Satpuda Vikas Mandal, Pal Tahasil- Raver, District- Jalgaon (Maharashtra) Reged. Public Trust R. N. E. 248 (Jalgaon) 15/12/1971 (New Scheme 10/04/1991) Constitution 1) Name - The name of the Organization shall be “Satpuda Vikas Mandal, Pal” hereinafter called the Mandal. 2) Registered Office - The registered office the Mandal shall be located at Pal, Tal- Raver, Dist- Jalgaon. 3) Jurisdiction – The jurisdiction for the functioning of the Mandal shall be the all over India. 4) Aims and Objects – The broad objective of the Mandal is to work for social transformation and towards creating a classless society, free from exploitation and based on decentralization, as envisaged by the welfare philosophy of Sarvodaya. The Mandal shall undertake, with this view, the following projects to bring about educational, social, economic and cultural upliftment of the people in the rural and Adivasi (Tribal) areas. A. To establish pre-primary, primary, secondary and higher secondary schools, technical schools and colleges for higher education; to take over existing schools and appoint teachers for them. B. To open boarding house and Gymnasiums, to set up extension service centres, libraries, Laboratories and dispensaries. C. To publish literature which will promote the aims of the Mandal. D. To create facilities for agricultural education and research work and to set up agricultural extension service centres and to fulfill the necessary eventual requirements. E. To establish training centres for the village industries. F. To plan and organize camps, symposia, campaigns, excursions and cultural functions with a view to create an awareness among the masses about the new social order. G. To purchase acquire or otherwise procure lands and buildings for the use of the Mandal and to do such other things as will be conducive to the attainment of the objectives of the Mandal. 5) Funds and Property a) The property, indicated in Annexure I shall belong to the Mandal, according to the Section 17 of the Bombay Public Trust Act, 1950. b) That property of the Mandal, otherwise not recorded due to mistake in the Annexure –I, shall also belong to the Mandal only. c) The Mandal shall raise funds through any or all of the following means – A) Donations. B) Contributions from the members. C) Loans D) Deposits E) Grants and aid from Government and other institutions. F) Donations made for a specific cause in conformity with the objectives of the Mandal shall be utilized as per the wishes of the donor. 6) Membership – Any person above 21 years of age belonging to either sex and believing in the aims and objects of the Mandal can be a member of the Mandal. A) Founder Members – 1) Shri. Balasaheb alias Madhukarrao Dhanaji Chaudhari PAGE 2 2) Shri. Bhausaheb alias Dhanji Maharu Bonde 3) Shri. Bhanu Chaudhari alias Janardan Dhanu Chaudhari 4) Shri. Khushal Jayaram Patil 5) Shri. Vajirkhan Chandkhan Tadavi 6) Shri. Sunit Dhanji Bonde 7) Shri. Shirish Madhukarrao Chaudhari B) Life Members – A life member is one who has given a pledge to dedicate himself to the work of the Mandal for a minimum period of 20 years and who fulfills the following conditions. 1) Full faith is the aims and objectives of the Mandals and full dedication to its work. 2) Faith in the upliftment of the rural and Adivasi (Tribal) people and complete dedication to the work of their development. 3) Non-participation in any activity that conflicts with the objectives of the Mandal. 4) Non-involvement in any criminal activity. 5) Payment of the annual subscription of Rs. 100/- regularly. C. A patron is one who contributes more than Rs. 25,000/- or donates immovable property of the same value. D. A Donor is one who contributes Rs. 5,001/- or donates immovable property of the same property of the same value. E. Fellow – A Fellow is one who contributes Rs. 1,001/-. F. Ordinary Membership – An Ordinary Member is one who pays an annual subscription of Rs. 25/- and devotes himself for at least one day in month or 12 days in a year to the work of Mandal. The work may be either mental or physical. A person shall not be deemed a member unless his membership is approved by the Executive Committee. 7. Cessation of Membership – A person shall cease to be member on the following grounds – 1) Death of a member. 2) Resolution of the General Body by 2/3 majority canceling membership as per Bye-Law 8. 3) Resignation as per Bye-Law 9. 4) Permanent insanity. 5) Deletion of name from the list of members as per Bye-Law 10. 6) Absence at the General Meetings continuously for two years without prior permission. 