RECOMMENDATIONS 1. Council adopt this report and the Ordinance of Intention, and that the proceedings be conducted in accordance with Sections 6.95 - 6.127 of the Los Angeles Administrative Code, Section 53753 of the California Government Code, and Proposition 218 (Articles XIII C and XIII D of the California Constitution). This includes Council holding a Public Hearing for the proposed District Diagram with City page number 15420. 2. Upon Council adoption of the Ordinance of Intention, the Bureau of Street Lighting be instructed to: Mail notices of the assessment ballot proceedings, and Mail assessment ballots (as required by Prop. 218) to the property owners in the lighting district. 3. Upon completion of Item 2 above, the City Clerk be instructed to conduct the assessment ballot proceedings (i.e. count, certify, and report the results of the assessment ballot proceedings to the Council). 4. Following the conclusion of the final public hearing, if a project has weighted “YES” votes equal to, or in excess of weighted “NO” votes, the Council shall deny the appeals, confirm the maintenance assessments, and adopt the Final Ordinance levying the assessments. If the weighted “NO” votes are in excess of weighted “YES” votes, Council will abandon the lighting district and proceedings in accordance with Proposition 218; and the affected street lighting system shall be removed from service or not be constructed. -

The following information is provided to you for your information and use. This peer review addresses the adequacy of the GPA prepared landmark application for the subject property. Our review in performing the peer review included an assessment of the designation application and conclusionary findings; site visit of the property; and additional data collection and research of building permits, Sanborn fire insurance maps, historic aerial photographs, prior survey assessments of the site and area, and the collection and review of other primary and secondary sources. A review for accuracy, clarity and understanding, and validity of the information provided in the application narrative was also conducted as part of the peer review. Introduction Generally, peer reviews of historic resources assessment reports are conducted to reassure lead agencies requesting the assessments that the identification and evaluation efforts performed are adequate, that the eligibility determinations made are logical and well supported, and that the document will, if necessary, facilitate environmental compliance under the provisions of CEQA. Review of historic resources documents for quality control is an essential part of the environmental planning process. -

The lot size of the irregularly shaped subject parcel is approximately 206 feet by 76 feet. A narrow alley known as First Court borders the subject property on its west parcel line. Another alley (unnamed) borders the property on its south side. The subject property, originally known as the Teriton Apartments, consists of a two- and three-story apartment building arranged in a modified U-shaped configuration around landscaped courtyards with its primary elevations facing San Vicente Boulevard. Additionally, a detached utility room/parking garage and smaller detached parking garages are accessed from rear alleys. The 28-unit vernacular Modern style garden apartment complex was built in 1949 and is located in a primarily multi-family residential neighborhood. This property has been previously identified and assessed under the City’s on-going survey process on numerous occasions. It was documented as a contributor to a potential San Vicente Apartment Courts historic district comprised primarily of 1930s-1950s vernacular Modern style apartment buildings as part of the City’s 1983 historic resources survey. -

UNITED STATES ENVIRONMENTAL PROTECTION AGENCY REGION IX 75 Hawthorne Street San Francisco, CA 94105 September 20, 2007 Mr. Ron Kosinski California Department of Transportation 100 South Main Street Los Angeles, California 90012-3606 Subject: Draft Environmental Impact Statement for the Interstate 405 Sepulveda Pass Widening Project, from Interstate 10 to U.S. 101, Los Angeles County, California (CEQ #20070218) Dear Mr. Kosinski: The U.S. Environmental Protection Agency (EPA) has reviewed the Draft Environmental Impact Statement (DEIS) for the Interstate 405 (I-405) Sepulveda Pass Widening Project, from Interstate 10 (I-10) to U.S. 101, Los Angeles County, California and two updates to the project provided to our agency on May 28, 2007 and July 20, 2007 (herein, referred to as July 2007 DEIS Revisions). Our comments on these three documents are provided under the National Environmental Policy Act (NEPA), the Council on Environmental Quality’s NEPA Implementing Regulations (40 CFR 1500-1508), and Section 309 of the Clean Air Act. Our detailed comments are enclosed. Based on our review, we have rated the proposed I-405 Sepulveda Pass Widening Project DEIS as Environmental Concerns – Insufficient Information (EC-2). A Summary of EPA Rating Definitions is enclosed. While the DEIS was updated and revised in July 2007 to include several project changes, including the addition of a south bound mixed flow lane which extends for several miles, the sections evaluating impacts to the physical and biological environment, such as air quality, water quality, and natural communities, do not appear to have been updated. EPA recommends that Caltrans clarify whether the July EIS Revisions would affect the reporting or analysis provided in the May 2007 DEIS in both the physical and biological environments sections, and provide additional information in the Final Environmental Impact Statement (FEIS) regarding impacts and mitigation if warranted. -
