For and on behalf of Lieutenant Governor of Union Territory of Jammu & Kashmir, sealed e-tenders in two covers, are invited from experienced, reputed and registered firms/ genuine manufacturer/ authorized distributors/dealers/workshop holders / SSI Unit holders. 1.1 The bidding documents consisting of qualifying/eligibility criteria, technical specifications, general and commercial terms and conditions of contract and other details can be seen/downloaded from the website https://jktenders.gov.in 1.2 The Cost of “Tender Document” shall be furnished in the shape of Treasury Challan (Annexed to this document) demand draft in favour of the Executive Engineer, PHE Mechanical Division (North) Sopore and 2% of estimated cost be furnished as earnest money deposit pledged to the Executive Engineer, PHE Mechanical Division (North) Sopore drawn from a scheduled bank. 1.3 The bids shall be submitted in electronic format on the website https://jktenders.gov.in. Submission of Tenders: The tenders shall be submitted on line in two covers. 2.1 First cover shall contain self-attested copies of the following documents:

• Scanned copy of tender document fee in shape of Treasury Challan (Annexed to this document) or demand draft mentioning there in NIT No. and Serial No.

• Scanned copy of Bank Document in respect of Earnest money for in the shape of CDR/FDR/BG and the date of issuance of CDR/FDR/BG should be after the date of issuance of the e-NIT.

• Scanned copy of Goods and Services Tax (GST) Registration Certificate.

• Scanned copy of certificate, if any, for carrying out the similar nature of job duly endorsed by the officer not less than the rank of Executive Engineer.

• Scanned copy of “Commercial terms and conditions” as per annexure “C” duly conformed by the bidder.

• Bidder are requested to visit the site before quoting the rates.

• The successful bidder should have a transformer bank to replace the damaged one till the departmental damaged HT Transformer is repaired. (In case of HT transformers only)

Note: i. The above documents shall be subject to proper scrutiny. Bids without pre qualifications shall be rejected. ii. Exemptions of EMD and tender document fee shall be entertained only if all the tendered items fall in the Permanent Registration Certificate issued by Industries Department. Any tender with less EMD or tender document fee shall be rejected out rightly. iii. The bidder must submit their respective email IDs and phone numbers/WhatsApp Nos. for future communications. The communication via email / WhatsApp shall be considered as authentic and final. iv. In case of any error/mistake or correction necessary corrigendum will be issued 3. Second Cover shall contain the Price Bid/BOQ Tenders not submitted in two covers, containing above documents, shall be rejected out rightly. 3.1. First Cover (Prequalification) shall be opened online in the office of the Executive Engineer, P.H.E. Mechanical Division (North) Sopore after which the financial bids of qualifying bidders shall be opened. 4. Validity The tenders shall be valid for a period of 120 days from the date of opening of First Cover. 5. After the tenders are opened, no tenderer shall be allowed to change the equipment offered by him or the prices or terms and conditions quoted by him, unless specifically asked to do so by the Department in writing by way of clarifications.

6. The Executive Engineer, P.H.E. Mechanical Division (North) Sopore reserves the right to reject, or, accept any or all tenders in part or in full, without assigning any reason thereof. 7. For any typographical error or omission in the various conditions and contents of the tender document, the interpretation as given by the Department will be final and binding upon the tenderers. 8. Conditional tenders shall not be accepted and rejected out rightly without assigning any reason thereof.

9. Expenses for tendering:

The tenderer shall not be entitled to any claim towards expenses incurred incidental to the submission of the tender or subsequent evaluation/clarification thereof.

10. Result of tender:

Successful tenderer will be informed about result by the Department/ via email and have to submit the hard copies of EMD and tender document cost. On receipt of the written order to commence the work from the Department and on the basis of the stipulations in these tender documents, subject to the changes mutually agreed upon by the Department and the tenderer before the award of the contract, the contractor will start the work. Time taken in signing the agreement will not affect the time of completion specified for the work. No payment shall, however, be made till the agreement is executed.

