After socking Howard Stern affiliate KLSX Los Angeles with a $105,000 fine for alleged indecency, the FCC has sent a letter of inquiry to Stern's original three affiliates WXRK New York, WYSP Philadelphia, and WJFK -FM Washington, D.C. The seemingly rhetorical letter asks the three stations if they carried the same programs that KLSX was just fired over. Stern, meanwhile, spent the day before the presidential election encouraging listeners to put an end to his FCC travails by voting for Bill Clinton, and "praying" for FCC chairman Al Sikes recently treated prostate cancer to spread to his other organs, then to his FCC commissioners. Incidentally, the New York Post recently conducted a week long 900 -number poll and found out that a large majority of its readers were tired of hearing about Madonna. Which makes us wonder if any of you are tired of hearing about Stern every week.

There are, incidentally, stations who still care what the FCC thinks. WKBQ St. Louis PD Mark Todd has been fired, even though he was on vacation when his morning

team, Steve & D.0 , put a couple on the air while the couple was ostensibly having sex. The bit, according to press reports, went on for 15 minutes, which gives a new meaning to quarter hour maintenance. WKBQ owner Chase is in the process of selling the station to Evergreen, which will then spin it to Saul Frischling, and WKBQ's move is seen as a good faith gesture toward the commission. It did not, however, remove its morning team from the air for more than a few days.

Communications Daily reports that President_ Bush has signed into law legislation demanding the FCC choose a single AM stereo standard, more than 10 years after stations began trying to hash that out for itself before, by and large, losing interest. "The mandate," NTIA writes, "was a little noticed provision in an NTIA authorization bill that cleared both houses of Congress shortly before adjournment" last month. The FCC has 60 days to start work on the issue and a year to come up with a standard.

Jeff Davis Broadcasting Service, licensee of WKPO, Prentiss, MS had its renewal of license application dismissed. The FCC deleted the call letters. ELSEWHERE

When the announced that it would switch its top 40 format, The Heat, to what eventually became known as Young Adult Contemporary this fall, it, in effect, gave its affiliates this choice: go hot AC, even though you may not have wanted to go hot AC, or stay CHR by finding the money to go local, even though CHR isn't having such a great time of it these days. The only other national CHR format, City FM's Superradio, seems to have finally gone hot AC also, after a year of insisting that it was that in the first place.

A month after the announced transition date for Young AC, only two of the 32 Heat affiliates that M Street surveyed say they've gone local and stayed CHR. One is WHET Sturgeon Bay /Green Bay, Wisc. The other is WQMZ Charlottesville, Va.- -which doesn't seem to have finished the transition, judging from a recent market visit. A few stations, among them KWWW -FM Quincy, Wash., and KVHT Vermillion, S.D., say they've kept the local portions of their programming CHR, instead of trying to match SMN's format. Only four of the stations we spoke to indicated they might be looking at a change down the line -- either at the end of the year or when their contracts ran out. SMN, meanwhile, continues to add new Heat /YAC affiliates, the latest being WTRC -FM Natchez, Miss., this week.

One reason SMN seems to have come through the transition with so many of its affiliates intact is that hot AC is probably what a lot of them were asking for in the first place. Although the Heat and its predecessor Rock'N'Hits were always a lot more AOR- leaning than most large- market CHRs, the presence of any rap music was enough to make many GMs nervous. Besides, the CHR -to -hot AC transition is one that many GMs of locally programmed CHRs were making themselves without any help from SMN. One might have expected some SMN CHRs with format monopolies to stay, especially KLZR Lawrence /Topeka, Kan., which found itself turned into the Heat's first real medium- market ratings success after the other CHR in Topeka got out. But CHR format monopolies didn't mean a lot in Baltimore or Washington, D.C., this year. So you can't expect that they'd mean much in, say, Yuma, Ariz. (Ironically, Charlottesville and Green Bay are both markets where the former Heat affiliate still has other CHR competition.)

ELSEWHERE (cont'd) Will there be a national CHR format again? Right now, CHR is probably the format where it's hardest to come up with a national mean. Heartland stations are touchy about even mainstream urban music, much less rap. Large market CHRs, including those that don't consider themselves urban -leaning, say there's little non -urban, non -ballad product that's worth anything these days. It's worth noting that it took CHR until late '83 to get a national outlet. That was 18 months after the format's renaissance became obvious, something it's a long way from being now.

