It is my great pleasure to introduce to you the School of Law at City University of Hong Kong.

Established in 1987, the School of Law offers quality education to undergraduate and postgraduate students. In particular, three goals are high on our agenda, namely: to be a world renowned centre for research and teaching of law; to equip students with global knowledge, skills and perspectives; and to maintain close links with local and international legal establishments. These goals are reflected in the composition of our faculty, our curricula and enrichment activities.

Our School is staffed by a stellar international faculty with a multicultural profile, bringing with them a diversity of expertise and strengths. With the Professor combined efforts of staff and students, our School has established expertise in a Geraint Howells wide range of fields including Chinese law, comparative law, Hong Kong Basic Law, commercial law, consumer law, environmental law, constitutional law, human rights, criminal justice, WTO law, international trade and investment law, international economic law, arbitration and alternative dispute resolution.

To meet the challenges of globalization, our School has established an International Advisory Board, comprising distinguished legal practitioners as well as renowned professors from overseas universities, to guide and further enhance the quality of our teaching and research.

Our School maintains close links with its counterparts in Mainland , Europe, North America and across the Asia-Pacific region. Students have many opportunities to develop a global perspective in the study of law through exposure in various activities organized by the School, including collaborative programmes with Aix- Marseille University and University 1, Panthéon-Sorbonne in , the Global Legal Education and Awareness Project (G-LEAP) in cooperation with Monash University in Australia and University College, Oxford in UK, legal placements in Mainland China, Hong Kong and overseas, as well as international mooting competitions.

In addition, we collaborate with the Supreme People’s Court of the PRC and its National Judges College to admit Chinese judges to our Master of Laws (LLM) programme and to offer a tailor-made Doctor of Juridical Science (JSD) programme for Chinese senior judges, while a short-term and highly specialized programme is also organized for other Chinese senior judges. The presence of these mainland judges in our School offers an exceptional opportunity to our students for exchange of views as well as a well-informed understanding of the current Chinese legal system and its development.

The Master of Laws (LLM) Programme is dynamic in meeting the society and the world’s needs. It provides local and overseas students with the opportunities to learn the professional skills and knowledge necessary to become an integral part of the emerging Asian economy. In recognition of the soaring demand in specific fields, our programme consists of seven streams: Chinese and Comparative Law Stream, International Economic Law Stream, Common Law Stream, Maritime and Transportation Law Stream, Intellectual Property and Technology Law Stream, Corporate and Commercial Law Stream, and General Stream. It is notable that the Chinese and Comparative Law Stream as introduced in 1995 was the first programme of its kind in the world. With the rich curriculum we provide, you are able to choose among different streams to best suit your personal interests and career ambitions. You may also take advantage of the research opportunities, cutting-edge professional skills course, internship possibilities and innovative collaborative programme at the School of Law. The LLM programme is taught not only by our law school’s reputational faculty but also by a team of distinguished scholars and experienced professionals from well-known law schools worldwide.

CityU School of Law has been running a pioneering Chinese judge programme for six cohorts. Collaborating with the Supreme People’s Court of China and National Judges College, a number of Chinese judges are selected to study the LLM programme at CityU. In consequence, our LLM students have this unique opportunity to interact with Chinese judge students in order to gain insider’s perspectives on Chinese judicial system.

The School of Law has collaborative programmes with Europe-Asia Research Institute of Aix-Marseille University and University Paris 1, Panthéon-Sorbonne. Selected students will study at these partner universities and obtain two postgraduate degrees: one from the partner university and the other from CityU. Current CityU LLM students in their last year of study at CityU may apply for admission to the LLM in European Business Law programme at the Aix-Marseille University. Successful students will receive advanced standing. The cooperation with University Paris 1, Panthéon-Sorbonne enables participating CityU students to spend a semester at University Paris 1, Panthéon-Sorbonne and other semester(s) at CityU.

In sum, our programme offers a unique blend of academic and practical training in a broad range of subjects; it provides substantial leadership in its area and is taught by highly qualified and experienced professionals. 3 INTRODUCTION

In 1995, the School of Law (SLW) at City University of Hong Kong (CityU) began the Master of Laws Programme in response to significant demand by the professional community for lawyers with postgraduate legal training in Chinese and Comparative Law. Since then the development of China’s economic and legal reform, its accession to the World Trade Organization, the transformation of the Asian economy and the globalization of the world’s economy have only increased the demand for more lawyers with advanced legal education. The professional demand, for international lawyers with sophisticated legal skills and knowledge to execute international business transactions, participate in sound dispute resolution methods, promote sustainable development as well as contribute to the digital economy and cultural/scientific exchanges, is expanding.

The LLM Programme provides local and overseas students the opportunity to learn the professional skills and knowledge necessary to become an integral part of the emerging Asian economy. The programme permits students to design their legal studies to suit their own career goals. In particular, our comprehensive educational programme provides students the chance to write a publishable thesis, learn essential professional legal skills, hone them in a professional setting and study any of a variety of courses offered each semester. Our students may choose a specialization in Chinese and Comparative Law, International Economic Law, Common Law, Maritime and Transportation Law, Intellectual Property and Technology Law, Corporate and Commercial Law, or follow a general course of study.

