False Statements and Obstruction of the 3 6 Investigation INTRO SUMMARY The Special Counsel’s office is authorized “to prosecute federal crimes arising from its investigation” on the matters assigned to it.

The Special Counsel’s Office determined:

1. Contacts between the Trump Campaign and Russia-linked individuals either:

❏ Did not involve the commission of a federal crime, or ❏ That evidence was not sufficient to obtain and sustain a criminal conviction.

2. The Principles of Federal Prosecution supported charging certain individuals connected to the campaign with making false statements or otherwise obstructing the investigation or parallel congressional investigations.

A. RUSSIAN “ACTIVE MEASURES” SOCIAL MEDIA CAMPAIGN SUMMARY OF RESULTS

● Grand Jury indicted 13 Russian nationals and 3 Russian entities - including the IRA and Concord Mgmt & Consulting Group - of interfering with U.S. Elections and political processes. ○ Count One: Conspiracy to defraud the (all defendants) ○ Count Two: Conspiracy to commit wire fraud and bank fraud (3 defendants) ○ Count Three - Eight: Aggravated identity theft ● No Trump campaign official or any other U.S. person charged with participating in the conspiracy. ● One U.S. national (Richard Pinedo) charged with one count of identity fraud - for his role in supplying false or stolen bank account numbers to the IRA. B. RUSSIAN HACKING & DUMPING OPERATIONS SUMMARY OF RESULTS

A Grand Jury indicted Russian military intelligence officers from the GRU with:

● Count One: Conspiring to hack into various U.S. computers used by the Clinton Campaign, DNC, DCCC, and other U.S. persons. ● Counts two - ten: Committing identity theft and conspiring to commit money laundering in furtherance of that hacking conspiracy. ● Count eleven (aka the Netyksho Indictment): Conspiracy to hack into the computers of U.S. persons and entities responsible for the administration of the 2016 U.S. election.

C. RUSSIAN GOVERNMENT OUTREACH AND CONTACTS SUMMARY OF RESULTS

● Foreign Agents Registration Act (FARA) charges levied against Paul Manafort and Richard Gates based on their activities on behalf of the Ukraine (e.g., they didn’t register as foreign agents). ● Some individuals charged with making false statements and obstructing justice. ● No individuals associated with the Trump campaign charged with conspiracy to commit a federal offense arising from Russia contacts or conspiracy to defraud the United States.

“Thing of Value” legally includes: ● Law enforcement reports that would reveal the identity of informants ● Classified materials ● Confidential information about a competitive bid ● Secret grand jury information ● Information about a witness’s whereabouts ● The value which the defendant subjectively attaches to the items received ● The provision of any goods or services without charge (including membership lists and mailing lists, lists of activists, polling data, and other election materials).

Criteria For Making False Statements

To meet the standard, the following must be proved beyond a reasonable doubt:

● The statement was false, fictitious, or fraudulent ● The defendant knew it was false and that it was unlawful to make a false statement ● The false statement was “material” - i.e., has a natural tendency to influence, or be capable of influencing a discrete decision or any other function of the agency to which it is addressed. Criteria For Perjury

To meet the standard, the following must be proved beyond a reasonable doubt:

● The defendant testified under oath before a federal grand jury ● The defendant’s testimony was false in one or more respects ● The false testimony concerned matters that were material to the grand jury investigation ● The false testimony was knowingly given Criteria For Obstruction of Justice

Contains these three basic elements:

● An obstructive act ● Some form of nexus between the obstructive act and an official proceeding ● Criminal (i.e., corrupt) intent