In other news this week:

Daynet has, as expected, announced that it will start providing national night- time talk programming after ABC's Tom Snyder show goes away on Nov. 27. Claire Carter will do early evenings; Leslie Marshall will do late nights. The move puts Daynet in position for Larry King's expected- but -yet -unofficial move to middays next year.

New LMA /duopolies this week: KFRG San Bernardino, Calif., will buy crosstown KQLH. Ironically, those calls belonged to KFRG in its previous incarnation; KSFI Salt Lake City will operate rival KRSP -FM (and not, as prei(usly repoted, its AM KKDS); Trumper. buys WLFX Lexington, Ky., to pair w_th its WLAP /WMXL there; WCQL -AM -FM Portsmouth, N.H., has just turned its salss over to rival WZNN /WWEM which also launches WXBB Kittery, Me., this week, giving it e grand total of f've stations in the Portsmouth area to sell; WAVZ New Haven, Conn., has been sold from Noble to Clear Channel for $10, reuniting it with former FM WKCI- -which had been LMA'ing WAVZ since the sale anyway.

Also, WIBM -AM -FM Lansing, Mich., has entered into an LMA -to -buy with WJXQ. One interesting twist: WIBM -FM and WJXQ are the only two FMs licensed to Jackson, Mich., itself a sizeable market 40 minutes away from Lansing. While both are now considered Lansing outlets, and while Jacksonians can certainly hear plenty of other signals, the LMA -to -buy does give one company a lock on local FM service in that market.

R &R reports that a federal judge has fined KWOD Sacramento, Calif., $10,000 for using allegedly pirated copies of the Selector music software. KWOD owner Ed Stolz says he'll appeal.

Birmingham, Ala. -based Vanguard Audio Features has launched a 90- second daily short form radio feature with the self -explanatory title "Parentwise." The child - rearing show is hosted by psychologist Dr. Perry Buffington, probably best known to you from his association with the Burkhart /Douglas consultancy. Here's one that's easy to adopt to your market: all -talk WTKN Daleville, Ala., will forego a syndicated Christmas special this year in favor of a day of Christmas music performed by locals. WASHINGTON THIS WEER R &R reports that a coalition of broadcasters, including the National Assn. of Broadcasters, the major TV networks, and the folks at Infinity Broadcasting --who seem to have just a little interest in this topic --have filed comments asking the FCC not to cite stations for indecency unless the commission can prove there are an "appreciable" number of listeners under 12 out there. The comments were filed as part of a brief against the Congressionally mandated overnight indecency ban.

The NAB has also filed comments opposing an FCC staff decision which encourages greater use of FM directional antennas. The NAB says DAs "will only lead to the same kind of interference and overcrowding problems" that hurt AM.

Although Canada's broadcast regulator has been reasonably flexible in allowing easy listening stations to reduce their instrumental music content to 35% or less --a move that usually signals a switch to soft AC, the CRTC is cracking down on stations that bury their remaining instrumental committment at night. Comparing that practice to the onetime practice of dumping a lot of Canadian content music in late nights, the CRTC has ordered stations to distribute their instrumentals evenly throughout the day, or apply for AC licenses. (Many of the stations involved had already gone through the hearing process to reduce their instrumental content to 50 %.) While the CRTC crackdown may present a problem for stations like CJEZ Toronto or CHQM -FM Vancouver that were doing soft AC during the day and instrumentals at night, one particularly has to wonder how it will affect CKKL Ottawa which had segued first from easy listening to soft AC then to rock AC --a format where there may not be much compatible instrumental music. Incidentally, when this story ran in the Canadian trade, The Record, one prominent Canadian consultant justified Canadian radio's mass -exodus from easy listening by saying that "the over 55 market has lost interest in radio." This, of course, is something not even many American broadcasters were brazen enough to claim; most admitted, if pressed, that the numbers were still there for easy listening but that they didn't :hink the 45 -plus crowd was saleable. To say that older listeners have lost interest is to overlook the fact that they've been forceably separated from the radio with a crowbar. (Or, perhaps in the case of CKKL, the Canadian rock band, Crowbar. But we digress.) ELSEWHERE

The Sports Final Radio Network, formerly heard on American Radio Network and American Forum Radio Network, announced this week that it will provide reports from the basebal. draft every hour on the half hour beginning November 17. The reports will be hosted by George Grande, who will also host a long -form program from New York. President of the network, Tom Star, said that Sports Final has split completely from American Forum, but would not elaborate. Attempts to reach American Forum's Don Emanuel at press time were unsuccessful.

