Age and Sexual Consent
Per Se or Power? Age and Sexual Consent Joseph J. Fischel* ABSTRACT: Legal theorists, liberal philosophers, and feminist scholars have written extensively on questions surrounding consent and sexual consent, with particular attention paid to the sorts of conditions that validate or vitiate consent, and to whether or not consent is an adequate metric to determine ethical and legal conduct. So too, many have written on the historical construction of childhood, and how this concept has influenced contemporary legal culture and more broadly informed civil society and its social divisions. Far less has been written, however, on a potent point of contact between these two fields: age of consent laws governing sexual activity. Partially on account of this under-theorization, such statutes are often taken for granted as reflecting rather than creating distinctions between adults and youth, between consensual competency and incapacity, and between the time for innocence and the time for sex. In this Article, I argue for relatively modest reforms to contemporary age of consent statutes but propose a theoretic reconstruction of the principles that inform them. After briefly historicizing age of consent statutes in the United States (Part I), I assert that the concept of sexual autonomy ought to govern legal regulations concerning age, age difference, and sexual activity (Part II). A commitment to sexual autonomy portends a lowered age of sexual consent, decriminalization of sex between minors, heightened legal supervision focusing on age difference and relations of dependence, more robust standards of consent for sex between minors and between minors and adults, and greater attention to the ways concerns about age, age difference, and sex both reflect and displace more normatively apt questions around gender, gendered power and submission, and queer sexuality (Part III). -

The study aimed to identify risky sexual and reproductive behaviours and their underlying factors among in-school and out-of-school adolescents and how parenting styles might play a role. While the data from the study provided a useful snapshot and a clear picture of sexual and reproductive behaviours of the teenagers surveyed, it did not point to any strong association between parental styles and teens’ sexual reproductive behaviours. Keywords: Parenting styles; parents; youth sexuality; premarital sex; teenage pregnancy; adolescent sexual and reproductive behavior. The specific characteristics of adolescents and the lack of maturity facilitates the acquisition of sexual risk behaviors such as relaxation in the use of barrier contraceptives or the use of toxic substances, alcohol or drugs during sexual relations, increasing of sexually transmitted infections (STIs) and unwanted pregnancies. Health education in sexuality is one of the best ways to prevent risk behaviors and to promote healthy and responsible sexuality. While there have been different works in sex education in adolescents, there is still a lack of a comprehensive systematic literature review that including randomized and non-randomized clinical trials and quasi-experimental pre-post studies addressing education programs that provide information on healthy and responsible sexuality. Further, it is noted that a protocol drafted in consideration of the existing approaches is needed to present a basis for a systematic literature review in this area. This article, therefore, proposes a review protocol that will evaluate the impact of comprehensive sex education programs in the level of knowledge about STIs, behavioral level concerning the frequency of use of effective contraceptive methods and level of knowledge about sexual identity, diversity and/or responsible sexuality, after the intervention. -

Harper* INTRODUCTION Childhood and adolescent sexuality are complex phenomena that are impacted by a host of cultural, developmental, environmental, and familial factors. As young people traverse the developmental path- way to adult sexuality, some are confronted with unwanted or prema- ture sexual activity with an adult that can have deleterious psychological, social, or physical consequences. Given the power dif- ferential that exists between adults and youth, one that is intensified in male and female dyadic relationships, young people who are in- volved in such sexual interactions are often not capable of protecting themselves from the dangers of sexual contact with adults. Thus, vari- ous statutory rape laws have been developed in the United Sates and elsewhere to protect young people from sexual coercion and exploita- tion by adults.1 Although these laws have a long history and have undergone nu- merous transformations throughout the years, 2 there has been a re- cent focus on reexamining the status and heightened enforcement of statutory rape laws. -