Our LLM students are also eligible to take part in the GLOBAL GATEWAY® Programme, a dynamic opportunity for international legal study. It allows students to tailor their international legal study objectives based upon their interests and career goals. The GLOBAL GATEWAY® Programme has a series of cooperative agreements with a number of legal education institutions worldwide that allows students to participate in concurrent study opportunities or exchange programme.

Current enrollment is over 120 students. There are around 40 full time faculty members and an expanding number of adjunct faculty members, all recognized practitioners in the field, involved in teaching of the LLM Programme. Guest lecturers have included, amongst others, scholars from prestigious universities from overseas, international lawyers, mainland judges and government officials.

4 PROGRAMME DESCRIPTION

AREAS OF SPECIALIZATION Our Master of Laws (LLM) Programme offers a unique blend of comprehensive legal information, innovative skill-based training, opportunity for independent research, the flexibility to study any of a variety of streams and international study options.

Students are able to obtain their LLM degrees in any of the following streams: Chinese and Comparative Law The Chinese and Comparative Law Stream focuses on a comparative understanding of the legal framework in China.

International Economic Law The International Economic Law Stream deals with international legal issues concerning business transactions with particular emphasis on problems relating to different jurisdictions.

Common Law The Common Law Stream provides students with an opportunity to study the origins, practices, values, principles and theories of common law, and equips students with legal skills of comparing common and civil law systems and methods.

Maritime and Transportation Law The Maritime and Transportation Law Stream deals with legal issues concerning maritime and transportation law at both the regional and international levels.

Intellectual Property and Technology Law The Intellectual Property and Technology Law Stream explores cutting-edge issues relating to copyright, patent, trademark, design, trade secret and cyberspace.

Corporate and Commercial Law The Corporate and Commercial Law Stream focuses on legal issues concerning corporations, finance and business with practical importance in the regional and international markets.

General The General Stream provides students with the opportunity to study any topics in which they may be interested.

VIDEO-LINK LECTURES BY RENOWNED PROFESSORS

At our Law School, you can receive the same good education as in the leading law schools in the world. The School has invited renowned professors from Europe and the USA to teach our courses through video-link facilities. In future semesters, the School will endeavour to continue this practice.

5 As a first of its kind in Hong Kong, the real-time virtual lecture enables students to learn from world-class professors and take part in the classes of top law schools without having to leave the local campus. Students will be able to experience the world-class academic culture and teaching styles of top universities. It is an innovative combination of high technology and eminent scholars that transplants the international education culture into our local community.

COOPERATION WITH OVERSEAS UNIVERSITIES

The School of Law operates collaborative programmes with Europe-Asia Research Institute of Aix-Marseille University and University Paris 1, Panthéon-Sorbonne. Selected students will study at these partner universities and obtain two postgraduate degrees: one from the partner university and the other from CityU.

Current CityU LLM students in their last semester of study at CityU may apply for admission to the LLM in European Business Law programme at Aix-Marseille University.

CityU students enrolled in the collaborative programme with University Paris 1, Panthéon-Sorbonne will spend a semester at the partner university and other semester(s) at CityU. They should acquire 30 ECTS in the partner university by taking taught courses and writing a dissertation. Upon satisfactory completion of the 30 ECTS (including Dissertation), students will be given credit transfer of 12 CityU credit units. Students who have successfully satisfied all requirements of the partner university and CityU will obtain an LLM degree from CityU as well as a Master 2 degree from University Paris 1, Panthéon-Sorbonne.

6 COOPERATION WITH SUPREME PEOPLE’S COURT OF THE PRC

CityU School of Law also collaborates with the National Judges College and the Supreme People’s Court of the PRC to provide advanced legal education to Chinese judges. A number of Chinese judges are selected to study the LLM programme at CityU. During their study at CityU, they will have the opportunity to undertake internships at the Hong Kong Courts.

DISSERTATION

Students may register for the Dissertation course. Six credit units may be earned for completing a postgraduate level dissertation. The course may be completed in one semester or over two semesters.

MEDIUM OF INSTRUCTION AND ASSESSMENT

In 2016/17 academic year, only English module will be offered for the following streams: • Chinese and Comparative Law • International Economic Law • Common Law • Maritime and Transportation Law • Intellectual Property and Technology Law • Corporate and Commercial Law • General

MODE OF PROGRAMME AND CLASS SCHEDULE

Combined mode: Local students taking programmes in combined mode can attend full-time (12–18 credit units per semester) or part-time (no more than 11 credit units per semester) study in different semesters without seeking approval from the University. For non-local students, they will be admitted to these programmes for either full-time or part-time studies. Non-local students must maintain the required credit load for their full-time or part-time studies and any changes will require approval from the University.

Classes are held during daytime. Classes may be offered in weekday evenings / Saturdays in special cases.

7 DURATION OF PROGRAMME

The programme can normally be completed in one year for full-time study mode and 2 years for combined study mode.

The maximum study period for full-time students is 2.5 years and for combined mode students is 5 years. Classes are held during daytime. Classes may be offered in weekday evenings or Saturdays only in exceptional cases.

AWARD REQUIREMENTS

Students who complete the required courses and electives and achieve a cumulative Grade Point Average of 2.0 or above will receive the degree of Master of Laws (LLM).