KNEW San Francisco has picked up radio rights to the Oakland A's games effective next spring. In the "my brave face" department, longtime A's affiliate KSFO has issued a press release announcing that it has "resigned" the rights to the team and noting that the recent glut of baseball on TV has lowered radio ratings as much as 40% from 1990 levels ... We decided to superserve our regular listeners and advertisers by concentrating on our principal, successful format." After saying that, KSFO notes that it will hold on to a 10 hour sports talk block, including the Pete Rose show, at night.

Inside Radio also says that has backed away from its plan to move Larry King to middays as soon as January after what the paper calls an "anemic" affiliate response. We don't know quite how firm WW1's plans are -- Inside Radio claims some stations had already been put on notice --but judging from the few GMs we talked to who would have been forced to choose between King and Rush Limbaugh in middays, it's not a decision that WW1 would have wanted to force. We didn't ask how they would have chosen between Jim Bchcnnon a.ld Dr. Dean Edell.

We tried to stay away from Howard Stern, but we just couldn't. Inside Radio reports that The Congress of Filipino -American Citizens has filed a $65- million class action lawsuit against Howard Stern for "racist and defamatory" comments in which he characterized the Philippines as "a country where fathers sell their daughters for sex" and where "they eat their young." In other painfully ongoing stories.

Four new markets can now say, "Hello, Hanson." Kurt Hanson's AccuRatings has announced that it will do fall books in New York, San Francisco, Philadelphia, and Raleigh, N.C., to its existing markets, including Chicago, San Diego, and South Bend, Ind.

Pat Robinson is launching a new radio news network called Washington News Desk as a companion to his current religious outlet, National News Desk. Managing editor John Rodman, known for his work at WEEI Boston, says the new net will be on in mid -December.

Unistar says it has acquired the "exclusive radio rights" to "Tonight Show" host Jay Leno's opening monologue. The routine is now being marketed as "Last Night on Tonight with Jay Leno" and stations are being told they can run the show twice a day --the second time without network inventory. Many stations have, of course, been using both Leno and David Letterman material without anybody's help. Like most TV drop -ins, it's not material that stations really had the right to use anyway, but the Unistar move means that somebody will now notice --at least in Leno's case. The Radio Advertising Bureau has announced that its first Certified Radio Sales Manager program, scheduled for Denver on November 14 -16 has reached its target of 75 trainees and is thus a complete sellout. If, however, you receive this in time, you can check for cancellations at 800 -RAB -SELL.

Stern Und Drang, Ft. 47: R &R, which was right about the $100,000 -plus fine levied on Howard Stern affiliate KLSX Los Angeles, now suggests that the FCC may block Stern's parent company, Infinity, from acquiring Cook Inlet stations in Chicago, s Boston, and Atlanta and may, specifically, hold hearings into Infinity's fitness as a licensee. Just in case you're convinced that all this will end with the Bush Administration in eight weeks, R &R also reports that it's VP -elect Al Gore who will oversee U.S. telecommunications policy, and will be responsible for filling two FCC seats. And remember, more people hear Stern than ever heard any of those records that Tipper dragged into those Senate hearings in 1985.

The National Assn. of Broadcasters has taken issue with an FCC proposal to allocate spectrum for personal communications services --i.e, pocket size mobile phones. The NAB contends that such spectrum would interfere with broadcasters' mobile news -gathering operations. Also, the NAB reports that its "political hotline" logged 750 calls for legal guidance on the FCC's Byzantine political ad rules.

WKIJ, Parrish AL (1130 KHz) had its licensed revoked this week. The station had been silent for quite some time. The call letters have been deleted.

The Commission has denied T.C. Monte, Inc.'s application for review of the dismissal of its applications filed in several proceedings over the last few years. The applications were dismissed under the "inconsistent application rule." At the time the applications were filed, some of the principals cf the company held attributable interests in Jacor Communications, thus pushing the company past the ownership limits.

In other actions, the Commission:

- - denied Safe Broadcasting's petition for reconsideration of its Order affirming a review board decision to grant the application of Tri -State Broadcasting Company for a new FM on 95.7 MHz in Trion, GA.

- - reaffirmed its decision to grant the application of Orion Communications for a new FM in Biltmore Forest, NC.

