Margaret Collins of BMI welcomed the academy and introduced NATAS Nashville/Midsouth President and National Trustee Ellen Jones Pryor of the Frist Center for the Visual Arts. Ms. Pryor said “The upcoming gala will mark our twenty-seventh Emmy® Awards. For this grand occasion, we are proud to return to the Schermerhorn Symphony Center on January 26, 2013. The television remote facilities will be provided in high definition by Tennessee Digital Video, with additional support for the live telecast from guestbooker.com, and Regions.” NATAS National Trustee Gene Policinski of The First Amendment Center announced that the Board of Governors selected the Vanderbilt Television News Archive as the recipient of the Governors’ Award for Lifetime Achievement, the academy’s highest honor. He said, “It is the world's most extensive archive of television news, creating, preserving and providing access to the U.S. network news broadcasts which have been recorded since august 5, 1968.” Silver Circle Chairman Phillip L. Bell of BellMedia announced the newest inductees into the prestigious Silver Circle which honors contributions to broadcasting over a quarter century. -

ELKINS* PREFACE That I adopted as part of the title for this article "All My Friends Are Becoming Strangers"' suggests the need for expla- nation-what humanistic sociologists call a reflexive statement. More simply put, this article needs a preface. The psychiatrist, Robert Coles, has suggested that a preface permits an author to tell where he stands, and unquestionably in so doing he runs the risk of self-centeredness if not self-display .... We owe it to ourselves and our readers to show something of our lives and our purposes, to indicate, as it were, the context out of which a particular book has emerged.2 This article began as an angry and polemical response to an article by William Simon calling into question what he called The Psychological Vision in legal education.' Upon first reading the Simon article I was dismayed that anyone could be so bold and presumptuous as to attack the psychological perspective and its role in legal education. -

Introduction and Summary Consumers today enjoy a wealth of choices in the multichannel video programming distribution marketplace. This vibrantly competitive environment represents a dramatic departure from decades past, when claims as to the existence of bottlenecks were used to justify intrusive government intervention. One rising, and perhaps unexpected and largely unreported, source of multichannel competition is over-the-air broadcasting. Of course, dramatic changes in the media marketplace have been occurring for many years – and yet, due to its size, procedures, and inherent inertia, the "Communications Regulatory Complex" simply is unable to keep pace, especially in the face of considerable reflexive opposition by those who oppose any deregulatory changes. But with regard to broadcasting, cable, direct broadcast satellite (DBS), telco TV, and other media outlets, continued imposition of legacy regulatory restrictions of various types are in increasing tension with their First Amendment rights. Over the last ten years, the number of U.S. households that utilize an antenna to view their local television stations has increased by over a third, from nearly 11.8 million to 16 million. Another is that, as consumers "cut the cord" – that is, discontinue their subscriptions to traditional multichannel video programming distributors (MVPDs) and transition to streaming options like Netflix, Hulu, Disney+, and/or Amazon Prime Video – over-the-air television provides a free means to continue to receive the popular content, both national and local, that television stations carry. -
