VICTORIA. ANNO SECUNDO GEORGII QUINTI REGIS. No. 2340. An Act to provide for the constitution under the Local Government Acts of the Shire of Walpeup and for other purposes. [24M October, 1911.] E it enacted by the King's Most Excellent Majesty by and with B the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled ana by the authority of the same as follows (that is to say):— 1. This Act maybe cited as the fValpeup Shire Act 1911 and short title and shall be construed as one with the Local Government Ad. 190,3 (here- const™ction- inafter called the Principal Act) which Act and any Act amending- the Ko*1S9J&C* same and this Act may be cited together as the Local Government Acts. 2. (1) Notwithstanding anything in the Local Government Acts Power to sever the Governor in Council without any petition may make an order— hires'"nX*oertain (a) severing from the respective municipal districts of the sliires Jhe8«hireeofbeBame of Dimboola, Karkarooc, Lawloit, Lowan, Mildura, and walpeup. Swan Hill so much thereof as is described in the First First Schedule. •Schedule to this Act and constituting the same a shire under the Local Government Acts under the name of the shire of Walpeup ; (h) altering [6d.] 183 16146. 2 GEO. (b) altering the boundaries of the respective municipal districts of the said shires from which portions are severed so as to correspond w7ith the boundaries of the Second Schedule. said shires as set forth in the Second Schedule to this Act; (c) determining that the council of the said shire of Walpeup shall consist of six members, and that the municipal district thereof shall be subdivided into two ridings with Third Schedule. the names and boundaries set forth in the Third Schedule to this Act; and (d) severing from the municipal district of the shire of Swan Fourth Schedule. Hill so much thereof as is described in the Fourth Schedule to this Act aud annexing to the shire of Karka- rooc the portion as severed. Effect of order. (2) For the purposes of the Local Government Acts the said No. 1893 s. 16. order shall be deemed and taken to be and may be dealt with in all respects as if it were an order made under the powers conferred by section sixteen of the Principal Act. (2) For the purposes of such valuation the person so appointed shall have and may exercise all the powers duties and functions of a valuer under the Local Government Acts, and shall make his valuation and return in a form con taining particulars as nearly as practicable resembling a valuation and return as required to be made under the Local Government Acts. (3) From the information contained in such valuation and return the person so appointed shall compile a list con taining the names of all persons whose names appear therein and who are of the full age of twenty-one years and who if a rate were made on such valuation would be liable to be rated in respect of any rateable property included in such valuation. (4) Such list shall as nearly as practicable be in the form and contain the particulars required to be inserted in the voters' roll for a municipality (including the number of votes m 2 GEO. [No. 2340 & votes to which persons whose names are contained in such list would be entitled if such list were a voters' roll); and after being certified as correct by the person so appointed shall be printed; and shall have the same force and effect in all respects as if it were a voters' roll for the said shire made as provided by the Local Govern ment Acts and shall continue in force until a new voters' roll for the municipality comes into operation. (5) For the purpose of making and levying the first general rate to be made and levied by the council of the shire of Walpeup the valuation and return made under this section shall (unless the council cause a new valuation to be made for the purpose) have the same force and effect as if it had been a valuation and return made by a valuer appointed by the said council and such rate may be made upon such valuation accordingly. (6) The costs and expenses of making the valuation and of compiling and printing the list as provided in this section shall be borne and paid by the council of the said shire after the constitution thereof out of the municipal fund. 4. Portions of the Municipal Districts of the Shires of Dimboola, Karkarooc, Lawloit, Loivan, Mildurtiy and Swan Hill proposed to be severed from the said shires and constituted the Shire of Walpeup. Commencing at a point on the west boundary of tho State of Victoria where it is intersected by (lie 3oth parallel of south latitude ; bounded thence north by the said boundary eight miles ; thence east by a lino to the west boundary of mallee block 14A ; thence south and cant by that block to a point on the south boundary thereof where it would bo met by the prolongation of the centre line of the road forming the boundary hetwoeu allotments 8 and 9, parish of l'irro ; thence south by a line and the said road to the south-east angle of allotment 8o ; thence west by a road to the south-west angle of allotment 88A ; thence north by a road to the north boundary of the parish of Dering ; thence west by that boundary and the north boundary of the parish of Patchewollock to a point due north of the north-east angle of mallee block 46A ; thence south by a lino to the said angle; thence west by the north boundary of the last- mentioued block to the Outlet Creek ; thenco southerly by that creek to the north boundary of mallee block 45B ; thence west by that block twenty-five miles eight chains thirty-four links; thence south by aline to the north boundary of mallee block 42A ; thence west by flint block and a line to the west boundary of the State of Victoria ; aud thence north by that boundary to the point of commencement. SECOND SCHEDULE. Boundaries of the Shire of Dimboola as Altered and Re-defined. Commencing at a point on the Winnncra River where the south boundary of mallee allotment 124, county of Lowau, abuts thereon; thence west by the said boundary and the south boundary of mallee allotment 138A to the east boundary of mallee allotment 139B ; thence north by that allotment and a road to the north-west angle of the parish of Woraigworm ; thence west by the north boundary of the parish of Winiam to the t?outh-weBt angle of the parish of Kiata; thence north aud east by the west and part of the north boundaries of that parish to the south-west angle of the parish of Ni Ni; thence north by the west boundary of that parish and part of the west boundary of the parish of Babatchio to the north-east angle of mallee allotment 81n ; thence west by that allotment and mallee allotments 81A and 81C to the ilorth-west angle of the last mentioned allotment; thence north by a road to the north-west angle of mallee allotment 76; thence west by the south boundary of the county of Weeah, being also the south boundary of mallee block 41B, to a point thereon distant twelve and a half miles east from the eouth-west angle of the said block ; thence north by a line to the north boundary of mallee block 4.5B ; thence easterly by that boundary and the Outlet Creek to the 142nd meridian line ; thence south by that line to the north boundary of the parish of Hindmarsh ; thence east by a road to the north-west angle of the parish of Willenabrina; thence south by the west boundaries of the parishes of Willenabrina, Yellangip, Cannum, Wullup, and Kewell West to the south-west angle of the parish last named ; thence west by the south boundary of the parish of Dimboola to the Wimmera River; and thence southerly by that river to the commencing point.
