2012 F Or Manori Gorai Uttan Notified Area Development Control Regulations - 2012 F or Manori Gorai Uttan Notified Area Mumbai Metropolitan Region Development authority (MMRDA) PREAMBLE The sanctioned Regional Plan, 1996-2011 for Mumbai Metropolitan Region (MMR) recognized the tourism potential of the Gorai-Manori-Uttan ar ea and designated it as Recr eation and Tourism Development Zon e (RTDZ). The Government of Maharashtra vide its Notification No. 4307/108/CR29/07/UD-11 dated 1 st December 2007 notified the Manori-Gorai-Uttan area as Recr eation and Tourism Development and under Section 40 of th e Maharashtra Regional and Town Planning Act 1966, appointed MMRDA as the Special Planning Authority for the said area. Survey no. 341 of Uttan village was excluded fr om th e SPA ar ea. The MGU Notified Area comprises of 8 villages in all of which Manori and Gorai with an area of abou t 19.52 sq km fall under the administrative jurisdiction of Mun icip al Corpor ation of Greater Mu mbai (MCGM) and Chowk, Dongri, Pali, Tarodi, Morva and Uttan with an area of abou t 23.61 sq km fall under the jurisdiction of Mira Bhayander Municipal Corporation (MBMC). The SPA, ther eafter, following th e pr ocedure laid down in the Maharashtra Region and Town Plannin g Act, 1966, prepared th e Dr aft Development Plan (DDP) along with Develop ment Contr ol Regulation s (DCRs) for th e eight villages of MGU Notified Area excluding th e r evenue survey no. 341 of Uttan . While preparing th e DDP an d th e DCRs for MGU Notified Ar ea, th e provisions of Development Plan s of MCGM and MBMC have b een studied and suitable modification s have b een prop osed to facilitate the development of RTDZ. Introduction The preparation of the CZMP for Mira Bhayandar Municipal Corporation has been undertaken as part of the CZMP preparation for the coastal zone of Thane and Sindhudurg districts. The approach and methodology followed are the same for all the Municipal Corporations, Municipal Councils and rural areas in the above districts. The damages to the coastal zone and the impact of coastal hazards to communities and properties, to a certain extent, can be controlled by regulating high impact activities in the coastal zone. It was with this objective the Coastal Regulation Zone (CRZ) Notification (MoEF, 2011; 1991) was introduced in the country. 1. 1 Coastal Zone Management Plans The CRZ provides a spatial planning framework for Coastal Zone Management Plans which provide setbacks around sensitive eco-zones restricting development and other activities close to it. Setbacks require specific reference lines and boundaries for its meaningful implementation. The High Tide Line (HTL) forms the cardinal reference line for determining the setbacks for CRZ. The 100, 200 and 500m CRZ lines landward from the HTL are the landward setback lines. The Low Tide Line (LTL) and the Territorial water boundary (12 NM) form the setback lines towards the sea.     MANORI GORAI UTTAN NOTIFIED AREA DEVELOPMENT PLAN 2022 Background note from MMRDA website The sanctioned Regional Plan of MMR identified Gorai-Manori-Uttan area as Recreation and Tourism Development Zone. Following this, the Government of Maharashtra vide Notification dated 24th August, 2004, appointed MMRDA as “Special Planning Authority” for Gorai-Manori-Uttan area. The MMRDA has established a Joint Committee comprising officials from Municipal Corporation of Brihan Mumbai, Mira-Bhayander Municipal Corporation, Maharashtra Tourism Development Corporation and Maharashtra Coastal Zone Management Authority. As required under the MR&TP Act, 1966 and as proposed by the Joint Committee, the MMRDA has taken up preparation of Development Plan for the notified area. The intention to prepare Development Plan was declared on 4th December, 2006 M/s. EPC Management Planning and Development Private Limited, Ahmedabad have been appointed as consultant for preparation of Development Plan for the notified area. The Draft Development Plan proposals are expected to be prepared by the end of December 2010. After approval of the same by the MMRDA, the Draft Development Plan will be published inviting suggestions and objections. The proposed development plan for the notified area was published in November 2011. UDRI participated in the suggestions and objections by sending in a letter dated 14th December 2011 which highlighted the critical shortfalls of the plan. The letter highlights the following: 1. Mumbai’s Affordable housing needs: The population of Greater Mumbai living in slums and wadis in 2005 is estimated as 6.5 million people (51% of the population) and growing. That is a shortfall of about 15 Lakh dwelling units.

    Minutes of CRZ Clearance proposals considered in 210th Meeting of SEIAA held on 1610.2020 Item no.21 Proposal No.:-NA Type of Project: CRZ Clearance Subject-CRZ Clearance for Proposed Reconstruction & Extension of Existing Storm Water Drain (SWD) Outfall at Janta colony, Worli Koliwada, G/S ward, Mumbai by MCGM MCZMA Deliberation — The MCGM officials presented the proposal before the Authority. The MCGM has proposed reconstruction & extension of existing SWD outfall at Janta colony, Worli koliwada, G/S ward, Mumbai to give relief to citizens / residents from flooding and to improve SWD network system in G/S ward. There are total 21 nos. of marine outfalls which needs reconstruction & extension due their current dilapidated conditions. The said outfalls are having length of around 12 to 19 meter. MCGM officials further informed that there are slums around the site and storm water gets flooded in the slums causing hardships to the local residents. Hence, reconstruction & extension of the existing outfalls is necessary to prevent the flood situation in the nearby surrounding locality. There are no mangroves in and around the site. The Authority noted that as per approved CZMP of Greater Mumbai under CRZ Notification, 2011, the site is located in CRZ-I B area. It is further noted that as per para 3(v) of the CRZ Notification, 2011, Storm water drains and ancillary structures for pumping is a permissible activity form CRZ point of view. It is essential infrastructure facility as flood control measure for the residents of the Worli Koliwada and its surrounding locality. The Authority further noted that as per amended CRZ Notification dated 28th November, 2014 published by MoEF, For the projects specified under 4(i)(except with respect to item (d) thereof relating to building projects with less than 20,000 sqm of built up area) and for the projects not attracting EIA Notification, 2006, clearance from SEIAA is required based on the recommendation from MCZMA.