ENTRANCE REQUIREMENTS

To be eligible for admission, applicants must satisfy the general entrance requirements and the following programme-specific entrance requirements: * • hold an honours degree in law or equivalent qualification; or • be admitted for professional practice of law in Hong Kong or other jurisdictions; or • have obtained either a Common Professional Examination (CPE) of the United Kingdom or Hong Kong with satisfactory results, provided that a second class honours degree has also been obtained; or • have obtained a Postgraduate Certificate in Hong Kong Law or Master of Arts/Laws in Arbitration and Dispute Resolution; or • (applicable to applicants for Maritime and Transportation Law Stream) hold an honours degree in maritime or logistics studies, or related disciplines, or hold an honours degree in any discipline with 3-year or above working experience relating to Maritime or Logistics industry; # AND • be proficient in English if they are applying for the English Module; or be proficient in English and Chinese (Putonghua) if they are applying for the Chinese Module.

For applicants whose entrance qualification is obtained from an institution where the medium of instruction is not English, the minimum English language proficiency requirement will usually be: ^ • a TOEFL score of 595 (paper-based test)or 97 (internet-based test); or • an overall band score of 7 in IELTS; or • a score of 500 in the Chinese mainland’s College English Test (CET) Band 6; or • other equivalent qualifications.

* An applicant who holds a legal qualification from a common law jurisdiction will not be eligible to enrol in the Common Law Stream. # Foundation Courses Students of the LLM MTL stream who do not have a degree in law are required to take two foundation law courses, which are LW6164E Law of Contract and LW6181E Common Law System, Reasoning and Methodology, on top of the stipulated curriculum for students with a law degree to keep up their study progress. ^ The School has stipulated a validity period of three years for results of the above tests. With the accession of China to the World Trade Organization, the dynamic growth of the Asian economy and the general impact of commercial globalization, it is increasingly important for lawyers and executives to understand the new rules of doing business in the international marketplace. ACADEMIC COMMUNITY

At the School of Law, we are developing a lively intellectual environment that will allow students to learn and grow. We have established the Centre for Chinese and Comparative Law (RCCL), Hong Kong Centre for Maritime and Transportation Law (HKCMT) and host the Asia Pacific Law Review. The Asia Pacific Law Review is the first Asia-based law journal to be included in the Social Science Citation Index (SSCI), the world- renowned database of Thomson Scientific. We also provide students, through our Seminar series, with the opportunity to participate in roundtable discussions with leading practitioners and scholars on topics of practical and timely relevance. 12 GRADUATE LEGAL STUDIES IN HONG KONG

As our students find out, the City University of Hong Kong is a well-equipped place to study law. The Library supports the research and teaching and learning activities of the CityU School of Law faculty and students. It provides an excellent collection of law materials, tailor-made services as well as an extensive array of equipment and facilities. Law materials include the legal literature of Hong Kong, China, Great Britain and other common law countries. The print collection contains more than 123,000 volumes. It is enriched by a growing number of electronic resources, comprising electronic databases, electronic journals and electronic books. A majority of these electronic resources can be accessed throughout the campus as well as remotely. It also features two special collections, the English Law Special Collection and the Chinese Legal History Special Collection. The former focuses on pre-1900 English law materials while the latter covers the period from Ancient China to the 1949. To further extend the resource base, the Law Section staff carefully selects and organizes important legal sites. Their web page (http://www.cityu.edu.hk/lib/collect/ law/subjres/lawlink.htm) serves as a gateway to legal information worldwide. Law library workshops covering a variety of topics and closely tied to the academic programmes and courses are offered to students in both semesters. Librarians also provide legal reference services at the point of need. On the equipment and facilities side, there are computer workstations, networked printers, photocopiers and group discussion rooms. Users can also enjoy wireless local area network access services throughout the Library.

Hong Kong itself includes a number of public and private organizations that students may look to in order to further their legal research. The Hong Kong Stock Exchange is one of the largest in Asia. Banks including the Hong Kong and Shanghai Bank as well as the Standard Chartered Bank have been based in the territory for years. There are about 851 solicitor’s firms, 1,275 barristers and 79 registered foreign law firms. A number of non- governmental organizations have recently established themselves in Hong Kong. Some of these organizations also provide opportunities for internship for our students.

TEACHING METHODOLOGY In order to provide students with the best learning environment, we utilize a variety of innovative teaching methods. The lecture-based approach teaches the essential principles necessary to understand how the Chinese legal system functions. The claims-based approach instructs students on the fundamental check list of rules necessary to answer legal questions dealing with public and private law issues. The problem-based method and the case-study method encourage students to learn proactively through the resolution of realistic or hypothetical disputes. Experiential learning through internship facilitates education through actual practice.

The programme also takes advantage of technology for improved classroom experiences. The campus is wired for high-technology. Many of our instructors utilize multi-media for instruction, including special web-based software programmes and powerpoint presentations. Our students are entitled to access LEXIS and Westlaw.

