Date: March 7, 2018 Consent Calendar: CONSENT Recommendation: INEXPEDIENT TO LEGISLATE STATEMENT OF INTENT This bill requires all bottled water sold in New Hampshire to be tested annually for the presence of 24 chemicals and labeled with certain results of such tests. The committee had a wide range of concerns centered on how this bill could be implemented and enforced and had fears that the passage of this bill would dry up the availability of bottled water in New Hampshire. Vote 17-1. Original: House Clerk Cc: Committee Bill File HB 1214 Int. Study, 20-0 CC HB1214 seeks to ban all flame retardant chemicals in new residential upholstered furniture. The bill, however, includes an exemption from the ban for any flame retardants used in upholstered furniture in public facilities. Flame retardants have been used in upholstered furniture and other consumer products to decrease the ability of the material to ignite, however there have been concerns about long term health issues. The Committee believes that while the issue of the health effects of certain chemicals on the public and our firefighters is important to address, there is a need for additional study to determine the practical effect on consumers, retailers, wholesalers and manufacturers in our state. The State of Maine is the only state in the country that has passed a similar law, but it has not yet gone into effect. There are also proceedings at the national level, by the US Environmental Protection Agency, the Consumer Product Safety Commission and the National Fire Protection Association related to both the federal regulation of chemical flame retardants and a national furniture flammability standard. We believe additional study at this time is appropriate to review the experience in Maine and monitor the proceedings at the federal level to determine any future New Hampshire action. The committee felt this was extremely punitive and unworkable. HB 1653 ITL,18-0 CC H131653 adds to NH's Chapter law of the uniform commercial code, that all contracts with sovereign "inhabitants" defined under Part 11 Article 30 of the New Hampshire Constitution shall have a disclosure that "all rights reserved" or "without prejudice RSA 382-A:1-306, RSA 382-A:1-103, UCC 1-103, UCC 1- 308." Failure to put this disclosure in any contract would be a forfeiture of $10,000. Mindi Messmer, prime sponsor - We have had many instances where municipal water has become contaminated. Tap water regulated by EPA and bottled water by FDA which means less restrictions than tap water. See information. A township in Oakland compared tap water and bottled water. This bill asks for additional sampling where ground water is being labeled as spring water when the ground water is being pumped out of the ground. We are concerned about PFC's and volatile organic chemicals and arsenic. We need to understand that bottled water may not be any safer than their tap water. NH is undergoing a large monitoring because of bladder cancers. Q: Rep. Butler - The cost of this analysis required and how it would be communicated and labeled. A: The state of NH has about a $200 for PFC's, around $310 for the complete analysis. Those results should be labeled. Q: How often for that cost? A: Annually. It is a small cost in order to allow the public to make an informed decision. Q: Rep. David Luneau - Would this section only apply to NH bottlers? A: All water sold in NH. Q: On lines 7 to 9 would only apply to NH? A: It allows any one who sells in NH or mfr in NH would have to be labeled.