- - denied a petition for reconsideration of a previous action upholding the dismissal of the app. of R. Ronnie Goodale for a new FM on 103.3 MHz in Lenoir NC.

- - denied an application by Eve Ackerman for review of a review board decision denying the applications of Ackerman and Harmon Broadcasting Partners and granting the application of L.L. Broadcasting for a new FM on 92.5 MHz in Alachua, FL.

- - denied White County Broadcasting review of a decision which held that Helen Broadcasters is better qualified to be licensee of a new FM on 105.1 MHz in Helen GA.

- - dismissed a petition by Long Island Music Broadcasting asking the COmmission to revoke the grant of a new CP to Shore Media for a new FM on 103.1 MHz in Bay Shore, NY.

- - denied the application by Peter & Patricia Devlin for a review of a decision granting the application of Brooker Broadcasting and denying the Devlin's application for a new FM on 106.3 Mhz in Seymour, WI.

The Commission has consented to the transfer of KCML Hanford, CA from Liggett Broadcast to Harry J. Pappas, even though Pappas owns 99% of UHF TV station KMPH. The transfer quaiified under note 7 of the one -to -a- market rule because the transfer involved stations in the top 25 markets with 30 or more signals and the transfer involved "failed" broadcast stations.

The Commission has slapped Jones Eastern, licensee of WRSF Columbia NC, with a $20,000 fine for "willful continuing violation of the Commission's rules by relocating its main studio outside the stations principal community contour." Jones unsuccessfully argued, among other things, that the new site would "enable the station to attract a broader sample of guests for public affairs shows."

Out with the old....Commission Forms 314 & 315 have been revised to reflect the new multiple ownership rules, eliminating any need to file a separate Form 155. The old forms will be accepted until December 11. Form 301, application for a CP for commercial broadcast station, has also been revised. No word on how long the old form will be accepted. The Radio Advertising Bureau's Radio Creative Fund has announced its second annual Mercury Awards program, scheduled for next June 9 at New York's Waldorf Astoria. The Mercury Awards jackpot -- $200,000 for the best radio commercials, is the same. New program rules and entry categories -- reportedly featuring some changes that will give local spots a better chance of winning --will be announced next month.

Sleeping With The Enemy? The Interep Radio Store has become a 50% partner in Chicago -based cable TV rep Cable Media. While Radio Store people won't sell cable, or vice versa, the two reps will make joint sales calls, according to Inside Radio.

The Rochester, N.Y. -based North East Satellite Network, cvrrently offering a nights -only AC format throughout the Northeast, has gone national, and full -time. NESE is now known as NSE, National Satellite Entertainment. NSE's expanded lineup includes such DXer familiar names as George Hamberger (ex -WKBW Buffalo) and Bob Savage (ex -CKLW Detroit and a nearby station owner).

WJFK -AM -FM Washington /Baltimore p.m. drivers Don Geronimo & Michael O'Meara have reached an out -of -court settlement with publicist Carol Sewell. She had filed a $15- million lawsuit against the pair following remarks they made while still on crosstown WAVA. Geronimo & O'Meara, angry that an interview with actor Leslie Nielsen had fallen through, allegedly called her a "bitch" and a "liar" and encouraged listeners to go to her hotel room and "gouge her eyes out." As is increasingly the case with out of court settlements, terms of the agreement are secret. Pioneering radio tipsheet The Gavin Report has been acquired by Morgan- Grampian, the British publisher behind U.K. trades Music Week and Music Business International.

On the transaction /LMA front, the Noble /Viacom swap that would give KNDD Seattle to Viacom and KHOW -AM -FM Denver to Noble is finally official. And Keymarket will LMA WGBI -AM -FM Wilkes Barre, Pa., to pair with its current outlet, WKRZ.

Starting December 1, you'll really have to use your imagination for the Make Believe Ballroom. That's the date that new WNEW New York owner Michael Bloomberg will reportedly flip the adult standards legend to all- business. Simulcast classical outlet WQXR -AM will make its flip to adult standards WQEW the next day.

www.americanradiohistory.com THE M STREET JOURNAL page 6 Nov. 25, 1992 WASHINGTON THIS WEEK The FCC has approved a settlement agreement between Shawn Phalen and James Evans which grants Evans' application for a new FM station at Montecit.o, CA, and approves a payment of $130,000 by Evans to Phalen for the dismissal application. of her Phalen's application was contested because it was alleged the actual majority partner in her company was her father, Richard, who owns a station in Longmont, CO.

