnerable stu- dents’ aid packages this week, leading to confusion and distrust of the program. The CMP provides students with Dining Dol- lars — and, as of recently, meal swipes — to ensure they don’t go hungry. However, a small group of users received an email from the Office of Financial Aid on Wednesday notifying them that their finan- cial aid packages would be adjusted due to their use of the program. Student government Chairperson and Gallatin se- nior Jakiyah Bradley previously served as a Senator at- Large for food-insecure students. Bradley first learned about the policy change through a constituent, but saw Instagram stories drawing attention to it being widely circulated by students. Bradley said immedi- ately after hearing about students’ financial aid being affected, she brought the issue to administrators who said they would begin working to resolve it. Bratton, today announced that 15 employees and managers of nine massage parlors in Brooklyn were arrested on prostitution and promoting prostitution charges following a long-term investigation. District Attorney Thompson said, “We conducted these raids and made these arrests because the good people of Bay Ridge and Bensonhurst are sick and tired of these dens of prostitution, masquerading as legitimate businesses, popping up in our communities.” Commissioner Bratton said, “As a result of these arrests, we hope to address the issue of prostitution in these communities and the possibility that these individuals may be victims of human trafficking. The New York City Police Department, in partnership with the Kings County District Attorney’s Office, remains committed to improving the quality of life for residents and stopping those who profit from the exploitation of others.” The District Attorney said that nine defendants were charged in criminal complaints with misdemeanor prostitution, two were charged with promoting prostitution, and 10 were variously charged with providing unlicensed massage services, a felony. The District Attorney said that, in today’s takedown, authorities entered the premises to make arrests and execute search warrants. They were joined by the Mayor’s Office of Special Enforcement, which includes inspectors from the Fire Department and the Department of Buildings.
