SEIM 01-29 WEST VIRGINIA LEGISLATURE Senate Committee SEIM 01-29 WEST VIRGINIA LEGISLATURE Senate Committee on Energy, Industry and Mining Tuesday, January 29, 2019 1:00 p.m. Members Present: Senator Randy Smith (Chair), Senator Dave Sypolt (Vice Chair), Senator Charles Celments, Senator Sue Cline, Senator Bill Hamilton, Senator Chandler Swope, Senator Doug Facemire, Senator William Ihlenfeld, Senator Glenn Jeffries, Senator Richard Lindsay, Senator Mike Woefel Members Absent: Senator Donna Boley, Senator Kenny Mann Pursuant to the call of the Chairman, the Senate Committee on Energy, Industry and Mining met at 1:00 p.m. on January 29, 2019, in Room 208 of the West Wing. All members being present, apart from Senator Donna Boley and Senator Kenny Mann. Chairman Smith recognized Vice Chairman Sypolt who moved to approve the minutes from the January 24, 2019 meeting. The motion was adopted by the committee. Chairman Smith brought the following bills before the committee S. B. 52 - Entitling natural resource producers to economic opportunity tax credit. Counsel explained the bill. A representative, Randy, from Arch Coal was asked to address the Committee and answer questions. A representative, Mark Morton, from the Tax Department was asked to address the Committee and answer questions. The department stated that they did not have a stance on the bill but wanted to speak on the significant revenue impact of the bill. On the motion of the Vice Chairman, the committee recommended SB52 be reported to the full Senate with the recommendation that it do pass, under the original double Committee reference first be referred to the Committee on Finance. The Vice Chairman moved to adjourn the meeting. The motion passed unanimously. .

The Senate was then led in recitation of the Pledge of Allegiance by the Honorable Gregory L. Boso, a senator from the eleventh district. Deborah Thomas, Nondenominational Fellowship Pentecostal Ministries, Charleston, West Virginia, then proceeded in the singing of “I Called on the Lord and Got an Answer” and “There’s A Blessing in This House”. On motion of Senator Takubo, the special order of business set for this position on the calendar (consideration of executive nominations) was postponed and made a special order of business at 3 p.m. today. Pending the reading of the Journal of Friday, March 8, 2019, At the request of Senator Ihlenfeld, unanimous consent being granted, the Journal was approved and the further reading thereof dispensed with. The Senate proceeded to the second order of business and the introduction of guests. At the request of Senator Sypolt, unanimous consent being granted, Senator Sypolt addressed the Senate regarding resolutions urging Congress to provide exceptions to weight limits on interstates that were introduced in the Senate but not acted upon by the House of Delegates. At the request of Senator Baldwin, and by unanimous consent, the Senate stood in observance of a moment of silence recognizing the Honorable Jesse O. Guills, former senator from the tenth district who is hospitalized in critical condition, and Adam DeBoard, a miner who was killed in a Greenbrier County mining accident on Thursday, March 7, 2019.
