SUBJECT: Public Hearing and First Reading of an Ordinance amending Chapter 22 – Environment, Article II – Nuisances, Section 37 (a) Definitions, (c) Specific noise prohibitions.

SUMMARY: City Council is asked to consider an Ordinance to amend Chapter 22- Environment, Article II – Nuisances, Section 37 (a) Definitions, (c) Specific noise prohibitions that would prohibit the use of certain leaf blowers within the City’s corporate limits.

City Council is provided with three options for amending the Ordinance.

First, City Council may consider prohibiting all gasoline powered leaf blowers and, battery and electric powered leaf blowers that exceed 65 dBA as shown on the manufacturers label affixed to the leaf blower. This option would allow contractors and residents to use only those battery and electric powered leaf blowers that have a dBA rating of 65 or less.

Second, City Council may consider prohibiting all leaf blowers that exceed 65 dBA as shown on the manufacturers label affixed to the leaf blower. This option would allow contractors and residents to use only those leaf blowers that have a dBA rating of 65 or less regardless of their power type.

Finally, City Council may give staff direction for an Ordinance amendment different from what has been proposed. If this option is preferred, staff will prepare a revised Ordinance, based upon City Council direction, for discussion at the October 21, 2020 Regular City Council meeting.

BACKGROUND: During Public Comment at the May 13, 2019, City Council Workshop, Mr. James Streicher, representing the Old Naples Association (ONA), presented a petition to City Council requesting relief from noise generated by the use of lawn (leaf, debris, etc.) blowers in the ONA area. More specifically, the petition, which included 198 electronic signatures, requested the City consider requiring contractors to use lawn blowers that do not exceed 65 decibels dBA.

During City Council discussion, former City Councilor Reg Buxton asked that the City review options that would prohibit the use of gasoline-powered lawn blowers in the City. City Council agreed to schedule a Workshop discussion at a future date to consider ONA’s petition and Councilor Buxton’s suggestion. The City Council workshop was held on December 16, 2019.

At the December 16, 2019 City Council workshop, Council directed staff to present a text amendment that would include a 1-year lead time for landscapers to comply with equipment and decibel requirements, schedule discussions with landscape industry concerning the Ordinance amendment, and analyze enforcement issues for the Ordinance amendment. At the December 2019 workshop, staff included an option where properties exceeding one acre in size would be exempt from any Ordinance prohibiting gas powered leaf blowers. After consideration of enforcement issues, staff has not included that exemption in the current Ordinance options. This may create a hardship for contractors or property managers who maintain large properties (i.e., golf courses, parks, airport, etc.).

As previously directed, Ordinance options 1 and 2, provided for City Council consideration, propose an effective date that is one year from the date City Council approves an Ordinance at second reading.

Staff conducted an on-line survey to obtain feedback from the landscape contractors and residents. Public meetings were not held due to the COVID-19 public health emergency. Staff has considered Code Enforcement issues related to each Ordinance option.

Naples Noise Ordinance Noise is regulated under Chapter 22 – Environment, Article II – Nuisances, Section 37 Noise, of the City’s Code of Ordinances. As the Ordinance does not provide any specific regulation of leaf blower noise, regulation falls under the ‘General prohibitions.

The Ordinance provides both simple and complex definitions and measurement of noise. The use of leaf blowers in the City continues to be a source of complaints from some residents as evident through the petition from the ONA.

Leaf blowers are used liberally by landscape professionals, homeowners, and other trades workers throughout the City. The City’s Code Enforcement Division receives few formal complaints concerning leaf blower use. When a complaint is received, more often than not, the individual using the leaf blower has stopped using the machine by the time a Code Enforcement Officer arrives at the scene. If a Code Enforcement Officer does arrive while someone is using a leaf blower, the Code Officer will check the leaf blower for proper operation to include mufflers, excessive exhaust emission, fluid leaks, etc. If the machine does not have any mechanical problems, there is nothing the Code Officer do.

The Community Services Department receives periodic complaints about the use of leaf blowers in City parks by staff and contractors.

Old Naples Association Request for Neighborhood Specific Ordinance In their petition, the ONA requested that City Council approve an Ordinance (or similar directive) to prohibit commercial landscapers from operating leaf blowers that exceed 65 decibels only in the ONA Neighborhood. The boundaries of the ONA are shown below.

The City Attorney met with Mr. Streicher (ONA representative) and staff to discuss the ONA’s neighborhood-specific request. The City Attorney explained that any amendment to the City’s Noise Ordinance to prohibit leaf blowers only would need to apply to the entire City. A copy of the ONA petition is included in the agenda packet.

Measurement of Leaf Blower Noise The American National Standards Institute (ANSI) is a private, not-for-profit organization dedicated to supporting the U.S. voluntary standards and conformity assessment system and strengthening its impact, both domestically and internationally (source: ANSI website).

ANSI has issued ANSI B175.2-2000 (R2005) for the testing of Hand-Held and Backpack, Gasoline-Engine-Powered Blowers. The testing of leaf blowers is complex as explained in the ANSI testing standard for leaf blowers. The decibel level of leaf blowers is measured at a distance of 50’ from the source. This measurement is used by leaf blower manufacturers when marketing their equipment to potential buyers. A copy of this standard is included in the agenda item packet.

Based upon their testing, ANSI rates blowers in the following categories:

Category 1: Leaf Blowers that are rated at 65dba or lower Category 2: Leaf Blowers that are rated between 65dBa to 70dBa’s Category 3: Leaf Blowers that are rated at 70dBa and above

ANSI B175.2-2000 (R2005) requires leaf blower manufacturers to include a label that identifies which Category and therefore the decibel rating for each leaf blower sold in the .

In December 208, Washington DC (DC) approved legislation that will ban the sale and use of gas-powered blowers in the City effective January 1, 2022 (3-year phase-in). An article titled, “Get Off My Lawn” appeared in the Atlantic Magazine in April 2019 and discusses leaf blower noise and the DC ban. A copy of this article is included in the agenda packet.

A Technical Note titled “Leaf Blower Noise” was developed for the DC discussion. The study measured 7-commonly used leaf blowers. Three (3) were gas-powered and 4 were battery powered. This technical note concludes with a finding that gas-powered blowers created a lower frequency noise than battery blowers and that this low-frequency noise transmitted into residential properties more easily than the noise generated by battery blowers. The Technical Note is included in the agenda packet and the conclusions are inserted below.

While the DC study and eventual legislation concluded that battery-powered blowers produced less noise than gas-powered blowers, not all battery-powered or corded electrical blowers are rated with a 65 dBA sound rating (or lower) as requested by the ONA petition.

Emissions Some cities and towns have prohibited gas-powered leaf blowers due to concerns with emissions generated from 2-stroke engines (operates on a mix of gasoline and oil). These communities either allow battery and electric-powered blowers or ban all leaf blowers regardless of the power type.

The United States Environmental Protection Agency (EPA) conducted a study in 2015 titled “National Emissions from Lawn and Garden Equipment” to study emissions from lawn and garden equipment. The study concludes that lawn and garden equipment do generate emissions and increased educational campaigns should be used to increase public awareness about generated emissions. The study is included in the agenda packet.

There are multiple articles available that discuss the concerns of emissions generated by 2- stroke engines that are used broadly throughout communities. Two articles are provided in the agenda packet. The first is from Washington University in St. Louis which discusses concerns Ethics above all else... Service to others before self... The second article is from the Sierra Club titled “Lifestyle Eco- Actions: Gas-Powered Leaf Blowers” which speaks more specifically to the concerns of using gas-powered leaf blowers.

Additionally, staff has provided a scientific paper titled “Less Noise, No Fumes – Testing Cordless Leaf Blowers” for informational purposes.

Town of Palm Beach, Florida Leaf Blower Regulation There are many cities and towns in the United States that regulate or prohibit leaf blowers. Examples of Washington DC and Burlingame, CA restrictions and prohibitions were provided in the previous section of this memorandum. The Town of Palm Beach, FL is a community that has been previously discussed with City Council as it is a Florida community that has effectively restricted the use of leaf blowers to address the concerns raised by residents.

First, Palm Beach provides a specific definition for leaf blowers and prohibits the use of gas- powered leaf blowers on any property within the Town that is less than one acre in size. This means only battery or electric-powered leaf blowers can be used on parcels under 1-acre in size whether residential, commercial, or public in use.

Second, Palm Beach prohibits the use of leaf blowers that exceed 65 decibels measured at 50 feet from the source (ANSI Standard) in any location. This means gas, battery and electric- powered blowers must all be rated at 65 decibels or less to be used within the town.

The Town phased-in compliance over a 6-month period and, the use of blowers as provided in the Town Ordinance applies to commercial operators, Town operations and residents.

Staff has discussed the effectiveness of the Town Ordinances with the Code Enforcement staff in Palm Beach. There is good compliance to the Ordinances now. Once the Town Council approved the Ordinances referenced above, educational information was sent to commercial operators and residents. Friendly enforcement (warnings) were issued after the 6-month phase-in period. Offenders were provided with a one-time warning and their information was entered into the Police CAD system. If a second offense occurred (1st official offense), the fine was $120. Fines increased for second and third offenses to $250 and $400, respectively.

Public Engagement – On-Line Survey To obtain public input from residents and contractors, the City conducted an on-line “Leaf Blower Survey” during the month of March 2019. The COVID-19 public health emergency prevented any follow-up public meetings. The survey; however, provided good feedback for this public policy process. The City solicited responses to the survey by sending emails to landscape contractors registered with Collier County and residents through a variety of City electronic databases and communications with the Presidents’ Council.

In total, the survey received 192 responses. Respondents answered most but not all the survey questions. A copy of the full survey is included in the agenda packet.

The survey illustrates that 61 (32%) of the 192 respondents identified as contractors and 131 (68%) respondents identified as residents.

The survey asked respondents if they supported amending the City Ordinance to allow only battery powered leaf blowers that have a decibel rating of 65 dBA or lower, 107 (55.7%) responded yes and 85 (44.27%) responded no.

Landscape Contractor Concerns: In general, landscape contractors who service properties in Naples do not support prohibiting equipment they use and need to perform their work efficiently and effectively. Landscapers are concerned that prohibiting leaf blowers with a dBA rating over 65 that they currently own, will increase their costs that will be passed along to customers and result in higher fees to manage the same property.

Landscape contractors are also concerned with the option that prohibits the use of gasoline leaf blowers in favor of battery and electric leaf blowers (Option 1). Electric leaf blowers (rated at or below 65 dBA) may be sufficient for homeowners, but they are not a viable option for landscape contractors. Battery powered leave blowers (rated at or below 65 dBA) have a higher upfront cost than gasoline powered leaf blowers because of the cost of backup batteries. The lifetime costs of battery powered leaf blowers, however, are lower than the lifetime costs of gasoline powered blowers. A representative from will provided City Council with additional information concerning lifetime costs of leaf blowers. The agenda packet includes information on equipment cost and Stihl battery run times.

The City’s survey asked landscape contractors and residents who own a leaf blower to estimate how much it would cost to purchase compliant equipment (rated at or below 65 dBA). Approximately 16% of the respondents believe their compliant equipment costs would range between $5,000 and over $10.000.