13 CAREER PROSPECTS

The LLM Programme has hundreds of graduates working locally and worldwide, including the United States, France, Italy, Germany, China and Singapore. In Hong Kong alone our graduates are working in governmental offices, law firms, non-governmental organizations and corporations. CityU offers the opportunity to study law with students from all over the world. Students from North America, Europe, China and Singapore participate in the programme. The student body is composed of law students, attorneys, corporate executives, journalists and professionals from other law related disciplines.

Students can enjoy numerous shops, restaurants, movie theatres and even ice-skating in Festival Walk, purportedly the largest shopping mall in Hong Kong. The mall is conveniently located just across the street from the campus. Transportation is easy and convenient from the campus, as our stop, Kowloon Tong, serves as the transportation hub for downtown Central, Kowloon and the New Territories. Via the Mass Transit Railway (MTR) students can easily find themselves downtown in about 20 minutes. Downtown diversions include Lan Kwai Fong and Soho. Lan Kwai Fong provides the territory with the latest and most modern bar restaurants and discothéques. Soho, close by in the mid-levels, is a mellower alternative, located next to the longest escalator in the world, providing quiet and down-to-earth cafés and restaurants.

This course aims to develop the students’ ability to conduct research at an advanced level. The skills taught will have a wide application to both scholarly inquiry and problem solving generally.

LW6101E Jurisprudence and Political Theories

The primary aim of this course is to foster and develop with students a basic appreciation of the major theoretical and philosophical approaches that have guided the law in all stages of its development. Students will be introduced to a wide range of sources, from the classical writings of philosophers past, to the seminal texts of contemporary philosophers and legal scholars writing on present day jurisprudential debates. Students will learn to reflect in a disciplined and critical manner on the nature and role of the law, as well as the importance of legal systems, legal reasoning, and legal institutions. And students will also have the opportunity to participate in discussions on the presuppositions and methods of legal, political, and therefore also, to some extent, moral philosophy and related social theories for as far as these bear on the institutions, norms and methods of legal systems.

LW6103E Company Law I

This course examines the law and regulation of companies and other business organisations: the formation, management and operation of companies, corporate governance, the constitutional framework of corporate bodies, the relationship between the internal stakeholders of the company, as well as their relationship with external parties. The course will analyse the theoretical underpinning of the legal rules and principles of corporate law, as well as the policy drivers behind the shaping of corporate law.

LW6104E Company Law II

This course aims to build upon basic company law knowledge through a review of the law, policy and practice in relation to equity and debt financing of companies, and the external administration of companies (receivership, liquidation etc).

LW6105E The Law of Corporate Restructuring (subject to approval)

This course aims at introducing students to the concept, principles, mechanics, practice, doctrinal and statutory rules, as well as the theories of, or relating to, corporate restructuring.

15 LW6106E Legal and Operational Aspects of Corporate Governance

This course examines the notion of Corporate Governance, which is usually described as being the governance of large corporations which dominate modern economic life. It is international in outlook as it will look at the main corporate governance and legal regimes around the world.

LW6107E Capital and Securities Market Regulation (subject to approval)

This course offers an introduction to the securities regulation in Hong Kong from a comparative law perspective. Students will learn the Hong Kong and international equity offering markets and relevant laws relating to public offering, from the prospectus regime to continuing disclosure requirements and corporate governance of public companies. This course will also explore the liabilities of relevant parties to the public offering, insider dealing, other market misconduct and the public and private enforcement of securities laws. Comparisons with US securities regulation will often be made. Company Law I is a pre-requisite for this course.

LW6109E Banking Law

This course aims to equip students with a sound general knowledge and conceptual understanding of aspects of banking law and aims to develop in students associated practical legal skills in the application of those principles to banking problems. It also aim to introduce students to the law relating to negotiable instruments and the regulatory framework within which the banking system operates in Hong Kong. At the same time, the course will enable students to develop analytical and problem-solving skills in relation to various aspects of banking law. This course will also enable students to understand the concept and understanding of the essential principles of banking law and to apply these principles to solve factual problems that arise especially in the banker-customer relationship.

LW6110E Commercial Law

This course aims to encourage students to discover the meaning and purpose of commercial law, its origins, development and limitations and some of its major issues; to equip students with a sound general knowledge and conceptual understanding of aspects of commercial law; to develop students’ associated practical legal skills in the application of those principles to real life commercial problems; to allow students to reflect effective solutions or challenge current legal framework; and to develop a habit of research and mind for learning.

LW6111E Insurance Law (subject to approval)

This course aims to introduce students to basic principles of insurance law and how the insurance industry is operated, along with explore duties and liabilities of key players in the insurance industry, namely insurers or underwriters, brokers, and assureds. With many types of insurance available in the industry, this course will focus on commercial insurances.

16 LW6112E Human Rights Responsibilities of Business (subject to approval)

With the rise in the power and functions of corporations in a globalised economy, business enterprises are increasingly expected to bear social responsibilities beyond maximising profit for shareholders. Against this background, this course aims to enable students to explore the idea, and foundation, of corporate social responsibility (CSR) as a component of corporate governance and examine critically various regulatory initiatives that seek to promote responsible corporate citizenship. CSR is taken in a broad sense to include both legal and moral/ethical responsibilities in the areas of human rights, labour rights, and the environment. Students will be exposed to three sets of questions: why should companies have social responsibilities; what is the nature and extent of these responsibilities; and how could social responsibilities be enforced against corporations, especially those which operate at a transnational level. After completing this course, students should be able to discover why and how CSR policies should be integrated into day-to-day business decisions and how corporate executives could handle ethical dilemmas that arise during business operations. During the course, students should also be able to internalise the importance of acting in an ethical and socially responsible manner in their normal lives.