Great Scott Broadcasting's WMBO Auburn NY was pegged broadcasts $5000 for misleading and failing to have a licensed operator on duty after an inmate nearby prison at a complained that the station teased the top -of- the -hour newscast as if it were live, but which was actually prerecorded. Great Scott did not contest the violations, but asked the Commission to consider the fact that it was an inmate who complained. The Commission was not moved.

Insufficient contest announcements cost Media Partners' KRYS -FM Corpus Christi TX The $6,250. station ran a doughnut promotion that was ruled a lottery. The Commission said that the statement "no purchase necessary" is not enough to eliminate the element of consideration in a contest --what matters is that the number of chances available to purchasers must he approximately equal to those chances given to non -purchasers- -and the promotional announcements must provide detailed information, such as locations, times, and manners in which the free chances are available. Take heed....

The battle for time between the Educational Broadcast Cooperative and the University of Texas at Austin continues as the two licensees will share 91.7 MHz in Austin. The original grant gave each licensee alternating days of the week on the new station. Neither were happy with that and are continuing to negotiate. The Commission has asked for a progress report, which is due within 90 days. The Commission denied Safe Broadcasting Corporation's petition for reconsideration of a review board decision that upheld the grant of Tri -State Broadcasting's application for 95.7 MHz in Trion GA. It also denied a petition filed by McKenzie River Broadcasting seeking reconsideration of a R &O which allotted 100.5 MHz to Cottage Grove OR and substituted 102.3 Cl for 102.3 A at Brownsville OR.

Defending the FCC's new ownership rules against groups concerned about their effect on minority ownership, the National Assn. of Broadcasters has filed comments asking the FCC to uphold the new rules. The NAB says it's in favor of other programs to help minority broadcasters.

Oft- quoted media revenue guru George Riven has authored a new, self -explanatory text called "Predicting Radio Station and Market Revenue" that is available through the NAB. Call 800- 368 -5644. The NAB has also announced that some of the revenue from its text "Pricing & Rate Forecasting Using Broadcast Yield Management" will go to a joint NAB /Maxagrid scholarship fund at Wake Forest University.

Top 40 radio on FM takes a step closer to reality this month as the Canadian Radio -television & Telecommunications Commission accepts station applications from stations that want to eliminate the minimum library size and maximum repeat factor requirements, two things that had effectively kept all but a few stations from attempting the format on FM. Canadian FMs will still have to 7i.eal with a 50% non -hit requirement.

ELSEWHERE

Amidst ongoing rumors that some or all of its radio stations would be sold, perhaps to Shamrock, Group W has announced the sell -off of several non -broadcast related divisions, including its credit, furniture, and real estate companies. Group W Broadcast chairman Burt Staniar will now oversee the Westinghouse Thermo King division in addition to trying to keep the broadcast division cool and comfortable.

ABC Radio Networks has promoted director of network programming Frank Raphael to VP/line network programming. Raphael will now oversee all non -news related programming including ABC's six networks and its weekend talk shows. He'll continue to oversee the morning show prep services. Also, former independent consultant Larry Green has been named managing director of international business development for ABC Radio International.

They've always been bitter rivals, but now Jacor Communication's WLW Cincinnati and Great American's WKRC will be cohorts. WLW has entered into a LMA with WKRC, currently a full- service -AC days, talk nights outlet.

Look for National Public Radio to get a new home next fall when it moves to its new headquarters at 635 Massachusetts Ave., N.W. This moves NPR from D.C.'s so- called "new downtown" back to its old (pre -1967 riots) downtown, an area recently revitalized by the new Washington Convention Center.

Retail consultants Paul Leblang and Fred Newell will headline the closing session of the Radio Advertising Bureau's Managing Sales Conference scheduled for Feb. 4 -7 in Dallas. The session, "Retailing: What We Don't Know Is Killing Us" will focus on the threat posed by database marketing to radio and other competing advertising mediums.

M STREET DATABASE USERS UPDATE

The Southern California area has undergone another area code split. Those stations in the San Bernardino /Riverside area are now listed in the database with a (909) area code. Orange county remains as (714). Also, the (512) area code has been split. San Antonio and the Rio Grande Valley will now be (210), while Austin and Corpus Christi will remain (512). The Database has been changed to reflect each station's correct area code. Approximately 150 stations were affected by the changes.
