Property and Ownership Gerald Gaus 1 PRIVATE PROPERTY: FUNDAMENTAL OR PASSÉ? For the last half century, thinking within political philosophy about private property and ownership has had something of a schizophrenic quality. The classical liberal tradition has always stressed an intimate connection between a free society and the right to private property.1 As Ludwig von Mises put it, “the program of liberalism....if condensed to a single word, would have to read: property, that is, private ownership....”2 Robert Nozick’s Anarchy, State and Utopia, drawing extensively on Locke, gave new life to this idea; subsequently a great deal of political philosophy has focused on the justification (or lack of it) of natural rights to private property.3 Classical liberals such as Eric Mack — also drawing extensively on Locke’s theory of property — have argued that “the signature right of any rights-oriented classical liberalism is the right of self-ownership.”4 In addition, Mack argues that “we have the same good reasons for ascribing to each person a natural right of property” in “extrapersonal objects.”5 Each individual, Mack contends, has “an original, nonacquired right … to engage in the acquisition of extrapersonal objects and in the disposition of those acquired objects as one sees fit in the service of one’s ends.”6 Essentially, one has a natural right to become an owner of external property. Not all contemporary classical liberals hold that property rights are natural, but all insist that strong rights to private property are essential for a free society.7 Jan Narveson has recently defended the necessity in a free society of property understood as “a unitary concept, explicable as a right over a thing owned, against others who are precluded from the free use of it to which ownership entitles the owner.”8 GAUS/2 The “new liberal” project of showing that a free society requires robust protection of civil and political rights, but not extensive rights of private property (beyond personal property) has persistently attacked this older, classical, liberal position. -

Economic Calculation and the Limits of Organization Peter G. Klein conomists have become increasingly frustrated with the text- book model of the firm. The "firm" of intermediate microeco- Enomics is a production function, a mysterious "black box" whose insides are off-limits to respectable economic theory (relegated instead to the lesser disciplines of management, organization theory, industrial psychology, and the like). Though useful in certain contexts, the textbook model has proven unable to account for a variety of real- world business practices: vertical and lateral integration, geographic and product-line diversification, franchising, long-term commercial contract- ing, transfer pricing, research joint ventures, and many others. As an al- ternative to viewing the firm as a production function, economists are turning to a new body ofliterature that views the firm as anorganization, itself worthy of economic analysis. This emerging literature is the best- developed part of what has come to be called the "new institutional eco- nomics."' The new perspective has deeply enhanced and enriched our un- derstanding of firms and other organizations, such that we can no longer agree with Ronald Coase's 1988 statement that "[wlhy firms exist, what determines the number of firms, what determines what firms do . are not questions of interest to most economists" (Coase 1988a, p. 5).The new theory is not without its critics; Richard Nelson (1991), for example, ob- jects that the new institutional economics tends to downplay discretion- ary differences among firms. The author of this essay maintains that liberalism has been the primary source of progressive change in the United States since its earliest history. To support his claim, he traces the philosophical and political history of liberalism in England and the United States. The specific forms of liberalism have varied in different periods of history; but, he maintains, there is an underlying spirit of liberalism that has persisted throughout the past 350 years and can be the source of dynamic progressive social change in the 21st century. Throughout history, he maintains, liberalism has been committed to social progress and has sought to improve the lives of populations that are economically and politically disadvantaged. This underlying spirit, the author argues, can be the source for an energized liberal agenda for the 21st century. Keywords: liberalism; political philosophy; political history 1. Introduction Conservative – and even centrist – opponents of liberalism reject it because they identify it with cumbersome government; reckless spending; high tax- ation; naiveté about economics, crime, and world power; and lack of moral values. What a mistake! In fact, liberalism has been the source of social and political progress in the Western world since the 17th century. The idea that rights set a limit on the legitimate power of government is a liberal idea. The idea that govern- ment must respect the liberty of individuals is a liberal idea. -

We’ll cover the historical development of IR as a professional discipline since the interwar period, going over the main foundational debates that organized the field, and addressing its sociological evolution. By the end of the course, students should have an understanding of the main meta‐theoretical issues in the discipline and thus be able to enlarge their toolkit to critically engage scholarship in IR, political science, and the social sciences more broadly. COURSE OUTLINE The course covers the historical evolution of IR as a professional discipline from the meta‐theoretical perspective. As the field evolves, we’ll look at the development of the philosophical foundations of IR scholarship, covering the main positions in it and addressing the main criticisms of each. Finally, we’ll study the sociology of IR, interrogating the ways in which scholarship is produced and the field is structured and disciplined. REQUIREMENTS, GRADING, AND DEADLINES Basic knowledge of IR theory is a plus. The course will consist in a series of seminar sessions with pre‐assigned readings. Students are expected to do all the readings prior to each session, as well as attend and participate in all sessions. -

The Types and Functions of Samizdat Publications in Czechoslovakia, 1948–1989 Martin Machovec Czech Literature, Charles University, Prague Abstract The term samizdat, now widespread, denotes the unofficial dissemination of any variety of text (book, magazine, leaflet, etc.) within “totalitarian” political sys- tems, especially those after World War II. Such publishing, though often not explic- itly forbidden by law, was always punishable through the misuse of a variety of laws under various pretexts. It occurred first in the Soviet Union as early as the 1920s, before the term was used, and then, labeled as such, from the 1950s onward. While samizdat publication occurred in Czechoslovakia after 1948, the word itself was used there only from the 1970s on. This article seeks to clarify the term and the phenome- non of samizdat with regard to the Czech literary scene to trace its historical limits and the justification for it. I will first describe the functions of Czech samizdat during the four decades of the totalitarian regime (1948–89), that is, examine it as a non- static, developing phenomenon, and then I will offer criteria by which to classify it. Such texts are classifiable by motivations for publishing and distributing samizdat; the originator; traditionally recognized types of printed material; date of production and of issuance, if different; textual content; occurrence in the chronology of politi- cal and cultural events under the totalitarian regime; and type of technology used in production. The applicability of such criteria is tested against the varied samizdat activities of the Czech poet and philosopher Egon Bondy. Both in Czech literary history and, as far as we know, in the literary his- tories of other countries as well there is a tendency to claim what is more or less obvious: that samizdat books, periodicals, leaflets, and recordings 1. -

Information Libertarianism Jane R. Bambauer & Derek E. Bambauer* Legal scholarship has attacked recent First Amendment jurisprudence as unprincipled: a deregulatory judicial agenda disguised as free speech protection. This scholarly trend is mistaken. Descriptively, free speech protections scrutinize only information regulation, usefully pushing government to employ more direct regulations with fewer collateral consequences. Even an expansive First Amendment is compatible with the regulatory state, rather than being inherently libertarian. Normatively, courts should be skeptical when the state tries to design socially beneficial censorship. This Article advances a structural theory that complements classic First Amendment rationales, arguing that information libertarianism has virtues that transcend political ideology. Regulating information is peculiarly difficult to do well. Cognitive biases cause regulators to systematically overstate risks of speech and to discount its benefits. Speech is strong in its capacity to change behavior, yet politically weak. It is a popular scapegoat for larger societal problems and its regulation is an attractive option for interest groups seeking an advantage. Collective action, public choice, and government entrenchment problems arise frequently. First Amendment safeguards provide a vital counterpressure.