As illustrated in the survey results (Question 9), landscape contractors and residents who own a leaf blower favor the longest possible lead time for their companies to purchase equipment that would comply with any Ordinance amendments approved by City Council. The survey results are included in the agenda packet.

Options to Consider: 1. Amend Ordinance to prohibit the use of gasoline-powered leaf blowers within the City and restrict the use of electric or battery powered leaf blowers to those that do not exceed 65 dBA.

2. Amend Ordinance to prohibit the use of leaf blowers that exceed 65 dBA. This allows for the use of gasoline, electric or battery powered leaf blowers within the City.

3. Other – As may be recommended by City Council and reschedule first reading for an Ordinance amendment at a future City Council meeting.

Potential Impact of Options 1. Amend Ordinance to prohibit the use of gasoline-powered leaf blowers within the City and restrict the use of electric or battery powered leaf blowers to those that do not exceed 65 dBA.

o Potential Impact - Prohibiting the use of gasoline-powered leaf blowers will require contractors to replace equipment and purchase backup batteries so they may perform their required work within the parameters of a revised Ordinance. • This cost could be mitigated by making the effective dated of the Ordinance 1-year from approval at 2nd reading. Assuming landscape contractors replace leaf blowers periodically, contractors can begin the acquisition of battery-powered leaf blowers in advance of an effective Ordinance date. • Staff has spoken with a representative of Stihl equipment. Staff was informed that the upfront cost of purchasing battery-powered blowers and batteries is more expensive than gas blowers; however, the life cycle cost of battery-powered blowers is less than gas blowers.

2. Amend Ordinance to prohibit the use of leaf blowers that exceed 65 dBA. This allows for the use of gasoline, electric or battery powered leaf blowers within the City.

o Potential Impact - Allowing the use of gasoline-powered leaf blowers would not address the concerns of residents who raise concerns over the use of emissions generated by gasoline powered leaf blowers.

o Potential Impact - Prohibiting the use of gasoline-powered leaf blowers with a decibel rating of 65 decibels or less will require commercial landscape contractors to replace equipment. • This cost could be mitigated by making the effective dated of the Ordinance 1-year from approval at 2nd reading. Assuming landscape contractors replace leaf blowers periodically, contractors can begin the acquisition of blowers with a maximum decibel rating of 65 decibels or less in advance of an effective Ordinance date.

Application City Attorney Jim Fox recommends that any changes recommended by City Council apply city- wide. It would not be feasible to enforce an Ordinance that is specific to the ONA area of the City or any other neighborhood association area.

The Ordinance amendments drafted for consideration would apply to contractors and residents alike.

Code Enforcement Code Enforcement Manager Karla Gibbs has contributed to the development of the Ordinance options presented to City Council. The following information provides some insight from Code Enforcement.

(1) Prohibiting gasoline leaf blowers (Option 1) can be easily enforced when Officers observe a gasoline leaf blower in use or when they receive a complaint about a gasoline leaf blower from residents.

(2) Requiring leaf blowers to have the manufacturers label affixed to the machine allows Officers to check the label for compliance with the Ordinance when complaints are received.

(3) When responding to complaints about leaf blowers, the equipment user may have left the area or put the equipment away which may complicate enforcement efforts.

(4) The City will need to create educational information concerning an Ordinance amendment so residents, contractors and property managers can acquire equipment (if needed) that complies with the Ordinance. An example of Saratoga, CA informational brochure is included in the packet. The City of Saratoga

Leaf Blower Labels Both Option 1 and 2 proposed that leaf blowers used in the City cannot “exceed a decibel level of 65 dBA as shown on the manufacturers label affixed to the leaf blower”. The manufacturers label shows the leaf blower has been tested in accordance with ANSI B175.2 and the decibel rating printed on the label represents the decibels generated 50 feet from the point of operation.

As previously stated, the ANSI B175.2 ratings are:

Category 1: Leaf Blowers that are rated at 65dba or lower Category 2: Leaf Blowers that are rated between 65dBa to 70dBa’s Category 3: Leaf Blowers that are rated at 70dBa and above

Some labels may only show the decibel category for the leaf blower, only show the decibel rating, while others may show both the dBA rating and the Category. Examples of labels are shown below.

The following statement is from the Echo publication titled “A Training Manual in the Proper Use of Leaf Blowers” which speaks to the effectiveness of noise ordinances that rely on labels to enforce the use of ‘quiet’ leaf blowers.

“If there must be an ordinance, here’s one that works. Require landscapers and homeowners to use only “Quiet” leaf blowers. What is a “Quiet” blower? It’s one that is at least 70 dB(A) or less according to the ANSI Standard, B-175.2. Sixty-five is better, but really not necessary in most cases since the whine generated by the is no longer an issue. This type of ordinance is easy to enforce and therefore complied with voluntarily by landscapers. Why? Because the manufacturer marks “Quiet” leaf blowers with its sound level per the industry Standard. This allows the police to simply stop and look at the product at any time convenient to them, in order to catch violators. No need to wait for a complaint. No need to rush across town to catch a violator in the act.”

While the ANSI Standard B-175.2 is required for gasoline powered leaf blowers, most manufacturers provide the same label on battery powered leaf blowers such as the Stihl BGA 100 shown above. However, other manufacturers of battery powered leaf blowers do not include a dBA rating on their equipment such as the Greenworks GBB 700 label shown below. Based on the Ordinance options provided for this discussion, the Greenworks leaf blower could not be used within the City limits.

Fines The Ordinance currently provides for the following fines for violations of the Ordinance:

“A violation of this section is a non-criminal infraction, and the civil penalty is $100.00 for the first offense and $500.00 for each subsequent offense occurring within one year after a finding of violation of the previous offense or a plea of no contest.”

Staff has not recommended any changes to the fines for violations.

Industry Presentation Michael Surrena, Stihl Southeast District Manager for Florida will present information to City Council concerning both gasoline and battery powered blowers. Mr. Surrena was recommended to City staff by the Town of Palm Beach. After speaking with Mr. Surrena staff believes he can provide valuable technical information for this discussion. Mr. Surrena’s presentation is included in the agenda packet.

AN ORDINANCE RELATING TO LEAF BLOWER USE, AMENDING CHAPTER 22, ENVIRONMENT, ARTICLE II, NUISANCES, SECTION 22-37, NOISE; PROVIDING A SEVERABILITY CLAUSE, A REPEALER PROVISION, AND AN EFFECTIVE DATE.

WHEREAS, the City of Naples regulates Noise as specified in Chapter 22, Article II, Section 37, Code of Ordinances; and

WHEREAS, residents have petitioned City Council asking for relief from excessive noise generated by certain leaf blowers that unreasonably interferes with resident’s customary use and enjoyment of their property; and

WHEREAS, City Council desires to prohibit the use of certain leaf blowers within the City’s corporate limits to mitigate excessive noise that is generated by certain leaf blowers;

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NAPLES, FLORIDA:

Section 1. That Section 22-37, Noise, of the Code of Ordinances, City of Naples, is hereby amended to read as follows (with underlining indicating additions and strikethrough indicating deletions):

Sec.22-37. - Noise.

(a) Definitions.

A-weighted level (dBA) means the total broad band sound level of the noise spectrum as measured using the "A-weighted network" of a sound level meter (SML). The unit of measurement is the dBA. All sound level meter settings will shall be for slow response, except for impulsive noise measurements which will shall be fast response.

Ambient sound means the all-encompassing sound associated with a given environment, being usually a composite of sounds from many sources near and far. For the purposes of this section, ambient sound level is the level obtained when the sound level is averaged over a period of at least 15 minutes without inclusion of sound from occasional or occasional and transient sources, at the location and time of day near that at which a comparison is to be made.

Amplified sound means sound augmented by any electronic means that increases the sound level or volume.

Decibel (dB) means a unit for describing the amplitude of sound, equal to 20 times the Ordinance 2020- Page 2

logarithm to the base ten of the ratio of the pressure of the sound measured to the reference pressure, which is 20 micronewtons per square meter.

Impulsive sound means a noise which is characterized by brief excursions of sound pressure which significantly exceed the ambient sound level.

Leaf Blower means any air blowing machine that uses a concentrated stream of air to push, propel, or blow dirt, dust, leaves, grass clippings, trimmings, cuttings, refuse, or debris.

Nearest adjacent property line means the property line closest to the noise source.

Noise, or noise disturbance, means any sound that: (1) Exceeds the maximum permitted sound levels set out in Table 1 of this section; or (2) Is loud and raucous so as to unreasonably disturb, injure, or endanger the comfort, repose, health, peace, tranquility, or safety of reasonable persons of ordinary sensibilities; (3) Constitutes a breach of the peace or a public nuisance; (4) Is plainly audible at a distance of 25 feet or more from the property line; or (5) With respect to vehicles and vessels, is plainly audible at a distance of 25 feet from the noise source.

Non-residentially zoned areas means those zoning districts which are not zoned primarily for single-family or multifamily use. Non-residentially zoned areas include all commercial, industrial, public service, PD for commercial uses, and other districts which permit nonresidential uses.

Octave band means all of the components in a sound spectrum whose frequencies are between two sine-wave components separated by an octave.

Property line means an imaginary line exterior to any enclosed structure, at the ground surface, which separates the real property owned by one person from that owned by another person, and its vertical extension.

Pure tone means any sound which can be distinctly heard as a single pitch or a set of single pitches. For the purposes of measurement, a pure tone will shall exist if the one-third octave band sound pressure level in the band with the tone exceeds arithmetic value of the sound pressure levels of the two contiguous one-third octave bands by five dB for center frequencies of 500 Hz and above and by eight dB for center frequencies between 160 and 400 Hz and by 15 dB for center frequencies less than or equal to 125 Hz.

Receiving property means the property which is receiving the noise.

Sound means an oscillation in pressure, stress, particle displacement, particle velocity, or other physical parameter, in a medium with internal forces. The description of sound may include any characteristic of such sound including duration, intensity, and frequency.

Sound amplifying equipment means any machine or device for the amplification of human voice, music, or any other sound.

Sound level meter means an instrument to measure the sound pressure level of relatively continuous and broadband noises. The sound level meter used to determine compliance with this section must shall meet or exceed the requirements for Type 2 sound level meter in accordance with ANSI Standard S1.4. Ordinance 2020- Page 3

(b) General prohibitions.

(1) It will shall be unlawful and prohibited for any person to make, continue, or cause to be made or continued any noise, as defined in this section, or to create any noise disturbance within the limits of the city. (2) It will shall be unlawful and prohibited for any person owning or in possession of any building or premises to use, allow the use, or rent the same for any business or residential use, or for any purpose of pleasure or recreation if such use makes, continues, or causes to be made or continued, any noise, as defined in this section, within the limits of the city.