LW6120E Basic Law of Hong Kong*

This course aims to examine the nature of the constitutional framework established under the Hong Kong Basic Law. It will offer an understanding of the legal, political and social values underlying the Basic Law. It will seek to explain the legal position of Hong Kong vis a vis the Central Government and the Constitution of the People’s Republic of China.

LW6121E Constitutional and Administrative Law of China

This course aims to introduce the historical and ideological background of the constitutional and administrative law of the PRC and give students a specialized knowledge of the actual working of the legal system of the PRC from the constitutional and administrative law perspectives. It gives students a thorough knowledge of the legislative process of the PRC and enables them to understand the dynamics behind the rapidly changing constitutional and administrative law of the PRC.

LW6122E Chinese and Comparative Financial Law*

This course aims to introduce the study of banking and financial laws and regulations, and the regulatory framework within which the banking system operates in Hong Kong, China and the major industrialized countries and to study the rules governing the operation of multinational organizations and central banks at international levels. It also aims to allow students to develop advanced knowledge of the substantive rules in respect of banks and financial systems of the relevant countries and international organizations.

This course aims to introduce the laws and regulations relating to criminal liabilities and procedures in the PRC from a comparative perspective. It will provide a general understanding of the nature and function of criminal law and procedures in China. This course aims to introduce the study of Chinese legal history and legal thought through which the current Chinese legal system has developed.

LW6126E Dispute Resolution in Theory and Practice

This course aims to introduce the theory and practice of dispute resolution, and to examine the spectrum of dispute resolution processes in China and other jurisdictions with particular emphasis on Arbitration, Mediation, Adjudication, Negotiation, Litigation. The course will further innovate a student’s ability to grasp the fundamental concepts with the ultimate goal of discovering how the spectrum of dispute resolution processes are applied into actual practice.

International and Comparative Intellectual Property Law: LW6127E Trademarks and Patents*

This course seeks to examine and compare the trademark and patent law regimes of Hong Kong, the People’s Republic of China, and, where appropriate, the United States of America, the European Union and other jurisdictions.

LW6129E Chinese and Comparative Environmental Law*

This course aims to introduce the developing area of international environmental law, in particular the concept of sustainable development. Students will learn about the basic principles of environmental law in the People’s Republic of China, Hong Kong and other relevant jurisdictions.

LW6130E Seminar on Advanced Issues in International Law*

This is an advanced course on public international law. The aim is to provide a future oriented, discovery-based knowledge of legal principles of public international law; to familiarise students with major issues in this field and allow them through advanced discussions to appreciate the nature, scope, objective and enforceability of international law principles; to encourage students to discover the meaning and purpose of the international law through research and to ignite a passion and motivation to discover knowledge in this area. This course seeks to impart necessary professional skills to students and allow them, based on their knowledge, not only to comment but also advice in the field of international law.

LW6133E International and Comparative Copyright Law

This course seeks to compare the copyright system of the People’s Republic of China (PRC), with those of the United States (US), the United Kingdom (UK), Canada and/or other selected jurisdictions. Additionally, the course will trace the development of copyright law from a global perspective, and explore how the laws of the selected jurisdictions fit within the international copyright system.

LW6134E Chinese and Comparative Company Law

This course aims to introduce the study of company law and regulations in China, Germany, the UK, the US, and Hong Kong; to inspire students to correctly appreciate the differences between various forms of business organizations and to comprehend the rights and duties of different stakeholders in a company; to encourage students to discover the current issues in Chinese corporate law and understand those issues in a comparative approach.

LW6136E Property Rights in China: Legal, Economic, and Policy Analysis

The past two decades have witnessed increased levels of private homeownership and domestic protest in China, despite a growing economy and rising living standards. This course aims to introduce contemporary and modern perceptions of private property from legislative, economic and sociological perspectives. Content-wise, it depicts land tenure system, housing reform, real estate development, rural land transfer, property management and land grabs etc. It also analyses the legislative framework concerning real property in China, including relevant legislation at national and local levels. In a nutshell, the course will equip the students with a good knowledge of legal issues underlying the public and private properties in China.

LW6137E Dissertation

This course aims to develop students’ ability to carry out independent research and to develop expertise in a given subject area through critical application of theory and techniques provided by the course. Students will be required to undertake individually supervised research and produce a dissertation.

LW6138E Chinese Law of Obligations

This course aims to offer a general survey on Chinese law of obligations, in particular the law of contract and the law of tort in China; to introduce to students the concepts and principles of Chinese law of obligations; and to lay the academic foundation for advanced research and practice in these areas.

This course aims to introduce the advanced concepts and principles of selected areas of civil law and civil procedure of the PRC as well as the analytical skills required for civil law practice in those areas. It lays the academic foundation for the study of advanced research and practice in the areas of civil and commercial laws of China.

