Geomorphic Setting
DRAFT NCCP/MSAA/HCP CHAPTER 3: EXISTING BIOLOGICAL AND HYDROLOGIC/ GEOMORPHIC SETTING This Chapter describes the biological setting of the approximately 131,600-acre Southern NCCP/MSAA/HCP study area, including portions of the CNF (Figure 3-M). Within the study area, the approximately 91,660 acres of non-federal land defines the planning area for the NCCP/MSAA/HCP. Management of resources in the CNF is the responsibility of the USFS. Therefore, the description of the biological and hydrologic/geomorphic setting includes a general description of the CNF, but the main focus of this section is the 91,660-acre planning area. The 91,660-acre planning area is further subdivided into the four Subarea Plan areas described in Chapter 1 (Figure 3-M). The Subareas total approximately 86,339 acres. The remaining 5,321 acres are comprised on the cities of Lake Forest and Dana Point, and internal areas that are “not a part” of the Subareas, such as Ladera Ranch, Las Flores, the wastewater treatment plant in lower Chiquita, Tesoro High School, FTC-North, and the Nichols Institute bounded by Caspers Wilderness Park. To describe the biological setting of the NCCP/MSAA/HCP planning area, this Chapter includes the following sections: Section 3.1 Database development methods; Section 3.2 Vegetation communities that make up theplanning area and the key wildlife species that are typical of, or indicate, high quality vegetation communities; Section 3.3 Existing geomorphic and hydrologic conditions and processes; Section 3.4 Sensitive wildlife and plant species distribution in the planning areaand subarea plan areas; and Section 3.5 Regional and subregional wildlife habitat linkages. -

Tribal and Cultural Resources 5.11 TRIBAL AND CULTURAL RESOURCES 5.11.1 PURPOSE This section identifies existing cultural (including historic and archeological resources), paleontological and tribal resources within the Study Area, and provides an analysis of potential impacts associated with implementation of the General Plan Update. Potential impacts are identified and mitigation measures to address potentially significant impacts are recommended, as necessary. This section is primarily based upon the Cultural and Tribal Cultural Resources Technical Report for the Rancho Santa Margarita General Plan Update, Rancho Santa Margarita, Orange County, California (Cultural Study), and the Paleontological Resources Impact Assessment Report for the Rancho Santa Margarita General Plan Update, Orange County, California (Paleontological Assessment), both prepared by SWCA Environmental Consultants (SWCA) and dated April 2019; refer to Appendix F, Cultural/ Paleontological Resources Assessment. 5.11.2 EXISTING REGULATORY SETTING Numerous laws and regulations require Federal, State, and local agencies to consider the effects a project may have on cultural resources. Center for Ecosystem Management and Restoration NAPA COUNTY Huichica Creek Watershed The Huichica Creek watershed is in the southwest corner of Napa County. The creek flows in a generally southern direction into Hudeman Slough, which enters the Napa River via the Napa Slough. Huichica Creek consists of approximately eight miles of channel. Huichica Creek In March 1966 and in the winters of 1970 and 1971, DFG identified O. mykiss in Huichica Creek (Hallett and Lockbaum 1972; Jones 1966, as cited in Hallett, 1972). In December 1976, DFG visually surveyed Huichica Creek from the mouth to Route 121 and concluded that the area surveyed offered little or no value as spawning or nursery grounds for anadromous fish. However, the area was said to provide passage to more suitable areas upstream (Reed 1976). In January 1980, DFG visually surveyed Huichica Creek from Route 121 upstream to the headwaters. Oncorhynchus mykiss ranging from 75–150 mm in length were numerous and were estimated at a density of 10 per 30 meters (Ellison 1980). -