(c) Specific noise prohibitions. The following acts, where meeting the definition of noise above, are declared to be examples and prima facie evidence of noises that constitute a noise disturbance, breach of the peace, and public nuisance:

(1) Radios, audio or visual equipment, sound equipment, sound amplification devices, exterior loudspeakers, musical instruments and similar devices. Operating or permitting the use or operation of any radio, musical instrument, audio or visual equipment, sound amplification devices, exterior loudspeaker, or other device for the production or reproduction of sound in such a manner as to cause noise. The operation of any such device for the production or reproduction of sound: a. Between the hours of 10:00 p.m. and 7:00 a.m. must shall be controlled so that it is not loud or disturbing or a nuisance to persons within the area of audibility, or b. At any time with louder volume than is necessary for convenient hearing for persons who are in the same dwelling unit of any multiple dwelling in which such device is operated, will shall be deemed prima facie evidence of a violation of this section.

Radios, audio systems, and similar devices associated with motor vehicles or motorboats, shall not be operated in such a manner as to create noise that is plainly audible at 25 feet or more from such device, when operated on a public right-of-way, waterways, beaches, or public space.

(2) Engine mufflers. Operating any internal combustion engine, including such an engine associated with a motorboat, or motor vehicle without a muffler. or other device at least as effective as that installed as original equipment by the manufacturer, which will effectively prevent loud or explosive noises therefrom. (3) Motor vehicle, motorcycle, or motorboat repair in residential areas. The noncommercial repairing, rebuilding, modifying, or testing of any motor vehicle, off-road vehicle, or motorboat within or abutting any residential land use designation in such a manner as to create noise across a real property line between the hours of 10:00 p.m. and 7:00 a.m. (4) Activities near in the vicinity of schools, churches, and health care facilities. Creating noise on any street adjacent to any school, church, or health care facility, which unreasonably interferes with the workings of such institution, or which disturbs or unduly annoys patients in a health care facility. (5) Peddling, hawking, or vending. Peddling, hawking, or vending, including shouting, crying out by peddlers, hawkers, or vendors along or on a Ordinance 2020- Page 4

roadway. (6) Yelling, shouting. Yelling, shouting, hooting, whistling, singing, or the making of similar noises, and loud, boisterous conduct other than normal conversation at reasonable levels, inside of or on the grounds of any public or private property between the hours of 10:00 p.m. to 7:00 a.m., that so as to annoys or disturbs the quiet, comfort, or repose of other persons or create a disturbance. (7) Horns, signal devices. Sounding of any horn or audible signal device of any motor vehicle, boat, engine, or machine of any kind while not in motion, nor will shall such horn or signal device be sounded under any circumstances except as required by law, or as a danger warning, nor will shall it be sounded for any unnecessary or unreasonable period of time. (8) units and other mechanical equipment including, pool or spa heaters and pumps, and regularly-used generators, irrigation pumps, and exhaust fans. Operating any noise creating fan or blower, air conditioner, compressor unit, pool heaters, pool pumps, heat pumps, or the electric motor or any engine used to drive such device, the operation of which causes excessive and unnecessary noise, unless such noise is muffled and deadened by adequate noise compression and muffling devices to minimize annoyance and disturbance to persons within range of hearing. Noise will shall be presumed excessive if it exceeds decibel limitations prescribed in Table 1 when measured at the property line of the receiving property. Mechanical equipment installed before December, 2006 shall not exceed 60 decibels (dBA). (9) Drums, cymbals, musical instruments, and loudspeakers. Creating, making, or maintaining any noise by the use of any drum, cymbals, loudspeaker, or other similar instruments in the city for the purpose of attracting attention to any performance, show, sale, or display of merchandise, or place of business. This provision shall not apply to permitted special events. (10) Bells or sirens on vehicles. Using, in connection with an unauthorized vehicle, any bell or siren similar to that used on ambulances or vehicles of the sheriff, fire departments, and other public safety agencies. (11) Skateboard ramps. Using any skateboard ramp or similar configuration for skateboarding or rollerblading between 10:00 p.m. and 7:00 a.m. in a residential land use designation in such a manner that results in noise across a real property line. (12) Powered model vehicles. Operating or permitting the operation of powered model vehicles in such a manner as to create noise across a real property line between the hours of 9:00 p.m. and 7:00 a.m. (13) Animal noises. Allowing an animal to habitually bark, whine, howl, squawk, screech, or cause any other noise which is objectionable due to pitch, frequency, duration, or timing. (14) Lawn, landscape, and tree maintenance. Permitted days and hours of operation for lawn and landscape maintenance, tree trimming, and tree removal. Lawn and landscape maintenance activities, tree trimming activities, and tree removal activities may be conducted only during the following hours, Monday through Sunday except New Year's Day, Easter Sunday, Memorial Day, July 4th, Labor Day, Thanksgiving Day, and Christmas Day: a. Monday through Friday hours of operation: 1. In residential areas: 7:30 a.m. to 5:30 p.m. 2. In nonresidential areas: 6:30 a.m. to 5:30 p.m. b. Saturday hours of operation: Ordinance 2020- Page 5

1. Businesses that perform lawn and landscape maintenance, tree trimming, or tree removal services may perform services in residential and nonresidential areas from 8:00 a.m. to 4:00 p.m. 2. Residents may perform lawn and landscape maintenance activities in residential areas at their own property from 8:00 a.m. to 7:00 p.m. c. Sunday hours of operation: 1. Businesses that perform lawn and landscape maintenance, tree trimming, or tree removal services are prohibited from working on any Sunday in residential or nonresidential areas. 2. Residents may perform lawn and landscape maintenance activities in residential areas at their own property from 8:00 a.m. and 5:00 p.m. (15) Leaf blowers. The use of gasoline-powered leaf blowers is prohibited within the city. This prohibition will become effective one year from the date approved by Council. a. Battery- and electric-powered leaf blowers may be used within the city provided they do not exceed a decibel level of 65 dBA as shown on the manufacturers label affixed to the leaf blower. b. Battery- and electric-powered leaf blowers that do not have a manufacturers label affixed to it that reflects its dBA rating may not be used within the city.

(165) Outdoor live entertainment. Providing outdoor live entertainment, as authorized in section 56-125 of the Code of Ordinances. a. In such a manner as to create noise as defined in this section as measured at the receiving property or a substantially similar location. (d) Exemptions. The following noises will shall be exempt from the restrictions set forth in the other sections of this article: (1) Noises of authorized safety signals and warning devices. (2) Noises resulting from any authorized emergency vehicle, when responding to an emergency call, or acting in time of emergency, or any other public safety operation. (3) Noises resulting from emergency work, which is to be construed as work made necessary to restore property to a safe condition following a public calamity, or work required to protect persons or property from any imminent exposure to danger. (4) Noises incidental to and necessary for city approved solid waste collection equipment, public works construction and maintenance; and police or fire training. a. The city manager, may grant a waiver, may prescribe any reasonable conditions or requirements it deems necessary to minimize adverse effects upon the community or the surrounding neighborhood. b. A waiver may be given upon finding that it will not unreasonably disturb, injure, or endanger the comfort, repose, health, peace, or safety of any affected persons because it is temporary in nature, adjacent property owners do not object, or for necessity or unavoidability. c. Waivers may be issued for no longer than 30 days, renewable by further application to the city manager. Ordinance 2020- Page 6

(5) City maintenance activities and equipment operation within public service zoning districts, whether performed by city staff or a city contractor, may take place between the hours of 8:00 a.m. and 4:00 p.m. on Sunday. (6) City maintenance activities and equipment operation at public beach access areas, whether performed by city staff or a city contractor, may take place between the hours of 7:30 a.m. and 4:00 p.m. on Saturday and Sunday. (7) Golf course maintenance activities and equipment operation within the city is not restricted during the hours listed in subsection 22-37(c)(14). (8) Lawn and landscape maintenance equipment may be used within the Fifth Avenue south special overlay district and the Third Street commercial area special overlay district between the hours of 8:00 a.m. and 4:00 p.m. (9) Special event permit holders may use lawn and landscape maintenance equipment after the afternoon hours listed in subsection 22-37(c)(14) to clean up special event areas provided the cleanup is performed expeditiously and immediately after the event ends. (e) Octave band levels. In addition to the noise limitations listed in this section, for any source or sound that can be detected on a receiving property, when measured at the nearest point of the property line of the receiving property, the maximum allowable sound level limit for the individual octave bands must shall comply with Table 1. In no case will shall the noise level on the premises of any other occupied property measured at a point on the nearest adjacent property line closest to the noise source, or if a condominium, apartment house, duplex, or attached business, within any adjoining unit, exceed the ambient noise level by more than five decibels.

(f) Enforcement and penalties. A violation of this section is a non-criminal infraction, and the civil penalty is $100.00 for the first offense and $500.00 for each subsequent offense occurring within one year after a finding of violation of the previous offense or a plea of no contest. It is also enforceable and punishable as provided in subsections 1-15(b), (c), (d) and (e) of this Code. In addition, if a permit for live entertainment, a special event, or extended hours has been issued and the permit holder or person acting under the permit, violates this section, the permit is subject to revocation or non-renewal.

Section 2. That if any word, phrase, clause, subsection, or section of this ordinance is for any reason held unconstitutional, invalid, or ineffective, the same will not affect the validity of any remaining portions of this ordinance. In such event, the pre-existing word, phrase, clause, subsection, or section, will be revived.

Section 3. That all sections or parts of sections of the Code of Ordinances, City of Naples, all ordinances or parts of ordinances, and all resolutions or parts of resolutions in conflict herewith, be and the same are hereby repealed to the extent of such conflict.

Section 4. This ordinance will take effect immediately upon adoption at second reading.

AN ORDINANCE RELATING TO LEAF BLOWER USE, AMENDING CHAPTER 22, ENVIRONMENT, ARTICLE II, NUISANCES, SECTION 22-37, NOISE; PROVIDING A SEVERABILITY CLAUSE, A REPEALER PROVISION, AND AN EFFECTIVE DATE.

WHEREAS, the City of Naples regulates Noise as specified in Chapter 22, Article II, Section 37, Code of Ordinances; and

WHEREAS, residents have petitioned City Council asking for relief from excessive noise generated by certain leaf blowers that unreasonably interferes with resident’s customary use and enjoyment of their property; and

WHEREAS, City Council desires to prohibit the use of certain leaf blowers within the City’s corporate limits to mitigate excessive noise that is generated by certain leaf blowers;

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NAPLES, FLORIDA:

Section 1. That Section 22-37, Noise, of the Code of Ordinances, City of Naples, is hereby amended to read as follows (with underlining indicating additions and strikethrough indicating deletions):

Sec.22-37. - Noise.

(a) Definitions.

A-weighted level (dBA) means the total broad band sound level of the noise spectrum as measured using the "A-weighted network" of a sound level meter (SML). The unit of measurement is the dBA. All sound level meter settings will shall be for slow response, except for impulsive noise measurements which will shall be fast response.

Ambient sound means the all-encompassing sound associated with a given environment, being usually a composite of sounds from many sources near and far. For the purposes of this section, ambient sound level is the level obtained when the sound level is averaged over a period of at least 15 minutes without inclusion of sound from occasional or occasional and transient sources, at the location and time of day near that at which a comparison is to be made.

Amplified sound means sound augmented by any electronic means that increases the sound level or volume.

Decibel (dB) means a unit for describing the amplitude of sound, equal to 20 times the Ordinance 2020- Page 2

logarithm to the base ten of the ratio of the pressure of the sound measured to the reference pressure, which is 20 micronewtons per square meter.

