These notes refer to the Defamation Bill as introduced in the House of Commons on 10 May 2012 [Bill 5] DEFAMATION BILL —————————— EXPLANATORY NOTES INTRODUCTION 1. These Explanatory Notes relate to the Defamation Bill as introduced in the House of Commons on 10 May 2012. They have been prepared by the Ministry of Justice in order to assist the reader of the Bill and to help inform debate. They do not form part of the Bill and have not been endorsed by Parliament. 2. The Notes are to be read in conjunction with the Bill. They are not, and are not meant to be, a comprehensive description of the Bill. Where a clause or part of a clause does not seem to require any explanation or comment, none is given. SUMMARY 3. The Defamation Bill reforms aspects of the law of defamation. The civil law on defamation has developed through the common law over a number of years, periodically being supplemented by statute, most recently the Defamation Act 1952 (“the 1952 Act”) and the Defamation Act 1996 (“the 1996 Act”). BACKGROUND 4. The Government’s Coalition Agreement gave a commitment to review the law of defamation, and on 9 July 2010 the Government announced its intention to publish a draft Defamation Bill. The Draft Defamation Bill (Cm 8020) was published for full public consultation and pre-legislative scrutiny on 15 March 2011. The false news that the Claimant, Ricardo Eric Charles, was a “Most Wanted man” for having committed a crime, “flew” over the Defendants’ live and recorded television broadcasts on their crime prevention television programme “Beyond the Tape”. This together with the spontaneous commentary by the show’s host suggested that the public’s assistance was needed to find this person who was wanted by the police on that outstanding warrant. -

This consultation seeks views on some of the recommendations made by the Commission. It also seeks views on issues that were not raised as part of the Commission’s reform project. The protection of freedom of expression is essential for the democratic political process and the development of every human being. As Lord Hailsham said, “I regard freedom of expression as the primary right without which one cannot have a proper functioning democracy.” Yet at the same time it can conflict with other rights, such as reputation. Reputation is a component of the right to private life, and it forms the basis of the law of defamation. -

Contents Page Mapping the Path towards Codifying - or Not Codifying - the UK Constitution ROBERT BLACKBURN, PhD, LLD, Solicitor Professor of Constitutional Law Centre for Political and Constitutional Studies King's College London PROGRAMME OF RESEARCH Aims This programme of research has been prepared at the formal request1 of the House of Commons Political and Constitutional Reform Committee chaired by Graham Allen MP to assist its inquiry, and the policy debate generally, on the proposal to codify - or not - the UK constitution. The work been prepared in an impartial way, adopting a pragmatic approach to the issues involved, and does not seek to advocate either codification or non-codification. Its purpose is to inform the inquiry of the issues involved and, in the event that a government in the future might wish to implement such a proposal, it seeks to provide a starting point and set of papers to help facilitate the complex and sensitive issues of substance and process that would be involved. Structure of the Research The content starts (Part I) by identifying, and giving a succinct account of, the arguments for and against a written constitution, prepared in rhetorical manner. It then (Part II) sets out a series of three illustrative blueprints, prepared in the belief that a consideration of detailed alternative models on how a codified constitution might be designed and drafted will better inform and advance the debate on the desirability or not of writing down the constitution into one documentary source. These are - (1) Constitutional Code - a document sanctioned by Parliament but without statutory authority, setting out the essential existing elements and principles of the constitution and workings of government. -

THE HAMLYN LECTURES Thirtieth Series LIBERTY, LAW AND JUSTICE Sir Norman Anderson I STEVENS 1 LIBERTY, LAW AND JUSTICE by SIR NORMAN ANDERSON O.B.E., Q.C., LL.D., F.B.A. formerly Professor of Oriental Laws and Director of the Institute of Advanced Legal Studies in the University of London The concepts of liberty, law and justice, and the extent to which they serve to guarantee individual freedoms, form the central theme of the 1978 Hamlyn Lectures. Sir Norman Anderson examines the legal framework within which fundamental rights may be exercised in an important contribution to current discussion. Divided into four lectures, the work commences with an analysis of the relation of law to individual liberty today. In the second lecture, the author weighs up the prospect of incorporating a Bill of Rights into the Constitution of the United Kingdom. He looks at the American Constitution and considers the Universal Declaration of Human Rights and the European Convention. Anti-discrimination legislation is explored next. Enactment of the Sex Discrimination Act 1975 and the Race Relations Act 1976 aroused sharp controversy and the likely effectiveness of these measures remains problematic. In a detailed exposition of the back- ground to these statutes, comments of many leading authorities are reviewed. Limitation of human rights is dealt with in the final lecture. The degree of freedom enjoyed by Britain's Press is compared with that obtaining in the United States. There is a survey of the much-criticised Official Secrets Acts and forthright views are offered on a wide range of censorship questions.
