Evidence from Longitudinal Data and Job Queues Alan B. Krueger Several academic researchers have addressed the issue of whether federal government workers are paid more than comparable private sector workers. In general, these studies use cross-sectional data to estimate the differential in wages between federal and private sector workers, controlling for observed worker characteristics such as age and education. (Examples are Smith 1976, 1977 and Quinn 1979.) This literature typically finds that wages are 10-20 percent greater for federal workers than private sector workers, all else constant. In conflict with the findings of academic studies, the Bureau of Labor Statistics’s of- ficial wage comparability survey consistently finds that federal workers are paid less than private sector workers who perform similar jobs.’ Moreover, the government’s findings have been confirmed by an in- dependent study by Hay Associates (1984). Additional research is needed to resolve this conflict. When the focus turns to state and local governments, insignificant differences in pay are generally found between state and local govern- ment employees and private sector employees. -

NEW YORK CITY RUBBER ROOMS: THE LEGALITY OF TEMPORARY REASSIGNMENT CENTERS IN THE CONTEXT OF TENURED TEACHERS’ DUE PROCESS RIGHTS By Bree Williams Education Law & Policy Professor Kaufman May 14, 2009 1 I. INTRODUCTION Jago Cura, a 32 year-old English teacher, was three months into his teaching assignment in the New York City Public School District (“the District”) when he was assisting students in his class with a group project.1 For no discernible reason, he began to lose control of his students and the class environment turned chaotic.2 Unable to deal with the stress, Cura began screaming and cursing at his students and, shortly after that, picked up a chair and flung it toward a blackboard.3 The chair bounced off the blackboard and grazed a student.4 After a moment, Cura realized what he had done and left the classroom.5 The day after this incident, the principal of Cura’s school instructed him to go to a Department of Education building for work instead of his classroom to teach.6 Unbeknownst to him at the time, Cura was being sent to a Temporary Reassignment Center, or what teachers within the District have termed, a “rubber room.”7 Rubber rooms are Department of Education facilities throughout the District that serve as a type of holding facility where teachers awaiting investigations or hearings involving alleged mishaps are sent for an indefinite period of time. This paper analyzes the legality of rubber rooms as a form of re-assignment for teachers that have allegedly engaged in misconduct, in light of a teacher’s tenure rights and right of due process. -

The evidence offered in this chapter reveals that federal employee groups were able to utilize these earlier institutional changes to expand their influence and direct the subsequent course of the civil service system. Indeed, as an interest group, federal workers have done rather well. Even though fed- eral workers do not have the right to strike, most of the evidence indicates that the ‘compensation of federal employees generally exceeds the amount that they would earn either in the private sector or elsewhere in the public sector. Federal unions have achieved this favorable outcome, at least in part, be- cause they have been granted direct input into the design of the very institutions that determine their members’ compensation. By law, federal wages must be comparable with those in the private sector. -

J&c- P REPORT BY THE Comptroller General OF THE UNITEDSTATES Options For Conducting A Pay Equity Study Of Federal Pay And Classification Systems This report discusses ways to determine why female federal employees earn less than male federal employees. Two general approaches are discussed--economic analysis and job content. Economic analysis attempts to measure and explain existing wage differentials between men and women using characteristics of individuals, occupations, and the workplace. Such an analy- sis could indicate the extent to which factors such as education, work experience, and occupa- tion account for wage differences by sex in the federal government. The job content approach focuses on the characteristics of jobs in seeking to identify wage disparities. A job content study could provide a measure of the value of various federal jobs to the government and a correspond- ing comparison of the present grades or salaries for those jobs. GAO believes that each approach has merit. Accordingly, in GAO’s view, the most compre- hensive and effective means through which to conduct a pay equity study at the federal level would be to include both approaches. Jeeps, Communists, and Quonset Huts: World War II Surplus Disposal in the Territory of Hawai‘i gwen sinclair In the waning days of World War II, the Honolulu Advertiser pub- lished a prescient article by a reporter named Gerry Burtnett about military surplus disposal: The disposal of surplus property in Hawaii is going to be one of the big- gest stories of the last days of the war and the postwar period. It may be a rather unpleasant story, from present indications.1 Disposal of war surplus in Hawai‘i was a big story, judging from the hundreds of newspaper articles about it published between 1945 and 1950. As soldiers, sailors, and marines returned home and life in the Territory began to be shaped by peacetime concerns, surplus disposal became an important industry in the Territory of Hawai‘i and in the nation as a whole. The disposal of surplus property captured the attention not only of the surplus-consuming public, but also of Congressional investigating committees. This paper will examine the effects of surplus disposal, why surplus held people’s attention for so long, and the major events and key people involved with surplus dis- posal in the Territory of Hawai‘i. Gwen Sinclair is a librarian and Head of the Government Documents & Maps Department at the University of Hawai‘i at Mānoa Library. Her publications and research interests range from government secrecy to presidential executive orders and proclamations relating to federal property in Hawai‘i. Nothing in this Agreement shall constitute a waiver or modification ofany provision ofany collective bargaining agreement, letter (including but not limited to the June 27, 2008 letter from the Chancellor to the President ofthe UFT) or other agreement between the DOE and the UFT except as specifically set forth herein. Nothing in this agreement shall be construed to convert non-mandatory subjects ofbargaining into mandatory subjects ofbargaining. As used herein, the term "CBA" shall refer to the collective bargaining agreement covering teachers and corresponding provisions ofother UFT-DOE collective bargaining agreements. The long delays that have arisen in the current process ofinvestigating alleged acts of misconduct and adjudicating charges pursuant to Education Law § 3020-a benefit neither the DOE nor the employees represented by the UFT. The DOE and the UFT are committed to ensuring that the agreements reached here will be carried out so that those delays will be ended and the process outlined in the law, the contracts between the parties, and this Agreement will be adhered to. For purposes ofthis Agreement, all timelines shall be measured in calendar days, but shall not include the summer break, all recess periods and holidays. -
