Hamilton, Ph.D. Examination Committee Member Rebecca Gill, Ph.D. Graduate College Faculty Representative ii ABSTRACT United States expansion following the Mexican-American War served as the catalyst for a reinvention of American Federalism. While much of the historiography traces the accretion of sovereign power in the national government to events caused by the divisions between northern states and southern states, there is an important and understudied East to West component of the process by which sovereign boundaries changed. The American West is a legal space where the hazily defined and capacious concept of federalism received fuller form and clearer definition. During the late nineteenth century and first few years of the twentieth century, the United States modified and ultimately solidified three important relationships: (1) its relationship with Native American Tribes; (2) its relationship with territorial law and governance; and (3) its relationship to the land and natural resources. The Framers of the Constitution, including those of the Fourteenth Amendment, acknowledged Native American tribal sovereignty. The power of tribes to police themselves remained relatively undisturbed until one particular specie of intra-tribal violence attracted the attention of Anglo- American authorities – witch killings. With the sensationalization and publication of witch killings, Native Americans were introduced to the Anglo-American criminal justice system. Since that time, the United States iii has severely curtailed Native American power to police and regulate their own tribes. After the Civil War, the national government re-formulated territorial governance to assert greater control over areas of law, including common law, traditionally reserved to local sovereigns, and did so in the service of a nationalizing project. Concerned that local territorial citizens might re- assert their local laws following statehood, Congress placed increasingly stringent conditions on statehood for territories in the West. Finally, the national government asserted robust powers not only over people in the West, but also over its most valuable natural resources – minerals, timber, water, and land. Whereas the national government had initially served as something akin to a real estate sales agent for the nation, ensuring that the public domain was disposed, it adopted a different role in the West – that of a Landlord. All these changes necessitated new theories of federalism. Legal elites articulated these theories in Supreme Court cases, legal commentaries, and Congressional legislation. By the second decade of the twentieth century, the hazily defined federalism that had existed in flux had congealed. iv ACKNOWLEDGMENTS Graduate students in history learn, at the outset of their education, to adopt a critical eye in the reading of historical scholarship. The requirement to write a dissertation, I am convinced, serves to temper and refine our critical attitude in two ways. First, it instills an appreciation of the difficulty in conducting sound research and writing well. Second, it reminds us that scholarly inquiry is a collaborative enterprise. Our research and writing is enhanced through formal processes and informal conversations. This work is far better than it would have been due to helpful feedback from generous scholars. First and foremost, David Tanenhaus is the epitome of kindness and is everything one could hope for in an advisor. Kendall Editors’ Summary: Federalism has become a highly politicized term in envi- ronmental law, with some parties having adopted the term to signify an ideol- ogy of devolving federal authority over environmental protection back to the states. In this Article, the author argues that from the states’ perspective, the U.S. Supreme Court is using federalism both too much and too little. Too much, in striking down federal law where even the states recognize that a federal role is necessary to address a national problem. Too little, in inappropriately limit- ing state experimentation.     The State of Our Federalism Michael S. Greve The Oldest Question of American Constitutional Law Federalism has been called “the oldest question of American constitutional law.” And so it is. Federalism was the central question of our constitutional founding. It has been a constant theme of our politics ever since, and it has been a central, highly contentious question in every critical era in our history—the Civil War and Reconstruction; the Progressive Era; the New Deal; and the Civil Rights Era. We are now living through another critical period. The country is broke, and our political institutions seem incapable of finding solutions. And as always, federalism is playing a prominent role in a heated political debate. You’ve heard the story line: an overbearing, out-of-touch, out-of-control government in Washington, D.C. has aggrandized itself and trampled state and local governments underfoot. To restore fiscal sanity and democratic government, we should restore federalism’s balance. We should respect the Tenth Amendment, return power to the states, and so bring government closer to the people. All of the Republican contenders for the presidency advocate this program, with varying degrees of enthusiasm. I agree with their analysis and prescription—up to a point. Washington has indeed assumed far too much power over local affairs. In many policy areas, decentralization would improve our policies and our politics. I also agree that our problems have a potent constitutional dimension. And yet: I will try to persuade you that our federalism problem is a great deal more complicated. “Federalism” in the sense of decentralization and state authority is not just a solution.

Emancipation toppled the region’s economy and led many Southerners to try to establish a “New South” to replace their antebellum plantation society. Their task was unprecedented, and necessitated completely reimagining the economic structure of the entire region. Although most Southerners believed that the region was blessed with abundant natural resources, there were many competing ideas about how these resources should be used in order to achieve prosperity. By examining how these different visions shaped New South economic development, this dissertation reconsiders a longstanding interpretation of the postbellum American South, and provides a fresh historical perspective on the challenges of sustainable development in underdeveloped places worldwide.

I would like to provide some context on the suffrage movement in Ohio and the efforts by organizations across the state to prepare to celebrate this centennial and ensure inclusivity. From the first days of the movement, long before 1848 and the Seneca Falls Women’s Rights Convention, Ohio and Ohioans led the nation in campaigning for equal rights and opportunities for women: 1828 Frances Wright becomes the first woman in the United States to speak in public, launching what would become an international speaking career in the Hamilton County (Ohio) courthouse. An abolitionist and woman's rights activist dubbed "The Red Harlot of Infidelity," Wright persisted despite harsh criticism and threats of physical violence. 1848 Less than 2 months after his participation in the Seneca Falls Convention, Frederick Douglass led the National Convention of Black Freemen in Cleveland, Ohio, which became the very first national convention to permit participation by women when a "Mrs. Sanford" was allowed to address the participants. 1850 Activists, including Betsy Mix Cowles, in Salem, Ohio host the Ohio Women's Convention, the first convention to be run and organized entirely by women. 1851 Sojourner Truth delivers her "Ain't I a Woman?" speech at the Ohio Women's Rights Convention in Akron.