Impulsive sound means a noise which is characterized by brief excursions of sound pressure which significantly exceed the ambient sound level.

Leaf Blower means any air blowing machine that uses a concentrated stream of air to push, propel, or blow dirt, dust, leaves, grass clippings, trimmings, cuttings, refuse, or debris.

Nearest adjacent property line means the property line closest to the noise source.

Noise, or noise disturbance, means any sound that: (1) Exceeds the maximum permitted sound levels set out in Table 1 of this section; or (2) Is loud and raucous so as to unreasonably disturb, injure, or endanger the comfort, repose, health, peace, tranquility, or safety of reasonable persons of ordinary sensibilities; (3) Constitutes a breach of the peace or a public nuisance; (4) Is plainly audible at a distance of 25 feet or more from the property line; or (5) With respect to vehicles and vessels, is plainly audible at a distance of 25 feet from the noise source.

Non-residentially zoned areas means those zoning districts which are not zoned primarily for single-family or multifamily use. Non-residentially zoned areas include all commercial, industrial, public service, PD for commercial uses, and other districts which permit nonresidential uses.

Octave band means all of the components in a sound spectrum whose frequencies are between two sine-wave components separated by an octave.

Property line means an imaginary line exterior to any enclosed structure, at the ground surface, which separates the real property owned by one person from that owned by another person, and its vertical extension.

Pure tone means any sound which can be distinctly heard as a single pitch or a set of single pitches. For the purposes of measurement, a pure tone will shall exist if the one-third octave band sound pressure level in the band with the tone exceeds arithmetic value of the sound pressure levels of the two contiguous one-third octave bands by five dB for center frequencies of 500 Hz and above and by eight dB for center frequencies between 160 and 400 Hz and by 15 dB for center frequencies less than or equal to 125 Hz.

Receiving property means the property which is receiving the noise.

Sound means an oscillation in pressure, stress, particle displacement, particle velocity, or other physical parameter, in a medium with internal forces. The description of sound may include any characteristic of such sound including duration, intensity, and frequency.

Sound amplifying equipment means any machine or device for the amplification of human voice, music, or any other sound.

Sound level meter means an instrument to measure the sound pressure level of relatively continuous and broadband noises. The sound level meter used to determine compliance with this section must shall meet or exceed the requirements for Type 2 sound level meter in accordance with ANSI Standard S1.4. (b) General prohibitions.

(1) It will shall be unlawful and prohibited for any person to make, continue, or cause to be made or continued any noise, as defined in this section, or to create any noise disturbance within the limits of the city. (2) It will shall be unlawful and prohibited for any person owning or in possession of any building or premises to use, allow the use, or rent the same for any business or residential use, or for any purpose of pleasure or recreation if such use makes, continues, or causes to be made or continued, any noise, as defined in this section, within the limits of the city.

Mechanical equipment installed before December, 2006 shall not exceed 60 decibels (dBA). (9) Drums, cymbals, musical instruments, and loudspeakers. Creating, making, or maintaining any noise by the use of any drum, cymbals, loudspeaker, or other similar instruments in the city for the purpose of attracting attention to any performance, show, sale, or display of merchandise, or place of business. This provision shall not apply to permitted special events. (10) Bells or sirens on vehicles. Using, in connection with an unauthorized vehicle, any bell or siren similar to that used on ambulances or vehicles of the sheriff, fire departments, and other public safety agencies. Leaf blowers that do not have its manufacturers label affixed to it that shows its dBA rating may not be used within the city. (165) Outdoor live entertainment. Providing outdoor live entertainment, as authorized in section 56-125 of the Code of Ordinances. a. In such a manner as to create noise as defined in this section as measured at the receiving property or a substantially similar location. (d) Exemptions. The following noises will shall be exempt from the restrictions set forth in the other sections of this article: (1) Noises of authorized safety signals and warning devices. (8) Lawn and landscape maintenance equipment may be used within the Fifth Avenue south special overlay district and the Third Street commercial area special overlay district between the hours of 8:00 a.m. and 4:00 p.m. (9) Special event permit holders may use lawn and landscape maintenance equipment after the afternoon hours listed in subsection 22-37(c)(14) to clean up special event areas provided the cleanup is performed expeditiously and immediately after the event ends. (f) Enforcement and penalties. A violation of this section is a non-criminal infraction, and the civil penalty is $100.00 for the first offense and $500.00 for each subsequent offense occurring within one year after a finding of violation of the previous offense or a plea of no contest. It is also enforceable and punishable as provided in subsections 1-15(b), (c), (d) and (e) of this Code. In addition, if a permit for live entertainment, a special event, or extended hours has been issued and the permit holder or person acting under the permit, violates this section, the permit is subject to revocation or non-renewal.

Section 2. That if any word, phrase, clause, subsection, or section of this ordinance is for any reason held unconstitutional, invalid, or ineffective, the same will not affect the validity of any remaining portions of this ordinance. In such event, the pre-existing word, phrase, clause, subsection, or section, will be revived.

Section 3. That all sections or parts of sections of the Code of Ordinances, City of Naples, all ordinances or parts of ordinances, and all resolutions or parts of resolutions in conflict herewith, be and the same are hereby repealed to the extent of such conflict.

Section 4. This ordinance will take effect immediately upon adoption at second reading.

REQUEST FOR QUIETER GAS POWERED LEAF BLOWERS IN OLD NAPLES NEIGHBORHOOD

SECTION 22-37 OF THE NAPLES CODIFIED ORDINANCES CURRENTLY PROHIBITS ANY NOISE WHICH UNREASONABLY DISTURBS THE COMFORT OF REASONABLE PERSONS OF ORDINARY SENSIBILITY OR IS IN EXCESS OF EXISTING DECIBEL LEVELS OUTLINED IN THE CODE.

AT THE RECENT ANNUAL MEETING OF THE OLD NAPLES ASSOCIATION (ONA) THERE WAS OVERWHELMING SUPPORT FOR QUIETER LEAF BLOWERS AND THE MEMBERS PRESENT ASKED THE ONA BOARD TO PETITION CITY COUNCIL FOR SOME RELIEF NOW THAT LOWER NOISE LEAF BLOWERS ARE AVAILABLE AND DESIGNED FOR USE IN NEIGHBORHOODS LIKE OLD NAPLES.

THE DIRECTOR OF COMMUNITY SERVICES FOR THE CITY RECENTLY TESTED THE LEAF BLOWERS BEING USED BY LANDSCAPE CONTRACTORS FOR THE CITY AND NONE COMPLIED WITH THE EXISTING NOISE ORDINANCE. THE DIRECTOR ALSO PROVIDED COUNCIL WITH A COMPARRISON OF GAS POWERED LEAF BLOWERS TO VACUUMS AND ELECTRIC LEAF BLOWERS, BUT FOR A VARIETY OF LEGITIMATE REASONS ( COST, BATTERY LIFE, POWER,INEFFICIENCY) NO MEANINGFUL ACTION WAS TAKEN.

IN RESPONSE TO HUNDREDS OF COMMUNITIES SEEKING SOME RELIEF FROM THE OF GAS POWERED BLOWERS, MANUFACTURERS (ECHO, STIHL, OTHERS) ARE BUILDING QUIETER MODELS. ECHO CLAIMS ITS LOW NOISE BLOWER IS AROUND 75% QUIETER THAN A TRADITIONAL BLOWER. THE QUIETER BLOWERS ARE COMPARABLE IN PRICE AND EFFICINCY. COMMERCIAL LANDSCAPERS GENERALLY CYCLE LEAF BLOWERS EVERY THREE YEARS OR SO AND THERE WOULD BE LITTLE OR NO COST TO REPLACE A LOUDER BLOWER WITH A QUIETER ONE IF IT IS TO BE USED IN OLD NAPLES. ONLY SPOT CHECKS AND AN APP OR LIST OF LEAF BLOWER MODEL RATINGS ARE NEEDED TO PROVE THAT SOUND PRESSURE OF A BLOWER IN USE IS RATED BY THE MANUFACTURER AT 65 DECIBELS OR LESS TO COMPLY WITH OUR NOISE ORDINANCE. OUR REQUEST IS NEIGHBORHOOD SPECIFIC ( PORT ROYAL­ STREET PARKING ORDINANCE). LANDSCAPERS WOULD NOT BE ADVERSLY AFFECTED.

A FEW WEEKS AGO, ONA CIRCULATED A PETITION TO MEMBERS AND RECEIVED 190 SIGNED PETITIONS IN LESS THAN A WEEK REQUESTING COUNCIL TO REQUIRE THAT ONLY THE QUIETER LEAF BLOWERS (65 DECIIBELS OR LESS) BE USED BY COMMERCIAL LANDSCAPERS IN THE OLD NAPLES NEIGHBORHOOD. THE OLD NAPLES NEIGHBORHOOD IS DENSLY POPULATED AND THE NOISE GENERATED BY THE LOUDER BLOWERS IS ESPECIALLY IRRITATING TO OUR RESIDENTS, VISITORS AND GUESTS. BY ENFORCING OUR NOISE ORDINANCE, COUNCIL WOULD BE GIVING SOME IMMEDIATE AND DESERVED RELIEF TO THE OLD NAPLES COMMUNITY FROM THE NOISE GENERATED FROM THE LOUDER BLOWERS. AN ORDINANCE OR DIRECTIVE, SIMILAR TO THE FOLLOWING, COULD BE ADOPTED AND PRESENTED TO THE CITY MANAGER TO IMPLEMENT, POSSIBLY BEFORE YOUR SUMMER RECESS:

About this petition

The Naples City Ordinances currently prohibit any noise which exceeds the maximum permitted sound levels allowed in Table 1 of Section 22-37 of the Code or unreasonably disturbs, injures or endangers the comfort, repose, health, peace, tranquility or safety of reasonable persons of ordinary sensibilities. Most leaf blowers currently used in the neighborhood exceed the noise level permitted under the Code. Quieter leaf blowers are now available that are as efficient and cost competitive According to manufacturers they are up to 70% quieter than comparable models and would comply with the permitted sound levels allowed by the Code (65 dBA as measured at 50 feet ).

We the undersigned request Council to direct that effective January 1, 2020, the above mentioned Code be enforced and landscapers operating in the Old Naples Neighborhood be required to use blowers that have been stamped by the manufacturers showing the noise level is 65 dBA or less.

So we know first hand that prolonged exposure can impact our hearing. This is why when at concerts, gun ranges, and shuttle launches hearing protection is recommended.

So knowing all of this, where does the PB-250LN gasoline powered blower from ECHO fall in terms of decibels? Measured at 50 feet it is a mere 65 dB(A)! It seems with burgeoning growth we are assaulted with more noise pollution, daily. The City of Naples has ordinances in place to control excessive noise. Leaf Blowers used in our neighborhoods do not currently meet City code even though cost effective, efficient, and quieter models are available. Many of you have contacted us for help with the issue.

The ONA Neighborhood Committee has drafted a petition to request City Council to enforce the use of compliant leaf blowers in Old Naples. Landscapers generally turn over equipment every 2 - 3 years, so enforcement beginning with Old Naples is fair to all. We agree that you deserve to have codes enforced and to have your environment be as peaceful as possible.