Updated Biological Inventory Report for the Rancho Malibu Religious Memorial Project, 4000 Malibu Canyon Road, City of Malibu, California
November 18, 2015 Project Number 15-02065 Jake Jesson Assistant Project Manager Green Acres, LLC 22837 Pacific Coast Highway #775 Malibu, California 90265 Via Email: [email protected] Subject: Updated Biological Inventory Report for the Rancho Malibu Religious Memorial Project, 4000 Malibu Canyon Road, City of Malibu, California This letter report updates the previous findings of the Biological Inventory Report (BIR) for the Rancho Malibu Religious Memorial Project due to a change in the project scope and grading plan. An Environmental Impact Report (EIR) was first prepared for this site (CBA, 1997) and certified by the City of Malibu City Council (March 23, 1998) along with conditions of approval contained in Conditional Use Permit No. 96-005. A BIR was prepared for the project site by Rincon Consultants, Inc. (Rincon) in May 2007 for plans to build a 146 room luxury hotel. An updated report was prepared in September 2011 (Rincon) as part of a Coastal Development Permit (CDP) application and Site Plan Review. In February of 2012, Rincon conducted a native tree assessment. In 2011 a reconnaissance survey and BIR update was prepared by Rincon to support the applicant’s plans to change the project from the development of a luxury hotel to a religious memorial and cemetery. This BIR (October 2015) documents the changes in potential impacts to special-status biological resources as they relate to the revised scope and grading plan for the proposed religious memorial and cemetery. PROJECT LOCATION AND DESCRIPTION The project site is located in the central portion of the City of Malibu, immediately north of Pacific Coast Highway between Malibu Canyon Road and Civic Center Way at 4000 Malibu Canyon Road. -

4.3 BIOLOGICAL RESOURCES 4.3 BIOLOGICAL RESOURCES This section identifies biological resources present on the project site and assesses the project’s impacts upon those resources. It is based on previous biological resource assessments for the site (conducted for the applicant) and a review of those assessments and supplemental field surveys and research conducted by the City’s EIR consultant. Since the Notice of Preparation was published March 9, 2010, the applicant has undertaken minimal amount of site disturbance activity for environmental research and maintenance. These activities involved conducting cultural resources investigations in March 2011, fuel maintenance as required by the County Fire Department in May 2011, and geotechnical exploration of the project site to assess possible construction design (i.e. foundation designs) on June 13-15, 2011. Each of these activities was planned and monitored to avoid any significant biological resources. Fuel modification is conducted on an ongoing basis once every three months. 4.3.1 Existing Conditions This section discusses the regional setting, project site conditions, and the existing and potentially occurring biological resources at the project site. Biological resources within the surrounding area are also discussed, when relevant. Methodology The description of existing conditions provided below is based on a literature review and site surveys. SECTION 12, WATERSHED ACTION PLANS 12.0 WATERSHED ACTION PLANS 12.1 Introduction The Third Term Permits have, with varying degrees of specificity, required the Permittees to develop and implement a watershed-based approach to urban stormwater management to complement the established jurisdictional-based approaches. In the area of the County under the jurisdiction of the San Diego Regional Board, Watershed Urban Runoff Management Plans (WURMPs) termed DAMP/Watershed Action Plans1 (WAPs), have been prepared for each of the six principal watersheds. In the Santa Ana Regional Board area of the County, which has a long history of watershed planning focused on the Newport Bay Watershed, the Permittees were required to update Appendix N of the DAMP to reflect the implementation measures and schedules related to the fecal coliform TMDL. Watershed management is the term used for the approach to water quality planning that places an emphasis on the watershed (the area draining into a river system, ocean or other body of water through a single outlet) as the planning area and looks to solutions to problems that cut across programs and jurisdictions. In Orange County, these efforts focus additional effort on the highest priority water quality constituents of concern in each watershed. The approach taken to develop the DAMP/WAPs establishes the jurisdictional DAMP/LIPs and the DAMP/WAPs as the principal policy and program documents for two separate, but nonetheless similar and highly interdependent, water quality planning processes targeting the control of pollutants in urban runoff (see Section 3.0, 2007 DAMP). In a number of watersheds these efforts are supportive of a third planning process that is focused on achieving broader objectives such as watershed habitat restoration and connectivity rather than specific water quality outcomes. -

Box 532711 Los Ange les, California 90053-2325 Dear Colonel Toy: This letter transmits the Clean Water Act (CWA) jurisdictional determination for the Los Angeles River. On August 17, 2008, EPA's Assistant Administrator for Water designated the Los Angeles River as a "Special Case" as defined by the EPA-Corps 1989 Memorandum ofAgreement (MOA) regarding coordination on matters ofgeographic jurisdiction. Pursuant to the MOA, designation ofthe "Special Case" made EPA responsib le for determining the extent to which the Los Angeles River was protected as a "water ofthe United States." Specifically, EPA analyzed the river's status as a "Traditional Navigable Water," one ofseveral categories ofjurisdictional waters under the Act. We conclude that the mainstem ofthe Los Angeles River is a "Traditional Navigable Water" from its origins at the confluence of Arroyo Calabasas and Bell Creek to San Pedro Bay at the Pacific Ocean, a distance of approximately 51 miles .
