Box 5006, Fremont, CA 94537-5006 510 284-4011 ph | 510 284-4001 fax | www.fremont.gov August 17, 2020 The Honorable Phil Ting California State Assembly, State Capitol, Room 6026 Sacramento, CA 95814 Re: Assembly Bill 2553- Shelter crisis declarations Support from the City of Fremont Dear Assemblymember Ting: On behalf of the City of Fremont, I want to thank you for your commitment to addressing the needs of our State’s most vulnerable populations, especially during the COVID-19 pandemic. I am writing to express my support for Assembly Bill 2553, related to a city or county’s declaration of a shelter crisis and the subsequent suspension of certain regulations on specified construction projects. AB 2553 is a straightforward bill that would help to immediately facilitate the construction of homeless shelters throughout the state and help cities meet the urgent need for more shelter space. Due to the severe housing and homelessness crisis in California, it is imperative that cities have the opportunity to create safe spaces for homeless and housing insecure families and individuals, without costly and time-consuming barriers. We particularly appreciate the language in this bill to clarify that “Safe-Parking Programs” are a type of homeless shelter that is exempt from certain regulations during a declared shelter crisis. There are many homeless families and individuals who are temporarily living in a motor vehicle but have no legal or safe place to park it. “Safe- Parking Programs” provide a safe place for people to park while accessing off-site services to end their homelessness. Clarifying that “Safe Parking Programs” are a type of homeless shelter eligible for regulatory exemptions enables cities to more confidently and expeditiously pursue a multi-pronged approach to meeting the needs of homeless residents. Again, we are pleased to support Assembly Bill 2553, which will help ensure that all Californians can reside in a safe, designated space without fear for their safety or legal repercussions. Until his election to the Assembly in 2012, he served four terms on the Lassen County Board of Supervisors. Dahle's Lassen County farm was purchased by his grandparents in the 1940s and has remained in the family since then. When his parents retired, he and his wife, Megan, purchased the farm, which is now over 2,000 acres. They also operate and manage Big Valley Seed and Big Valley Nursery. City of Santa Monica Court of Appeal, Second Appellate District, Division Eight, Case No. B295935 Los Angeles Superior Court Case No. BC616804 Dear Chief Justice and Associate Justices of the California Supreme Court: In its July 9, 2020 Opinion, the Court of Appeal held that the California Voting Rights Act (Elections Code 14025-14032, “CVRA”) only applies to jurisdictions in which a minority community is numerous and geographically concentrated enough to comprise the majority of voters in a compact election district. The Court of Appeal reasoned that only with a majority in an election district could a minority community elect its preferred candidates. Our collective experience, as Latino, Black and Asian Pacific Islander elected officials in California demonstrates that the Opinion is wrong. As discussed below, nearly half of us were elected to the Legislature by districts where the corresponding minority community accounts for between 20% and 49% of the district’s eligible voters. Still, it is, in part, because of the strong support we receive from our respective minority communities that we have prevailed in elections. Not only is the Opinion wrong, it is horribly damaging to the voting rights of millions of Californians, and the prospects for the next generation of minority leaders. Because California is exceptionally diverse (one of our state’s great strengths), and not as segregated as the Deep South (at which the federal Voting Rights Act of 1965 was directed), minority communities are not compact enough to comprise the majority of voters in an election district in many jurisdictions.