Sec. 22-37. - Noise.

(a) Definitions. A-weighted level (dBA) means the total broad band sound level of the noise spectrum as measured using the "A-weighted network" of a sound level meter (SML). The unit of measurement is the dBA. All sound level meter settings shall be for slow response, except for impulsive noise measurements which shall be fast response. Ambient sound means the all-encompassing sound associated with a given environment, being usually a composite of sounds from many sources near and far. For the purposes of this section, ambient sound level is the level obtained when the sound level is averaged over a period of at least 15 minutes without inclusion of sound from occasional or occasional and transient sources, at the location and time of day near that at which a comparison is to be made. Amplified sound means sound augmented by any electronic means that increases the sound level or volume. Decibel (dB) means a unit for describing the amplitude of sound, equal to 20 times the logarithm to the base ten of the ratio of the pressure of the sound measured to the reference pressure, which is 20 micronewtons per square meter. Impulsive sound means a noise which is characterized by brief excursions of sound pressure which significantly exceed the ambient sound level. Nearest adjacent property line means the property line closest to the noise source. Noise, or noise disturbance, means any sound that: (1) Exceeds the maximum permitted sound levels set out in Table 1 of this section; or (2) Is loud and raucous so as to unreasonably disturb, injure or endanger the comfort, repose, health, peace, tranquility or safety of reasonable persons of ordinary sensibilities; (3) Constitutes a breach of the peace or a public nuisance; (4) Is plainly audible at a distance of 25 feet or more from the property line; (5) With respect to vehicles and vessels, is plainly audible at a distance of 25 feet from the noise source. Nonresidentially zoned areas means those zoning districts which are not zoned primarily for single- family or multifamily use. Nonresidentially zoned areas include all commercial, industrial, public service, PD for commercial uses and other districts which permit nonresidential uses. Octave band means all of the components in a sound spectrum whose frequencies are between two sine-wave components separated by an octave. Property line means an imaginary line exterior to any enclosed structure, at the ground surface, which separates the real property owned by one person from that owned by another person, and its vertical extension. Pure tone means any sound which can be distinctly heard as a single pitch or a set of single pitches. For the purposes of measurement, a pure tone shall exist if the one-third octave band sound pressure level in the band with the tone exceeds arithmetic value of the sound pressure levels of the two contiguous one-third octave bands by five dB for center frequencies of 500 Hz and above and by eight dB for center frequencies between 160 and 400 Hz and by 15 dB for center frequencies less than or equal to 125 Hz. Receiving property means the property which is receiving the noise. Sound means an oscillation in pressure, stress, particle displacement, particle velocity or other physical parameter, in a medium with internal forces. The description of sound may include any characteristic of such sound including duration, intensity and frequency. City of Naples Noise Ordinance

Sound amplifying equipment means any machine or device for the amplification of human voice, music, or any other sound. Sound level meter means an instrument to measure the sound pressure level of relatively continuous and broadband noises. The sound level meter used to determine compliance with this section shall meet or exceed the requirements for Type 2 sound level meter in accordance with ANSI Standard S1.4. (b) General prohibitions. (1) It shall be unlawful and prohibited for any person to make, continue, or cause to be made or continued any noise, as defined in this section, or to create any noise disturbance within the limits of the city. (2) It shall be unlawful and prohibited for any person owning or in possession of any building or premises to use, allow the use, or rent the same for any business or residential use, or for any purpose of pleasure or recreation if such use makes, continues, or causes to be made or continued, any noise, as defined in this section, within the limits of the city. (c) Specific noise prohibitions. The following acts, where meeting the definition of noise above, are declared to be examples and prima facie evidence of noises that constitute a noise disturbance, breach of the peace and public nuisance: (1) Radios, audio or visual equipment, sound equipment, sound amplification devices, exterior loudspeakers, musical instruments and similar devices. Operating or permitting the use or operation of any radio, musical instrument, audio or visual equipment, sound amplification devices, exterior loudspeaker, or other device for the production or reproduction of sound in such a manner as to cause noise. The operation of any such device for the production or reproduction of sound: a. Between the hours of 10:00 p.m. and 7:00 a.m. shall be controlled so that it is not loud or disturbing or a nuisance to persons within the area of audibility, or b. At any time with louder volume than is necessary for convenient hearing for persons who are in the same dwelling unit of any multiple dwelling in which such device is operated, shall be deemed prima facie evidence of a violation of this section. Radios, audio systems and similar devices associated with motor vehicles or motorboats, shall not be operated in such a manner as to create noise that is plainly audible at 25 feet or more from such device, when operated on a public right-of-way, waterways, beaches, or public space.

(2) Engine mufflers. Operating any internal combustion engine, including such an engine associated with a motorboat, or motor vehicle without a muffler or other device at least as effective as that installed as original equipment by the manufacturer, which will effectively prevent loud or explosive noises therefrom. (3) Motor vehicle, motorcycle or motorboat repair in residential areas. The noncommercial repairing, rebuilding, modifying or testing of any motor vehicle, off-road vehicle, or motorboat within or abutting any residential land use designation in such a manner as to create noise across a real property line between the hours of 10:00 p.m. and 7:00 a.m. (4) Activities in the vicinity of schools, churches, and health care facilities. Creating noise on any street adjacent to any school, church, or health care facility, which unreasonably interferes with the workings of such institution, or which disturbs or unduly annoys patients in a health care facility. (5) Peddling, hawking, or vending. Peddling, hawking, or vending, including shouting, crying out by peddlers, hawkers or vendors along or on a roadway. (6) Yelling, shouting. Yelling, shouting, hooting, whistling, singing, or the making of similar noises, and loud, boisterous conduct other than normal conversation at reasonable levels, inside of or City of Naples Noise Ordinance

on the grounds of any public or private property between the hours of 10:00 p.m. to 7:00 a.m., so as to annoy or disturb the quiet, comfort, or repose of other persons or create a disturbance. (7) Horns, signal devices. Sounding of any horn or audible signal device of any motor vehicle, boat, engine, or machine of any kind while not in motion, nor shall such horn or signal device be sounded under any circumstances except as required by law, or as a danger warning, nor shall it be sounded for any unnecessary or unreasonable period of time. (8) Air conditioning units and other mechanical equipment including, pool or spa heaters and pumps, and regularly-used generators, irrigation pumps and exhaust fans. Operating any noise creating fan or blower, air conditioner, compressor unit, pool heaters, pool pumps, heat pumps, or the electric motor or any engine used to drive such device, the operation of which causes excessive and unnecessary noise, unless such noise is muffled and deadened by adequate noise compression and muffling devices to minimize annoyance and disturbance to persons within range of hearing. Noise shall be presumed excessive if it exceeds decibel limitations prescribed in Table 1 when measured at the property line of the receiving property. Mechanical equipment installed before December, 2006 shall not exceed 60 decibels (dBA). (9) Drums, cymbals, musical instruments and loudspeakers. Creating, making, or maintaining any noise by the use of any drum, cymbals, loudspeaker, or other similar instruments in the city for the purpose of attracting attention to any performance, show, sale, or display of merchandise, or place of business. This provision shall not apply to permitted special events. (10) Bells or sirens on vehicles. Using, in connection with an unauthorized vehicle, any bell or siren similar to that used on ambulances or vehicles of the sheriff, fire departments, and other public safety agencies. (11) Skateboard ramps. Using any skateboard ramp or similar configuration for skateboarding or rollerblading between 10:00 p.m. and 7:00 a.m. in a residential land use designation in such a manner that results in noise across a real property line. (12) Powered model vehicles. Operating or permitting the operation of powered model vehicles in such a manner as to create noise across a real property line between the hours of 9:00 p.m. and 7:00 a.m. (13) Animal noises. Allowing an animal to habitually bark, whine, howl, squawk, screech, or cause any other noise which is objectionable due to pitch, frequency, duration, or timing. (14) Lawn, landscape and tree maintenance. Permitted days and hours of operation for lawn and landscape maintenance, tree trimming and tree removal. Lawn and landscape maintenance activities, tree trimming activities, and tree removal activities may be conducted only during the following hours, Monday through Sunday except New Year's Day, Easter Sunday, Memorial Day, July 4th, Labor Day, Thanksgiving Day and Christmas Day: a. Monday through Friday hours of operation: 1. In residential areas: 7:30 a.m. to 5:30 p.m. 2. In nonresidential areas: 6:30 a.m. to 5:30 p.m. b. Saturday hours of operation: 1. Businesses that perform lawn and landscape maintenance, tree trimming, or tree removal services may perform services in residential and nonresidential areas from 8:00 a.m. to 4:00 p.m. 2. Residents may perform lawn and landscape maintenance activities in residential areas at their own property from 8:00 a.m. to 7:00 p.m. c. Sunday hours of operation: 1. Businesses that perform lawn and landscape maintenance, tree trimming, or tree removal services are prohibited from working on any Sunday in residential or nonresidential areas. 2. Residents may perform lawn and landscape maintenance activities in residential areas at their own property from 8:00 a.m. and 5:00 p.m. (15) Outdoor live entertainment. Providing outdoor live entertainment, as authorized in section 56- 125 of the Code of Ordinances. a. In such a manner as to create noise as defined in this section as measured at the receiving property or a substantially similar location. (d) Exemptions. The following noises shall be exempt from the restrictions set forth in the other sections of this article: (1) Noises of authorized safety signals and warning devices. (2) Noises resulting from any authorized emergency vehicle, when responding to an emergency call or acting in time of emergency or any other public safety operation. (3) Noises resulting from emergency work, which is to be construed as work made necessary to restore property to a safe condition following a public calamity, or work required to protect persons or property from any imminent exposure to danger. (4) Noises incidental to and necessary for city approved solid waste collection equipment, public works construction and maintenance; and police or fire training. a. The city manager, may grant a waiver, may prescribe any reasonable conditions or requirements it deems necessary to minimize adverse effects upon the community or the surrounding neighborhood. b A waiver may be given upon finding that it will not unreasonably disturb, injure or endanger the comfort, repose, health, peace or safety of any affected persons because it is temporary in nature, adjacent property owners do not object, or for necessity or unavoidability. c. Waivers may be issued for no longer than 30 days, renewable by further application to the city manager. (5) City maintenance activities and equipment operation within public service zoning districts, whether performed by city staff or a city contractor, may take place between the hours of 8:00 a.m. and 4:00 p.m. on Sunday. (6) City maintenance activities and equipment operation at public beach access areas, whether performed by city staff or a city contractor, may take place between the hours of 7:30 a.m. and 4:00 p.m. on Saturday and Sunday. (7) Golf course maintenance activities and equipment operation within the city is not restricted during the hours listed in subsection 22-37(c)(14). (8) Lawn and landscape maintenance equipment may be used within the Fifth Avenue south special overlay district and the Third Street commercial area special overlay district between the hours of 8:00 a.m. and 4:00 p.m. (9) Special event permit holders may use lawn and landscape maintenance equipment after the afternoon hours listed in subsection 22-37(c)(14) to clean up special event areas provided the cleanup is performed expeditiously and immediately after the event ends. (e) Octave band levels. In addition to the noise limitations listed in this section, for any source or sound that can be detected on a receiving property, when measured at the nearest point of the property line of the receiving property, the maximum allowable sound level limit for the individual octave bands shall comply with Table 1. In no case shall the noise level on the premises of any other occupied property measured at a point on the nearest adjacent property line closest to the noise source, or if a condominium, apartment house, duplex, or attached business, within any adjoining unit, exceed the ambient noise level by more than five decibels. _____ City of Naples Noise Ordinance

(f) Enforcement and penalties. A violation of this section is a non-criminal infraction, and the civil penalty is $100.00 for the first offense and $500.00 for each subsequent offense occurring within one year after a finding of violation of the previous offense or a plea of no contest. It is also enforceable and punishable as provided in subsections 1-15(b), (c), (d) and (e) of this Code. In addition, if a permit for live entertainment, a special event or extended hours has been issued and the permit holder or person acting under the permit, violates this section, the permit is subject to revocation or non-renewal.

