IN NEWS Four judges elevated to Supreme Court

EXAM POINT OF VIEW

The Centre has cleared four names recommended by the Supreme Court Collegium for elevation as judges of the apex court. Four new judges are likely to be sworn in as Supreme Court justices soon, taking the total to the court's full strength of 31 for the first time in five years. Justices Aniruddha Bose, AS Bopanna, and have been elevated to the top court.

Supreme Court (Articles 124-147)

 Chapter IV under Part V of the constitution (Union) deals with the The Union Judiciary. The constitution and jurisdiction of Supreme Court is stated in detail from articles 124-147. Unlike the other two branches, executive and legislature, in India Judiciary is integrated. This

means that even though there may be High Courts in states, the law declared by the Supreme Court shall be binding on all courts within the territory of India (Article 141)

BENEVOLENT IAS ACADEMY, COIMBATORE  Article 124 provides for the establishment and constitution of , which is the apex court of India. It was established on 28th January, 1950 i.e. two days after the commencement of the Constitution.

 Article 124(1) – “There shall be a Supreme Court of India consisting of a and, until Parliament by law prescribes a large number, of not more than seven other judges.”

 The Parliament is competent to increase the number of judges if it deems necessary. To begin with, besides the Chief Justice, there were only 7 other judges. The Parliament has increased the number of judges from time to time. As in 2014, there are 29 judges besides the Chief Justice who is also called the Chief Justice of India. The sanctioned strength of the judges is 31, consisting of the Chief Justice and 30 other judges.

Qualifications for appointment as a judges of the Supreme Court

1. be a citizen of India; and

2. has been a Judge of a High Court or two or more such courts in succession for at least 5 years; or

3. has been an Advocate of a High Court or one or more such courts in succession for at least 10 years; or

4. a distinguished jurist in the opinion of the President.

Tenure and Removal of the Judges of Supreme Court

A Judge of the Supreme Court vacates his office on attaining the age of 65 years or by resignation addressed to the President or by removal by the President upon a resolution passed by both Houses of Parliament. A judge of the Supreme Court does not hold office during the pleasure of the President. In exceptional cases, he may be removed before the age of retirement, according to the procedure laid down in the Constitution. He can be removed from office by an order of the president, passed after an address by each House of the Parliament supported by a majority of total membership of the House not less than two-third majority of the members of each House present and voting, passed in the same session, has been presented to the President. The ground for such removal can be „proved misbehavior or incapacity only. Further, Parliament under Article 124(5) may by law regulate the procedure for the removal of judges of the Supreme Court.

Accordingly, Parliament has passed Judges (Inquiry) Act, 1968. Under this Act, a motion seeking the removal of a Judge can be presented before either of the House of Parliament.

Appointment of acting Chief Justice (Article 126): When the Office of the Chief Justice of India is vacant or when the Chief Justice, by reason of absence or otherwise, is unable to perform the duties of his office, the duties of the office shall be performed by such one of the other Judges of the Court as the President may appoint for the purpose.

Appointment of Ad hoc Judges (Article 127): If at any time there is a lack of quorum of the Judges of the Supreme Court to hold or continue any session in the Court, the Chief Justice of India may with the previous consent of the President and after consultation with the Chief Justice of the High Court concerned, request in writing the attendance at the sittings of the Court, as an ad hoc Judge, for such period as may be necessary, of a Judge of a High Court duly qualified for appointment as a Judge of the Supreme Court to be designated by the Chief Justice of India.

Attendance of retired Judges at sittings of the Supreme Court (Article 128): The Chief Justice of India with the previous consent of the President may request a retired Judges of the Supreme Court or Federal Court or a retired Judge of a High Court who is duly qualified to be appointed as a Judge of the Supreme Court to sit and act as a Judge of the Supreme Court. Such a judge is entitled to such allowances as the President may determine.

The Bangladesh High Commission in Islamabad has stopped issuing visas to Pakistani nationals for one week over a fresh diplomatic row amid strained bilateral ties since 2013 when Dhaka decided to hang several of the 1971 war criminals. In 2018, Dhaka denied a visa to the Pakistan High Commissioner. The Foreign Office in Dhaka, however, is yet to make any formal confirmation and no official notification has been issued on the halting of visas to the Pakistani nationals.

Bangladesh refusal for Pak. new high commissioner:

Bangladesh has reportedly refused to accept the 'agreement' from Islamabad for the appointment of a new high commissioner. Pakistan Ministry of Foreign Affairs named Saqlain Syedah as its new High Commissioner to Bangladesh, but Dhaka refused to accept the "agreement", a diplomatic requirement under which a host country has to confirm the appointment of an incoming envoy.

The Indo-Pakistani War of 1971 was a military confrontation between India and Pakistan that occurred during the liberation war in East Pakistan from 3 December 1971 to the fall of Dacca (Dhaka) on 16 December 1971. The war began with preemptive aerial strikes on 11 Indian air stations, which led to the commencement of hostilities with Pakistan and Indian entry into the war of independence in East Pakistan on the side of Bengali nationalist forces. Lasting just 13 days, it is one of the shortest wars in history.

As a result of the war, East Pakistan disintegrated and became an independent country, Bangladesh, as the world's fourth most populous Muslim state on 16 December 1971. Pakistan itself secured the release of Sheikh Mujibur Rahman from the Headquarter Prison and allowed him to return to Dacca. On 19 January 1972, Mujib was inaugurated as the first President of Bangladesh, later becoming the Prime Minister of Bangladesh in 1974

The earth observation satellite RISAT-2B is capable of observing Earth during the day, night and even under rainy and cloudy conditions. The launch of the PSLV marks the third launch in 2019.

 Pakistan appointed Mueenul Haq as the High Commissioner to India. Haq succeeds Sohail Mehmood. Haq, a career diplomat, is currently serving as Ambassador to France.

1. Pranab Mukherjee

He is an Indian politician who served as the 13th President of India from 2012 until 2017. He has been a senior leader in the Indian National Congress and has occupied several ministerial portfolios in the . Prior to his election as President, he was Union Finance Minister from 2009 to 2012.

2. Nanaji Deshmukh

He was a social activist from India. He worked in the fields of education, health, and rural self-reliance. He was a member of RSS, a leader of the Bharatiya Jana Sangh and also a member of the Rajya Sabha. He was honoured with the Padma Vibhushan in 1999. Indiá's first Saraswati Shishu Mandir was established by him at Gorakhpur in 1950.

3. Bhupen Hazarika

He was an Indian playback singer, lyricist, musician, singer, poet and film- maker from Assam, widely known as Sudhakantha. Before he got Bharat Ranta (India's highest civilian award), received the National Film Award for Best Music Direction in 1975. Recipient of Sangeet Natak Akademi Award (1987), Padmashri (1977), and Padmabhushan (2001), nad also awarded with Dada Saheb Phalke Award (1992).