8. Cancellation of Membership If a member a) misleads or deceives the Mandal by providing false information or PAGE 3 b) becomes insolvent or renders himself unfit for membership by committing some legal offence, or, c) Deliberately acts in such a way as to discredit the Mandal he shall cease to be a member of the Mandal the General Meeting passes a resolution to that effect by 2/3 majority of the members present. The Member concerned shall be given 15 day’s advance show cause notice of such an action. 9. A Member desiring to his resign membership shall a) Send to the Secretary a 1 month advance notice conveying his intention to resign and, b) Pay the subscription due, if any. 10. Rules for Payment of Subscription A) Annual subscription shall be paid within 3 months from the 1st April. B) Failure to pay subscription within the specified period shall disqualify member for voting and contesting election, if already elected, he shall cease to be office bearer. C) Membership shall be cancelled if a member fails to pay his subscription continuously for two years. 11. The Financial year – of the Mandal shall commence on the 1st of April. 12. Management – There shall be the following 3 committees to manage the work of the Mandal. 1) General Body 2) Executive Committee 13. General Body – The General Body shall consist of – 1) All Life Members 2) All Founder Members 3) All Ordinary Members 4) Patrons 5) Donors 6) Fellows 14. Annual General Meeting – Annual General Meeting shall be held twice in a year. The first Annual General Meeting shall be conducted within 6 months from the expiry of the previous financial year. The functions of the first Annual General Meeting shall be. A) To appoint the Executive Committee after every 3 years. B) To appoint a qualified Auditor and fix his emoluments if necessary. C) To approve previous year’s, Annual Report and Accounts of the Mandal. D) To prepare plan for next year’s work. E) To consider the Auditors Report and to give directions to Office Bearers accordingly. The second Annual General Meeting shall be conducted to discuss and ratify the budget for the next financial year during the first three months and every calendar year. 15. Special General Meeting PAGE 4 Special General Meeting shall be called if a) The Executive Committee resolves to that effect by majority vote. 16. Procedure Regarding Convening General Meeting. Sufficient notice of Annual General Meeting shall be given to all the members of the Mandal. The notice shall contain the time, place and agenda and shall be displayed on the office Notice-Board or shall be given publicity through any other convenient means. 17. Procedure of General Meeting A) If there is no quorum the Meeting shall be held after ½ hours at the same place to transact business, with the members present. If necessary it shall be continued to the next day to transact the remaining business. B) A member, fulfilling the conditions as laid down in Bye-law 10 A, shall be entitled to cast one vote. The President shall have a casting vote in addition to his vote as a member. Voting by proxy shall not be allowed. 18. Executive Committee 1) The Executive Committee shall consist of 7 to 11 members. Members shall be as follows :- A) All Founder Members - 7 B) From Life Members – 2 C) From Ordinary Members – 1 D) From Patrons - 1 Note :- If there is no Patron Member, one more member shall be from Life- Members. Also if there are less than 7 living founder member, the vacancies shall be filled in from the life members. 2) Functioning A) For the management of all matters concerned with the Mandal an Executive Committee consisting of 7-11 members shall be formed. Its tenure shall be of 3 years. B) The President, Vice President, Secretary and Joint Secretary of the Executive Committee shall be elected from amongst the elected members of the Executive Committee. C) The Office-Bearers of the Executive Committee shall be deemed as office-Bearers of the Mandal for a period of 3 years. D) The Executive Committee shall exercise its powers in conformity with the resolutions passed by the General Body and as per existing Bye- Laws. E) The number of the meetings and their dates shall be decided by the Executive Committee as dictated by the exigencies of the business to be transacted. Subject to the proviso that that at least one meeting shall be held during a period of two months. F) The Executive Committee shall fill in the vacancies if, any, during its tenure by Co-option. PAGE 5 G) Members of the Executive committee remaining absent for three consecutive meetings without prior permission shall cease to be members of the Committee. H) Any action taken by the Committee or a member there of shall be deemed legal even if the election of the committee or the member concerned is subsequently proved to be invalid.