They will need to augment batteries with electrics. But sooner or later everyone must bite the bullet and eliminate gas as there an environmental issue that even supersede the noise issue.

A battery charger (85.00) would be required as well. Based on an average usage of 3 hours per day, 6 batteries would be required, per blower. The batteries have a 3 year warranty, so would most likely need to be replaced every three years. Do the math on the expense. 1 blower, 6 batteries and 2 chargers total 2270.00 per blower. Prior to banning blowers the exceed 65 DBA, why not require blower manufacturers to produce blowers that meet the requested requirement? That would be a sensible solution. Thank you.

I currently have 18 plus maintenance crews in the City of Naples area. After you add in the construction crews, it brings that number up to 25 plus crews. To out fit all crews with the number of blowers and equipment required to keep that equipment charged our cost to set up is over $100,000. That includes generators to charge the batteries. There are several gas powered blowers that are at the 65 dbl rating that would be more financially feasible than switching over to battier powered blowers. There will be a cost increase to the client's due to the lower efficiency of the smaller blowers. It will take longer to do the work. We use blowers everyday on almost every account.

This standard sets forth sound-tevel test procedures and labeling requirements for the sound level of gasoline-powered backpack and hand-held blowers.

This standard was developed by the ANSI B175 Accredited Standards Committee. The Committee is comprised of several organizationsand individuals interested in these products. The Committee's membership includes representatives from the following groups: accredited testing laboratories, component manufacturers, dealer associations, federal government agencies, individuals, and original equipment manufacturers.

The initial standard was developed in 1990 in response to the needs expressed by various county and municipal governments and professional and consumer users. It was revised in 1996 to reflect changes to several clauses, namely Scope and Purpose, Definitions, Measurement of Noise in Sound Room, Test Data to be Recorded, Labeling, and Operator Manual Recommendations.

Since 1996, the Committee has focused on the need to revise the test procedures to improve the accuracy and repeatability of the sound level measurements and to clarify labeling requirements. Continuing regulation of leaf blowers by local governments demonstrates a need for the uniform sound level test procedures that this standard provides. The revised labeling requirements are intended to clarify sound level measurements for interested communities and product users.

The year 2000 revisions to this standard are found in the following clauses: Definitions, Measurement of Sound in a Free Field, Measurement of Sound Level in Sound Room (Alternate Method), Blower Operation, Measurements, Test Data to be Recorded, Labeling, and Operator Manuals.

1 Scope and Purpose

1.1 Scope The requirements of this standard apply to new portable, backpackand hand-held, gasoline-engine-poweredblowers, including those blowers that accept vacuum attachments.

1.2 Purpose The purpose of this standard is to establish bystander sound level test procedures and labeling requirements for hand-held and backpack, gasoline-engine-powered blowers. This standard also includes requirements for operator manual(s) instructions.

NOTE: Metric units are included for information only

2 Definitions

2. 1 Blower. A device that propels an airstream in a directed manner.

23. Blower Tubes. Devices that direct the blower airetream.

2.3 Category. Group designation of measured sound levels according to decibel range (for example, low, medium, high). The sound categories are as follows: Category I dB(A) < 65, Category II 65 < dB(A) <.70, and Category III dB(A)> 70.

2.4 Handle(s). Hand grip(s) on unit.

2.5 May. The term that indicates a permissive condition.

2. 6 MufRer. Device for reducing engine exhaust noise and directing the exhaust gases.

2.7 Nozzle. The opening at the end of the blowertube from which the airstream exits.

2. 8 On/Off Control. A control to allow the engine to run or to stop the engine.

2.9 Shall. The temn that indicates a mandatory requirement.

2. 10 Throttle. A control that adjusts the volume of air and fuel delivered to the engine.

2.11 Throttle Control. A part of the unit actuated by the operator to regulate the throttle.

2. 12 Vacuum Attachment. A device(s) that converts the blower from the blowing mode to the vacuuming mode.

3 Sound-Level Test Procedure

3.1 Scope. This test procedure establishes the instrumentation, test site, blower operation, and measurement method for determining the bystander sound level of blowers.

3.2 Instrumentation. The following instmmentation shall be used:

a) A microphone. Suitable measuring devices are sound level meters meeting or exceeding the requirements of a Type 1 instrument in accordance with IEC Publication 651 . It is recommended that a microphone with a diameter not greater than % inch (13 mm) be used for the measurements. A wind screening attachment to the microphone may be used, provided that this is allowed for, if necessary, in the calibration and does not alter the measured sound level by more than ± 0.5 dB(A) as a consequence of its effect on the omnidirectional characteristics of the microphone.

b) Eitherof the following systems may be used: 1) A precision sound level meter that meets the Type I requirements of ANSI S 1. 4 for direct measurements.

2) A data acquisition system that meets the requirements of the ANSI/SAEJ184 3) A sound level calibrator. (See 3. 6. 2. 3(d))

3.3 Test Site

3. 3. 1 Measurement of Sound in a Free Field

3.3. 1. 1 The test area shall be a flat, open space with natural ground cover (such as grass) of at least 1 inch (25 mm), but not to exceed 3 inches (76mm) and free of any large reflecting surfaces, such as signboards and buildings, for a minimum distance of 100 feet (30m) from the blower and the microphone.

3.3.1.2 The ambient sound level at the point of measurement (including wind effects) coming from sources other than the blower being tested shall be at least 10 dB(A) lower than the sound level of the blower.

3.3. 1.3 Measurements shall be made only when the wind is less than 5 miles per hour (2. 25 m/s), m'th gusts less than 12 miles per hour (5. 4 m/s), with the wind in the direction awayfrom the microphone toward the blower being tested.

3. 3. 1.4 Ambient conditions. The ambient air temperature shall be 41 °F (5°C), or greater at the time of test.

3.3.2 Measurement of Sound Level in Sound Room (Alternate Method)

3. 3.2. 1 An anechoic or semianechoic chamber may be used for conducting sound level tests, provided that if the variation exceeds ± 0.5 dB(A) from the free-field test results, the correlation between the sound room measurement and free-field sound measurement shall be applied to the result obtained from the sound room. The correlation shall be confirmed with tests in free field conditions and tests in the anechoic chamber on the basis of identical machines and under equivalent conditions as specified in the applicable sections of this standard.

3.3.2.2 Sound levels for distances exceedingthe dimensions of the chamber may be calculated from measurements taken in the chamber, provided sufficient data is available to substantiate such calculations. A floor covering in the chamber, which has sound attenuating qualities similarto grass, such as artificial grass or carpeting, shall be used.

3.4 Blower Operation

3.4. 1 The blower shall be adjusted in accordance with manufacturer's instructions, including the operating speed or carburetor setting.

3.4.2 Operator. The blower shall be operated by a person of medium height and build, in the manner recommended by the manufacturer. The operator shall weartypical and appropriate working clothes without acoustical absorbent or reflecting surfaces. (See Figures 1, 2, and 3.)

3.4.3 The blower shall be evaluated with each of the attachments that are shipped with the unit.

3.4.4 The attachments shall be mounted in accordance with the manufacturer's instructions.

3.4.5 All readings shall be taken with the blower running at wide open throttle and in a normal operating position with the lowest part of the nozzle at least 2 inches (51mm) but no more than 12 inches (30.5cm) above the ground cover. To insure consistency in readings, a support may be attached to the end of the nozzle, provided the support is demonstrated not to affect the sound level readings.

3.4.6 Priorto the test, the blower shall be run-in and warmed up per the manufacturer's instructions.

3.5 Measurements

3.5.1 The sound level meter shall be set for slow response and the A-weighting network.

3.5.2 Measurements shall be taken at every 45 degrees (a total of 8 different positions) with the microphone 50 feet (15m) from the operator and 4 feet (1.2m) above ground (See Figures 1- 4). The microphone shall be positioned with its axis of highest sensitivity generally parallel to the ground and pointed toward the blower operator. Five readingsshould be taken at each position at least 5 seconds apart. Each reading may be an average of minimum 2 seconds duration. The arithmetic average of the five readings is to be used in the calculation of the reported sound level. If the test data at each position vary more than 3 dB(A), the test shall be repeated until five sequential readings are within 3 dB(A) at each

measuring position. If an analog sound level meter is used, the average of the highest and the lowest indicated readings shall be used.

NOTE: It is important that the operator stand straight at all times with shoulders square to the eight positions.

3. 5. 3 The individual reading the meter shall be at least 8 feet (2. 4m) behind the microphone. Not more than one person other than the individual reading the meter and the operator shall be within 58 feet (17. 7m) of the blower, and that person shall be directly behind the individual reading the meter, on a line through the microphone and the individual reading the meter. Alt other observers should be no closer that 100 feet (30.5m) to the blower or microphone.

3. 5.4 The operator and blower shall rotate 360 degrees with respect to the microphone in a fixed position.

3.5.5 The reported sound level shall be the arithmetic average of the eight averaged readings taken as provided in 3.5.2 and rounded to the nearest whole decibel (ASTM E29J.

3.6 General Comments

3.6.1 Recommendations

3.6.1.1 Technicallytrained personnel should conduct the test.

3.6.2 Precautions

3.6.2. 1 Proper use of all test instrumentation is essential to obtain valid measurements.

3.6.2.2 Operating manuals and other literature furnished by the instrument manufacturer should be referenced.

3.6.2.3 Specificitems to be considered are deschbed as follows:

a) Instmmentation. The type of microphone and its orientation relative to the source of noise should be considered. The microphone shall be positioned with its axis of highest sensitivity generally parallel to the ground and pointed toward the blower operator.

b) Weather. The effect of ambient weather conditions on the performance of all instruments should be taken into consideration.

c) Equipment Installation. Proper signal levels, terminating impedances, and cable lengths on multi-instmment measurement systems should be checked.

d) Calibration:

1) Proper acoustical calibration procedures shall be observed.

2) Field calibration shall be made immediately before and after each test sequence. Either an externat-calibrator or intemal- calibration means is acceptable.

3) All test results shall be considered invalid if the recheck by external calibration is not within 0.5dB(A) of the initial calibration.