LW6140E Chinese and Comparative Commercial Law*

The objective of this course is to study PRC contract and commercial law in comparison with the international rules of law on international contracts and commercial law. In addition to Chinese contract and commercial law and practice, this course examines fundamental principles of private international law against the rapid development of Chinese and international commercial law and practice. It raises issues relating to the harmonization of Chinese and international contract and commercial law and relevant problems of private international law. Chinese as well as international dispute settlement will be discussed during the course.

LW6141E Chinese Foreign Trade and Investment Law

This course aims to offer an advanced examination and analysis of the legal framework of foreign trade and investment laws in China and related practical aspects.

LW6142E International Investment Law

This course aims to provide students with an overview of international laws and treaties governing international investment activities, protection and issuance, to offer students practical examples in order to understand and apply those laws and treaties and to understand how international investment disputes may be resolved.

LW6143E Law and Business in Asia*

This course aims to offer a survey of different legal issues relating to doing business in Asia from a practitioner’s point of view; provide the opportunity to study the law concerning business transactions in the region in depth and compare different Asian (and industry-specific) business environments. The regions covered include: China, Hong Kong, Southeast Asia, South Asia and relevant international jurisdictions. The business sectors covered are commercial and investment banking, telecoms, trade, E-business, mining and petroleum, logistics, mergers, acquisitions, environment, energy, commerce, government, sports and entertainment. This course aims to provide students with a critical understanding and assessment of the multilateral trading system; to encourage students to identify and search for an appropriate understanding of the current issues in WTO law.

This course aims to provide an understanding of the theoretical and practical issues relating to law and development, the extent to which law as a tool for social engineering has affected development and how far development process has influenced the understanding of law and the interaction among institutions.

LW6159E Comparative Constitutional Law and Politics

This course aims to provide students with knowledge on selected advanced legal issues and recent development in comparative constitutional law and politics, and develop their ability in finding out, understanding, and mastering the latest development in constitutional law and related political theory. It also teaches students methodology and skills in critical analysis of selected advanced legal issues of comparative constitutional law and comparative politics. The methodology and skills taught will have a wide application to problem solving generally, as well as to scholarly inquiry.

LW6160E Advanced Study of Antidumping and Countervailing Measures*

This course is intended to guide students to thoroughly examine the texts of 1994 Antidumping Agreement, 1994 Agreement on Subsidies and Countervailing Measures, as well as to analyze relevant cases which provide detailed interpretations of these two Agreements. It teaches students to understand the genuine purposes of these two Agreements and to critically evaluate specific domestic antidumping and countervailing measures in selected jurisdictions such as the USA, the EU and China.

21 LW6161E Competition Law

This course aims to conduct systematic study of competition laws and regulations by using comparative approach. It will deal with mainly four aspects, i.e., monopoly agreement, abuse of dominant position, concentration and administrative monopoly. Students are expected to understand the competition policies behind the relevant competition laws and regulations, as well as the importance of consumer protection.

This course aims to acquire knowledge of the law of contract; to apply that knowledge in the solution of typical problems; to critically analyse and evaluate the legal principles and doctrines in the law of contract; to work through the process of agreement and consider the nature of what is agreed; to prepare for further study of obligations, whether arising in contract, tort or otherwise; and to promote the attitude of critical and reflective learning of the law of contract.

This course aims to examine the nature, scope and objectives of tort law and its interception with other fields of law such as contract and criminal law; to encourage students to discover the meaning and purpose of tort law, its origins, development and limitations and some of its major issues; to equip students with a sound knowledge of the substantive rules of tort law; and, to develop students’ research skills, analytical and problem-solving skills, effective written and oral communication skills, presentation skills and the abilities to express ideas in relation to issues in tort law.

LW6167E Current Issues in WTO Law

This course is designed to depict the legal system of the World Trade Organization (WTO), one of the most important international economic organizations, and to provide guidance on the analysis of current legal issues within the WTO.

LW6168E Selected Problems in International Investment Law*

This course aims to provide students opportunities to study an emerging area of law so as to meet the challenges of working in a global legal environment; to allow students to be exposed to the teaching methods and viewpoints of a leading foreign legal scholar; and to offer more flexibility to students to plan and complete their studies; and develop further the research and analytical abilities of students.

LW6169E Chinese and Comparative Labour Law

This course aims to identify and analyse key issues in the regulation of labour in the PRC, Hong Kong, Japan, South Korea and Taiwan. It will also develop comparative perspectives on common issues including rights and duties under the contract of employment, employment termination, occupational safety and health/employees’ compensation, collective bargaining, institutional arrangements for labour regulation and labour migration.

22 LW6172E Law and Society in China

This course aims to provide an understanding of the theoretical and practical issues relating to law and society in China, the extent to which law as a tool for social engineering has affected social development and how far social forces have influenced the functioning of law and the interaction among legal institutions in China.

LW6173E Private International Law

The course provides students a practical and legal background to the nature, scope and rules of private international law (for the purposes of this course private international law is understood in a broad sense, including the conflict of laws and the law of international civil procedure) to enable future graduates to apply these principles in cases involving foreign elements. Particular emphasis will be given to Hong Kong, Mainland China, the United Kingdom, and the developments of the European Union.

