Reply Comments to Comment 36
Reply Comments to Comment 36. David B. Carroll 19 February 2003 1. Class of Work From Comment #361: Audiovisual works as follows: foreign-language audiovisual works not available for sale in the United States but available for purchase outside the US on DVDs that are regionally encoded to prevent playback on DVD players purchased in the United States. The exemption requested is to permit circumvention of the region coding mechanism. 2. Summary of Argument Additional factual information in support of Comment #36’s initial request for an exemption is submitted. The proposed class is compared against a similar class from Comment #352, which offers some advantages over this class. 3. Factual Support / Legal Arguments 3.1.Evidence of a need to circumvent DVD region coding for works in this class. The Library’s solicitation for comments makes it clear that a demonstration of actual or likely damage is a prerequisite for a successful exemption, rather than an argument based solely on hypothetical or legal grounds. I have collected additional examples of, and documentation for, real-world demand for DVD content unavailable in Region 1 (“R1”) format. 3.1.1. DVD features unavailable on VHS. In rejecting an exemption for circumvention of DVD access controls in 2000, the Library of Congress wrote3: 1 Carroll, David B. Contact: Kristyn Souder Communications Director Email: [email protected] Phone: (267)536-9566 PRESS RELEASE Zenkaikon Convention to Bring Anime and Science Fiction Fans to Lancaster in March Hatboro, PA – January 21, 2013: On March 22-24, 2013, Zenkaikon will hold its seventh annual convention in a new location at the Lancaster County Convention Center in Lancaster, Pennsylvania. The convention expects to welcome over two thousand fans of Japanese animation (anime), comics (manga), gaming, and science fiction to downtown Lancaster for the weekend-long event. Zenkaikon had typically been held in the Valley Forge area of Pennsylvania. However, with the conversion of the Valley Forge Convention Center to a casino and the continued growth of the event, Zenkaikon moved its convention to Lancaster. Many convention attendees don costumes of their favorite characters to attend the annual convention. Planned convention events include a variety of educational panels and workshops hosted by volunteers and guests; anime and live action screenings; a costume and skit competition (the "Masquerade"); a hall costume contest; performances by musical guests; a live action role play ("LARP") event; video game tournaments and tabletop gaming; a formal ball and informal dances; and an exhibit hall of anime-themed merchandise and handmade creations from artists. A number of Guests of Honor have already been announced for Zenkaikon 2013. John de Lancie, best known for his roles on Star Trek and Stargate SG-1, and more recently known for his role as Discord on My Little Pony: Friendship is Magic, will be hosting panels and meeting attendees. Prolific voice and live action actor Richard Epcar (Ghost in the Shell, The Legend of Korra, Kingdom Hearts) and actress Ellyn Stern (Robotech, Gundam Unicorn, Bleach) will also be participating in a variety of programming. -

Robotech Strategy We Again Saw Strength in the Industrial Space, Technology Hardware and Semiconductors

Circulation must be restricted accordingly Robotech strategy We again saw strength in the Industrial space, technology hardware and semiconductors • Global Equity markets rose with better than expected Q3 corporate result • Kion Group and Taiwan Semiconductor Manufacturing contributed to strategy performance • We continued to build our position in Marel (Icelandic food processing equipment manufacturer) Tom Riley Portfolio Manager, Robotech strategy What’s happening? Global Equity markets rose during the month as corporate result for the September quarter earning seasons came in better than expected, geopolitical tensions eased, and the Federal Reserve cut interest rates to support the US economy. We again saw stronger performance from the cyclical areas of the market such as Industrials, with notable performance from some of our European and Japanese holdings. The leading indicators are showing mixed signals at present, with the US Institute for Supply Management PMI Index reporting a score of 48.3 for October, improving modestly from September’s reading, suggesting that the weakness in the Industrial space is now stabilising. Portfolio positioning and performance The strategy outperformed the broader market during the month. We again saw strength in the Industrial space and technology hardware and semiconductors. Kion, a German manufacturer of warehouse automation equipment performed strongly after reporting order in Q3 which were materially better than anticipated and it better profitability for the quarter. After a challenging 12 months for Kion, due to trade war impacts and weaker German macro environment, its pleasing to see the stabilisation coming through now as its customers increase their investments following a period of underinvestment. -