3.7 Test Data to be Recorded.

The recorded test data should include the following:

(1) Geographical location. (2) Date and time. (3) Names of blower operator, sound-level meter reader and observer. (4) Weather conditions, including ambient temperature and wind velocity. (5) Make, type, and serial number of measuring equipment. (6) Make, model, displacement, and serial number of blower being tested. (7) Type of blower (hand-held or backpack) and all attachments. (8) All sound level readings taken (see Table 1). (9) Engine speed (rpm). (10) Documentation of microphone, blower, and attachment orientation. (For example, see Fig. 1.) (11) Ambient sound level. (12) Date of most recent calibration of the acoustical calibrator.

4 Labeling

4. 1 The power unit shall be cleariy and durably marked with the following or suitably paraphrased statements (pictorial or graphic illustrations may be used in lieu of, or in addition to, written statements);

(1) The sound level, as reported in section 3. 5. 5, shall be clearly and durably marked on the unit and identified as decibels (dB(A)) using simple block characters at least 0.25 inches (6mm) high.

(a) If a power unit is shipped with more than one attachment, the highest sound level per section 3.5.5 shall be marked.

(b) Sound levels with other attachments may also be marked on the power unit.

(c) The wording "measured at 50 feet (15 m) per ANSI B 175.2" shall accompanythe numerical noise level.

(d) The label shall also include a designation of the sound level category - Category I, Category II or Category III.

(2) WARNING! Read and follow all safety precautions in the operator's manual. Failure to follow these instructions could result in serious injury.

(3) Advise the operator to always wear hearing protection.

5 Operator anuals

5.1 Safety Precautions

The safety precautions set forth in 5. 1. 1 through 5. 1.7 may be used verbatim or suitably paraphrased in the operator manual(s) (pictorial or graphic illustrations may be substituted in lieu of, or used in addition to, the written statements):

5.1.1 To reduce the risk of associated with sound levet(s), hearing protection is required.

5. 1.2 To reduce the risk of injury associated with thrown objects:

(1) Always wear eye protection and foot protection. Eye protection should meet the requirements of ANSI Z87.1. (2) Do not allow bystanders in work area. (3) Do not point the blower nozzle in the direction of people or pets.

5.1.3 To reduce the risk of injury associated with objects being drawn into rotating parts, do not wear loose clothing, scarves, neck chains, unconfined long hair, and the like.

5.1.4 To reduce the risk of injury associated with the inhalation of dust, use a face filter mask in dusty conditions.

5.1.5 To reduce the risk of injury associated with contacting rotating parts, stop the engine before installing or removing attachments. Do not operate without guard(s) in place. Always disconnect the spark plug before performing maintenance or accessing movable parts.

5.1.6 To reduce the risk of injury associated with exhaust fume inhalation, do not operate in unventilated area.

5.1.7 To reduce the risk of fire and bum injury:

(1) Handle fuel with care. It is highlyflammable. (2) Do not smoke while handling fuel. (3) Do not refuel a hot engine.

(4) Do not refuel a running engine; (5) Avoid spilling fuel or oil. Always wipe unit dry before using. (6) Move at least 10 ft. (3 meters) away from the fueling point before starting engine. (7) Always store gasoline in a container approved for flammable liquids. (8) Make sure the unit is properly assembled and in good operating condition.

5.2 Operating Techniques -- Operator anual Recommendations

5.2. 1 Operate power equipment only at reasonable hours-not early in the morning or late at night when people might be disturbed. Comply with times listed in local ordinances.

5.2.2 To reduce sound levels, limit the number of pieces of equipment used at any one time.

5.2. 3 Operate power blowers at the lowest possible throttle speed to do the job.

5.2.4 Check your equipment before operation, especially the muffler, air intakes and air filters.

5.2.5 Use rakes and brooms to loosen debris before blowing.

5.2.6 In dusty conditions, slightly dampen surfaces or use mister attachment when water is available.

5.2.7 Conserve water by using power blowers instead of hoses for many lawn and garden applications, including areas such as gutters, screens, patios, grills, porches and gardens.

5.2.8 Watch out for children, pets, open windowsor freshly washed cars, and blow debris safely away.

5.2.9 Use the full blower nozzle extension so the air stream can work close to the ground.

5.2.10 After using blowers and other equipment, CLEAN UP! Dispose of debris in trash receptacles.

New Leaf Blower Regulations To help decrease noise pollution in Saratoga, the City Council passed new regulations for leaf blowers that will go into effect on October 1, 2019.

New Regulations • Leaf blowers used in Saratoga must be certified by the manufacturer to produce no more than 65 decibels at a distance of 50 feet. • Many commercially available leaf blowers that meet this criteria are labeled with the American National Standards Institute (ANSI) B175.2 sticker (pictured). This manufacturer’s label and/or product information will be used to verify compliance. • Homeowners are responsible for ensuring compliance on their property, regardless of who is using the leaf blower, and may be subject to penalties and fines for violations. Frequently Asked Questions Which leaf blower should I purchase? Many manufacturers make leaf blowers that comply with these requirements, and there are several home improvement stores and garden centers in the area that can help you find one. When making your selection, you should also consider the size of the lot, cordless and rechargeable options, and whether it is for professional or home use. When do I need to have a compliant leaf blower? On October 1, 2019 these regulations will go into effect and you will need to use a compliant blower. When can I use my leaf blower? Beginning October 1, 2019, all leaf blowers may be used Monday through Friday between 8:00 a.m. and 5:00 p.m. and on Saturdays between 10:00 a.m. and 5:00 p.m. Leaf blowers may not be used on Sundays. Where do these rules apply? These regulations only apply to leaf blowers used in Saratoga. What happens if I use a leaf blower that is not compliant? If a violation is verified by City staff, a courtesy notice will be sent to the property owner and/or landscape company. Introduction:

A great deal is being said about leaf blowers these days and much of it is negative. That is, a vocal few have done everything they can to control and in some cases ban the leaf blower. The stated reason is noise! Landscapers respond that they would not be able to remain in the lawn care business without a leaf blower, because it would take too long to do their final cleanup. Thus, profits would be severely impacted.

The leaf blower has been in the spotlight, under the microscope so to speak, and has been singled out from all other forms of industrial equipment as being too loud. There are many other commercial and industrial machines or devices that make excessive noise yet suffer no objections from those that must listen to them. You can read about the leaf blower in the newspaper, see it on TV and even in movies, nearly always in a negative light. In some communities, city councils are talking about creating ordinances to eliminate leaf blowers. It can’t be simply the volume that irritates. There must be more to this story than just the number of decibels emitted.

One primary factor in the leaf blower issue is none other than the operator himself. Some are inconsiderate, but most are only uninformed or untrained. As with everything, there is a right way and a wrong way to use a leaf blower. Accept that it is not always the right tool for the job.

The time of day one has to endure the sound, early morning or late in the evening, is often mentioned as being a problem. Some hate the way the engine is throttled up and down repeatedly. Maybe it is the proximity to a bystander and the rapid movement of air that irritates. It could even be what it does to a pet that pushes people to the limit of their tolerance, making dogs bark for example.

There is something to be said about the type of sound that a blower generates. It has to do with sound quality. Older blowers do tend to whine, which can be as difficult to ignore as a crying baby. Even at a moderate volume, this can be an issue.

Some say it is exhaust pollution or the dust that is kicked up by the airflow that is unacceptable.

So now you know that there is more than one reason why leaf blowers are considered irritating. It makes sense that it is more than just volume. Because of the mounting objection to leaf blowers, something had to be done to address this issue.

Echo has taken notice and has done many things to minimize if not eliminate the unwanted blower attributes. Part of this manual will point out what the physical improvements to leaf blowers are and what the facts are concerning dust, exhaust emission and noise, but the rest of this pamphlet talks about you, the operator.

In this guide you will learn the proper way to operate a leaf blower so as to avoid irritating your neighbor or a bystander. It will illustrate what the complaints are and what can be done to eliminate them. Finally, it will show you what could happen if leaf blower issues and community complaints are ignored. The origin of the leaf blower:

The leaf blower has been around for more than 40 years. The original blower was designed to spread fertilizer and pesticides over grain fields and fruit trees. A container was mounted above a centrifugal fan as the source for the chemicals that would be disbursed evenly over the area. Versions of this product are still in use today. Echo’s name for this device was and is the “Duster- Mister”. It was discovered, back in the 1970’s that this blower, less the chemical container, would make an excellent leaf blower, which of course is where it got its name.

Leaf blower use: Today, there are many uses for the leaf blower, including the cleaning of driveways and sidewalks after cutting the grass and the removal of debris from parking lots, sports arenas, city parks and construction sites. It quickly became an important cleanup tool, saving time over alternative methods. It turns out that this product does a far better job than a or broom and at far less cost due to the speed in which it can clean up an area. The Department of Public Services for the City of Coronado, CA conducted a test comparing brooms to leaf blowers. To clean the perimeter sidewalk of a downtown park with a broom took 80 minutes where it took only 6 minutes to clean with a blower. The leaf blower has become indispensable. Clearly, it is not just a leaf blower. It is an all-purpose outdoor clean up tool.

Note: A leaf blower is NOT intended for use on gravel driveways, dry dirt or other potentially dusty surfaces. Do not use on unstable ground!

How serious is the leaf blower problem?

In recent years, there have been several cities around the United States that have taken steps to regulate blowers. In 1998, the city of Los Angeles passed an ordinance that prohibits the use of leaf blowers within 500 feet of a personal residence. There have been other attempts at banning in both large and small cities. Several cities on the east coast are now banning blowers over the summer months. Banning can be a serious problem depending on the penalty associated with violating the ban and the persistence of the local police force.

Powerful entities have looked into banning blowers. In 2000, the California State Legislature instructed the California Air Resources Board (CARB) to conduct a study on the environmental impact of leaf blowers based on information and test results available at the time. The report from this study made a clear statement that there are many individuals, organizations and municipalities deeply bothered by the leaf blower.

However, factual information was not available at the time to conclude one way or the other if leaf blowers are detrimental to the environment or hazardous to anyone’s health. Since then, there have been reputable studies that prove leaf blowers to be benign.

The San Joaquin Valley Air Pollution Control District commissioned Dennis Fitz of the University of California at Riverside to study the potential for leaf blowers to generate dust. His published results show that the amount generated is actually insignificant. Comparing his data to other sources of dust in the San Joaquin Valley, one finds that daily driving of automobiles generates 100 times more dust than that from leaf blowers. Interestingly enough, Dr. Fitz also proved that brooms generate more dust than blowers because they dislodge caked dirt that a leaf blower leaves behind.

The Water and Power Department in Los Angeles spent millions on the design of an alternative battery powered leaf blower. They thought this would be the answer to leaf blower noise. It never made it to production. Performance was inadequate and couldn’t compare with gasoline- powered units. But this is still disturbing because the next attempt, should there be one, could be successful and better performing gasoline powered blowers could be displaced. Already, some cities allow corded electric blowers, but not gasoline powered. As you know, these small blowers are inadequate for professional use.