LW6175E Maritime Insurance Law

This course aims to provide an analysis of the foundations and fundamental concepts relating to the insurance of ships, cargoes, and freight. The law considered is predominantly the English law as codified in the Marine Insurance Act 1906 where the Marine Insurance Ordinance (Cap. 329) is primarily based upon. Throughout the course, the respective positions of assureds, brokers, underwriters are analysed, as also are the special feature of a marine insurance contract, the risks covered, the excluded cover, the causation, and the types of loss.

LW6176E International Air Law*

This course examines the major international law rules and case law that govern carriage by air of passengers, baggage and cargo. In particular, the course focuses on the laws that determine liability in the event of an air ‘accident’ involving injury to or assault of passengers, or where damage to or loss of cargo or baggage occurs. In addition to closely examining the Chicago, Rome and Warsaw Conventions, it also covers the new Montreal Convention and topical issues such as aviation security, DVT claims and incidents of air rage.

LW6177E Equity & Trusts

This course aims to examine the role of equity in the nature, scope and significance of trusts; to develop a sound knowledge of law, policy and practice in relation to modern trusts; to develop research skills, analytical and problem-solving skills, effective written and oral communication skills in relation to issues in trusts law; to develop an awareness of the social and commercial contexts in which trust law operates; to introduce students to some of the basic practical skills required to advise on application of trusts law; and to review the distinctions between trusts, gifts and the law of obligations (contract and tort).

23 LW6179E Maritime Arbitration Law*

The course introduces students to arbitration law and practice in the maritime industry. It aims to teach the skills, substantive law and procedures involved in maritime arbitration. Particular emphasis will be given to the arbitration law of Hong Kong, Mainland China and the United Kingdom.

LW6180E International Commercial Contracts and Uniform Sales Law

This course aims to introduce and examine the core areas of international contract law; interpretation, gap filling, formation of contract, obligations of the parties, remedies for breach of contract, unwinding of contracts and limitation of actions. It is conducted primarily on the basis of the United Nations Convention on Contracts for the International Sale of Goods 1980 (CISG), but also includes examination of the UNIDROIT Principles on International Commercial Contracts (UPICC) and other forms of internationalisation of contract law.

LW6181E Common Law System, Reasoning and Methodology

This course has three principal objectives. The first objective is to introduce students to the basic terminologies of law in general, and of the common law system in particular. The second objective is to introduce students to the techniques of case analyses. The third and final component of the course will deal with statutory interpretation. Overall, the course is designed to introduce students to the techniques of legal analyses – an essential building block on which they may erect their substantive knowledge of the law, at CityU and beyond.

LW6184E Special Topics in International Law: ICL/IHL*

This course aims to examine the models and methods of international accountability for crimes involving massive human rights violations; it will review the nature, character and legal elements of the crimes of genocide, serious war crimes, crimes against humanity and the crime of aggression. Students will review the history of international sanctioning bodies and identify jurisdictional constraints and other historical innovations and impediments. The course aims to analyze contemporary international criminal law initiatives in relation to principles of public international law and domestic state practice with regard to both theory and practical applications.

LW6186E Medical Law and Ethics

This course aims to provide students with the basic knowledge of medical law and ethics, and familiarise students with legal principles and rules on the core issues within the field of medical law and ethics; to prepare students to think analytically and critically on important and advanced topics relating to medical law and acquire problem-solving skills and effective research skills necessary to solve practical and academic problems regarding medical law.

24 LW6187E Chinese and Comparative Alternative Dispute Resolution

This course aims to introduce and critically examine the main types of alternative dispute resolution mechanisms in the PRC, namely, arbitration, mediation and negotiation. It identifies their main characteristics and considers the legal framework provided for them by current PRC law and practice. It also compares methods for resolving commercial disputes under the current law and practice in other jurisdictions.

LW6188E Chinese Maritime Law

This course surveys both substantive and procedural provisions in the Chinese maritime legal system from both comparative and international perspectives. Based on the Maritime Code and the Special Maritime Procedure Law of the People’s Republic of China as well as pertinent administrative regulations, departmental rules, and judicial interpretations, it covers all of the main areas of the Chinese maritime legal system. Wherever appropriate, each topic covered by this course is explored from a comparative perspective; pertinent international laws and conventions are addressed as well.

LW6189E Bills of Lading Law

This course examines the major international conventions, such as the Hague Rules, the Hague Visby Rules, the Hamburg Rules, the Rotterdam Rules and legal cases in relation to carriage of goods by sea. Sea carriage contracts in the form of bills of lading will be examined. Relevant Hong Kong legislation and cases will be closely examined.

LW6190E Charterparties Law

This course examines the law of voyage, time and demise charterparties by discussing clauses in benchmark standard forms and relevant legal cases. The benchmark standard forms to be discussed in the class mainly include GENCON, NYPE, and BARECON.

LW6191E Admiralty Law

This course aims at introducing students to the practical and procedural aspects of the Admiralty Jurisdiction as exercised by the High Court in Hong Kong. Issues including maritime liens and ship arrests are explored. Aspects of private international law (conflict of laws) as relevant to the Admiralty Jurisdiction are considered.