11. Clarifications:

In case of any technical clarifications, suggestions, comments, set forth in the tender documents, the tenderers shall address the Executive Engineer, P.H.E Mechanical Division (North) Sopore in writing on scheduled date of pre-bid meeting.

12. Prices:

The prices quoted shall be inclusive of CGST, SGST, freight (by road, transport from workshop to the site of installation), un-loading, transit insurance, testing, commissioning, toll, octroy and all other levies and taxes, whatsoever applicable.

Note: In case rates are found below the estimated/advertised cost, as mentioned in slab, the firm/contractor has to deposit additional amount of respective percentage in shape of CDR/FDR/BG/Undertaking pledged to undersigned prior to issue of formal allotment order. • Up to 15% Nil • If below 15% to 25% 4.00% of estimated cost or Undertaking from 1st Class Magistrate (As per Annexure) • Beyond 25% 6.00% of estimated cost or Undertaking from 1st Class Magistrate (As per Annexure) • In case the rates quoted by other bidders for particular item is less than that of the overall lowest bidder (L1) then the same rates shall be offered to L1. 13. Subletting of work:

The contractor shall not sublet the whole or part of the work, except where otherwise provided by the agreement. The contractor shall not assign the work or any part thereof or any benefit or any interest thereon or any claim arising out of the contract, without prior written consent of the Department.

14. Time of completion:

I. The entire equipment is to be procured, tested and commissioned within 02 days from the date of placement of order or letter of intent.

II. Penalty up to 10% of the total allotted cost shall be imposed if the work is not completed within the stipulated time. 15. Accommodation and other facilities: The contractor shall be responsible for complete watch and ward of the equipment, the installation, indoor as well as outdoor during the occurrence of the contract, which shall include maintenance of lights, guards, fencing and watching, safety and convenience of the staff, labour and general public. 16. Staff & labour: The Contractor shall make his own arrangements for the engagement of all type of staff/labour for execution of the contract. No worker below the age 18 years shall be employed on the works, and the contractor shall comply with the provisions of all labour laws and rules framed there under. 17. Accident provisions: The Contractor shall be responsible for any accident, which may occur during the period of work, to human life. Compensation, as shall be applicable under labour law, or any other law in vogue, shall be payable to the victim by the Contractor only. 18. Agreement: A formal deed of "Agreement", incorporating therein the terms and conditions which shall govern the Contract, will be executed by the successful tenderer with the Department within one week of the issuance of the formal Allotment Order. This written instrument of Agreement governing the contract shall, in all respects, be deemed to be, and construed to be, and shall operate as 'An Indian Contract' in conformity with laws applicable and in vogue in the State of Jammu & Kashmir, and shall be subject to the jurisdiction of the Courts in the State of Jammu & Kashmir only. Non-execution of formal agreement shall, in no way, make the Contract ineffective/in-operative. No payment, whatsoever, even against the work done, shall be released without drawl and acceptance of the formal agreement. 19. Terms of payment for procurement of fresh items: i) 80% of payment shall be released only after receipt of material in full at site of work/authenticated place of storage in case of non–completion of Civil structure and verification thereof by the competent authority /concerned Assistant Executive Engineer, subject to availability of funds. ii) 10% shall be released after installation, testing and successful commissioning at site iii) Balance 10% shall be shall be kept in deposit and released after 06 months of Defective Liability period is over from the date of its installation, testing and commissioning at site, subject to availability of funds. Terms of payment for repairing or shifting of equipment: i) 100% of payment shall be released only after re-installation, testing and successful commissioning of repaired equipment at site out of which 10% shall be kept in deposit and released after 06 months of Defective Liability Period from the date of its re-installation, testing and commissioning at site, subject to availability of funds. 20. Clean up: The contractor shall always keep the site clean, devoid of any dirt, dust, surplus materials as per the instructions of the Departmental Supervisors/workers. The equipment and sites should be kept neat and clean for the whole period of Contract. No extra payment shall be made by the Department on this account. 21. Consignee and payment making authority: The ‘Consignee’ and the ‘Payment making Authority’ for the Contract shall be Executive Engineer P.H.E Mechanical Division (North) Sopore