There are several non-governmental organizations springing up around the country that are strongly opposed to the existence of the leaf blower. Their greatest influence has been in California, but because these groups use the Internet and influence newspaper columnists, there is talk about banning blowers all over the country. Even in foreign countries such as in Germany and Australia, leaf blowers have become a notable issue.

These activities should serve as a wakeup call. If ignored, bans could impact the future existence of the leaf blower and the livelihood of the landscape contractor.

Leaf Blower Concerns:

What are the actual concerns that make so many people upset about the leaf blower?

The primary issue is the sound that is generated by leaf blowers, typically in residential areas. It is the “noise”. Most people just think a leaf blower is loud and complain only about that without understanding what the total problem really is. The whining sound typical of older designs also tends to irritate people. The sound of a leaf blower is historically uncomfortable to listen to.

There is also concern about when leaf blowers are used. There are many things one would rather not have to listen to after 8:00 PM or before 7:00 AM. Not surprisingly, the leaf blower is one of these.

Many operators do not know how to properly use a leaf blower. As with everything, there is a right way and a wrong way to use a blower and it is not always obvious. For example, because blowers at an idle are quieter than when run at high speeds, large blowers should rarely be Page 6 of 12

operated at full throttle in a residential area. Also, care should be given as to where debris is blown. It is imperative that the operator be courteous and conscientious.

Complaining on the basis of noise alone has not resulted in the kind of support needed to result in blower ban legislation as anti-blower activists had hoped. They had to expand their argument from a mere noise complaint, which is only a harmless irritation, to a potential health hazard. The result is their focusing on engine exhaust emission and the generation of dust. Intuitively, after listening to their argument, people tend to believe that blowers might be hazardous to your health, which helps their case. Of course, this has no foundation in fact, as the CARB report and others have indicated.

Exhaust emission was a problem many years ago, but not any more. Emissions have been reduced up to 90% to meet new stringent government Standards. Comparing actual emissions from a car to a leaf blower over the course of time, automobiles are considerably worse than leaf blowers. Think about it. Most households with one automobile run a tank of gasoline per week through a car (18 gallons on average) while a leaf blower’s fuel consumption is measured in ounces per week, per household.

Test results show that dust is insignificant compared to other common sources as was proven by the University of California study for the San Joaquin Valley Air Pollution Control District mentioned earlier in this pamphlet.

There have been many efforts to place a “black cloud” over leaf blowers. Supporters of this view are truly disturbed by the seemingly loud; mostly irritating sounds generated by older blowers and they feel compelled to do something about it. In their zeal, they are using every argument possible to paint the blower as an evil and unnecessary landscaping tool. Often they find someone that said something unflattering about the blower and then they quote this person as if what he said was fact. Although their argument is mostly anecdotal and unsubstantiated, this type of propaganda serves to reinforce those that are considering banning leaf blowers in other communities. You can find comments such as these on several web pages compiled and financed by dedicated and determined anti-leaf blower activists.

Leaf Blower Ordinances:

It should be pointed out that there really is no reason to create an ordinance to control blowers since by attrition; excessively noisy blowers will eventually disappear. New designs are inherently quieter. However, since this argument is often not accepted, one should consider the ramifications of introducing a leaf blower noise ordinance.

To begin with, the police will be expected to enforce this unenforceable law. The truth is, landscapers do not want to give up their leaf blower. In fact, where there is a ban such as in Los Angeles, many would rather risk paying the fine than have to use a time consuming and labor intensive broom or rake. The reason is obvious. It just takes too long. In most cities, an ordinance banning blowers has changed law-abiding citizens into clever violators. Most important, banning is not the answer! Page 7 of 12

If the ordinance is volume or sound magnitude limiting, sound meter readings turn out to be unreliable when taken by an untrained individual, which leads to disputes. Catching violators usually depends on receiving complaints and by the time the police arrive, the violator is nowhere to be found. And then there is priority. Should the police respond to a noise complaint or a domestic disturbance? What if there is a traffic accident, one with injury? And what about the cost of enforcement?

If there must be an ordinance, here’s one that works. Require landscapers and homeowners to use only “Quiet” leaf blowers. What is a “Quiet” blower? It’s one that is at least 70 dB(A) or less according to the ANSI Standard, B-175.2. Sixty-five is better, but really not necessary in most cases since the whine generated by the fan is no longer an issue. This type of ordinance is easy to enforce and therefore complied with voluntarily by landscapers. Why? Because the manufacturer marks “Quiet” leaf blowers with its sound level per the industry Standard. This allows the police to simply stop and look at the product at any time convenient to them, in order to catch violators. No need to wait for a complaint. No need to rush across town to catch a violator in the act.

Leaf blower improvements:

Echo Incorporated has taken the lead in the industry and has not been sitting by idly while anti- blower advocates complain about blower “noise”. Engineers met with these activists to understand the problems created by leaf blowers and have been working to improve sound levels and sound quality to a point that is no longer perceived as an irritation. An innovative approach to leaf blower noise has resulted in the quietest leaf blower products in the industry. Sound levels have been systematically lowered from 77 dB(A) per the ANSI B175.2 Standard, to 65 dB(A) for a 75% reduction in sound intensity.

Typical changes include adding silencers to the air intake, modifying mufflers, incorporating special vibration resistant materials, changing the shape of the fan and fan housing, adding sound barriers and absorbing foams and improving vibration isolation.

Note: For every 6 dB(A) reduction in sound, the sound intensity is reduced by 50 % or half.

Echo is the leader in the production of quiet blowers. Even Echo’s largest blower is three dB(A) quieter than older designs. Not only has the sound level been reduced by more than half, but also the sound quality of leaf blowers has been improved. On many new designs, the high-pitched whine or siren effect has been virtually eliminated. It’s all in the design of the fan and fan housing.

Guidelines for proper leaf blower use:

The primary solution to solving the leaf blower noise problem, after improving leaf blower design, is operator education. People must be made aware of the issues and become sensitive to the bystander’s complaint. Once trained, the conscientious operator should help others to understand how to avoid generating complaints. The trained operator can even help in the organization of additional training programs within their own company and community. If at the present time there is no leaf blower sound or noise related issue in your area, that is the best time to implement the following guidelines. In other wards, prevent the problem before it gets started. Once it reaches the point of pending legislation to control leaf blowers, it can be very difficult to reverse the trend. The leaf blower noise issue is best resolved at the source and before it becomes a problem.

Guideline #1.

Always be considerate of bystanders and adjoining property.

Debris should never be blown in the direction of people. No one wants to be pelted by particles of sand and debris. It can take one’s breath away. It is almost a certainty that there will be a complaint. People have been known to become hostile. Some see it as a type of assault and have even called the police.

On the other hand, a neighbor or passerby will smile back at you when you idle down your blower and point the nozzle away. They usually realize that you are only doing your job and will give you credit for being courteous.

Respect other people’s property. Do not blow material at automobiles or on neighbor’s lawns and driveways. This could start retaliatory action. They may blow it back… with interest.

Watch out for open windows and doors. Pointing the blower nozzle at or toward an open door will not only send debris into someone’s home, but it directs and increases the noise they must endure. Why call attention to what you are doing. Close the door.

Keep in mind that it is not only the neighbor and passerby that deserves consideration. If you are working on someone’s property as a contractor, you should always be considerate of the owner, his or her property and everyone living there, including pets. Being inconsiderate here is a sure way to lose your contract.

The best practice is to be aware of who is around you at all times and know where the debris is being blown. Always be considerate, courteous and conscientious.

Guideline #2

Know and observe your local noise ordinances.

Sometimes, there are local ordinances in place to limit blower use to certain hours of the day and days of the week. As an operator, you should be aware of these times and make sure you do not violate them.

Even if there are no designated hours for blower use, common sense should prevail. Do not create a problem by using leaf blowers late in the day or very early before people are normally up and about.

Guideline #3

Run blowers only at the revolutions per minute (RPM) needed.

Only run the blower at throttle settings necessary to do the job. Rarely does a large backpack blower have to run at full throttle in a residential area. The faster the engine runs, the louder it will be and the more irritating the whine will be (older blowers).

Guideline #4

Avoid using more than one blower at a time.

Two blowers will probably do the job in half the time, but rarely is it necessary. One exception may be when moving large piles of leaves during fall cleanup. This condition is seasonal and normally will not upset anyone because people understand that this is not an ongoing practice. Never the less, if possible, use only one blower.

Guideline # 5

Minimize dust during normal cleanup operations.

There is a logical, yet incorrect conclusion that leaf blowers generate vast amounts of dust. Of course, they can, but when used properly, they contribute very little to the particulate matter in the air. It is all in the way one holds the nozzle and the amount of air generated.

To begin with, one should ensure that whatever dust is created should not be allowed to travel toward any nearby person or neighboring property. Understand that there are times when the blower simply should not be used. The job should be performed at a time when no one is around or when the prevailing wind is in a favorable direction.

To minimize the generation of dust, hold the nozzle above the ground and at a distance from the debris such that the airflow at the ground is only sufficient to move the material you want moved. In dusty areas and when using larger blowers, the nozzle must be held even higher above the ground with an aiming point farther away from the operator. Air velocity is what dislodges the material to be moved and air volume is what keeps it suspended once it is in the air. Practice this by starting with the nozzle well above the ground and then lower it to where it picks up the debris but not the dust.

You may think that dust is very light and easily lifted into the air. In reality, it is very heavy per unit volume. A good example is cement dust. One cubic yard of concrete is 1000 pounds heavier than one cubic yard of sand, yet because the particles of cement are very fine, a leaf blower can lift them if enough air movement is applied. A leaf, a blade of grass or a paper cup, on the other hand, has a weight or density hundreds of times lower than dust. One can find the correct airflow speed and volume to move only the leaf and not the dust with only a little practice.

The measured and published velocity of any commercial leaf blower is the highest value one can measure. That means it is measured at the end of the nozzle. The actual velocity at the ground can be much less without slowing the engine. The airflow speed falls off rapidly as it travels away from the nozzle and spreads out over a wide area. Skilled blower operators direct only enough air to move the unwanted debris, controlling the velocity, volume and position of the nozzle to avoid kicking up any dust.

The concept of a larger blower generating more dust is incorrect. Large blowers are intended for cleaning large areas and can be handled in such a way that very little dust is generated. It takes practice to do this, but it can and must be learned to avoid this complaint.

Guideline #6

Never deliberately use a leaf blower to move dusty materials.

On occasion, the leaf blower is used to clean extremely dusty materials. A leaf blower, any blower, is not the proper machine for this job. It must be understood that there are occasions when the leaf blower is simply the wrong tool.

Heavy concentrations of gravel, construction dirt, plaster dust, pulverized cement, concrete dust and dry garden topsoil should never be moved with a leaf blower because these materials have excessive amounts of dust particles that will become airborne. In a residential area, this type of debris should be cleaned up with vacuums or with power brooms having water injected to control the dust. Even using a hand broom is incorrect for this job. Sometimes only a (water) will do the job courteously and safely.

Guideline #7

Replace your old leaf blower with a new low noise blower.

There have been many changes in the design of leaf blowers resulting in a much quieter and less irritating product. See your local Echo dealer for the finest products available and do your part to eliminate the complaint generated by inconsiderate use of old noisy leaf blowers.