LW6192E Maritime Law

The course covers issues of maritime law which are excluded from the syllabus of ‘Bills of Lading Law’, ‘Admiralty Law’, and ‘Marine Insurance Law’. This course focuses on three separate aspects: ship-owning, ship management, and ship casualties. However, the law relating to marine collisions will not be covered in this course as students will be required to have navigational knowledge to understand circumstances surrounding marine collision cases.

25 LW6194E The Law of the Sea*

This course provides an explanation of the foundational principles of the law of the sea, a critical overview of the 1982 United Nations Convention on the Law of the Sea, and an analysis of subsequent developments including the many bilateral, regional, and global agreements that supplement the Convention. It takes as its focus the rules and institutions established by the Convention on the Law of the Sea in both historical and contemporary context.

LW6195E Law of Copyright, Designs and Allied Rights in Hong Kong

This course seeks to examine the law of copyright and related rights in the Hong Kong SAR, including the Copyright Ordinance, the Registered Designs Ordinance, the Layout Design (Topography) of Integrated Circuits Ordinance and relevant case law; to apply the law of copyright and related rights of Hong Kong to fact-based problems; and to provide students with an overview of the law of copyright and related rights of Hong Kong from a practice-oriented and industry perspective.

LW6196E Law of Trade Marks and Patents in Hong Kong

This course seeks to examine the law of trade marks and patents in the Hong Kong SAR, including the Trade Marks Ordinance, the Patents Ordinance and relevant case law; and to apply the law of trade marks and patents of Hong Kong to fact-based problems.

LW6198E Intellectual Property: Law, Practice and Procedure*

This course seeks to examine the various types of intellectual property rights (IP) and allied rights, the law and procedure in obtaining protection of statutory IP rights and the law regarding infringement proceedings of IP rights in the Hong Kong SAR; to equip students with the procedural skills and techniques necessary to provide legal advice on contemporary IP issues and to represent clients effectively in both contentious and non-contentious IP-related proceedings; to discuss and analyze the legal remedies available to clients in IP and technology related disputes; and to apply the above skills and techniques to fact-based problems.

LW6199E Business Intellectual Property

This course aims at providing a discovery-enriched curriculum for students to discover and explore the principles and framework of intellectual property in the contemporary business environment. Through discovery-enriched group projects on certain contemporary business IP issues, interactive lectures by selected IP-related industry leaders or elite professionals, and practise oriented IP field trips, students will be put in a discovery-enriched environment to explore the structure and effects of a particular legal and regulatory environment concerning business IP.

31 ADMINISTRATIVE AND FINANCIAL INFORMATION

TUITION FEES

The 2016/17 tuition fee is HK$4,710 per credit unit. Fees are subject to review from time to time without prior notification.

SCHOOL OF LAW ADMISSION SCHOLARSHIP FOR THE LLM PROGRAMME

Outstanding LLM applicants will receive LLM Admission Scholarship to set off against the University tuition fees. Three types of scholarships are provided hereunder:* 1) a maximum of 1 full scholarship to the value of 24-credit tuition fees, which equals HK$113,040; 2) a maximum of 3 scholarships, each to the value of 12-credit tuition fees, which equals HK$56,520; and 3) a maximum of 7 scholarships, each to the value of HK$30,000.

* The number of scholarships and allocation of scholarships each year are left entirely at the discretion of the School.

All LLM applicants will be considered for the scholarship automatically.

THE HONG KONG MARITIME LAW SCHOLARSHIP SCHEME

The Hong Kong Maritime Law Scholarship Scheme was established in 2011/12 and has been operating under the Maritime and Aviation Training Fund since 1 April 2014. Each year, a number of scholarships are offered to selected students of the Maritime and Transportation Law Stream of the LLM programme. These scholarships can be used to cover the full tuition fees at CityU.

ACCOMMODATION

Students should be prepared to arrange their own accommodation, as on-campus accommodation is usually not available due to limited space. For assistance in locating information on off-campus accommodation, see “Off- campus Accommodation” at http://www.cityu.edu.hk/sro/htm/e_off-campus1.htm.

FINANCIAL ASSISTANCE

The Non-means-tested Loan Scheme provides financial assistance to the LLM students who meet the eligibility requirements of the scheme, one of which is:

“Applicants should have the right of abode in the Hong Kong Special Administrative Region (“Hong Kong”) or the right to land in Hong Kong or are permitted to stay in Hong Kong without restriction or have resided or have had their home in Hong Kong continuously for three complete years immediately prior to the commencement of the programme/course. This does not cover students studying in Hong Kong holding student visas.”

32 CONTINUING EDUCATION FUND

One of our English Module courses LW6126E “Dispute Resolution in Theory and Practice” has been included in the list of reimbursable courses for Continuing Education Fund (CEF) purposes. Eligible CEF applicants who have obtained at least 50% in the final mark and have attended at least 70% of the course may be reimbursed 80% of the course fee, subject to a maximum sum of HK$10,000, on successful completion of the course. IMMIGRATION AND VISA REQUIREMENT

If you are a non-local applicant and do not have the right of abode in Hong Kong, you will need a student visa if you are accepted for admission. Please submit your student visa application as early as possible. The approval process may take about two months or even more.
